SO IF YOU WOULD PLEASE STAND? THANK YOU.

LET'S PRAY.

ALTHOUGH WE RECOGNIZE YOUR GRACE IN SO MANY WAYS AND THANK YOU FOR YOUR CONTINUED PROVISION AND PROTECTION.

GOD, WE THANK YOU FOR OUR LEADERSHIP, THE LEADERS IN OUR COMMUNITY WHO WORK TO MAKE AMARILLO A BETTER PLACE AND GOD, SO WE ASK YOU TODAY TO BLESS THEM AND PRAY YOUR BLESSING UPON OUR CITY LEADERS, UPON OUR MAYOR AND EACH OF OUR COUNCIL MEMBERS.

GOD, WE ASK THAT YOU WOULD PROVIDE THEM WITH WISDOM TODAY FOR ALL THE ITEMS BEING CONSIDERED THAT YOU WOULD GUIDE THEM TO HELP THEM MAKE GOOD AND INFORMED DECISIONS.

GOD THAT ARE PLEASING TO YOU AND THAT YOU WOULD HELP THEM AND US TO BE GOOD STEWARDS.

OF ALL THAT WE'VE BEEN ENTRUSTED WITH.

GOD IN TIMES SUCH AS THESE, WE CONFESS THAT WE NEED.

WE NEED YOU.

SO PLEASE HELP US TODAY DURING THIS TIME AND IN ALL THE DECISIONS THAT WILL BE MADE.

AND WE PUT ALL THESE THINGS IN JESUS NAME.

AMEN.

YOU TURN IT ON.

OK, OK.

AT THIS TIME, I'D ASK YOU TO JOIN.

JOIN ME IN THE PLEDGE OF ALLEGIANCE.

I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS.

ONE NATION UNDER GOD, INDIVISIBLE WITH LIBERTY AND JUSTICE FOR ALL.

THANK YOU.

YOU MAY BE SEATED.

THANK YOU.

HUH..

YES, MA'AM.

ALL RIGHT.

[PROCLAMATIONS]

AT THIS PARTICULAR TIME, WE HAVE TWO PROCLAMATIONS ON THE LIST AND I BELIEVE THE FIRST ONE IS THE NATIONAL CLEANUP DAY, AND THAT'S GOING TO BE READ BY COUNCIL MEMBER DR.

EDDY SAUER.

YOU WANT ME TO JUST DO IT FROM HERE? OK.

WE'RE REALLY GRATEFUL FOR THOSE WHO'VE REALLY HELPED US OVER THE PAST FIVE YEARS WITH CLEANING UP THE CITY OF AMARILLO AND ESPECIALLY BABJI YALAMANCHILI AND ALL THE WORK THAT HE AND HIS CREW HAVE REALLY DONE.

AND THEN HONESTLY, REALLY, ALL OF THE NEIGHBORHOOD PROJECTS HAVE BEEN ALL INVOLVED IN THE SCHOOLS, AND IT'S REALLY BEEN.

I BELIEVE IT'S REALLY MADE A BIG DIFFERENCE FOR AMARILLO.

AND SO IT'S A REAL HONOR TO BE ABLE TO READ THIS PROCLAMATION.

BUT WE'D LIKE FOR THOSE OF YOU WHO ARE INVOLVED WITH THIS NATIONAL CLEANUP DAY, IF YOU ALL WOULDN'T MIND COMING FORWARD AND STANDING UP HERE WITH MAYOR PRO TEM FREDA POWELL, AND THEN WE'LL READ THE PROCLAMATION.

ALL THOSE YELLOW SHIRTS UP HERE.

YES, PLEASE.

I GUESS THAT MEANS WE SHOULD PROBABLY GO AROUND, SHOULDN'T WE? OK.

OK.

WHEREAS NATIONAL CLEANUP DAY WAS FOUNDED TO CELEBRATE THE IMPORTANCE OF UNITING INDIVIDUALS TO CARE FOR OUR OUTDOOR SPACES AND REMOVE LITTER SO OUR TRAILS, PARKS AND COMMUNITY SPACES REMAIN PLEASANT AND UNMOORED BY WASTE.

AND WHEREAS THE THIRD SATURDAY IN SEPTEMBER CELEBRATES THIS EVENT BY HELPING TO CLEAN THE COUNTRY, CONNECT PEOPLE AND STRENGTHEN THE RELATIONSHIP OF VOLUNTEERS IN NEIGHBORHOODS.

AND WHEREAS THE PURPOSE OF NATIONAL CLEANUP DAY IS TO ASSIST IN PROMOTING A CLEAN OUTDOORS FOR ALL BY CREATING A CALL TO ACTION TO HELP MOBILIZE COMMUNITIES AND TO BEAUTIFY THEIR AREAS.

AND WHEREAS AS A NATIONAL NETWORK OF STEWARDS OF THE OUTDOORS, NATIONAL CLEANUP DAY IS DEDICATED TO KEEPING OUR NATION'S URBAN, RURAL AND OUTDOOR PUBLIC SPACES FREE OF LITTER AND TRASH.

NOW, THEREFORE, WE MAYOR AND CITY COUNCIL MEMBERS OF THE CITY OF AMARILLO, TEXAS, DO HEREBY PROCLAIM SEPTEMBER 18TH, 2021 AS NATIONAL CLEANUP DAY AND AMARILLO, AND ENCOURAGE ALL CITIZENS TO DO THEIR PART TO HELP KEEP OUR CITY BEAUTIFUL, GIVEN UNDER OUR HANDS AND SEAL OF OFFICE THIS 14TH DAY OF SEPTEMBER.

MAYOR GINGER NELSON, COUNCIL MEMBER, COLE STANLEY COUNCIL MEMBER AND MAYOR PRO TEM

[00:05:03]

FREDA POWELL, COUNCIL MEMBER, EDDY SAUER AND COUNCIL MEMBER HOWARD SMITH, BABJI MIC] MR. DONNIE HOOPER.

OK MR. DONNIE HOOPER.

YOU GET TO COME ACCEPT THE PROCLAMATION, SIR.

I HAVE A COUPLE OF THINGS I WANT TO SAY.

FIRST, IF YOU DON'T MIND.

YES, SIR.

THIS IS NATIONAL CLEANUP.

YEAH, NATIONAL CLEANUP DAY IS THE 18TH AND THIS IS A GREAT EVENT FOR ANYONE AND EVERYONE TO PARTICIPATE IN.

OF COURSE, THESE PEOPLE THAT YOU SEE UP HERE ARE SO INVOLVED IN THINGS LIKE THIS YEAR ROUND.

BUT I WANT TO MENTION THAT THE CITY OF AMARILLO IS PARTICIPATING THIS YEAR AS WELL, AND WE HAVE HEAVY EQUIPMENT AND PERSONNEL THAT'S GOING TO BE WORKING IN THE ALLEYS ALONG WITH VOLUNTEERS.

WE HAVE ALSO A REPUBLIC SERVICE.

I DON'T KNOW IF ANYONE SHOWED UP FROM REPUBLIC HERE TODAY AND TODAY WE'D ASK THEM TO COME, BUT THEY HAVE VOLUNTEERED ALSO 24 ROLL OFF CONTAINERS TO PUT OUT THROUGHOUT THE CITY IN COOPERATION WITH OUR EIGHT CONTAINERS THAT WE HAVE FOR A TOTAL OF 32 THAT WILL BE SURROUNDING THE ENTIRE CITY FOR PEOPLE TO PUT THEIR WASTE IN.

SO THERE'S A COUPLE OF PEOPLE I'D LIKE TO RECOGNIZE, TOO, REPUBLIC SERVICES FOR ONE.

KEEP AMARILLO CLEAN.

WE MET WITH HIM LAST WEEK AND OF COURSE, THEY'VE DONE A GREAT JOB WITH ALL THIS.

THEY'RE VERY INSTRUMENTAL IN GETTING VOLUNTEERS.

NORTH HEIGHTS ADVISORY ASSOCIATION IS HERE TODAY.

THEY HAVE VOLUNTEER GROUPS THAT THEY HAVE PUT TOGETHER.

THE BARRIO NEIGHBORHOOD GROUP HAS PUT SOME VOLUNTEER GROUPS TOGETHER.

SAN JACINTO NEIGHBORHOOD ASSOCIATION HAS VOLUNTEER GROUPS THAT THEY PUT TOGETHER, AS WELL AS THE EAST RIDGE NEIGHBORHOOD PLAN ADVISORY COMMITTEE AND THEIR VOLUNTEER GROUPS.

THOSE ARE THE FOUR AREAS THAT WE ARE FOCUSING ON WITH OUR EQUIPMENT AS WELL.

PUBLIC WORKS ACTUALLY BEGAN ORGANIZING SOME OF THIS EQUIPMENT AND SOME OF THE STUFF BACK IN JULY.

ALAN HARTER IS HERE.

HE'S THE ASSISTANT DIRECTOR OF PUBLIC WORKS.

AND THEN STEPHANIE COGGINS WAS A PART OF THAT AS WELL WHEN SHE WAS OVER ON THE DARK SIDE IN PUBLIC WORKS OVER THERE BEFORE SHE CAME OVER HERE.

VERY INSTRUMENTAL IN PLANNING THAT WE HAVE 40 EMPLOYEES.

TWENTY TWO PIECES OF EQUIPMENT.

THEY'RE GOING TO BE OUT PARTICIPATING IN THIS.

ALSO, OUR PLANNING DEPARTMENT ANDREW, EMILY, TORRIE, ALL OF THOSE IN THAT GROUP.

WE WORK WITH THEM, THEY WORK WITH THE VOLUNTEER GROUPS THROUGHOUT THE AREA.

SO THIS IS GOING TO BE A BIG CLEANUP EFFORT.

IT'S AN INDIVIDUAL EFFORT THAT ANYONE CAN PARTICIPATE IN.

IF YOU DON'T WANT TO PARTICIPATE WITH A GROUP.

GRAB A BAG, GRAB SOME GLOVES.

GO GET SOME TRASH FROM WHEREVER YOU WANT TO DO THAT FROM.

THAT'S THE IDEA OF THIS.

WE WILL HAVE A PRESS RELEASE COMING OUT THIS AFTERNOON THAT WILL IDENTIFY ALL THE LOCATIONS OF OUR ROLL OFF CONTAINERS SO THAT ANYONE, EVERYONE WILL KNOW WHERE THOSE ARE AT.

AND WE ALSO HAVE COORDINATE ALL OUR ROUTING AS WELL FOR ALL OF OUR EQUIPMENT.

SO I JUST WANT TO SAY THANK YOU ALL AND THANK YOU, COUNCIL FOR PARTICIPATING IN THESE TYPE OF EVENTS AND THESE PROCLAMATION LIKE THIS THAT RECOGNIZES A LOT OF PEOPLE IN OUR COMMUNITY COMING TOGETHER FOR ONE COMMON GOAL, AND THAT'S TO CLEAN OUR COMMUNITY.

THANK YOU FOR THAT.

THANK YOU SO MUCH, DONNY.

WE REALLY APPRECIATE YOU AND YOUR EMPLOYEES, THEY CERTAINLY TAKE A LOT OF PRIDE IN TRYING TO HELP TO CLEAN UP OUR CITY, SO I APPRECIATE EVERYTHING THAT YOU'RE DOING SO MUCH.

AT THIS PARTICULAR TIME, WE HAVE ANOTHER PROCLAMATION IN REGARDS TO VOTER REGISTRATION MONTH.

AND I KNOW THAT WE HAVE MS. SONIA LETSON HERE ASSOCIATED WITH THE PROCLAMATION.

IS THERE ANYONE ELSE OUT IN THE AUDIENCE THAT'S ALONG WITH SONYA? THEY WOULD LIKE TO COME UP? OK.

YOU'RE IT SO SOUNDS GOOD.

WHEREAS OUR LOCAL, STATE AND NATIONAL GOVERNMENTS FUNCTION THROUGH VOTING ON BOTH CANDIDATES AND ISSUES, WHEREAS VOTING IS A RIGHT AS WELL AS A PRIVILEGE AND OUR ABILITY TO VOTE ADVANCES AND PROTECTS OUR RIGHTS AS CITIZENS.

WE FORM A MORE PERFECT UNION BY PARTICIPATING IN ELECTIONS AND VOTING FOR IDEAS AND CANDIDATES WE BELIEVE IN.

WHEREAS A CITIZEN OTHERWISE ELIGIBLE TO VOTE CANNOT DO SO UNLESS HE OR SHE IS REGISTERED TO VOTE, VOLUNTEERS AND ELECTION OFFICIALS ARE OFTEN NEEDED TO HELP CITIZENS INITIATE AND COMPLETE THE VOTER REGISTRATION PROCESS, WHEREAS WE ALL BENEFIT WHEN OUR FELLOW CITIZENS ARE INFORMED ABOUT HOW TO REGISTER, WHEN AND WHERE TO VOTE, AND THE IMPORTANCE OF PARTICIPATING IN OUR ELECTORAL PROCESS.

NOW, THEREFORE, WE, MAYOR AND CITY COUNCIL MEMBERS OF THE CITY OF AMARILLO, DO HEREBY PROCLAIM SEPTEMBER 2021 AS VOTER REGISTRATION MONTH IN AMARILLO, AND ENCOURAGE ALL ELIGIBLE CITIZENS TO REGISTER TO VOTE, TO EXERCISE THEIR RIGHT TO VOTE IN FORTHCOMING ELECTIONS AND TO GRACIOUSLY ENCOURAGE OTHERS TO DO SO, LIKEWISE.

[00:10:02]

GIVEN UNDER OUR HAND AND SEAL OF OFFICE THIS 14 DAY OF SEPTEMBER 2021.

THE HONORABLE MAYOR, GINGER NELSON, COUNCIL MEMBERS COLE STANLEY, FREDA POWELL, DR.

EDDY SAUER AND HOWARD SMITH.

AND HERE TO ACCEPT THE PROCLAMATION AS MS. SONYA LETSON AND SONYA.

AS AS A FRIEND, I JUST WANTED TO SAY WE APPRECIATE ALL THAT YOU HAVE DONE.

I KNOW THAT SINCE YOU'VE RETIRED IN THE LAST COUPLE OF YEARS, YOU'VE DONE A LOT FOR THE LEAGUE OF WOMEN VOTERS, AND YOU'RE PROBABLY LIKE THE PICTURE THAT'S OUTSIDE THE WHEN YOU SEE THE LEAGUE OF WOMEN VOTERS, WE SEE YOUR PICTURE RIGHT THERE BY IT.

SO I APPRECIATE ALL THE WORK THAT YOU'VE BEEN DOING TO HELP EDUCATE US AS CITIZENS AND ALSO AS VOTERS.

THANK YOU SO MUCH.

I APPRECIATE THAT.

AND OF COURSE, I CAN'T MISS AN OPPORTUNITY TO TALK ABOUT VOTING AND REGISTERING TO VOTE.

SO LET ME JUST TELL YOU GUYS THAT THE LEAGUE OF WOMEN VOTERS HAS BEEN TRYING TO GET PEOPLE REGISTERED AND OUT VOTING FOR OVER A HUNDRED YEARS.

AND HERE IN AMARILLO SINCE 1950, ALL OUR AMARILLO LEAGUE MEMBERS ARE VOLUNTEERS AND WE WANT PEOPLE TO REGISTER AND VOTE BECAUSE LOCAL ELECTIONS, SUCH AS THE ONE WE HAVE COMING UP ON NOVEMBER 2ND, ARE SOME OF THE MOST IMPORTANT ELECTIONS THAT WE HAVE.

THEY HAVE THE MOST IMPACT ON YOUR DAY TO DAY LIFE AND FOR ABOUT 60 PEOPLE IN THIS ROOM.

IF WE USED HISTORICAL AVERAGES, ONLY 18 OF US WOULD VOTE IN A LOCAL ELECTION.

LAST YEAR WE HAD MAJOR TURNOUT, LOTS OF INTEREST.

BUT MANY PEOPLE DON'T KNOW.

WE HAVE A NOVEMBER 2ND ELECTION WITH EIGHT CONSTITUTIONAL AMENDMENTS TO THE STATE CONSTITUTION AND THE CITY TAX RATE ISSUE ALSO ON THE BALLOT.

SO THIS IS THE TIME TO GET OUT THERE AND VOTE ON A LOCAL ISSUE THAT'S GOING TO MAKE A DIFFERENCE IN EVERYONE'S LIVES.

WE ENCOURAGE EVERYBODY TO DO THAT.

WE WILL BE REGISTERING VOTERS AT THE DOWNTOWN LIBRARY ON NATIONAL VOTER REGISTRATION DAY, SEPTEMBER 28TH FROM 10 TO ONE.

ALSO, WE'RE GOING TO BE AT THE AMARILLO POLICE DEPARTMENT, REGISTERING THEIR STAFF AND OFFICERS OCTOBER 1ST.

WE'LL BE AT THE UNITED STORES ON OCTOBER 2ND.

WE'LL BE AROUND TOWN AND WE'RE IN ALL THE PUBLIC HIGH SCHOOLS THIS FALL, REGISTERING VOTERS.

SO THANK YOU MAYOR AND MAYOR PRO TEM AND COUNCIL MEMBERS FOR THIS PROCLAMATION.

WE APPRECIATE YOU RECOGNIZING THE IMPORTANCE.

AND AGAIN, THANK YOU.

THAT'S.

RIGHT.

ALL RIGHT.

GOOD AFTERNOON, EVERYONE.

I'M FREDA POWELL, MAYOR PRO TEM FOR THE CITY OF AMARILLO, STEPPING IN FOR MAYOR NELSON, WHO IS OUT TODAY.

I'D LIKE TO CALL OUR MEETING TO ORDER AND AT THIS PARTICULAR TIME, WE WILL

[PUBLIC ADDRESS]

START WITH PUBLIC ADDRESS AND I'D LIKE TO KINDLY REMIND YOU THAT YOUR COMMENTS SHOULD BE TIED TO AN ITEM ON TODAY'S AGENDA.

AND IF IT IS NOT AND YOU WISH FOR ME TO KNOW ABOUT IT OR ANY OF MY OTHER FELLOW COUNCIL MEMBERS, PLEASE FEEL FREE TO CALL OR EMAIL.

IF YOU WOULD LIKE FOR US TO KNOW ABOUT AN ISSUE OR PROBLEM THAT YOU HAVE.

BE HAPPY TO LOOK INTO THAT.

SO AT THIS PARTICULAR TIME, I'LL TURN IT OVER TO MS. MASSEY.

THANK YOU.

THANK YOU FOR PARTICIPATING IN TODAY'S CITY COUNCIL MEETING.

YOUR INPUT AND YOUR OPINIONS ARE IMPORTANT TO US, AND WE'RE GLAD YOU'RE HERE TO SHARE THEM.

AT EACH POSTED MEETING, WE INVITE OUR FELLOW COMMUNITY MEMBERS TO ADDRESS CITY COUNCIL REGARDING POSTED AGENDA ITEMS TO ENSURE EVERYONE IS ABLE TO SPEAK.

WE LIMIT EACH SPEAKER'S TIME TO THREE MINUTES.

AT THE END OF TWO AND A HALF MINUTES.

A WARNING BEEP WILL SOUND FROM THE DAIS TO ALERT YOU THAT YOU HAVE 30 SECONDS LEFT TO WRAP UP YOUR THOUGHTS.

WE ASK YOU TO STAY WITHIN THE 3 MINUTES ALLOTTED.

YOUR START TIME WILL BEGIN AS SOON AS YOU START SPEAKING.

IN ACCORDANCE WITH THE OPEN MEETINGS ACT AND STATE LAW SPEAKERS ARE ASKED TO LIMIT THEIR COMMENTS TO ITEMS ON THE POSTED AGENDA.

DOING SO WILL ENSURE WE ARE FOLLOWING THE GUIDELINES AND ARE ABLE TO HAVE AN EFFECTIVE MEETING FOR ALL.

THANK YOU FOR YOUR CONSIDERATION FOR THIS PROCESS AND FOR YOUR VALUABLE INPUT.

AT THIS TIME, WE WILL ASK MICHAEL FORD TO APPROACH THE MICROPHONE FOR PUBLIC

[00:15:06]

ADDRESS.

DO YOU THINK HE MAY BE IN THE OTHER ROOM? MIGHT BE IN THE OTHER ROOM I WAS GOING TO GIVE HIM, GIVE HIM A MINUTE? MR. FORD ? OK, DO WE HAVE ANY OTHER SPEAKERS WHILE WE'RE WAITING ON MR. FORD? OK, WE'LL GIVE HIM A FEW MORE MOMENTS HERE AND SEE IF HE SHOWS UP.

THERE HE IS.

HELLO, MR. FORD.

I WAS WATCHING ON THE OVERFLOW ROOM AND DIDN'T REALIZE THERE WAS A DELAY, SO IT'S.

THAT MAY KEEP A GROUP WAITING.

I'LL WAIT, UNTIL YOU HAVE THE INFORMATION IN FRONT OF YOU.

ANOTHER DELAY.

MY NAME IS MIKE FORD, I'M HERE TO TALK ABOUT YOUR AGENDA AND THE ITEMS ON IT.

AND I'M GOING TO START AT THE VERY TOP.

CITY COUNCIL MISSION, WHICH SAYS TO USE DEMOCRACY TO GOVERN THE CITY EFFICIENTLY AND EFFECTIVELY IN THE ACCOMPLISH THE CITY'S COMMISSION MISSION.

SO THE QUESTION IS, ARE WE A DEMOCRACY OR REPRESENTATIVE REPUBLIC? WE'RE ACTUALLY HERE.

WE JUST RECOGNIZE VOTER REGISTRATION PROCESS AND WITH OUR FORMER JUDGE.

AND THE INTERESTING THING IS IS WE'RE A REPRESENTATIVE REPUBLIC.

YOU ARE ELECTED OFFICIALS, YOU'RE REQUIRED TO BE TRAINED ON THE REQUIREMENTS OF THE OPEN MEETING ACT.

THERE'S TWO THINGS THAT GOVERN PUBLIC COMMENT.

TWO ITEMS OF THE OPEN MEETINGS ACT THAT GOVERN PUBLIC COMMENT THAT YOU GUYS CONTINUE TO RECITE, RECITE, UNFORTUNATELY INCORRECTLY.

THE FIRST ONE IS 551.007 PUBLIC TESTIMONY.

IT SAYS A GOVERNMENT BODY SHALL ALLOW EACH MEMBER OF THE PUBLIC AND WILL YOU SAY THE PUBLIC WILL BE ALLOWED PERMITTED TO OFFER COMMENTS.

THERE'S ANOTHER ONE.

THERE'S ANOTHER VERY IMPORTANT PROVISION OF THE OPEN MEETINGS ACT THAT I'M GOING TO LET.

THIS SHOULD BE FAMILIAR TO YOU SINCE YOU ALL HAD OPEN MEETINGS ACT TRAINING.

BUT THIS IS JENNY HOLZER, DIVISION OF CHIEF OPINIONS OF THE OFFICE OF ATTORNEY GENERAL, COVERING THE SECOND PROVISION OF THE OPEN MEETINGS.

DURING THE PUBLIC COMMENTS SECTION, IT'S ALWAYS POSSIBLE THAT A MEMBER OF THE PUBLIC MAY RAISE A TOPIC THAT ISN'T POSTED ON THE AGENDA, AND THE LEGISLATURE ACKNOWLEDGES THIS POSSIBILITY AND EXPRESSLY ALLOWS A MEMBER OF A GOVERNMENTAL BODY TO RESPOND TO SUCH A COMMENT WITH A STATEMENT OF SPECIFIC FACTUAL INFORMATION OR A RECITATION OF EXISTING POLICY.

DESPITE THAT, SUCH INFORMATION WAS NOT NOTICED, SO THIS PROVIDES A LITTLE BIT OF COVER FOR YOU TO AT LEAST PROVIDE SOME VERY BASIC RESPONSE TO A MEMBER OF THE PUBLIC THAT HAS RAISED A TOPIC THAT YOU DIDN'T PROVIDE NOTICE FOR.

BUT ANY DELIBERATION OR DECISION ABOUT THE SUBJECT OF AN INQUIRY THAT WASN'T NOTICED MUST BE LIMITED TO PLACING THAT SUBJECT ON THE AGENDA FOR A SUBSEQUENT MEETING.

SO THERE'S TWO ISSUES HERE.

THIS SHOULD BE VERY FAMILIAR TO YOU ALL.

THIS IS YOUR REQUIRED TRAINING.

SO THE RECITATION THAT WE'RE MAKING UP HERE THAT YOU CAN ONLY TALK ABOUT ITEMS ON THE AGENDA IS ABSOLUTELY LEGALLY FALSE.

I CAN TELL YOU THAT FROM 14 YEARS OF SERVICE IN THE STATE OF TEXAS.

SO HOWARD, IF I'M UP HERE TALKING AND YOU SAY AND I'M TALKING ABOUT SOMETHING ON THE AGENDA, THEN YOU COULD SAY, MIKE, THAT'S THE STUPIDEST THING I'VE EVER HEARD, RIGHT? AND YOU'RE ALLOWED TO HAVE THAT CONVERSATION WITH ME.

IF IT'S NOT ON THE AGENDA, THEN YOU CAN ASK MR. CITY MANAGER, WHAT'S THE CITY'S POLICY ON THE STUPID STUFF THAT MIKE FORD IS SAYING, RIGHT? SO IT'S OK.

YOU HAVE.

THAT'S YOUR RIGHT.

ALL OF YOU HAVE THE RIGHT TO ADDRESS THE PUBLIC ON ITEMS OF THEIR ON THE AGENDA.

AND IF THEY'RE NOT ON THE AGENDA, YOU HAVE THE RIGHT TO REQUEST SOMETHING BE ADDED TO THE AGENDA.

BUT PLEASE, PLEASE GET THE LAW RIGHT.

MR. FORD, YOUR TIME IS UP.

YOU'RE TAKING THE RIGHTS AWAY FROM YOURSELVES AND FROM THE PUBLIC.

MR. FORD, THANK YOU FOR YOUR COMMENTS.

WE DID HAVE SOMEONE ELSE SIGN UP.

IF MR. BABJI YALAMANCHILI WOULD STEP TO THE MICROPHONE, PLEASE.

MY NAME IS BABJI YALAMANCHILI, I'M THE COORDINATOR AND FOUNDER OF KEEP AMARILLO CLEAN.

THIS IS NOT MY PROFESSION.

[00:20:04]

WE ARE DOING VERY WELL, AND THEN WE LIVE IN A BEAUTIFUL NEIGHBORHOOD, I DON'T HAVE TO DEAL WITH THIS THING.

BUT IT'S A GLOBAL ISSUE THAT IS A BIG PROBLEM AROUND THE WORLD.

TOSSING OUT IS A BIG PROBLEM.

IT'S A COMMON PRACTICE, YOU KNOW, GLOBALLY.

THAT'S WHY I'M STARTED PUTTING UP.

NO TOSS, PLEASE TAKE YOUR TRASH HOME AND PUTTING UP THE SIGNS AROUND WAL-MARTS.

I'M TRYING TO PUT THAT ON THE DRIVE THRU RESTAURANTS.

I MADE 100 SIGNS SO FAR AND I THINK I'LL TRY TO PUT AS MUCH AS I CAN.

AND ALSO, I SAY EVERY ONE OF YOU.

IT GO EVERYWHERE FROM YOUR NEIGHBORHOOD.

JUST TAKE FOUR SQUARE BLOCK AREA [INAUDIBLE] THAT CLEAN IT UP.

LET THE NEIGHBORS KNOW WHAT IT LOOKS LIKE WHEN IT'S CLEANED UP.

IT DOESN'T TAKE MUCH TIME.

IT'S ONLY HALF AN HOUR.

YOU KNOW, EVERY ONE OF YOU JUST GO OUT OF YOUR NEIGHBORHOOD BECAUSE THAT'S WHAT IT TAKES.

ACTUALLY, YOU KNOW, THERE'S SO MUCH TRASH IN SOME OF THE NEIGHBORHOODS.

BELIEVE IT OR NOT.

AND THE ONLY WAY YOU CAN BREAK THE CYCLE IS JUST GO OUT AND, YOU KNOW, DO THINGS, YOU KNOW.

AND ALSO, WE ARE TRYING TO CLEAR TEACH ALL THE KIDS IN THE SCHOOLS.

AND I'M DEALING WITH THE 62 SCHOOL DISTRICTS AND I'M TRYING TO, YOU KNOW, SEND ALL THE FLIERS TO THEM SO THAT THEY'RE ALSO ON THE SAME PAGE.

SO I'M TRYING TO, IT'S A GLOBAL PHENOMENON, AND WE'RE TRYING TO DEAL WITH THAT.

THAT'S WHAT I WANT TO SAY.

EVERY ONE OF YOU.

PLEASE TAKE JUST A FOUR BLOCK HERE IN OUR CITY AND TALK TO THE NEIGHBORS AND THEN, YOU KNOW, MAKE IT LOOK GOOD AND THEY'LL SEE THE DIFFERENCE.

THANK YOU.

THANK YOU, MR. YALAMANCHILI, FOR YOUR COMMENTS.

I THINK THAT'S IT, IS IT ALL WE HAVE FOR PUBLIC ADDRESS? THANK YOU SO MUCH.

MR. CITY MANAGER, DID YOU HAVE ANY ADDITIONAL COMMENTS IN REGARDS TO PUBLIC ADDRESS AS IT RELATES RELATES TO MR. MICHAEL FORD? WELL, AS FAR AS LOCAL GOVERNMENT CODE SECTION 551.007, IT SPEAKS TO AND IT'S A RECENT MODIFICATION TO LOCAL GOVERNMENT CODE.

IN A RECENT LEGISLATIVE SESSION, BUT IT SPEAKS TO WHAT IS REQUIRED, NOT WHAT IS ALLOWED.

SO WE ARE REQUIRED TO ALLOW PUBLIC ADDRESS, AND IT CHANGES PUBLIC COMMENT TO PUBLIC ADDRESS, AND IT REQUIRES THAT A CITY ALLOW ANY CITIZEN TO SPEAK ON ANY ITEM THAT IS BEFORE THE COUNCIL FOR CONSIDERATION PRIOR TO COUNCIL'S CONSIDERATION OF THAT ITEM.

AND THAT'S WHY WE DO PUBLIC ADDRESS AT THE START OF THE MEETING LIKE WE DO.

IT DOES NOT PROHIBIT A CITY COUNCIL FROM ALLOWING COMMENT ON ANY TOPIC, BUT NOR DOES IT REQUIRE A CITY COUNCIL TO ALLOW COMMENT ON ANY TOPIC.

SO WE HAVE BEEN STRICTLY COMPLIANT WITH 551.007 IN ALLOWING THE PUBLIC TO MAKE PUBLIC ADDRESS, TO PUBLICLY ADDRESS THE CITY COUNCIL ON ANY ITEM THAT WILL BE CONSIDERED BY THE CITY COUNCIL ON AN AGENDA.

AND THEN THERE'S THE QUESTION OF WHY WOULDN'T YOU HAVE PUBLIC ADDRESS ON ANY TOPIC? AND THE QUESTION IS WHAT'S THE WORK MEETING TO DISCUSS? SO WE WANT TO MAKE SURE THAT OUR MEETINGS ARE EFFICIENT, THAT THEY'RE EFFECTIVE AND THAT COUNCIL CAN ADDRESS THE ITEMS BEFORE THEM IN AN EFFICIENT WAY AND A RESPONSIBLE WAY.

SO THERE ARE MANY, MANY WAYS THAT A MEMBER OF THE PUBLIC CAN ADDRESS CITY COUNCIL THROUGH EMAIL, THROUGH PUBLIC PUBLIC INPUT ON THE WEBSITE, PHONE CALLS AND OTHER WAYS, MEETINGS.

SO WE WANT TO MAKE SURE THAT WE ARE COMPLIANT WITH STATE LAW.

WE ALSO WANT TO MAKE SURE THAT OUR WORK MEETINGS ARE EFFECTIVE AND EFFICIENT, AND WE ALSO WANT TO MAKE SURE THAT PEOPLE HAVE AS MANY WAYS AS POSSIBLE TO ADDRESS CITY COUNCIL, AND WE THINK WE FOUND THAT BALANCE WITH THE WAY WE DO IT.

ALL RIGHT, THANK YOU.

I APPRECIATE THAT.

ADDITIONAL INFORMATION.

OK, AT THIS PARTICULAR TIME, WE WILL MOVE ON TO OUR AGENDA ITEMS, SO WE'LL START WITH 1A, COUNCIL, ARE THERE ANY CONCERNS OR QUESTIONS THAT YOU HAVE FOR THE REGULAR MEETING AGENDA AND ATTACHMENTS? MR. MAYOR, BEFORE WE JUMP INTO 1A, IF I COULD? OH, I'M SORRY, YOU DO HAVE SOME PRESENTATION.

I JUST WANT TO RECOGNIZE A FEW EMPLOYEES AND A FEW REALLY NEAT THINGS.

WE HAVE GLEN LAVENDER.

WOULD YOU PLEASE COME UP HERE AND JUST STAND IN FRONT OF A MICROPHONE, YOU DON'T HAVE TO SAY ANYTHING, BUT YOU'RE GOING TO HAVE TO RECEIVE SOME RECOGNITION.

GLENN LAVENDER IS OUR.

HE RUNS OUR FLEET SERVICES OPERATION.

HE MAINTAINS ALL OUR VEHICLES.

HE WORKS WITH PURCHASING TO PURCHASE ALL OF OUR VEHICLES AND WE BUY A LOT.

[00:25:02]

WE HAVE A LOT OF ROLLING STOCK HERE IN THE CITY OF AMARILLO, AND GLEN'S RESPONSIBLE FOR IT ALL, NOT JUST THE ACQUISITION, NOT JUST THE MAINTENANCE, BUT ALSO THE OUTFITTING AND OPERATION OF ALL OF THOSE DIFFERENT VEHICLES, THOUSANDS OF VEHICLES AND PIECES OF APPARATUS THAT WE HAVE THROUGHOUT THE ORGANIZATION.

WELL, GLENN HAS RECENTLY BEEN RECOGNIZED AS THE FLEET PROFESSIONAL OF THE YEAR BY AT THE FLEET PROFESSIONALS CONFERENCE IN ROUND ROCK.

SO IT'S A STATEWIDE CONFERENCE WHERE ALL OF OUR FLEET PROS GO EVERY YEAR, SO IT'S A BIG DEAL.

IT'S GRANTED TO THE FLEET PROFESSIONAL WHOSE ORGANIZATION BRINGS OR HAS BROUGHT ABOUT A SIGNIFICANT ADVANCE IN THE MANAGEMENT OR OPERATION OF THE FLEET.

GLENN'S BEEN WITH US FOR 31 YEARS.

HE STARTED IN 1990.

HE WAS AN ASSISTANT SUPERINTENDENT IN '98.

SUPERINTENDENT IN 2011.

HE GOT HIS CERTIFICATE OF PUBLIC MANAGEMENT, OR CPM, IN 2004.

BORN HERE, HE'S LIVED HERE HIS WHOLE LIFE.

COMMITTED HIS WHOLE LIFE TO A TASCOSA GRAD, AMARILLO COLLEGE GRAD, TEXAS TECH WENT TO TEXAS TECH AS WELL.

HAS BEEN MARRIED 39 YEARS, TWO DAUGHTERS.

GOOD EXAMPLE.

A GREAT EXAMPLE OF WHAT YOU CAN ACCOMPLISH WHEN YOU COMMIT YOUR LIFE IN YOUR CAREER, TO AN ORGANIZATION, INTO A COMMUNITY, AND THEN TO BE RECOGNIZED BY YOUR PEERS AS THE BEST IN YOUR BUSINESS IS A BIG DEAL, AND I WANT TO I WANT TO RING THAT BELL EVERY CHANCE I GET.

SO, GLENN, CONGRATULATIONS.

BRAVO ZULU JOB WELL DONE.

YES.

THANK YOU.

THANK YOU.

CONGRATULATIONS.

I ALSO WANTED TO SINCE I HAVE JUST A MOMENT.

WE'VE BEEN, WE'VE MADE THE ANNOUNCEMENT ABOUT ANDREW FREEMAN AS ASSISTANT CITY MANAGER.

HE USED TO BE THE MANAGING DIRECTOR OF PLANNING AND ECONOMIC DEVELOPMENT.

BUT NOW, SINCE HE'S BEEN APPOINTED AS ASSISTANT CITY MANAGER, WE'VE HAD TO APPOINT A NEW DIRECTOR OF PLANNING AND A NEW ASSISTANT DIRECTOR OF PLANNING.

SINCE WE, WELL, WE HAD TO MAKE SOME MAKE SOME PROMOTIONS.

SO CHRIS VALVERDE IS NOW OUR DIRECTOR OF PLANNING.

CHRIS, WHERE ARE YOU AT? THERE HE IS BACK THERE, HE'S GOING TO STAY BACK THERE AND JUST WAVE AT YOU, BUT YOU MIGHT WANT TO SAY THINGS TO HIM.

HE'S GOT 23 YEARS OF MUNICIPAL GOVERNMENT EXPERIENCE.

HE'S BEEN WITH US FOR A LONG TIME.

BUT HE SPENT A LITTLE BIT OF TIME WITH THE CITY OF PLAINVIEW.

AS THE DIRECTOR OF PLANNING THERE CAME BACK TO US AS ASSISTANT DIRECTOR IN 2018.

PRIOR TO BEING WITH US.

LIKE I SAID, HE'S BEEN WITH US FOR 20.

HE'S WORKED IN MUNICIPAL GOVERNMENT FOR 23 YEARS.

IN JUST A FEW OF THAT WAS OUTSIDE THE CITY OF AMARILLO.

BUT PRIOR TO THAT, HE WAS ALSO A NAVY GUY.

SO YOU CAN UNDERSTAND WHY, WHY HE IS WELL LOVED IN OUR COMMUNITY.

WITH HIS NAVY BACKGROUND, BACHELOR'S DEGREE FROM WAYLAND BAPTIST BEEN WITH US FOR A LONG TIME.

LOTS OF PLANNING EXPERIENCE, SO PLEASE WELCOME.

CHRIS VALVERDE AS DIRECTOR OF PLANNING.

WE ALSO HAVE EMILY KOLLER.

EMILY, IS EMILY? THERE SHE IS.

EMILY KOLLER HAS BEEN WITH US SINCE 20? WHAT YEAR DID YOU COME, EMILY? 2017, 2018? 2019.

IT JUST FEELS LIKE A LONG TIME NOW.

EMILY WORKED WITH ME PREVIOUSLY IN THE CITY OF SAN MARCOS, SO SHE'S A KNOWN COMMODITY.

SHE BRINGS A WEALTH OF EXPERIENCE AND PLANNING.

SHE'S WORKED NOT ONLY FOR CITIES, BUT ALSO FOR THE STATE OF TEXAS.

SHE HAS A MASTER'S DEGREE IN COMMUNITY AND REGIONAL PLANNING FROM UT AUSTIN.

SHE'S AN ICP CERTIFIED PLANNER WITH THE AMERICAN PLANNING ASSOCIATION, AND SHE'S WORKED FOR THE CITY OF AMARILLO FOR TWO YEARS AND IN THE PLANNING FIELD FOR 10 YEARS.

SO WE HAVE A GREAT TEAM IN THE PLANNING DEPARTMENT WHERE I THINK FULLY STAFFED RIGHT NOW, WHICH IS A CHALLENGE IN MOST CITIES IN THE STATE OF TEXAS.

I CAN'T SAY THAT THEY'RE PLANNING TEAMS ARE FULLY STAFFED BECAUSE IT IS SUCH A COMPETITIVE FIELD, SO THEY'RE DOING A GREAT JOB OF LEADING THIS DEPARTMENT AND THAT IS PROVEN BY THE FACT THAT PEOPLE COME AND THEY STAY.

SO GREAT JOB, EMILY.

GREAT JOB, CHRIS.

LOOKING FORWARD TO WHAT YOU'RE GOING TO DO WITH THIS UNDER ANDREW'S LEADERSHIP, ANDREW IS STILL GOING TO BE MANAGING THE PLANNING FUNCTION IN AS ASSISTANT CITY MANAGER ROLE.

BUT ANY ANYTIME WE HAVE PROMOTIONS AND WE HAVE KEY POSITIONS, I WANT TO MAKE SURE THAT Y'ALL ARE AWARE OF WHO'S INHABITING THOSE POSITIONS AND UNDERSTAND THE QUALIFICATIONS AND PASSION THAT THEY BRING TO THOSE POSITIONS.

SO THAT'S ALL I HAD.

MAYOR OK, ALL RIGHT.

LET'S GIVE.

[1.A. Review agenda items for regular meeting and attachments]

THANK YOU, MR. CITY MANAGER.

NOW WE'LL MOVE ON TO THE AGENDA ITEM 1A, WHICH IS REVIEW AGENDA ITEMS FOR REGULAR MEETING AND ATTACHMENTS.

SO, COUNCIL.

ARE THERE ANY ITEMS THAT YOU HAVE QUESTIONS ABOUT OR NEED MORE EXPLANATION ON? NOPE.

OK, ALL GOOD.

MOVING ON TO AGENDA ITEM 1B, THIS IS AN UPDATE ON PARKS MASTER PLAN.

[1.B. Update on Parks Master Plan]

MR. CITY MANAGER? HI, MAYOR, WE JUST WANT TO KEEP YOU APPRIZED OF THE PROGRESS OF THE PARK'S MASTER PLAN.

THERE IS NOTHING FOR COUNCIL ACTION RIGHT NOW OR IMMINENT.

HOWEVER, IT WILL BE COMING TO YOU AT SOME POINT IN THE NEAR FUTURE.

[00:30:03]

WE'VE GOT DIRECTOR OF PARKS AND RECREATION MICHAEL KASHUBA HERE TO TALK TO US.

HE'S ALSO GOING TO BE INTRODUCING OUR REPRESENTATIVE FROM MIG.

SO, MICHAEL, TAKE IT AWAY.

MAYOR PRO TEM AND COUNCIL MICHAEL KASHUBA, DIRECTOR OF PARKS AND RECREATION.

EXCITED TO BRING YOU AN UPDATE ON THE PARK'S MASTERPLAN.

THIS HAS BEEN A LONG TIME COMING.

WE'VE BEEN WORKING ON THIS PROCESS SINCE ABOUT 2019, AND SO WE'RE REACHING THE END OF THE PROCESS AND WE REALLY WANTED TO PROVIDE AN UPDATE TO COUNCIL.

WANTED TO ALSO ACKNOWLEDGE JOHN INGERSON, OUR PARK BOARD CHAIR, WHO'S IN ATTENDANCE TODAY.

WE ACTUALLY PRESENTED THIS SAME INFORMATION TO OUR PARK BOARD THIS MORNING AND HAD A REALLY GOOD CONVERSATION ABOUT IT.

SO WHAT I'D LIKE TO DO IS INTRODUCE OUR CONSULTANT CINDY MENDOZA WITH MIG.

SHE'S GOT A LITTLE PRESENTATION TO WALK THROUGH AND THEN WE'D BE HAPPY TO ANSWER ANY QUESTIONS ABOUT IT.

WELCOME, CINDY.

THANK YOU SO MUCH.

IT'S MY HONOR TO BE HERE TODAY TO SPEAK ON BEHALF OF THE PARKS AND RECREATION DEPARTMENT WITH REGARDS TO THE PARKS AND RECREATION MASTER PLAN, AS YOU SEE ON YOUR SCREEN.

WE HAVE A PLAN THAT IS HERE BEFORE YOU TO BRING A BLUEPRINT OR GUIDANCE FOR THE NEXT 10 YEARS FOR ENHANCING YOUR PARK AND RECREATION SYSTEM.

IT IS AN IMPORTANT PLANNING PROCESS THAT YOU ALL HAVE WEIGHED IN ON MANY TIMES TO GET US TO WHERE WE ARE TODAY.

THE PLAN INCLUDES FIVE CHAPTERS WHICH REALLY VERY STRONGLY TIES TO YOUR COMMUNITY, ITS HERITAGE, ITS PRIORITIES, THE DIVERSE RESIDENTS WHO LIVE HERE, AS WELL AS THE INVESTMENT STRATEGY NEEDED TO MOVE FORWARD IN PARKS AND RECREATION.

THE PLAN ALSO INCLUDES FIVE APPENDICES, WHICH IS PROBABLY MORE DETAILED THAN YOU WILL WANT TO READ.

BUT IT IS CRITICAL FOR THE CITY STAFF TO HAVE THOSE DIRECTIONS TO BE ABLE TO MOVE FORWARD AND TO KNOW WHAT ACTIONS TO FOLLOW IN ENHANCING PARKS AND RECREATION IN THE FUTURE.

THE PLANNING PROCESS CONSISTED OF FOUR PHASES OVER THE LAST 10 YEARS.

WE DID SLOW IT DOWN STRATEGICALLY AT TWO POINTS IN THE PLANNING PROCESS.

ONE EARLY ON AS WE GOT STARTED WAS TO RESPOND TO THE COVID HEALTH RESTRICTIONS TO MAKE SURE THAT OUR OUTREACH PROCESS STILL WORKED WELL TO GET THE APPROPRIATE INVOLVEMENT FROM YOUR ENTIRE COMMUNITY.

AND THE SECOND ONE I'LL TELL YOU ABOUT AS WE MOVE FORWARD IN THIS PRESENTATION.

THE OUTREACH PROCESS WAS ROBUST.

MORE THAN 9500 PEOPLE INVOLVED PARTICIPATING, LENDING THEIR VOICE TO THIS PLANNING PROCESS AND ANOTHER 13000 OR MORE KEPT INFORMED THROUGH THE AMAZING COMMUNICATIONS TEAM IN THE PARKS AND RECREATION DEPARTMENT.

SO VIA SOCIAL MEDIA AND UPDATES ON THE PROJECT WEBSITE, PEOPLE KNEW ABOUT THE ISSUES AND CHALLENGES FACING PARKS AND RECREATION IN THIS COMMUNITY, SO IT ALLOWED THEM TO HAVE THE OPPORTUNITY TO SPEAK TO MANY OF THE ISSUES THAT WE RAISED.

BUT EVEN MORE IMPORTANTLY, WE HAD SEVERAL ADVISORY COMMITTEE MEMBERS INVOLVED, INCLUDING, COUNCIL YOU ALL WEIGHING IN AT SEVERAL KEY POINTS OF THE PLANNING PROCESS TO ENSURE THAT THE PLAN YOU HAVE BEFORE YOU NOW IS THE RIGHT PLAN FOR THIS COMMUNITY.

OUTREACH WAS CONDUCTED IN BOTH SPANISH AND ENGLISH TO ENSURE THAT PEOPLE HAD AN OPPORTUNITY TO WEIGH IN WITH REGARDS TO THEIR PRIORITIES.

AND AS YOU SEE ON THE GRAPHIC, THAT'S ON THIS PAGE.

CERTAINLY, MAINTAINING YOUR EXISTING PARK AND RECREATION ASSETS WAS A CLEAR PRIORITY TO COMMUNITY MEMBERS, AS WELL AS DIVERSIFYING OPPORTUNITIES TO HAVE A GREATER VARIETY OF RECREATION AND PARKS ACROSS THE SYSTEM.

BUT MORE THAN THAT, THERE WERE SO MANY VOICES INVOLVED IN THIS PLANNING PROCESS THAT WE INCLUDED A SNAPSHOT OF THOSE IN THE GRAPHIC THAT YOU SEE THERE.

THAT'S IN THE PLAN AS WELL, JUST TO REPRESENT THE VARIETY OF COMMENTS THAT WE HEARD FROM RESIDENTS AND THE CLEAR PRIORITIES FOR INVESTING IN PARKS AND RECREATION TO SUPPORT COMMUNITY LIVABILITY, TO SUPPORT QUALITY OF LIFE, TO PROVIDE OPPORTUNITIES FOR FAMILIES AND CHILDREN, AND EVEN TO BRING TEAMS TOGETHER THROUGH SPORTS.

CERTAINLY, THE TOP PRIORITIES WERE AROUND IMPROVING PARK MAINTENANCE, BUT EVEN TRAILS AND WALKABILITY WERE KEY, AS ARE BRINGING ATTENTION TO OUR DESTINATION FACILITIES, SUCH AS THE THOMPSON POOL THAT RECENTLY REOPENED HERE WITH YOUR FUNDING AND INVESTMENT.

THROUGH THIS PLAN, WE IDENTIFIED EIGHT GUIDING PRINCIPLES FOR THE PARK AND RECREATION SYSTEM.

I'M NOT GOING TO TALK THROUGH ALL OF THEM BECAUSE YOU'VE ACTUALLY HEARD THEM BEFORE, BUT A FEW KEY ONES THAT HELPED IDENTIFY THE GOALS FOR THIS PLAN ARE REALLY AROUND SUSTAINABILITY.

AGAIN, SUSTAINING THE ASSETS THAT YOU HAVE, AS WELL AS RESILIENCE, RECOGNIZING THAT WE ARE COMING THROUGH AN UNPRECEDENTED TIME IN OUR HISTORY THAT HAS BROUGHT MORE PEOPLE INTO PARKS AND APPRECIATING THE HEALTH BENEFITS OF PARKS THAN EVER BEFORE.

IT'S INCREASING THE NUMBER OF PEOPLE OUT GOLFING.

[00:35:02]

IT'S INCREASING THE DEMAND AND MAINTENANCE NEEDED FOR OUR PARKS AND FACILITIES.

SO WE WANT TO MAKE SURE THAT THIS PLAN PROVIDES GUIDANCE FOR HOW TO ADDRESS THAT MOVING FORWARD.

THE PLAN PROVIDES A SNAPSHOT OF THE PARK AND RECREATION SYSTEM AND INCLUDED AN UPDATE OF THE INVENTORY, WHICH WAS CRITICAL FOR GOOD DECISION MAKING.

THE WHOLE POINT OF THIS PLAN IS TO GIVE YOU THE TOOLS AND INFORMATION TO MAKE GOOD DECISIONS, SUCH AS WE DID AROUND CLARIFICATION AROUND THE OWNERSHIP OF SCHOOL PARKS, WHICH NOW ALLOWS A CONVERSATION ON HOW TO MOVE FORWARD, RECOGNIZING THAT THE CITY OWNS PART OF THE LAND AND SCHOOL PARKS, BUT SCHOOL DISTRICTS ACTUALLY OWN PART OF THE LAND AS WELL.

SO THIS PLAN PROVIDES INFORMATION NUMBERS AND COUNTS OF ALL THE AMENITIES IN YOUR SYSTEM, AS WELL AS THAT CLARIFICATION OF OWNERSHIP AND RESPONSIBILITIES.

IT ALSO IDENTIFIES AS SHOWN ON THE NEXT PAGE A REPORT CARD FOR SERVICES AND THE SCORES THAT ARE ASSIGNED HERE ARE BASED ON NEEDS ASSESSMENT THAT WE DID.

THAT WAS A TECHNICAL EVALUATION OF THE PARK SYSTEM AND SERVICES THAT ALSO WAS INFORMED BY THE PUBLIC OUTREACH AND ENGAGEMENT ACTIVITIES.

THOSE VOICES FROM RESIDENTS ACROSS THE CITY AND WHAT THE SCORECARD SHOWS IS THAT THE CITY IS OUTSTANDING IN SOME AREAS, INCLUDING THE PROVISION OF PARKLAND, WHICH IS ACTUALLY MORE AND HIGHER THAN MANY COMPARABLE COMMUNITIES.

BUT AT THE OTHER END OF THE SPECTRUM, IT IS POOR OR FAILING AT THINGS SUCH AS HAVING THE FUNDS FOR ASSET MANAGEMENT OR WAS WHEN WE STARTED THIS PLANNING PROCESS.

SO THE PLAN REPRESENTS A SHIFT MAKING SURE THAT WE ARE IDENTIFYING WHAT WAS NEEDED FOR THE SYSTEM AND BRINGING THAT IN PLACE SO WE CAN USE THIS AS A METRIC TO IMPROVE AND ENHANCE THE PARK SYSTEM TO IMPROVE THESE SCORES GOING FORWARD.

THE MAP THAT IS HERE ON THE NEXT PAGE IS ONE THAT YOU'VE SEEN BEFORE IS PART OF THE NEEDS ASSESSMENT.

WHAT IT SHOWS IS THAT THERE ARE AREAS OF THE COMMUNITY ACROSS THE CITY THAT ARE NOT WELL SERVED IN TERMS OF PARKS AND OTHER AREAS THAT ARE.

IT'S A DETAILED MAP.

SO THE LONG AND THE SHORT OF IT IS THAT THE PURPLE AREAS SHADED IN EITHER A DARKER PURPLE OR THE LIGHTER COLOR INDICATE THE TRAVEL DISTANCE, HOW FAR PEOPLE HAVE TO WALK OR BIKE TO GET TO PARKS.

SO THE AREAS THAT ARE SHADED IN PURPLE ARE SERVED BY PARKS WITH EITHER A HALF MILE OR A MILE WALKING DISTANCE OF PARKS, WHICH REPRESENTS THE CITY STANDARD FOR PROVIDING PARKLAND.

THE AREAS THAT COME THROUGH IN YELLOW ARE THOSE AREAS THAT ARE ZONED RESIDENTIAL, WHERE PARK SERVICE IS NOT PROVIDED BY CITY PARKS, TRADITIONAL CITY PARKS.

BUT WHAT THE OTHER INFORMATION CALLS ATTENTION TO THE BLUE RECTANGLES IS THAT SOME OF THOSE NEEDS WILL BE MET BY NEW GROWTH.

THOSE ARE AREAS WHERE NEW HOUSES ARE BEING ADDED, AND SO THE PARKLAND DEDICATION THAT IS COVERED IN THIS PLAN IN THE APPENDICES WILL BE AN IMPORTANT WAY TO SERVE THOSE AREAS.

AND THEN BEYOND THAT, THERE ARE AREAS THAT ARE ENCIRCLED IN ORANGE, WHICH SUGGESTS THAT THERE ARE SOME AREAS WHERE SCHOOL PARKS MAY CONTINUE TO HELP PLAY A ROLE FOR THE COMMUNITY MOVING FORWARD.

SO THERE'S JUST A VERY QUICK WAY OF UNDERSTANDING WHAT ARE THE NEEDS AND WHAT ARE THE OPPORTUNITIES TO MEET THOSE NEEDS.

SO THE PLAN INTRODUCES A VISION FRAMEWORK CONSISTENT WITH THOSE EIGHT GUIDING PRINCIPLES, WE'VE IDENTIFIED EIGHT GOALS FOR PARKS AND RECREATION ACROSS THE PARK SYSTEM, EVERYTHING FROM ASSET MANAGEMENT TO TRAIL CONNECTIVITY TO PARK ACTIVATION THROUGH PROGRAMS AND EVENTS.

AND IT ALSO INDICATES THAT THE BUSINESS OF THE PARKS AND RECREATION DEPARTMENT, THEIR MISSION IS STILL INTACT.

BUT WE PROVIDED A VISION TO CARRY FORWARD THE CITY THROUGH THE NEXT 10 YEARS AND THEN ALSO IN THE PLAN, IDENTIFIED OBJECTIVE STRATEGIES AND ACTIONS FOR EVERY SINGLE ONE OF THOSE GOALS.

SO THE CITY HAS CLEAR DIRECTION, A CLEAR BLUEPRINT FOR HOW TO ACHIEVE THOSE EIGHT GOALS.

AND THAT'S A LOT OF INFORMATION.

AND WHEN WE SHARED IT WITH OUR PARKS AND RECREATION ADVISORY BOARD, THEY GAVE US SOME VERY IMPORTANT FEEDBACK.

AND THAT IS, WOW, YOU KNOW, THERE'S A LOT TO DO HERE.

AND WHILE WE APPRECIATE THE VISION AND GUIDANCE, WE NEED SOME SIGNIFICANT HELP ON THE IMMEDIATE INVESTMENT AND THE IMMEDIATE FUNDING NEEDS WE HAVE FOR ASSET MANAGEMENT AND THE SHORTAGE THAT WE HAVE IN TERMS OF TAKING CARE OF OUR EXISTING PARKS AND FACILITIES.

SO WE WANTED TO CREATE AND GIVE YOU A MORE REALISTIC INVESTMENT STRATEGY.

ALL THOSE GOALS AND OBJECTIVES ARE STILL PART OF THE PLAN.

THEY'RE IN AN APPENDIX SO THAT WE THEN CAN START TO FOCUS ON THE LAST CONVERSATION WE HAD

[00:40:01]

WITH YOU, WHICH WAS WHERE ARE THE WAYS THAT PARKS DEPARTMENTS GENERATE REVENUES AND WHAT ARE THE THINGS THAT TRADITIONALLY THEY NEED TO SUBSIDIZE, SUCH AS PROVIDING CLOSE TO HOME PLAY SPACES AND UNDERSTANDING THAT KNOWING THAT SOME AREAS WILL EARN MONEY AND SOME AREAS YOU WILL NEED MONEY TO SUPPORT ALLOWED US TO CREATE AND IDENTIFY A LIST OF CORE SERVICES FOR THE DEPARTMENT.

THOSE ARE THE SERVICES THAT THE CITY REALLY SHOULD PROVIDE TO MEET CRITICAL NEEDS AGAIN.

CLOSE TO HOME PLAY SPACE SPORTS AND OPPORTUNITIES FOR HEALTH AND FITNESS ARE EXAMPLES OF THAT.

THEN IT FURTHER ALLOWED US TO IDENTIFY WHAT WE CALL ANCILLARY SERVICES, THE SUPPORT SERVICES THAT WHILE IT'S NOT THE CORE, IT'S NOT THE OUTCOME WE WANT TO ACHIEVE.

IT'S REPRESENTS THE THINGS THAT YOU NEED TO TAKE CARE OF, SUCH AS PARK MAINTENANCE IN ORDER TO HAVE A QUALITY PARK SYSTEM.

AND THEN WE STARTED TO IDENTIFY WHERE ARE THOSE AREAS WHERE WE CAN WORK WITH PARTNERS, WITH BUSINESSES, WITH STAKEHOLDERS TO SHARE COSTS IN PROVIDING PARKS AND RECREATION, INCLUDING WITH PRIVATE ENTERPRISE? SO THOSE SHARED COST SERVICES ARE THINGS THAT THE CITY MAY WANT TO HAVE A ROLE IN, BUT SHOULD NOT BE SOLELY RESPONSIBLE FOR BY THEMSELVES.

BEYOND THAT, WE IDENTIFIED ENTERPRISE SERVICES AGAIN, WHICH ARE USUALLY THOSE MAJOR FACILITIES THAT HAVE THE OPERATIONS AND STAFFING INVESTMENT, BUT ALSO THE CAPABILITY TO GENERATE REVENUE, SUCH AS YOUR GOLF COMPLEXES, FOR EXAMPLE.

AND THEN FINALLY, WHAT ARE THE NON-CORE SERVICES THAT THE CITY SHOULD NOT BE INVESTING IN AT THIS TIME, RECOGNIZING WE NEED TO RIGHT SIZE A SYSTEM THAT EVEN WITH AN INCREASED INVESTMENT, WE WANT TO MAKE SURE YOU ARE INVESTING THAT MONEY IN THE RIGHT PLACES.

SO WITH THAT, WE ENTIRELY REVISITED THE PARK CLASSIFICATION SYSTEM, STARTED SEPARATING PARKS INTO THOSE THAT SHOULD HAVE INCREASED INVESTMENT AND SHOULD BE GENERATING REVENUES SUCH AS YOUR LARGE COMMUNITY PARKS AND YOUR REGIONAL PARKS AT ONE END OF THE SPECTRUM.

AND THEN ON THE OTHER END, RECOGNIZING THAT YOU HAVE A NUMBER OF SMALL NEIGHBORHOOD PARKS THAT ARE PROVIDING CLOSE TO HOME RECREATION OPPORTUNITIES AND THOSE COULD BE SCALED BACK.

THEY DON'T NECESSARILY NEED ALL THE BELLS AND WHISTLES, SUCH AS A RESTROOM, SINCE PEOPLE WERE USING THOSE PARKS ARE USUALLY WALKING FROM HOME TO GET THERE.

AND SO WE MADE IT CLEAR THAT IN THIS INVESTMENT SPECTRUM, WE KNOW WHERE INVESTMENT IS NEEDED AND ALSO WHAT AREAS CAN BE SCALED BACK AND THEN FURTHER LOOKED AT HOW THAT'S DISTRIBUTED ACROSS THE SYSTEM SO THAT THE DETAILED MAP THAT IS THERE AND THE POWERPOINT REALLY LOOKS AT HOW DO WE SPREAD OUT OUR EXISTING INVESTMENT TO MORE EQUITABLY ENSURE THAT EVERYONE HAS ACCESS TO PARK OPPORTUNITIES SO THAT WE'RE NOT JUST CONSOLIDATING OUR PARK INVESTMENT IN ONE SPACE, BUT THOSE PEOPLE WHO ARE DISADVANTAGED OR WHO CANNOT GET IN THEIR CAR TO TRAVEL TO A PARK STILL HAVE OPPORTUNITIES NEAR THEM.

AND SO THIS MAP IS A COMPLEX WAY OF SAYING WE'RE STARTING TO SPREAD OUT THIS INVESTMENT AND REALLY FOCUS ON THOSE CRITICAL AREAS THAT NEED OUR SUPPORT.

AND THEN BEYOND THAT, THE PLAN INTRODUCED SEVERAL STRATEGIES TO REALLY RIGHT SIZE THE PARK SYSTEM.

SO THESE INVESTMENT STRATEGIES INCLUDED THINGS SUCH AS WHAT ARE THE NEW SMALLER NEIGHBORHOOD PARKS LOOK LIKE WHEN THEY'RE SCALED BACK AND IF THEY CAN'T PROVIDE EVERYTHING.

HOW DO WE DIVERSIFY THEM? SO THE PLAN INCLUDES CONCEPTS FOR PERKS THAT MORE FOCUSED ON HEALTH AND FITNESS, SOME THAT ARE FOCUSED ON YOUR COMMUNITY'S HERITAGE, ARTS AND CULTURE, AND OTHERS THAT CAN BE FOCUSED ON CONNECTING PEOPLE TO GREEN SPACE IN NATURE SO THAT EVERYONE STILL HAS THAT DIVERSITY AND VARIETY OF OPPORTUNITIES MOVING FORWARD.

IT ALSO STARTS A DISCUSSION AROUND SCHOOL PARKS.

IT UPDATES THE DEDICATION REQUIREMENTS FOR NEW DEVELOPMENT AS PART OF THE CITY'S ZONING ORDINANCE THAT IS CONSIDERING.

IT RECOMMENDS A NEAR NEW TIERED MAINTENANCE APPROACH AGAIN TO BE ABLE TO PUT THE RESOURCES WHERE MOST NEEDED TO TAKE CARE OF YOUR EXISTING ASSETS.

AND THEN FINALLY, IT PROVIDES GUIDANCE TO FOCUS ON REVENUE GENERATION USING A VARIETY OF PARTNERSHIPS, SPONSORSHIPS, PROGRAMS, LEASES AND OTHER REVENUE GENERATING OPPORTUNITIES.

WE WANTED TO MAKE SURE AT THAT POINT THAT WE WERE REALLY ON TRACK, WE HAD YOUR GUIDANCE, WE HAD THE GUIDANCE OF THE PARKS BOARD, WE WANTED TO HEAR FROM THE COMMUNITY.

SO THIS IS ANOTHER POINT WHERE WE SLOWED DOWN THIS PLANNING PROCESS TO REALLY GET PEOPLE INVOLVED IN UNDERSTANDING THE CHALLENGES AND TRADE OFFS THAT THE PARKS DEPARTMENT WAS FACING AND WHERE AND HOW TO INVEST IN THE PARK SYSTEM.

AND IN COMBINATION WITH THAT, WITH THE COMMUNICATIONS DEPARTMENT FROM PARKS AND RECREATION PUT TOGETHER A RED X CAMPAIGN, YOU ALL KNOW THAT RED HAS APPEARED IN

[00:45:05]

PARKS TO GET ATTENTION TO THE FACT THAT WE MAY NOT BE ABLE TO FUND EVERYTHING, AND THIS REALLY BROUGHT OUT A STRONG VOICE.

MORE THAN ALMOST 70 PERCENT OF PEOPLE WERE INDICATING THAT THE INVESTMENT SHOULD BE INCREASED IN PARKS AND RECREATION.

IT ALMOST COUNCIL A MANDATE TO SOME EXTENT, SAYING WE NEED TO DO SOMETHING TO SUPPORT OUR OUR ASSETS AND OUR QUALITY OF LIFE, WHICH WAS VERY STRONG.

AND IN FACT, THAT PERCENTAGE BASED ON THE TYPE OF SURVEY THAT WAS WAS EVEN MUCH HIGHER THAN EVEN I EXPECTED TO SEE.

IT WAS A FABULOUS TURNOUT THROUGH THE SURVEY AND THROUGH THE COMMUNITY SOLUTIONS MEETING, WHERE TWO HUNDRED AND SEVENTY PEOPLE CAME TO OFFER TESTIMONY ON THE IMPORTANCE OF THE PARK SYSTEM.

SO WITH THAT, WE WENT BACK AND CREATED THE ACTION PLAN THAT IS IN CHAPTER FIVE OF THE PLAN THAT REALLY FOCUSES ON THOSE KEY ACTION ITEMS THAT ARE NEEDED FOR SHORT TERM TURNAROUND OF THE PARK AND RECREATION SYSTEM, WITH SOME ADDED INVESTMENT AND APPROVED FUNDING.

AND SO THERE ARE SEVERAL ACTION ITEMS NOTED.

THEY'RE REALLY JUST GOING TO CALL ATTENTION TO A COUPLE OF THEM THAT AREN'T SELF-EXPLANATORY.

ONE IS WITH REGARDS TO EQUITY ENHANCEMENTS IN THE PARK AND RECREATION SYSTEM.

AGAIN, WE WANT TO BASE IT ON YOUR DIRECTION, FOCUS ON PROVIDING CULTURALLY APPROPRIATE RECREATION AMENITIES SUCH AS FOOTBALL AND ETC., AND A VARIETY OF OPPORTUNITIES FOR DIVERSE RESIDENTS TO ENGAGE IN SPORT, PARKS AND RECREATION TO SUPPORT THEIR HEALTH.

BUT THEN THINGS SUCH AS ADDING SHADE FOR SPORTS AREAS AND PLAY STRUCTURES AND EVEN PARKS AND UNSERVED AREAS, THOSE ARE ALL CRITICAL.

AND THEN, OF COURSE, THE OTHER ONE, AS YOU ALL HAVE HEARD THROUGH BOTH THE ASSET MANAGEMENT PLAN AND THE UPDATES WE'VE GIVEN YOU, GIVEN YOU FOR THE PARKS AND RECREATION MASTER PLAN IS LOOKING IMMEDIATELY AT THE INVESTMENT NEEDED AND FAILING ASSETS SUCH AS SPORTS LIGHTING, FOR EXAMPLE, THAT REALLY NEED SOME ADDED ATTENTION AND OTHERS ACROSS THE CITY AND BEYOND THAT IMMEDIATE INVESTMENT, THEN LOOKING AT THE LONG TERM LIFE CYCLE AND INVESTMENT NEEDS OF PARKS AND FACILITIES ACROSS THE SYSTEM.

SO WITH THAT, THAT ALLOWED US TO IN THIS PLAN WITH SOME CONCRETE DIRECTIONS FOR THE CITY TO MOVE FORWARD TO INCREASE REVENUES AT SAME TIME, WHILE AS INCREASING EFFICIENCIES TO FOCUS ON CORE SERVICES AND MAKE SURE THAT THE FUNDS THAT COUNCIL APPROVES AND THE COMMUNITY MAY APPROVE ARE INVESTED IN THE RIGHT PLACES TO ENHANCE THE PARK SYSTEM LONG TERM.

AND WE'RE HERE TODAY TO SEE IF YOU HAVE ANY FINAL COMMENTS FOR US BEFORE WE FINALIZE THIS PLAN.

AND BEFORE WE MOVE FORWARD TO ADOPTION.

SO WE AGAIN THOROUGHLY APPRECIATE THE GUIDANCE THAT YOU HAVE GIVEN US AND THAT OUR PARKS ADVISORY BOARD HAS GIVEN US THROUGH THIS PROCESS AND EVEN RESIDENTS WHO HAVE STEPPED FORWARD TO COMMENT ON THIS.

AND AGAIN, WELCOME YOUR GUIDANCE AS WE WRAP UP THIS PLAN.

THANK YOU SO MUCH.

[INAUDIBLE] COUNCILMAN.

WE HAVE, OF COURSE, CINDY.

WE HAVE MICHAEL.

WE HAVE OUR CHAIRMAN OF OUR PARKS BOARD.

JUST WANT TO MAKE SURE EVERYONE Y'ALL MAY HAVE RECOGNIZED AND I JUST MISSED.

BUT WE'VE GOT OUR PARKS BOARD CHAIRMAN HERE.

AND SO IF YOU HAVE ANY QUESTIONS, WE'D BE HAPPY TO ANSWER THEM FOR YOU NOW OR WE CAN LOOK FORWARD TO BRINGING IT TO YOU AT SOME POINT IN THE NEAR FUTURE.

OKAY.

COUNCIL.

ANY QUESTIONS WERE MS. MENDOZA OR MR. KASHUBA? SO HOW FAR ARE WE AWAY FROM PRESENTATION OF AN ACTUAL PLAN? SO OUR GOAL WOULD BE TO BRING BACK THE PLAN FOR ADOPTION AT THE NEXT COUNCIL MEETING.

THAT'S A LITTLE QUICKER THAN WHAT I INDICATED.

I KNOW I SAID IT'S NOT IMMINENT, ALTHOUGH IT LOOKS LIKE NEXT.

WE HAD A PARKS BOARD MEETING EARLIER TODAY.

SO.

SO WE HAD A PARK BOARD MEETING TODAY.

WE'VE REVIEWED THE PLAN.

WE'RE WAITING ON COMMENTS FROM OUR PARK BOARD.

WE WILL BE HAVING A SPECIAL MEETING ON FRIDAY TO BASICALLY RECOMMEND THE PLAN FORWARD TO COUNCIL FOR APPROVAL.

PENDING THAT RECOMMENDATION, WE'LL BE BRINGING IT HOPEFULLY THE NEXT MEETING FOR COUNCIL TO CONSIDER ADOPTION OF THE PLAN.

AT THE SAME TIME, AND I WANTED TO BRING THIS UP JUST VERY BRIEFLY.

WHEN COUNCIL ADOPT THEIR COUNCIL APPROVED FUNDING FOR THIS PLAN, THERE WAS REALLY THREE PLANS THAT WERE INCORPORATED INTO THIS.

SO WE'VE GOT THE PARKS MASTER PLAN.

WE'RE PRESENTING THAT TODAY WILL BE BRINGING IT BACK FOR ADOPTION, HOPEFULLY AT THE END OF THE MONTH.

AT THE NEXT MEETING, WE'LL BE BRINGING BACK AND DOING A WORK SESSION ON THE BEAUTIFICATION AND THE HIKE AND BIKE PLANS, AND THE GOAL WOULD BE FOR THEM TO BE ADOPTED AT THE FOLLOWING MEETING.

PART OF THE REASON WE'RE LOOKING AT THAT IS THERE'S SOME TEXAS PARKS AND WILDLIFE GRANTS THAT HIGHLY PREFER A MASTER PLAN.

AND SO WE WOULD BE ABLE TO SUBMIT FOR THOSE GRANTS AT THE END OF THE MONTH.

[00:50:04]

SO THAT'S KIND OF THE REASON WE'RE WORKING THE TIMELINE THAT WE ARE.

SO THE DEADLINE FOR APPLICATION ON THOSE GRANTS IS BY THE END OF SEPTEMBER.

SO IN ORDER FOR US TO BE ABLE TO CLAIM AND GET THE POINTS FOR HAVING A RECENTLY REVISED PARKS MASTER PLAN IS FOR US TO GO AHEAD AND CONSIDER IT IN A VERY TIMELY MANNER.

SO.

JOHN INGERSOLL IS BACK IN THE BACK CORNER.

JOHN, CAN YOU GIVE US SOME? SO I ALLUDED TO HIM EARLIER.

SO MICHAEL, YOU SAID THERE WERE THREE AREAS AND YOU MENTIONED THE PARKS MASTER PLAN AND THEN THE HIKE AND BIKE PLAN? AND THE BEAUTIFICATION AND PUBLIC ART.

SO BOTH OF THOSE PLANS HAVE BEEN REVIEWED WITH THOSE DIFFERENT ADVISORY COMMITTEES.

AND SO WE WILL BE FINISHING THOSE UP AND WE WILL BE BRINGING THOSE FORWARD AS A PART OF THE OVERALL.

TECHNICALLY, THEY'RE STANDALONE, BUT IT WAS INCORPORATED INTO THE SCOPE OF THIS PROJECT.

SO THERE'LL BE THREE STANDALONE PROJECTS THAT HAVE BEEN KIND OF WORKING CONCURRENTLY.

COUNCIL, ANY OTHER QUESTIONS? COUNCIL MEMBER STANLEY? MICHAEL, IF YOU COULD SPEAK TO, MAYBE WHEN WILL YOU GET TO THE DETAILS AND WILL THIS JUST PROVIDE A CONSTRUCT FOR LEASES, PUBLIC PRIVATE PARTNERSHIP, REVENUE OPPORTUNITIES, THINGS LIKE THAT? ARE YOU JUST GOING TO GIVE US AN OUTLINE OR ARE YOU ACTUALLY GOING TO HAVE SOME THINGS THAT ARE DETAILED INTO THAT? SO WE HAVE, IN THE PLAN THERE'S DIFFERENT STRATEGIES, INCLUDING HOW WE APPROACH DIFFERENT AGREEMENTS.

THERE'S ALSO SOME VERY SPECIFICS IN THE APPENDIX OF THIS DOCUMENT.

THERE'S ACTUALLY SOME VERY SPECIFIC GOALS AND OBJECTIVES, AND THIS IS MORE FOR STAFF.

SO WE WE WILL BE WORKING VERY CLOSELY WITH OUR PARK BOARD TO START LOOKING AT THOSE MAIN GOALS AND THOSE OBJECTIVES AND ASSIGNING THOSE TASKS TO STAFF TO MAKE SURE THAT WE'RE MOVING FORWARD.

BUT IT DOES GIVE SOME GUIDELINES IN TERMS OF HOW WE WANT TO INVEST.

WHAT TYPES OF CORE SERVICES WE SHOULD BE PROVIDING.

AND SO ALL OF THAT IS IN THE DOCUMENT.

I BELIEVE IT'S BEEN DISTRIBUTED.

WE'D BE HAPPY TO TAKE ANY QUESTIONS OR COMMENTS EVEN AFTER THE MEETING ABOUT THIS DOCUMENT.

BUT THAT'S THERE'S ONE SPECIFIC CHAPTER THAT JUST ADDRESSES HOW WE WANT TO INVEST MOVING FORWARD.

SO.

I DON'T KNOW IF THAT ANSWERED YOUR QUESTION.

YES, SIR, I'M JUST TRYING TO GET AN IDEA OF IF IF THERE WERE QUESTIONS, COMMENTS, CONCERNS OVER THE NEXT TWO WEEKS, HOW YOU'D BE RECEIVING THOSE, WE'D BE COMMUNICATING THOSE.

AND THEN WHEN IT COMES BACK IN FOR ADOPTION OR VOTE, THEN WE WOULD BE A STEP CLOSER.

YOU CAN SUBMIT THOSE TO OBVIOUSLY THE CITY MANAGER'S OFFICE AND THEY CAN FORWARD THOSE TO US.

WE'RE CURRENTLY WORKING WITH OUR PARK BOARD TO MAKE SURE THAT IF THERE'S ANY COMMENTS OR QUESTIONS THAT THOSE ARE COMING TO US AND THEN WE'LL WORK WITH OUR CONSULTANT TO MAKE SURE THAT THOSE ARE INCLUDED IN THE PLAN.

OK.

ANY OTHER QUESTIONS? OK.

ALL RIGHT, THANK YOU ALL.

THANK YOU.

OK, MOVING ON TO AGENDA ITEM 1C,

[1.C. Discuss Board and Commissions Appointment Process]

THAT'S DISCUSS BOARD AND COMMISSIONS, THE APPOINTMENT PROCESS.

MR. CITY MANAGER? HI, MAYOR.

WE HAVE OUR NEW CITY SECRETARY.

PROBABLY NEXT WEEK, I'LL STOP REFERRING TO HER AS NEW CITY SECRETARY AND JUST CALL HER CITY SECRETARY.

BUT STEPHANIE COGGINS HERE TO WALK YOU THROUGH THE THE DATES AND PROCESS THAT WE'LL BE FOLLOWING TARGETING A FIRST MEETING IN NOVEMBER.

MEETING FOR FILLING ALL VACANCIES ON BOARDS AND COMMISSIONS.

STEPHANIE, YES, SIR.

THANK YOU, JARED.

HI MAYOR PRO TEM AND COUNCIL JUST WANT TO GIVE YOU ALL A LITTLE BIT OF AN UPDATE ON THIS ANNUAL PROCESS FOR FILLING OUR BOARD AND COMMISSION APPOINTMENTS.

WE WILL BE OPENING UP APPLICATIONS ONLINE TOMORROW AND HOLDING THOSE OPEN FOR ABOUT A MONTH THROUGH MID-OCTOBER, AND SO BE ON THE LOOKOUT FOR AN EMAIL.

WE'LL SHARE THAT LINK WITH EACH OF YOU SO THAT IF THERE'S ANYONE IN THE COMMUNITY, ANY CITIZENS THAT ARE INTERESTED IN GETTING INVOLVED IN BOARDS AND COMMISSIONS, THEY CAN GO ONLINE AND APPLY.

SO IT'S A GREAT WAY TO SERVE.

WE HAVE ADVISORY BOARDS, WE HAVE SOME BOARDS THAT ARE REQUIRED THROUGH STATE STATUTE, SO WE HAVE A VARIETY.

WE HAVE AROUND 50 BOARDS AND COMMISSIONS OVERALL, SO A LOT OF ROOM TO SERVE IF CITIZENS ARE INTERESTED.

SO MID-OCTOBER WILL CLOSE OUT THOSE APPLICATIONS AND WE WILL START BUILDING YOUR PACKETS AND OUR TENTATIVE GOAL.

IF COUNCIL IS GOOD WITH IT AND IF IT WORKS ON THE AGENDA CALENDAR IS, WE WOULD GET YOU PACKETS THE WEEK OF NOVEMBER 2ND AND THEN Y'ALL WOULD CONSIDER APPOINTMENTS ON THE NOVEMBER 9TH MEETING.

SO THE OTHER OPTION WOULD BE TO CONSIDER APPOINTMENTS IN DECEMBER.

IF THAT'S NECESSARY, WE CAN DO THAT.

[00:55:01]

BUT TYPICALLY HISTORICALLY, I THINK YOU GUYS HAVE CONSIDERED THEM IN NOVEMBER, SO WE'LL WORK TO GET SOME INFORMATION OUT.

WE'LL WORK WITH COMMUNICATIONS TO PUT SOME INFORMATION OUT TO THE PUBLIC AS WELL AND SHARE THAT LINK AND GIVE EVERYBODY PLENTY OF TIME TO SIGN UP.

SO I ENTERTAIN ANY QUESTIONS YOU HAVE ABOUT THIS PROCESS.

OKAY, COUNCIL, ANY QUESTIONS? OK, MS. STEPHANIE, FOR CITIZENS THAT GO OUT THERE AND APPLY TO THE DIFFERENT BOARDS, IS THERE GOING TO BE LIKE MAYBE A SHORT DESCRIPTION SO THAT THEY BETTER UNDERSTAND, YOU KNOW, THE BOARD THAT THEY'RE WANTING TO SERVE ON AND WHAT THAT BOARD ACTUALLY DOES? AND THAT'S A GREAT QUESTION, THERE ARE LINKS TO EACH OF THE BOARDS, AND I THINK SOME HAVE MORE INFORMATION THAN OTHERS.

I WOULD ENCOURAGE THEM TO CALL THE CITY SECRETARY'S OFFICE, AND THAT PHONE NUMBER IS 378-3014.

IF THEY HAVE QUESTIONS ON A PARTICULAR BOARD.

WE ARE ALSO WORKING THROUGH RIGHT NOW OUR SOFTWARE FOR BOARDS AND COMMISSIONS, WHICH I THINK WILL BE A LIFESAVER AND WILL HELP HELP MAKE ALL OF OUR LIVES EASIER.

AND SO WE'RE WORKING THROUGH THAT RIGHT NOW JUST TO MAKE SURE THAT EVERYTHING IN THE INTERIM WAS CAPTURED.

AND SO WE'LL BE REACHING OUT TO OUR DEPARTMENT LIAISONS.

AND SO WE'LL HAVE AN IDEA OF WHAT EXACT VACANCIES ARE OUT THERE AS WELL IN THE NEXT WEEK OR SO.

BUT YEAH, THEY CAN CALL US, WE CAN GIVE THEM A DESCRIPTION IF THEY CAN'T FIND ONE ONLINE.

AND THEN LONG TERM, OUR GOAL IS TO GET MORE INFORMATION OUT THERE FOR EVERYONE.

OKAY.

ALL RIGHT.

THANK YOU, MISS STEPHANIE.

THANK YOU.

OK, MOVING ON TO AGENDA ITEM 1D, THAT IS DISCUSS CURRENT AND ALTERNATE

[1.D. Discuss Current and Alternative Locations Considered/to be Considered for City Hall]

LOCATIONS CONSIDERED OR TO BE CONSIDERED FOR CITY HALL.

SO MR. CITY MANAGER? RIGHT, MAYOR PRO TEM, WITHIN THE LAST FEW MEETINGS, WE WITHDREW OUR NOTICE OF INTENT TO ISSUE CERTIFICATE OBLIGATION TO RENOVATE A FACILITY, A NEW FACILITY OR AN OLD FACILITY AS NEW CITY HALL FACILITY AS PART OF THE PROCESS TO REEVALUATE WHERE WE'VE BEEN AND WHERE WE'RE GOING TO GO WITH REGARD TO CITY HALL.

WE'RE GOING TO START A VERY DELIBERATIVE PROCESS THAT'S GOING TO LOOK AT WHERE WE'VE BEEN, TAKE INPUT FROM COUNCIL AND THEN DO ADDITIONAL RESEARCH AND ANALYSIS ON LOCATIONS.

WHAT WE DO, HOW WE DO IT, HOW WE PAY FOR IT.

SO ONE OF THOSE STEPS AND THE VERY FIRST STEP IS TO LOOK AT WHERE WE'VE BEEN.

SO WE'VE GOT THE BROKER THAT ASSISTED US IN THIS IN THIS PROCESS, AARON EMERSON AND AARON, I APOLOGIZE.

I'M NOT GOING TO SAY ALL THE NAMES IN THE BUSINESS BECAUSE I'LL FORGET ONE OR SAY IT WRONG.

BUT I'LL LET YOU SAY IT WHEN YOU COME UP HERE, WHO'S GOING TO WALK US THROUGH ALL THE DIFFERENT BUILDINGS DOWNTOWN AND THROUGHOUT THE CITY OF AMARILLO THAT WE LOOKED AT AS A POTENTIAL FUTURE HOME FOR FOR CITY HALL.

THE TOPIC OR THE SCOPE OF WHAT WE'RE TALKING ABOUT TODAY IS REALLY JUST WHERE DO WE GO? AND SO ANY QUESTIONS ABOUT WHAT WE'VE LOOKED AT, ANY QUESTIONS ABOUT WHAT WE DIDN'T LOOK AT, BUT YOU THINK WE MAYBE SHOULD HAVE LOOKED AT ALL OF THOSE ARE GOOD QUESTIONS OR ANYWHERE YOU WANT TO GO ON THIS TOPIC THAT FITS WITHIN THE AGENDA ITEM IS FAIR GAME FOR YOU ALL.

BUT WE'VE GOT AARON EMERSON.

OF COURSE I CAN ANSWER ANY QUESTIONS.

WAS THERE PRESENT AND PARTICIPATING THROUGHOUT THE WHOLE PROCESS ALONG WITH MOST OF YOU? AND THEN WE ALSO HAVE GERRY DANFORTH, OUR DIRECTOR OF FACILITIES, AND ANDREW FREEMAN, ASSISTANT CITY MANAGER, WHO ASSISTED US AND HAS ASSISTED IN ALL OF OUR LAND ACQUISITIONS.

AARON.

WE ARE ALSO GOING TO REFER TO ONE OF OUR BUILDINGS AS BUILDING X, THE REASON FOR THAT IS NOT BECAUSE WE HAVE ANYTHING TO HIDE, BUT BECAUSE THE THE SELLER THAT WE WERE WORKING WITH HAS REQUESTED THAT WE MAINTAIN CONFIDENTIALITY ON THE DETAILS OF THAT REAL ESTATE DEAL AND THAT IS ALLOWED BY THEM.

JUST YEAH.

WELCOME, AARON.

THANK YOU.

WELL, STOP ME AND ASK QUESTIONS.

I'M JUST GOING TO KIND OF RECAP THE SEARCH, YOU KNOW, BACK WHEN WE STARTED LOOKING AND AGAIN, JUST THROW QUESTIONS IN THERE, IF YOU LIKE SO BACK.

AND BY THE WAY, I'M AARON EMERSON, [INAUDIBLE], WITTENBERG, EMERSON COMMERCIAL REAL ESTATE.

SO THIS WAS BACK IN JANUARY OF 2020.

CITY CALLED AND ENGAGED MY FIRM TO TO HELP FIND SOME LOCATIONS FOR A POTENTIAL, YOU KNOW, BUILDING TO RETROFIT FOR CITY HALL.

FROM START TO FINISH OF THE PROCESS, IT TOOK ABOUT 11 MONTHS.

SOME OF IT WAS PRETTY GRUELING AND SOME OF YOU WERE INVOLVED AND IT WAS IT WAS.

IT WAS INTERESTING.

BUT THERE WERE REALLY THREE OPTIONS THAT WE ZEROED IN ON, ONE OF WHICH WAS THE ZACHARY BUILDING, I-40 AND BELL.

LOCATION WISE, IT WASN'T PERFECT FOR CITY HALL BECAUSE IT'S NOT DOWNTOWN.

HOWEVER, BUILDING WISE, IT WAS BY FAR THE FAVORITE OF MY PERSONAL OPINION.

[01:00:05]

BUT IT WAS COMPLICATED IN ORDER TO MAKE THAT WORK.

I THINK YOU GUYS HAD DECIDED THAT WE'D HAVE TO RELOCATE A LOT OF THE USE AND THE SIMS BUILDING TO ZACHARY AND THEN RETROFIT THE SIMS BUILDING IN THE CITY HALL.

AND I'M NOT SURE WHAT I'LL DETAIL YOU WANT.

I MEAN, THERE'S A LOT OF CHALLENGES WITH THAT BUILDING.

PRIMARY AMONG THEM WAS A EXCESSIVE DISTRIBUTION OF PERSONNEL AND RESOURCES ACROSS THE CITY.

WHEN YOU'RE TALKING ADMINISTRATIVE FUNCTIONS, MEETINGS THAT HAVE TO TAKE PLACE AMONG CITY PERSONNEL, HAVING THEM DRIVE 20 MINUTES ONE WAY OR THE OTHER 15 MINUTES, HOWEVER FAR YOU WANT TO SAY IS FROM DOWNTOWN, BACK AND FORTH.

THERE'S A LOT OF INEFFICIENCIES THERE.

PLUS, FROM AN ENERGY STANDPOINT, IT'S WIDE OPEN BUILDING WITH LOTS OF GLASS.

IT'S GOING TO BE EXPENSIVE TO OPERATE RUN, BUT NO MORE EXPENSIVE THAN SOME OF THE OTHER BUILDINGS THAT WE LOOKED AT.

IT JUST HAD ITS OWN CHALLENGES.

YEAH.

AND AGAIN, MAYBE LOCATION WAS IT.

BUT IT WAS A GREAT BUILDING.

IF IT WAS SITTING IN THE MIDDLE OF DOWNTOWN, IT WOULD HAVE BEEN ABSOLUTELY PERFECT.

I THINK ANOTHER CHALLENGE THERE WOULD HAVE BEEN IF WE HAD MOVED CITY RESOURCES AWAY FROM A CENTRAL LOCATION TO AND PEOPLE WILL HAVE WHATEVER OPINIONS THEY HAVE.

BUT IF WE MOVED IT TO SOUTHWEST AMARILLO, THAT WOULD HAVE MADE A STATEMENT.

AND I DON'T KNOW, THAT'S THE RIGHT STATEMENT AS WE'RE TRYING TO SERVE OUR ENTIRE COMMUNITY.

YEAH.

AND THE THING THAT I LIKED ABOUT IT IS IT WAS VACANT AT THE TIME AND IT'S NOT VACANT NOW.

IT'S EFFECTIVELY FULL, ALMOST.

IT'S NOT PHYSICALLY FULL, BUT LEASES ARE SIGNED AND CONSTRUCTION'S GOING.

SO IT'S IT'S NO LONGER AN OPTION.

IT'S NO LONGER A BUILDING THAT CAN BE PURCHASED FOR THIS USE.

ANOTHER BUILDING WE LOOKED AT AND THIS IT DIDN'T FIT THE BILL AS MUCH, BUT IT WAS ON THE MARKET AT THE TIME.

VERY NEAT BUILDING WAS THE EAGLE CENTER BUILDING OVER OFF TYLER STREET.

LOCATION WAS DOWNTOWN.

IT DIDN'T HAVE THE PARKING.

YOU KNOW THE IF Y'ALL ARE FAMILIAR WITH THAT BUILDING, IT HAS A VERY TIGHT PARKING GARAGE.

I THINK IT WOULD HAVE BEEN IMPOSSIBLE BUILDING TO RETROFIT.

BUT AGAIN, IT WAS CONSIDERED AND I FEEL LIKE WE DIDN'T SPEND A TON OF TIME ON IT BECAUSE IT WAS JUST, YOU KNOW, WISH IT WOULD WORK, BUT IT'S JUST NOT GOING TO WORK.

WHICH THEN BRINGS US TO THE BUILDING THAT WE, YOU KNOW, WE FOCUSED ON AND WE'VE SIGNED SOME I KNOW I'VE SIGNED CONFIDENTIALITY AGREEMENTS ON IT, BUT THE LOCATION WAS GREAT.

THE BUILDING WAS GREAT.

IT WAS, HOWEVER, ABOUT 85 PERCENT OCCUPIED, IF I RECALL.

SO IT WAS ENCUMBERED BY TENANTS AND LEASES.

IF I RECALL, THE CITY WAS THE PLAN WAS TO OCCUPY ABOUT HALF OF THE BUILDING WHERE WE'D HAVE TO THEN RELOCATE TENANTS WITHIN THE BUILDING KIND OF PLAY A GAME OF TETRIS.

DO YOU WANT TO GET INTO PRICE ON ANY OF THIS? ANYBODY WANT IF ANYBODY WANTS TO ASK, THAT'S FINE.

THIS ONE WOULD HAVE BEEN SIMILAR IN PRICE TO WHAT WE'RE LOOKING AT.

AND THAT'S BEFORE CONSIDERING COST OF TI OR TENANT IMPROVEMENTS OR SOME OF THE PENALTIES OR PRICES WE WOULD HAVE HAD TO PAY TO MOVE TENANTS AROUND INSIDE THE BUILDING.

YEAH.

AND A LOT OF THE BUILDINGS HERE IN TOWN, EVEN THE THE NEWER ONES, YOU KNOW, SOME OF THE BRAND NEW CONSTRUCTION EXCLUDED, OBVIOUSLY, BUT MOST OF THESE BUILDINGS WERE BUILT IN THE 70S AND 80S.

AND TO GO IN AND RETROFIT ONE, WHICH WHICH I'VE BEEN A PART OF DOING THAT WITH SEVERAL, YOU PRETTY WELL HAVE TO JUST GO DOWN AND CHECK ALL OF THE BOXES.

AND BY THE END OF IT, YOU'VE PAID AGAIN, YOU KNOW, AT LEAST ANOTHER TIME OVER WHAT YOU PAID FOR THE BUILDING.

AND I BELIEVE THAT I BELIEVE THE IDEA IS THAT'S WHAT WOULD HAVE BEEN THE CASE HERE.

AND THE THING THAT I WAS THE MOST WORRIED ABOUT THAT WE DIDN'T REALLY GET TO BECAUSE WE NEVER WE NEVER GOT PAST THE POINT OF MAKING A DEAL.

THERE WAS A LOT MORE COST IN AGAIN, RELOCATING THESE TENANTS, BUYING OUT TENANTS, HAVING AND I'VE HAD TO DO THIS BEFORE.

IN OTHER BUILDINGS WHERE YOU HAVE TO RELOCATE A TENANT, YOU DON'T HAVE THE RIGHT TO MOVE THEM.

YOU GET ANOTHER LANDLORD THAT HAS THE SPOT AND THEN YOU HAVE TO FINANCIALLY INCENTIVIZE THEM, WHICH IS BUILDING A SPACE, GIVING THEM FREE RENT.

I MEAN, JUST THE COST ADDS UP QUICK, ESPECIALLY IF THEY KNOW THAT THEY HAVE THE LEVERAGE AND EVEN MORE IF THEY KNEW THAT THE CITY WAS NOW THEIR LANDLORD.

YOU KNOW WHERE IT'S UNFORTUNATE.

BUT A LOT OF TIMES IF PEOPLE KNOW THAT IT'S THE CITY YOU KNOW, OR THE PERSON THAT NEEDS IT, THE PRICE GOES UP FOR THEM.

EVERYONE'S HEARD OF THAT.

IS IT POSSIBLE TO HAVE SOME INFRASTRUCTURE ISSUES THAT WE WERE GOING TO HAVE TO DEAL WITH THAT ARE SOMEWHAT SIMILAR TO WHAT SITS IN THIS BUILDING CURRENTLY? YEAH, AND DEPENDING ON HOW THOROUGH YOU GET, BUT YEAH, IF.

[01:05:02]

FROM WHAT I REMEMBER, MAYBE ELEVATORS AND THINGS LIKE THAT, THEY GET INTO IT.

A LOT OF THE INFRASTRUCTURE WAS GOOD.

SOME OF IT WAS CHALLENGING.

JUST LIKE ANY, YOU KNOW, OLDER BUILDING IS ABOUT RIGHT AT 30 PERCENT USABLE SPACE, BIGGER THAN WHAT WE CURRENTLY HAVE.

BUT WHEN YOU CONSIDER THAT GROUND, AT LEAST HALF, IF NOT MORE IS OCCUPIED, THAT MEANS THAT FOR US TO BE ABLE TO UTILIZE IT, WE WOULD HAVE HAD TO BE BUYING OUT LEASES.

OR MOVING THEM TO DIFFERENT FACILITIES WITH PENALTIES, ET CETERA, SO THERE'S A LOT OF UNKNOWN VARIABLES THAT WERE NEVER CALCULATED INTO THE COST OTHER THAN TO SAY THAT'S GOING TO BE EXPENSIVE.

JUST BECAUSE UNLESS WE'RE REALLY SERIOUSLY WANTING TO LOOK INTO IT, WHICH WE WE DID SERIOUSLY LOOK INTO IT, BUT WE NEVER QUANTIFIED THAT AMORPHOUS UNKNOWN OF HOW MUCH IS IT GOING TO COST TO MOVE PEOPLE AND OR DO THE TENANT IMPROVEMENTS TO MOVE IN DIFFERENT LOCATIONS IN THE BUILDING SO THAT WE CAN EFFECTIVELY UTILIZE THE PARTS THAT WE DO KEEP? IT WAS JUST SORT OF A.

YOU SAID IT RIGHT? AARON SAID IT RIGHT, TETRIS.

THAT WOULD TAKEN YEARS, LITERALLY.

I MEAN, IT'S A IT'S A CASE BY CASE, TENANT, BY TENANT.

AND IT'S ALL IT'S ALWAYS TRICKY.

CAN I ASK YOU, AARON? YOUR OPINION IS A GOOD BROKER ON REVENUES OFFSETTING RELOADS IF GIVEN, SAY, THREE YEAR TIME FRAME.

WOULD YOU SEE THAT AS A BREAK EVEN? OR WOULD YOU STILL SEE IT AS A A BIG NEGATIVE ON THAT BUILDING X? AS FAR AS GETTING TAKEN INTO ACCOUNT, IF YOU REMODEL AMARILLO HARDWARE BY THE TIME YOU GET THERE, YOU'RE LOOKING AT AROUND A THREE YEAR TIME FRAME.

AND LET'S BE OPTIMISTIC AND SAY TWO YEARS.

YOU HAVE AN EXISTING BUILDING THAT YOU DON'T HAVE TO RECONSTRUCT, AS YOU KNOW, MAYBE AS MUCH, BUT WHEN YOU'RE TALKING ABOUT THOSE EXISTING CONTRACTS, YOU'RE WANTING TO BUY THEM OUT THERE.

ALSO YOUR ASSETS AND YOUR REVENUES.

YOU NOW HAVE A REVENUE BASE THAT'S BUILT IN.

AND SO RELOCATING THOSE GUYS IN THERE, CAN YOU JUSTIFY THAT WITH THE REVENUES THAT ARE THERE? IT DEPENDS, ESPECIALLY IF YOU HAD TWO TO THREE YEARS TO YEAH, SO WORK OUT.

THAT'S THAT'S WHERE IT DEPENDS.

AND YOU KNOW, I'D BE HAPPY TO SIT DOWN AND REALLY DIG INTO SOME OF THIS WITH YOU.

IT DEPENDS ON THE TENANT.

IT DEPENDS ON THE LEASE.

IT DEPENDS ON THEIR CREDIT.

YOU KNOW HOW MUCH TIME IS LEFT ON IT.

WHAT SPACE ARE YOU GOING TO RELOCATE THEM TO? IS IT COMPARABLE TO WHAT THEY HAVE? YOU KNOW, AND I COULD SIT HERE AND JUST ADD ALL THAT JUST BULLET POINT AFTER BULLET POINT.

BUT MAYBE.

BUT IT'S IT'S VERY HARD TO SAY, STILL VERY COMPLICATED.

RIGHT? YEAH.

NO, IT'S YEAH, VERY COMPLICATED.

BUT WE HAVE CALCULATED IN SOME ASSUMPTIONS ON REVENUE OR IF NOT ACTUAL NUMBERS ON HOW MUCH WE MIGHT BE ABLE TO GENERATE ON REVENUE FROM TENANTS INSIDE OUR FACILITIES.

DO WE HAVE THE OPPORTUNITY FOR GENERATING REVENUE? SO ON AMARILLO HARDWARE OR YOU MEAN THERE AND EVERY OTHER BUILDING THAT WE LOOKED AT? SO WHETHER IT'S ZACHARY, EAGLE ONE, BUILDING X AMARILLO HARDWARE, HARING, YOU KNOW, WE LOOKED AT HARING AS WELL.

I MEAN, SO WE'VE ALWAYS CALCULATED IN DO WE HAVE THE OPPORTUNITY OF OF LEASING SPACE NOW THAT ALSO HAS A BEARING ON HOW YOU ISSUE DEBT, IF YOU ISSUE DEBT ON BUILDING THE BUILDING BECAUSE WHATEVER YOU ASSUME IS GOING TO BE YOUR PERCENTAGE OF OF LEASED SPACE IS ALSO GOING TO HAVE TO BE TAXABLE DEBT.

SO THERE'S SOME ASSUMPTIONS YOU HAVE TO MAKE WHEN YOU WHEN YOU WHEN YOU DO THAT.

BUT WE FACTORED THAT IN INTO THE CONSIDERATIONS AS WELL IN A GENERAL MANNER BECAUSE WE COULDN'T DO IT.

EXACTLY.

MAYBE A BAD QUESTION, BUT ONE I'LL THROW OUT THERE DOES.

IS IT ALLOWABLE FOR A REVENUE BOND IN AN INSTANCE LIKE THIS, IF YOU HAD EXISTING TENANTS SO THAT YOU DECREASE YOUR AMOUNT OF DEBT BECAUSE IT'D BE JUSTIFIED WITH A REVENUE BOND, NOT WITH A, YOU KNOW, OTHER FORM? AND I'M GOING TO LAURA.

YOU STEP IN IF YOU IF YOU NEED TO, BUT THE THE ONLY CHALLENGE THERE WOULD BE THAT THE REVENUE BOND WOULD HAVE TO DETERMINE THAT, THE TERMS OF THE REVENUE BOND WOULD HAVE TO MATCH THE TERMS OF THE LEASE BECAUSE YOU ONLY HAVE GUARANTEED REVENUE DURING THE TERMS OF THAT LEASE AND ASSUMING THAT THEY DON'T HAVE AN OUT ON THAT LEASE.

SO THAT'S THE BIGGEST CHALLENGE THERE AND LAURA MAY HAVE SOME MORE TO ADD IN THERE.

I THINK I KIND OF TOUCHED ON THE VAGARIES THERE AND JUST KEEPING IN MIND ON SOMETHING LIKE THAT, IT WOULDN'T BE AN ACTUAL REVENUE BOND, IT WOULD BE PROBABLY A GO OR A CO THAT IS BACKED BY THE PROPERTY TAX RATE.

THE ONLY REVENUE BONDS THAT WE ISSUE ARE FOR WATER AND SEWER OR FOR DRAINAGE.

THOSE ARE THE ONLY TWO THAT DO SO.

YOU WOULDN'T.

THE REASON FOR THAT IS BECAUSE THOSE REVENUE SOURCES ARE EXACTLY WHAT I WAS

[01:10:01]

TALKING ABOUT.

THEY ARE THEY DON'T HAVE AN EXPIRATION DATE.

AND THEY HAVE THEIR OWN CREDIT RATING.

YEAH, THEY HAVE THEIR OWN CREDIT RATING.

SO REALLY NOT AN OPTION.

SO MAYBE AS I SAID EARLIER, A BAD QUESTION.

A REVENUE SOURCE TO BACK TO TO PAY FOR A BOND, EVEN THOUGH IT'S BACKED BY PROPERTY TAX.

KNOWING THAT WE'LL NEVER HIT THE PROPERTY TAX BECAUSE YOU HAVE THAT STABLE REVENUE SOURCE .

RIGHT, I AGREE.

WE HAVE TO GO THROUGH THE PROCESS OF EITHER ISSUING LIKE A GO BOND OR A CO BOND FOR THAT TYPE.

OK.

GREAT, THANK YOU.

OK, ERIN, GO AHEAD.

AND I DON'T KNOW IF YOU ALL WANT MORE DETAILS ON THAT ONE.

BUT AT THE END OF THE DAY, FROM GOING BACK AND LOOKING AT MY NOTES AGAIN, YOU KNOW, IF THAT WAS A $14 MILLION BUILDING, I THINK IT NEEDED $15 MILLION OF WORK AND THAT'S BEFORE ANYONE HOLDING YOU HOSTAGE THAT YOU KNOW ANY TENANTS THAT YOU COULD HAVE A TENANT WHOSE LEASE EXPIRES IN A YEAR AND THEY'VE GOT THREE FIVE YEAR OPTIONS TO RENEW.

I MEAN, YOU STILL HAVE TO DEAL WITH A LOT OF THAT.

SO THERE'S THERE'S JUST SOME WILD CARDS IN THERE WHO WHO KNOWS, AND WE DIDN'T GET INTO THAT.

SO THERE'S JUST A QUESTION MARK THERE.

BUT.

AND THEN MY UNDERSTANDING IS THAT PUT IT TO WHERE THAT COST MADE THE DEAL THAT YOU ULTIMATELY, YOU KNOW, WENT AFTER MADE IT LOOK ACTUALLY VIABLE.

SO A COUPLE OF OTHER THOUGHTS AND WE DIDN'T GO TOO FAR DOWN THIS PATH BACK LAST YEAR.

YOU KNOW, THERE'S A AMERICAN QUARTER HORSE ASSOCIATION BUILDING WAS ONE OF THEM THAT, YOU KNOW, WE KIND OF THOUGHT THROUGH, BUT IT WAS SHORT AND SWEET.

WE THOUGHT THEY WERE LEAVING AND, YOU KNOW, JUST WASN'T.

TIMING WASN'T RIGHT, BUT GLAD THEY'RE NOT LEAVING.

AND THEN EVEN LOOKING INTO, YOU KNOW, BUYING A COUPLE OF CITY BLOCKS AND LEVELING WHAT'S THERE AND STARTING FROM THAT POINT.

AND ALSO LOOKED AT USING NOT JUST BUYING PROPERTY DOWNTOWN, BUT ALSO USING EXISTING PROPERTY THAT WE OWN OR HAVE ACQUIRED OVER THE LAST FEW YEARS FOR NEW CONSTRUCTION.

AND ONE IN PARTICULAR, AND IT'S, YOU KNOW, IT'S STILL AN OPTION.

I DON'T SEE IT BEING WELL.

I'M NOT DUG INTO WHAT YOU'RE DOING NOW.

I DON'T KNOW THAT THIS IS A GOOD OPTION, BUT YOU KNOW, YOU'VE GOT THE AMARILLO GLOBE NEWS BUILDING AND THE WAY I UNDERSTAND IT, YOU'D HAVE TO HAVE TWO CONTIGUOUS CITY BLOCKS AND YOU'VE GOT TWO, I BELIEVE AT LEAST FOUR DIFFERENT OWNERS ON THOSE TWO BLOCKS THAT YOU'D HAVE TO DEAL WITH BACK WHEN WE WERE LOOKING, I THINK ALL IN.

I THINK YOU'D HAVE BEEN AT ABOUT THREE AND A HALF MILLION DOLLARS TO GET THOSE TWO BLOCKS DEMOED, AND THAT'S WITH A BALLPARK TWO HUNDRED THOUSAND PER BLOCK TO DEMO AND I DON'T YOU MAY KNOW MORE, BUT I DON'T KNOW IF THAT'S I DON'T KNOW IF THAT'S ENOUGH, PARTICULARLY THAT AMARILLO GLOBAL NEWS BUILDING WHEN THERE WAS A VARIETY OF BARRIERS AS FAR AS THAT WOULD HAVE PREVENTED US, OR AT LEAST MADE IT VERY PROBLEMATIC FOR US TO USE THE EXISTING BUILDING.

YEAH, AND THEN WHEN YOU LOOK AT DEMO OF THE EXISTING BUILDING, IT WAS EXTREMELY COST PROHIBITIVE.

YEAH, NO DOUBT.

SO AGAIN, THAT'S JUST THAT WAS ONE OTHER TO TRY TO FIGURE OUT HERE, YOU KNOW, HOW COULD WE COULD WE APPROACH THESE AND GO GET THIS LAND? AND I COULD SIT HERE AND TALK THROUGH 10 DIFFERENT RANDOM THOUGHTS I'D HAVE AS I'M WAKING UP IN THE MIDDLE OF THE NIGHT, YOU KNOW, THINKING ABOUT IT.

BUT THE MOST REALISTIC WERE THE, YOU KNOW, BUILDING X, AS YOU SAID, AND THEN THE ZACHARY BUILDING AND, YOU KNOW, PLAYING WITH THE SIMS BUILDING USE.

AND DO YOU HAVE ANYTHING IF WE WERE TO TRY TO LAY OUT NEW CONSTRUCTION AS A LEGITIMATE OPTION JUST TO LOOK AT JUST EVEN IF IT WAS ONLY COMPARATIVE, JUST TO BE ABLE TO WEIGH IT UP NEXT TO THE AMARILLO HARDWARE BUILDING OR EXISTING CITY HALL? DO YOU HAVE ANYTHING THAT YOU LIKE OR THAT YOU WOULD RECOMMEND AND SAY, YEAH, THIS WOULD BE YOUR MOST LIKELY PIECE OF LAND? THIS WOULD FUNCTION, THIS WOULD BE THE BEST OR THE CITY ALREADY OWNS IT.

DO YOU HAVE ANY AREAS THAT YOU WOULD LOOK AT OR RECOMMEND? WELL, I MEAN, THE THING AND YOU ALL HAVE TO REMEMBER, I MEAN, I'VE BEEN INVOLVED A FRACTION OF THE TIME THAT, YOU KNOW, THE CITY COUNCIL PUT INTO THIS, SO THERE COULD BE A LOT MORE FACTORS WHICH I'LL LOOK AT.

BUT I LIKE THE IDEA OF YOU GUYS HAVING A PIECE OF LAND THAT ATTACHES TO SOME OF YOUR OTHER LAND.

SO SOMEWHERE RIGHT HERE, YOU KNOW, WITHIN THIS, YOU KNOW, HOWEVER MANY BLOCKS THAT ARE PUT TOGETHER, I THINK, MAKES SENSE.

AND AGAIN, FROM MY STANDPOINT, YOU KNOW, THINK ABOUT THE PARKING LOT OUT THERE TODAY, YOU KNOW, REALLY ANY TIME YOU COME TO CITY HALL, THE PARKING LOT IS RELATIVELY FULL.

AND IF THERE'S A, YOU KNOW, IF THERE'S SOMETHING GOING ON WHERE THERE ARE A LOT OF PEOPLE, YOU GET TO OVERFLOW OVER TO THE CONVENTION CENTER AND, YOU KNOW, WHEREVER ELSE.

SO I FEEL LIKE THAT'S A GREAT IT'S A GOOD VALUE TO BE ATTACHED TO YOUR EXISTING

[01:15:05]

LAND AS OPPOSED TO GOING ACROSS DOWNTOWN FIVE BLOCKS.

I'D LOVE IT IF Y'ALL DID BECAUSE IT HELPED SOME OF MY CLIENTS OVER THERE, BUT I FEEL LIKE IF YOU KEPT IT TOGETHER, THAT MAKES SENSE NOW.

THAT'S JUST MY OPINION.

SO.

AND YEAH, YOU'LL FIRE AWAY IF YOU'VE GOT ANY.

SO THAT'S ALL YOU'VE GOT AS FAR AS PRESENTING FACILITIES THAT WE LOOKED AT, RIGHT? YEAH, I MEAN.

AND LET ME KNOW IF Y'ALL ARE THINKING OF SOMETHING I'M FORGETTING IT'S BEEN ABOUT 18 MONTHS.

YOU KNOW THAT.

NOW WE ALSO OUTSIDE OF AARON'S ASSISTANCE WE LOOKED AT, LIKE I MENTIONED EARLIER, YOU KNOW, THE HEARING BUILDING AND GREAT OWNER, GREAT BUILDING.

THERE'S SOME OBVIOUS CHALLENGES THERE WITH GREAT AGE.

COST OF RENOVATION.

CEILING HEIGHTS.

HISTORICAL CONSIDERATIONS, YOU KNOW, THAT MADE THAT A PROBLEMATIC, VERY AFFORDABLE ACQUISITION.

VERY EXPENSIVE RENOVATION.

SO YEAH.

OK.

COUNCIL, ANY OTHER COMMENTS QUESTIONS FOR AARON? SO I DON'T HAVE ANYTHING ELSE FOR AARON, BUT I DID WANT TO HAVE JUST A CONSIDERATION, MAYBE FOR JERRY DANFORTH ON THE EXISTING CITY HALL.

ARE WE CURRENTLY LOOKING AT ANYTHING THAT WE COULD SPEND MONEY ON AND PURCHASE NOW TO GET US THROUGH THIS WINTER AS IT'S ENCROACHING AND OUR CURRENT ISSUES THAT WE HAVE AND ESPECIALLY WHAT THINGS COULD WE BUY THAT WE'RE GOING TO NEED TO PURCHASE ANYWAY? SO REGARDLESS OF WHAT YOU DO, A GENERATOR, YOU KNOW, THAT COULD BE RELOCATED TO THE NEW BUILDING IF WE IF WE CHOOSE TO GO THAT WAY.

MR. JERRY DANFORTH GOOD, JERRY.

WE'RE TAKING STEPS TO MAKE SURE THAT WE ARE SET FOR THE WINTER OR AS PREPARED AS WE CAN POSSIBLY BE.

WE'RE NOT GOING TO HAVE TO BUY A GENERATOR.

IT'S SOMETHING WE WOULD WANT TO LOOK AT IF WE WERE TO TRY AND MAKE THIS BUILDING LAST LONGER THAN SAY IT WOULD TAKE TO RETROFIT ANOTHER FACILITY OR TO RENOVATE THIS FACILITY.

SO WELL, REALLY, IF WE ADDRESS IT LIKE WE DID IN THE LAST PRESENTATION I DID FOR WHAT WE WERE LOOKING AT ON THIS FACILITY ITSELF.

RIGHT NOW, WE HAVE THIS FACILITY UP AND RUNNING.

WE'RE MAINTAINING IT.

WE'RE NOT INVESTING IN IT CURRENTLY.

WE'RE GOING TO DO EVERYTHING WE CAN TO KEEP IT UP AND OPERATIONAL.

BUT WE DO.

WE ARE ABUNDANTLY AWARE THAT IF ONE OF THESE ISSUES HITS US, WE COULD BE AT A CATASTROPHIC FAILURE TO WHERE WE HAVE TO RELOCATE CITY HALL TEMPORARILY WHILE WE'RE STILL IN THE MIDDLE OF CONSTRUCTION OR DECIDING WHICH DIRECTION WE'RE GOING IS MR., MILLER SAID.

THE GENERATOR WE DON'T HAVE TO DO YET, BUT YOU'RE CORRECT.

IF WE WERE TO DO SOME OF THE THINGS SAY, FOR INSTANCE, THE FLOOD CONTROL ON THE NORTH SIDE OR THE EAST SIDE OF THE BUILDING, PUTTING A SYSTEM IN THERE THAT WOULD HELP, YOU KNOW, WE'RE STILL LOOKING AT A MAJOR INVESTMENT FOR THAT BECAUSE WHILE WE WOULD PUT A SUMP IN IF WE HAD A RAIN EVENT THAT WAS BIG ENOUGH TO OVERPOWER WHAT WE CURRENTLY HAVE, WE HAVE TO PUMP THAT A DISTANCE TO GET IT.

WE COULDN'T JUST DUMP THE WATER BACK IN THE PARKING LOT, I GUESS, IS WHAT I'M SAYING.

WE WOULD HAVE TO PUMP IT ALL THE WAY TO JOHNSON STREET.

THE PROBLEM WITH PUMP INTO JOHNSON STREET IS THE STORM DRAINS ARE ALREADY FULL THERE.

IF IT FLOODED INTO HERE, SO I'M ACTUALLY HAVING TO PUMP IT FURTHER.

SO THAT WOULD BE A CONSIDERATION THAT WE'D HAVE TO LOOK AT ANYTHING THAT WE DO AS PART OF FUTURE INVESTMENTS IN CITY HALL, AND WE'LL DEFINITELY WORK WITH MR. MILLER AND YOU AS A COUNCIL.

WE WON'T DO ANYTHING THAT WE CAN DO THAT IS TRANSFERABLE TO A NEW STRUCTURE.

I DON'T BELIEVE WE SHOULD MAKE AN INVESTMENT IN SOMETHING THAT IS NOT TRANSFERABLE.

THAT'S NOT TO SAY THAT WE COULD NOT END UP IN A SITUATION IF WE'VE BEEN ABLE TO PATCH THE CAST IRON IN THIS BUILDING.

BUT THERE'S COMING A POINT THAT I'M NOT GOING TO BE ABLE TO PATCH IT IF I HIT THAT POINT AND WE HAVE A CATASTROPHIC FAILURE ON IT.

ALL OF THE SUDDEN, I'VE GOT A WASTE PROBLEM IN CITY HALL THAT'S NO LONGER OCCUPY VIABLE.

THEN WE'VE GOT TO MOVE OR I'VE GOT TO START A MAJOR.

BUT WE WOULD HAVE TO MOVE WHILE I DID THE REMODEL, AND IT'S GOING TO BE A MAJOR INVESTMENT.

WE'RE LOOKING AT MILLIONS TO DO IT.

SO IT'S ONE OF THOSE THINGS THAT FOR A LACK OF A BETTER PHRASE, WE'RE ROLLING THE DICE RIGHT NOW.

WE KNOW THAT THESE PROBLEMS EXIST.

OUR JOB IS TO MAKE YOU AWARE OF THEM.

THEY ARE, YOU KNOW, WE'RE DOING EVERYTHING WE CAN TO KEEP IT OPERATIONAL.

THE HEATING ON THE BUILDING RIGHT NOW, IF WE HAVE A NUT OF THEIR BOILER THAT GOES DOWN.

WE HAVE THE ABILITY TO GET ANOTHER ONE IN SHORT ORDER.

[01:20:02]

WE, OF COURSE, WATCH THE WEATHER ON A REGULAR BASIS WHEN IT COMES TO THIS STRUCTURE, MAKING SURE THAT WE CAN DEAL WITH THE IMPACT.

WHEN JERRY SAYS WE HAVE THE ABILITY TO GET ANOTHER ONE IN SHORT ORDER, THAT MEANS WE WOULD TAKE ONE OF THE SEVEN OLD ONES OVER SEVEN REMAINING RIGHT OVER AT THE CIVIC CENTER AND BRING THAT OVER HERE.

EXCUSE ME, WHEN WE HAD THE FLOOD OVER AT THE CIVIC CENTER, WE WERE ABLE TO REPLACE EIGHT OF THE 16 BOILERS WITH NEW MODEL OR NEW TECHNOLOGY BOILERS, BUT THE OLD BOILERS, THERE ARE THE SAME TECHNOLOGY AS WHAT WE USE HERE, SO WE WERE ABLE TO GRAB ONE LAST YEAR RIGHT BEFORE THE FREEZE AND THROUGH, I GUESS, JERRY'S, YOU KNOW, CRYSTAL BALL.

WE PUT IT IN PLACE A COUPLE OF WEEKS BEFORE THE FREEZE HAPPENED, SO WE WERE GOOD TO GO THERE ACTUALLY THREE DAYS OVER OVERESTIMATE WHEN IT SAID A COUPLE OF THINGS.

DIDN'T MEAN TO BE GILDING THE LILY THERE.

YEAH.

THREE DAYS AWAY.

SO WE DO HAVE SOME OLD TECHNOLOGY.

WHAT THAT DOES IS REDUCE THE ABILITY OF THE CIVIC CENTER.

BUT IT IS AVAILABLE TO US.

I GUESS I'M JUST ASKING, DO YOU NEED TO BUY A NEW CRYSTAL BALL FOR THIS NEXT ONE OR DO YOU HAVE EVERYTHING YOU NEED? WELL, I WISHED I HAD THE ABILITY TO PURCHASE THAT THING.

IS THERE ANYTHING THAT YOU NEED TO ASK FOR IN ADVANCE SO THAT WE DON'T END UP SOMEWHERE WHERE WE DON'T LIKE IT IN DECEMBER? NO, WE ARE FUNCTIONAL RIGHT NOW AND WE WILL MAINTAIN FUNCTIONALITY AND WE WILL LIMIT WHATEVER THAT COST IS TO MAINTAIN THAT.

A GOOD EXAMPLE IS THE FRONT STEPS OF CITY HALL.

YEAH, WE NEED TO BE BUSTING THOSE OUT AND REPLACING THOSE.

BUT DO WE WANT TO GO IN THERE AND SPEND THAT MONEY FOR THAT RIGHT NOW, IF YOU GUYS ARE GOING TO MAKE A DECISION TO RELOCATE? WE CAN MAKE THAT WORK, AND THAT'S WHAT WE WILL DO IS MAKE THAT WORK THE SAME WITH THE HEATING AND THE COOLING IN THIS BUILDING.

THE REALITY OF IT IS WE'VE GOT A NINETEEN FIFTIES MODEL, FORD PICKUP AND WE'VE RUN IT THIS WHOLE TIME.

AND WE'RE TO THE POINT NOW TO WHERE WE'VE GOT TO ADDRESS SOME THINGS ON THAT OLD TRUCK.

COUNCIL, OTHER QUESTIONS FOR JERRY? NO, I JUST WANT TO MAKE A COMMENT BACK ON AARON'S COMMENTS, SO I THINK WHAT I WOULD HOPE THAT PEOPLE WOULD KIND OF UNDERSTAND IS WE SPENT WHAT, 18 MONTHS OR TWO YEARS LOOKING AT BETWEEN SEVEN AND 10 DIFFERENT PROPERTIES.

AND SO WE HAD TO DO THAT IN THE LIGHT OF PRETTY MUCH EXECUTIVE SESSION SO THAT WE COULD HOLD OUR CARDS CLOSE.

AND SO THAT GAVE US OPPORTUNITY.

AND STILL, EVEN NOW, ONE OF THOSE BUILDINGS CAN'T BE SPOKEN OF BECAUSE THEY'VE CHOSEN NOT TO.

BUT IT WASN'T JUST A QUICK, FLIPPANT DECISION TO MAKE THE MOVE THAT WE DID.

IT WAS A LONG, DRAWN OUT PROCESS LOOKING AT A LOT OF DIFFERENT PROPERTIES, AND I TOO WAS REALLY INTERESTED IN THAT ZACHARY BUILDING, IT LOOKED LIKE, BUT ALSO UNDERSTOOD WE HAD ALL THE PROBLEMS WITH IT.

BUT IT WAS A REALLY INTERESTING PIECE OF PROPERTY TO LOOK AT, AS WELL AS A LOT OF THE OTHER ONES THAT WE LOOKED AT, BUT IT WAS A PRETTY LONG, ARDUOUS, LONG DISCUSSIONS NOT GETTING HOME TILL AFTER FIVE OR SIX O'CLOCK IN THE EVENING AFTER A EXECUTIVE SESSION TRYING TO FIGURE OUT WHAT'S GOING TO BE THE BEST WAY TO MOVE FORWARD.

SO I THINK THAT'S ONE OF THE THINGS THAT I WOULD HOPE PEOPLE WOULD UNDERSTAND WAS THIS WASN'T TAKEN LIGHTLY AT ALL.

WE HAD BEEN WORKING ON IT FOR SEVERAL YEARS, TRYING TO COME UP WITH THE RIGHT OPPORTUNITY THAT WOULD BE IN THE BEST INTEREST OF THE OF THE ENTIRE CITY OF AMARILLO.

YEAH, YEAH, IT WAS A LOT OF LONG NEGOTIATIONS.

AND I MEAN, EVEN SOME AGAIN, THERE'S A I DON'T WANT TO SIT HERE AND RAMBLE ON BLOW MY COVER HERE.

BUT I MEAN, EVEN RENTING A SPACE FOR THIS ROOM IS SOMETHING I THOUGHT LIKE, ALL RIGHT, IF WE CAN DO THIS WHILE YOU'RE DOING, YOU KNOW? YOU KNOW, I'VE HAD IDENTIFIED ONE THAT, YOU KNOW, THIS IS PERFECT.

AND I MEAN, IT'S JUST THERE WAS THERE WAS A BUNCH OF DIFFERENT SCENARIOS.

SO YEAH, IT WAS LONG AND GRUELING.

SO.

HMM.

ANY OTHER I'D SAY I DIDN'T HAVE ANY QUESTIONS BECAUSE WE WENT THROUGH TWO YEARS OF GOING THROUGH QUESTIONS.

IT'S ALL OLD NEWS TO ME.

OKAY, THANK YOU.

COUNCIL MEMBER SMITH.

ALL RIGHT.

ANYTHING ELSE, MR. CITY MANAGER ON THAT PARTICULAR TOPIC? NO, MA'AM.

OK, THANK YOU.

ALL RIGHT.

[1.E. Request future agenda items and reports from City Manager]

MOVING ON TO AGENDA ITEM ONE E AND THAT IS REQUEST FUTURE AGENDA ITEMS IN REPORTS FROM THE CITY MANAGER COUNCIL.

YES, MA'AM.

I'D LIKE TO REQUEST AN ITEM TO DISCUSS THE LAW IN PUBLIC ADDRESS.

ANY OTHER TOPICS?

[01:25:03]

WE HAD AN ARTS AND BEAUTIFICATION MEETING TODAY, SO IT PROBABLY NEEDS TO BE ON THE NEXT AGENDA, CORRECT? THAT IS CORRECT.

COUNCIL MEMBER SAUER? OK.

IF NOTHING ELSE, WHAT WERE YOU? YOU HAD TO ASK SOME BEAUTIFICATION.

YEAH, ARTS AND BEAUTIFICATION WAS TODAY.

YEAH, ACTUALLY, I HAD TO DO IT INSTEAD OF DOING THE PARKS AND RECREATION.

BUT AT THE SAME TIME.

OK, NEXT, MOVING INTO THE CONSENT AGENDA.

[2. CONSENT ITEMS]

CITY MANAGER, DO YOU HAVE ANY COMMENTS THERE? YES, MA'AM.

WE'VE GOT A COUPLE OF THINGS I NEED TO TOUCH ON.

SO IN FRONT OF YOU, YOU'VE GOT SOME REVISED MINUTES FROM LAST WEEK.

SO WHAT WE'VE DONE IS PROVIDE THE ONLY DIFFERENCE BETWEEN THE MINUTES IN YOUR PACKET AND THE MINUTES IN FRONT OF YOU IS THE MOTION.

ON THE ITEM WHERE WE APPROVED ON A 3-2 VOTE, THE PHASE ONE REZONING OF.

NORTH HEIGHTS.

SO THAT IS ITEM.

SORRY.

THAT IS ITEM 3A, NON CONSENT ITEM, 3A.

SO WE PUT MORE DETAIL IN THERE AND HAVE A VERBATIM WORD FOR WORD INCLUSION OF MAYOR PRO TEM FREDA POWELL'S MOTION TO APPROVE THE ITEM, WHICH WAS SECONDED AND APPROVED BY A 3-2 VOTE.

WE INCLUDED THAT JUST BECAUSE OF THE FACT THAT IT WAS A 3-2 VOTE AND IT WAS A COMPLICATED ISSUE.

SO A BIT MORE DETAIL ON THAT, BUT THAT'S THERE FOR YOU.

AND WHEN YOU MAKE THE MOTION TO APPROVE THE MINUTES, THE REQUEST WOULD BE THAT YOU ALSO INCLUDE WITH THE REVISED MINUTES THAT WERE PROVIDED TO COUNCIL.

ALSO, YOU'LL ALL NOTICE THAT YOU HAVE IN FRONT OF YOU JUST SOME PROPOSED LANGUAGE IF YOU WANT TO MAKE MOTIONS IN SECONDS AND THINGS WITH THE ITEMS THAT ARE ON THE AGENDA FOR ACTION.

THIS DOES NOT SAY THESE ARE THE ONLY LANGUAGE THAT YOU CAN USE.

IN FACT, COUNCIL MEMBERS HAVE A WILDLY VARIABLE LANGUAGE THAT THEY CAN USE, WHICH WILL STILL PASS ITEMS. IN FACT, YOU CAN BE AS BASIC AS I MOVE THAT WE APPROVE THE ITEM AS PRESENTED.

SECOND, ALL THOSE IN FAVOR SAY THAT KIND OF THING.

BUT BECAUSE OUR MAYOR PRO TEM VERY GRACIOUSLY FOR THE LAST FOUR YEARS, FIVE YEARS HAS PROVIDED VERY DETAILED MOTIONS WHEN SHE MAKES A MOTION AND A NUMBER OF OTHER COUNCIL MEMBERS DO AS WELL.

AND BECAUSE SHE'S SERVING AS AS THE MAYOR TODAY WITH THE GAVEL, WHILE LEGALLY SHE CAN MAKE MOTIONS AND SECONDS FROM THAT POSITION, SHE WOULD PREFER THAT THE REST OF THE COUNCIL MAKE THE MOTIONS IN SECONDS AND SHE WOULD FUNCTION AS A MAYOR AND JUST VOTE AND NOT MAKE MOTIONS IN SECONDS.

SO Y'ALL WILL DO WHATEVER YOU WANT TO DO.

THIS IS PRESENTED FOR YOUR INFORMATION TO USE IF YOU SEE FIT OR TO NOT USE AND DO SOMETHING DIFFERENT.

AND IT DOES NOT REQUIRE YOU TO VOTE TO PROPOSE THAT WE PASS ANYTHING THAT'S IN FRONT OF YOU FOR CONSIDERATION TODAY.

IT IS JUST FOR YOU USE IF YOU CHOOSE TO USE IT.

OKAY.

ALL RIGHT.

SO CAN I GET CLARIFICATION ON THE CHANGE I'M READING ON ITEM 3A, YOU KNOW, MOTION WAS MADE TO AMEND AND APPROVED PLANNING AND ZONING RECOMMENDATION, WITH THE MODIFICATION SHOWN ON THE EXHIBIT.

CAN I GET CLARIFICATION ON THAT? LIKE WHAT? BECAUSE IT WAS REALLY STAFF'S RECOMMENDATION THAT WE VOTED ON, WASN'T IT? AND SO I'M JUST THE RECOMMENDATION WAS TO AMEND THE P AND Z RECOMMENDATION.

SO THE MOTION WAS TO APPROVE P AND Z'S RECOMMENDATION WITH THE MODIFICATIONS MADE, WHICH WERE STAFF'S RECOMMENDATIONS.

YES, AND THAT WAS MY COMPLETE MOTION AT THE LAST COUNCIL MEETING, WHICH WAS NOT INITIALLY INCLUDED IN THE FIRST MINUTE.

OK, SO THIS IS THE CORRECTED LANGUAGE.

YES, IT IS.

IT'S MORE DETAIL AS I PRESENTED THE MOTION, AS IT IS IN THE PACKET, IT'S CORRECT.

THIS JUST PROVIDES A LOT MORE DETAIL.

SO THE CLARIFICATION THAT I'M LOOKING FOR, I GUESS, IS WE WERE PRESENTED WITH TWO OPTIONS STAFF'S RECOMMENDATION AND P AND Z'S RECOMMENDATION.

WE VOTED TO APPROVE OR IT PASSED.

WE VOTED ON STAFF'S RECOMMENDATION.

CORRECT.

OK.

AND.

THIS JUST SAYS MOTION WAS MADE TO AMEND AND APPROVED PLANNING AND ZONING RECOMMENDATION, AND THE STAFF'S RECOMMENDATION WAS A MODIFICATION OF THE RECOMMENDATION.

OK.

SO IT WAS A MOTION TO APPROVE THIS RECOMMENDATION WITH THE FOLLOWING MODIFICATIONS.

SO AND THAT'S THE LANGUAGE OF ALTERNATE RECOMMENDATION.

AM I UNDERSTANDING THAT CORRECTLY? WHERE DO YOU SEE THAT? JUST AS WITH THE MODIFICATION SHOWN ON THE EXHIBIT LABELED ALTERNATE RECOMMENDATION.

YES, THAT WOULD BE THE ALTERNATE RECOMMENDATION MADE BY THE STAFF.

[01:30:03]

CORRECT.

OK.

OK.

ALL RIGHT.

IN REGARDS TO THE CONSENT AGENDA, ARE THERE ANY QUESTIONS REGARDING ANY ITEMS, ANY OTHER ITEMS ON THE CONSENT AGENDA THAT COUNCIL HAS? IF NOT, I WILL ASK FOR A MOTION.

MAYOR PRO TEM, I MOVE TO APPROVE THE CONSENT AGENDA AS PRESENTED, INCLUDING THE REVISIONS PRESENTED FOR THE MINUTES FOR THE AUGUST 24, 2021 MEETING.

OK, I HAVE A MOTION FROM COUNCIL MEMBER SAUER.

IS THERE A SECOND? SECOND, I HAVE A SECOND FROM COUNCIL MEMBER SMITH.

QUESTIONS? ALL THOSE IN FAVOR BY SIGN OF SAYING AYE.

AYE.

OPPOSED? THAT PASSES WITH A 4-0 VOTE.

MOVING ON TO THE NON CONSENT AGENDA, THAT'S ITEM 3A, CONSIDER APPROVAL AGREEMENT

[3.A. CONSIDER APPROVAL - AGREEMENT FOR SERVICES BETWEEN CENTER CITY OF AMARILLO lNC.]

FOR SERVICES BETWEEN CENTER CITY OF AMARILLO, INC.

MR. CITY MANAGER? WELL, MAYOR, WE HAVE BETH DUKE, WHO IS THE EXECUTIVE DIRECTOR FOR CENTER CITY HERE TO GIVE US JUST A BRIEF PRESENTATION ON WHAT'S GOING ON AND THEN WE'LL APPROVE THEIR BUDGET.

WELCOME, BETH.

IT'S ALWAYS A PLEASURE TO HAVE YOU HERE.

THANK YOU, AND THANK YOU SO MUCH FOR LETTING ME HAVE JUST A FEW MINUTES OF YOUR TIME TODAY TO TELL YOU HOW PROUD I AM OF HOW FAR WE'VE COME AND SOME EXCITING THINGS THAT YOU'LL LOOK BACK OVER.

2020-2021 AND SAY, EVEN DURING THIS ROUGH AND CHALLENGING YEAR, WE WERE ABLE TO DO A LOT OF GREAT THINGS, ESPECIALLY IN CENTER CITY.

THE FIRST EXCITING THING IN YOUR NOTEBOOK IS THE CERTIFICATE.

DID YOU GET THE CALL? YES.

OK, OK.

THE FIRST EXCITING THING IS THAT FOR THE 19TH CONSECUTIVE YEAR, CENTER CITY HAS MET OR EXCEEDED ALL OF THE STANDARDS FOR NATIONAL MAIN STREET AND TEXAS HISTORICAL COMMISSION TEXAS MAIN STREET RECOGNITION.

AND THIS IS A HUGE MARK OF ACCOMPLISHMENT FOR OUR VOLUNTEER BOARD AND FOR STAFF.

BECAUSE EVEN THROUGH THE UPS AND DOWNS OF LAST YEAR, PLANNED EVENTS THAT SOMETIMES GOT CANCELED AND PUSHING THROUGH, WE WERE ABLE TO MAINTAIN ALL OF OUR DESIGNATIONS.

SO WE'RE VERY PROUD OF OF THAT DESIGNATION.

RIGHT BEYOND THAT CERTIFICATE IN YOUR NOTEBOOKS.

THE GREAT THING THAT I'D LIKE TO TELL YOU SOME NUMBERS FOR 2020, CENTER CITY REINVESTMENTS TOTALED MORE THAN FIVE AND A HALF MILLION IN PRIVATE INVESTMENT.

SIXTEEN MILLION IN PUBLIC INVESTMENT.

AND ALMOST $7 MILLION IN PUBLIC PRIVATE PARTNERSHIPS.

AND THAT WAS FOR A TOTAL OF ALMOST 28 AND A HALF MILLION INVESTMENTS IN OUR DOWNTOWN.

I CHART THIS QUARTERLY FOR TEXAS HISTORICAL COMMISSION AND TEXAS MAIN STREET.

IT'S ALL DRAWN FROM PUBLIC RECORD BUILDING PERMITS AND SALE OF BUILDINGS, AND I COULDN'T BE MORE PROUD THAN OUR DOWNTOWN KEEPS THRIVING.

SINCE 2007, WHICH IS THE BASELINE YEAR FOR TEXAS HISTORICAL COMMISSION.

FOR THEIR REPORTING SINCE 2007, CENTER CITY REINVESTMENTS HAVE TOTALED 422 MILLION DOLLARS, INCLUDING PRIVATE, PUBLIC AND PUBLIC PRIVATE PARTNERSHIPS.

I JUST THINK THAT'S FABULOUS.

THIS IS PARTICULARLY NOTEWORTHY, TOO, BECAUSE THE NEW CENTER FOR THE PERFORMING ARTS WAS COMPLETED IN 2005.

SO THAT'S 39 MILLION.

THAT DOES NOT EVEN SHOW UP IN THAT 422 MILLION.

AND IT TAKES A VILLAGE.

IT TAKES ALL OF US, AND I JUST AM PROUD OF HOW FAR WE'VE COME.

YOU ALSO APPROVE TODAY THE BUDGET FOR THE CENTER CITY TAX REINVESTMENT ZONE THAT WAS ESTABLISHED IN 2006 AND SINCE 2006, WHEN IT WAS ESTABLISHED, THE PROUD VALUE HAS INCREASED FROM 139 AND A HALF MILLION TO TWO HUNDRED AND FIFTY ONE AND NINE ALMOST TWO HUNDRED AND FIFTY TWO MILLION, AND TO GO FROM ONE POINT THIRTY NINE TO TWO POINT FIFTY TWO SINCE 2006 IS REALLY REMARKABLE.

AND I'LL TELL YOU, WE'VE GOT PEOPLE ALL OVER THE STATE WHO CALL ME AND SAY, ARE YOU SURE? AND I SAID, YES, I'M SURE.

NOW IN YOUR I KNOW THIS IS LITTLE TINY PRINT, BUT IF YOU REALLY LOVE SPREADSHEETS LIKE SOME OF YOU DO, THIS IS GOING BACK TRACKING ALL OF THAT INVESTMENT.

[01:35:03]

SO I PUT THAT IN YOUR NOTEBOOK, SO YOU'D HAVE A CHANCE TO SEE THAT WE ARE SO PROUD OF OUR ACTIVITIES.

WE'RE VERY PROUD OF OUR FACADE GRANT PROGRAM WE ADMINISTER ON BEHALF OF THE CITY.

SINCE IT BEGAN IN 1994, THE FACADE GRANT PROGRAM HAS INVESTED $1.3 MILLION BACK IN DOWNTOWN, AND I CALL THIS SAVING DOWNTOWN ONE BUILDING AT A TIME.

THESE ARE MATCHING GRANTS, AND WE KNOW THAT EVERY RECIPIENT HAS SPENT AT LEAST TWO TO THREE TIMES THAT MUCH IN MAKING DOWNTOWN BE MORE WELCOMING AND HAVE BETTER CURB APPEAL.

SOME OF THE PROJECTS WE DID THIS YEAR, WE COMPLETED THIS YEAR OR THE PERGOLA SHOP BRACEROS THAT NEON SIGN ON POLK STREET, BANK OF COMMERCE AND WILSON HAYS CPA.

AND THEN, AS YOU KNOW, BECAUSE YOU.

MANY OF YOU CELEBRATED THAT WITH US.

WE FINALLY OPENED THE BARFIELD HOTEL.

I'VE GOT A CUMULATIVE REPORT GOING BACK TO 1994 IN YOUR NOTEBOOKS AND PICTURES OF OUR FACADE GRANTS.

AND THEN I WANT TO TELL YOU, OUR DISTRICTS DID A GREAT JOB LAST YEAR.

THE DOWNTOWN DINING DISTRICT SURVIVED THE PANDEMIC.

MOST OF OUR RESTAURANTS ARE REOPENING.

THEY'RE HAVING TROUBLE WITH STAFFING.

SOME HAVE LIMITED HOURS OR LIMITED MENUS.

BUT I WILL TELL YOU THAT ALMOST ALL OF THEM ARE GOING TO BE ABLE TO COME BACK.

WE HAVE NEW RESTAURANTS ON THE HORIZON, INCLUDING TUSCAN ITALIAN STEAKHOUSE IN THE BARFIELD, WHICH IS NOW OPEN, AND THE NEW\ BRACEROS IN THE FORMER ACAPULCO.

AMARILLO CULTURAL DISTRICT WORKED TIRELESSLY THROUGH COUNTLESS ZOOM MEETINGS FOR A WAYFINDING AND SIGNAGE PROJECT FOR DOWNTOWN.

THERE'S A MOCK UP PICTURE IN YOUR NOTEBOOK OF THAT.

I'M REALLY PROUD OF THE WAY FINDING AND SIGNAGE PROGRAM BECAUSE ON THE BACK OF SOME OF THE SIGNS, THERE WILL BE PICTURES AND DESCRIPTIONS OF HISTORICAL LANDMARKS AND THINGS FOR TOURISTS AND RESIDENTS ALIKE TO LEARN A LITTLE MORE ABOUT OUR DOWNTOWN.

IN ADDITION, CENTER CITY COMPLETED ITS SIXTH SEASON OF AMARILLO COMMUNITY MARKET.

THANK YOU TO EVERYONE WHO CAME.

WE AVERAGED 50 VENDORS EVERY WEEK, WHICH WAS AMAZING CONSIDERING THE PANDEMIC, QUARANTINE, AND SOME OF THE DIFFERENT CHALLENGES THAT OUR VENDORS FACED THROUGH PANDEMIC.

A LOT OF OUR VENDORS LEARNED HOW TO MAKE AND BAKE, AND I TELL WE ARE BUILDING ENTREPRENEURS.

THIS IS TRULY ECONOMIC DEVELOPMENT.

YOU HAVE SOME PICTURES IN THERE OF THAT.

WE WERE ABLE TO HAVE EIGHT OUT OF NINE CONCERTS FOR HIGH NOON ON THE SQUARE.

TWO INCHES OF RAIN ONE WEDNESDAY MORNING DEFLECTED THAT, BUT WE'RE ALWAYS GLAD FOR THE RAIN.

WE JUST DIDN'T WANT TO MESS UP.

POTTER COUNTY'S LAWN WE HAD TO CANCEL JAZZ TOBER LAST YEAR.

WE GOT ONE CONCERT AND THEN THE CITY WENT TO A DIFFERENT STATUS OF RED AND WE DECIDED FOR SAFETY REASONS TO CANCEL JAZZ-TOBER.

BUT I'M PROUD TO TELL YOU JAZZ-TOBER WILL START AGAIN THIS YEAR.

EVERY TUESDAY NIGHT IN OCTOBER, RIGHT THERE, [INAUDIBLE].

WE HAVE BEEN ABLE TO DO SOME OTHER AMAZING, SMALLER EVENTS.

WE WORKED WITH THE FIRST BANK SOUTHWEST TOWER RUN.

IT'S THE ONLY VERTICAL RUN WE HAVE IN AMARILLO.

WE'RE PROUD TO CO-SPONSOR THAT.

AND THEN A GREAT THING WE DID WAS THE DOWNTOWN TX TOUR, WHERE PEOPLE COULD COME AND SEE SOME OF THESE GREAT PROJECTS FROM THE INSIDE THAT THEY MIGHT NOT BE ABLE TO SEE OTHERWISE.

SO I JUST APPRECIATE ALL YOUR SUPPORT OR YOUR ONGOING SUPPORT.

WE COULDN'T DO IT WITHOUT BEING PARTNERS, AND WE JUST WORK EVERY DAY TO MAKE YOU PROUD OF DOWNTOWN AND PROUD OF CENTER CITY.

I GUESS THAT'S THERE.

THAT'S KIND OF LIKE THE EMMYS WHERE THEY JUST SIGNED YOU OFF.

SO IF YOU HAVE ANY QUESTIONS, I'D BE HAPPY TO ANSWER.

AND I JUST THANK YOU SO MUCH FOR YOUR SUPPORT.

SO, BETH, I WAS JUST NOTICING DAVID'S RESTAURANT IS COMING DOWNTOWN AND WHERE'S THAT GOING TO BE LOCATED? DAVID'S RESTAURANT, IT'S GOING TO HAVE A DIFFERENT NAME NOW SINCE I PRINTED THIS OUT.

IT IS OK.

DEPENDS HOW LONG YOU'VE WORKED DOWNTOWN.

IF YOU'VE WORKED DOWNTOWN A LONG TIME, IT'S JERRY THE KING BARBECUE.

AND THEN IT WAS POBLANO'S AND THERE WAS GOING TO BE DAVID'S.

AND THAT'S GOING TO BE ITALIAN.

AND I'M NOT SURE THE NAME OF IT, BUT I TALKED TO THEM LAST WEEK.

THEY ARE VERY CLOSE TO OPENING.

THIS WOULD BE AT 9TH AND TYLER.

OK.

RIGHT DOWN FROM ABC BLUEPRINT.

OK.

ALL RIGHT.

BECAUSE I WAS SELLING THE ADDRESS OF 600 SOUTH TYLER, I THINK IT'S WHAT IT WAS SELLING HERE.

SO OK.

COUNCIL, DO YOU HAVE ANY QUESTIONS FOR BETH? AND THERE'S EVEN A CUTE PICTURE IN THERE, FREDA AT HIGH NOON.

[01:40:03]

THANK YOU.

MAYOR PRO TEM AND A CUTE PICTURE OF MAYOR NELSON JUDGING OUR PATRIOTIC PET PARADE WHERE WE HAD 32 DOGS AND TWO KITTIES.

WELL, AS YOU AND YOUR GROUP DO A WONDERFUL JOB.

THANK YOU.

THANK YOU.

COUNCILMAN SAUER AND THANK YOU FOR BEING A REGULAR AFTER HE RODE HIS BIKE TO POWDER CANYON.

HE CAME TO MARKET FOR A FROZEN LEMONADE AND WE WE ARE GRATEFUL.

WE'RE GRATEFUL FOR YOU AS A CUSTOMER, TOO.

THANK YOU, BETH.

WE APPRECIATE ALL THAT.

YES.

AND IF YOU HAVE ANY QUESTIONS, JUST CALL ME.

I PUT IT IN A NOTEBOOK.

I KNOW THAT'S A LITTLE LOW TECH, BUT AT LEAST IT GIVES YOU A CHANCE TO TAKE IT HOME AND STUDY IT.

SO IF YOU HAVE SOME QUESTIONS, PLEASE CALL US.

YES, AND I ALWAYS APPRECIATE THAT VERY MUCH.

OK, MOVING ON TO THE NON CONSENT AGENDA ITEM B.

WELL, I THINK WE NEED TO APPROVE THE CONTRACT WITH.

I'D LIKE TO MAKE A MOTION, SO I MOVE TO APPROVE A ONE YEAR AGREEMENT WITH CENTER CITY OF AMARILLO, INC.

FOR CONTINUED SERVICES ASSOCIATED WITH THE PRESERVATION IMPROVEMENT REVITALIZATION OF THE CENTRAL BUSINESS DISTRICT OF AMARILLO.

THANK YOU, COUNCIL MEMBER STANLEY.

YOU'LL HAVE A SECOND, OK? COUNCIL MEMBER SMITH SECOND.

ANY OTHER QUESTIONS? ADDITIONAL QUESTIONS? IF NOT, I'LL CALL FOR THE VOTE.

ALL THOSE IN FAVOR BY SAYING AYE.

AYE.

ALL THOSE OPPOSED.

OK, THAT PASSES WITH A 4-0 VOTE.

THANK YOU, MR. CITY MANAGER.

I'M SORRY.

AMONG THE DIFFERENT HAT TODAY, SO.

AND WITHOUT A FREE TO TO OR WITHOUT A COUNCIL MEMBER POWELL TO KEEP YOU STRAIGHT CAN TELL YOU MAKING THESE MOTIONS DIFFICULT.

IT IS DIFFICULT, BUT YOU BACK IN YOUR SEAT.

ALL RIGHT.

OK, MOVING ON TO AGENDA ITEM 3B, IT'S A PUBLIC HEARING AND CONSIDERATION OF

[3.B. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7927]

ORDINANCE NUMBER 7927.

MR. CITY MANAGER.

ALL RIGHT.

WE'VE GOT ASSISTANT CITY MANAGER ANDREW FREEMAN TO PRESENT THE ITEM.

THIS A LITTLE BIT OF PRECURSOR WORK BEFORE A POTENTIAL ECONOMIC DEVELOPMENT INCENTIVE.

ANDREW, SIR, GOOD AFTERNOON.

I'M FILLING IN FOR KEVIN KOLLER WITH ADC.

TODAY HE IS OUT OF TOWN AND HE WILL BE BACK FOR THE NEXT MEETING FOR THE SECOND READING, AS WELL AS THE TAX ABATEMENT THAT GOES ALONG WITH THIS REINVESTMENT ZONE.

WELL.

STAND BY.

SO THIS IS ACTUALLY A STATE LAW REQUIREMENT WHEN IT COMES TO CITIES CONSIDERING TAX ABATEMENTS, YOU HAVE TO ADOPT A REINVESTMENT ZONE IN PLACE DESIGNATED ZONE BEFORE YOU CAN CONSIDER ENTERING INTO AN AGREEMENT.

SO THAT'S PART OF CHAPTER 312 OF THE TAX CODE.

SO BY DESIGNATING THIS ZONE, IT WOULD BE A TERM OF FIVE YEARS, WHICH IS BASICALLY THE WINDOW THAT YOU COULD CONSIDER A TAX ABATEMENT.

SO THE PROPOSED LOCATION IS 7.29 ACRES, IS REINVESTMENT ZONE NUMBER 14 AT WALLACE BOULEVARD AND GENTRY DRIVE.

AND AGAIN, THE PURPOSE OF THIS ZONE IS TO ALLOW COUNCIL THE ABILITY TO OFFER ECONOMIC DEVELOPMENT INCENTIVES TO A PROSPECTIVE HEALTH CARE REHABILITATION FACILITY IN THAT AREA.

HERE'S JUST AN OVERVIEW OF THE AREA.

IT IS ACROSS THE STREET FROM ATMOS AND BLUE CROSS BLUE SHIELD IN POINT WEST.

AS PART OF THIS PROCESS, WE DO PUBLISH THIS IN THE NEWSPAPER FOR THE PUBLIC HEARING, AS WELL AS SENDING IT TO EACH TAXING ENTITY SO THEY ARE AWARE OF THE REINVESTMENT ZONE IN CASE THEY'D ALSO LIKE TO PARTICIPATE IN ANY UPCOMING TAX ABATEMENTS AS WELL.

SO I'M HAPPY TO ANSWER ANY QUESTIONS AS FAR AS THE REINVESTMENT ZONE ITSELF.

IT DOES REQUIRE PUBLIC HEARING BEFORE TAKING ACTION.

AND SECOND READING WILL TAKE PLACE IF APPROVED, WILL TAKE PLACE AT YOUR NEXT SEPTEMBER COUNCIL MEETING.

OKAY.

QUESTIONS, COUNCIL? ANDREW, IF YOU'D TELL US THE ABATEMENT, THE YEARS AND THE PERCENTAGE, PLEASE.

SURE.

SO WE DO HAVE THAT UP ON OUR WEBSITE, SO WE DO HAVE TO PUBLICIZE TAX ABATEMENTS ALSO 30 DAYS IN ADVANCE.

SO WHAT IS BEING PROPOSED WITH THIS PROJECT IS A SIX YEAR ANNUAL ABATEMENT AT 60 PERCENT OF THE INVESTMENT THAT THEY PLACE ON THE PROPERTY, WHICH IS COMPARABLE TO ANOTHER HEALTH CARE FACILITY JUST DOWN THE STREET FROM THIS ONE THAT ALSO RECEIVED A SIMILAR TAX PAYMENT.

THANK YOU.

ANY OTHER QUESTIONS? OK, AT THIS TIME, I'LL OPEN THE PUBLIC HEARING AND IS IT GOING TO BE OK? SO KAT IS GOING TO READ THE LANGUAGE FOR THE PUBLIC HEARING ADDRESS.

IF YOU WISH TO MAKE A COMMENT DURING THIS PUBLIC HEARING, PLEASE COME FORWARD AND STATE YOUR NAME.

AND IF YOU LIVE WITHIN THE CITY OF AMARILLO CITY LIMITS, YOU WILL HAVE THREE MINUTES.

OK, DO WE HAVE ANYONE THAT WISHES TO SPEAK FOR OR AGAINST ASYLUM?

[01:45:05]

SEEING NONE AT THIS TIME, I'LL CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.

MAYOR PRO TEM, I MOVED TO ADOPT ORDINANCE NUMBER 7927, DESIGNATING CERTAIN AREAS OF THE CITY AS REINVESTMENT ZONE 14 FOR COMMERCIAL INDUSTRIAL TAX ABATEMENT, SPECIFICALLY A ZONE APPROXIMATELY 7.29 ACRES IN THE VICINITY OF WALLACE BOULEVARD AND GENTRY DRIVE.

OK, I HAVE A MOTION FROM COUNCIL MEMBER SAUER.

DO I HEAR A SECOND? SECOND.

SECOND FROM COUNCIL MEMBER SMITH.

QUESTIONS? ALL THOSE IN FAVOR BY SIGN OFF SAYING AYE.

AYE.

ALL THOSE OPPOSED? PASSES WITH A 4-0 VOTE.

[3.C. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7928]

MOVING ON TO AGENDA ITEM C, WHICH IS A PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NUMBER 7928.

MR. CITY MANAGER? ALL RIGHT, COUNCIL, GOT BRADY KENDRICK PLANNER, ONE OF OUR PLANNERS TO BRING THE ITEM TO YOU.

THIS IS ABANDONMENT OR VACATION OF A ROAD NEAR THE SHARPE AND DION STUDIOS DEVELOPMENT.

PRETTY SURE.

GOOD AFTERNOON.

THIS IS A PUBLIC HEARING AND CONSIDERATION OF AN ORDINANCE 7928, VACATION OF A TWENTY FOUR THOUSAND SQUARE FOOT PORTION OF PUBLIC RIGHT-OF-WAY, ALSO KNOWN AS SOUTHWEST 14TH AVENUE LINE BETWEEN BLOCKS 182-197.

PLEMONS ADDITION IN SECTION 170 BLOCK TO A BINGHAM SURVEY.

POTTER COUNTY, TEXAS THE VICINITY IS SOUTHWEST 14TH AVENUE AND TYLER STREET, AND THE APPLICANT IS CHRIS SHORT FOR AMARILLO JUNIOR COLLEGE.

THE APPLICANT IS REQUESTING THE VACATION OF THE JUST MENTIONED RIGHT-OF-WAY IN ORDER TO COMBINE THE TWO TRACTS OWNED BY THE APPLICANT INTO A UNIFIED DEVELOPMENT SITE FOR THE SHARP AND IRON STUDIOS PROJECT.

IN ANALYZING THE REQUEST.

EXISTING UTILITIES AND TRAFFIC IMPACTS, IF ANY, ARE CONSIDERED.

IN THIS INSTANCE, THE APPLICANT HAS AGREED TO PROVIDE AN EASEMENT FOR EXISTING UTILITIES IN THE RIGHT WAY.

ADDITIONALLY, THE CITY TRAFFIC ENGINEER AND THE PLANNING AND ZONING COMMISSION AGREED THAT DUE TO THE LOW TRAFFIC COUNTS ON THIS SEGMENT OF 14TH AVENUE AND CONSIDERING 14TH AVENUE EAST OF THIS SEGMENT HAS ALREADY BEEN VACATED PREVIOUSLY.

TRAFFIC IMPACTS OF THIS AREA WOULD BE MINIMAL AND PER TRAFFIC COUNT THAT WAS CONDUCTED AS PART OF THIS VACATION.

APPROXIMATELY FIVE CARS AN HOUR USE THIS SEGMENT OF 14TH.

AS WITH ANY REQUEST FOR VACATION, THE APPLICANT IS REQUIRED TO EITHER PAY THE FAIR MARKET VALUE OF THE RIGHT AWAY, DEDICATE AN AREA OF EQUAL OR GREATER VALUE, PAY THE HIGHER COST OF THE FAIR MARKET VALUE OR ANY RELOCATION COST OR A COMBINATION OF THE ABOVE REQUIREMENTS.

IN THIS INSTANCE, THE COMBINATION OF EASEMENTS BEING DEDICATED AND THE CONSTRUCTION OF PUBLIC INFRASTRUCTURE BY THE APPLICANT DO EXCEED THE FAIR MARKET VALUE OF THE AREA TO BE VACATED.

PUBLIC NOTICES WERE SENT TO ALL PROPERTY OWNERS WITHIN 200 FEET AS REQUIRED BY STATE LAW.

AS OF THIS MEETING, NO COMMENTS FROM THE PUBLIC HAVE BEEN RECEIVED REGARDING THE REQUEST.

THE PLANNING AND ZONING COMMISSION RECOMMENDED APPROVAL, THE REQUEST BY UNANIMOUS VOTE.

AND ON THIS SLIDE, YOU'LL KIND OF SEE WHAT THEY HAVE IN MIND FOR THE SITE ONCE THEY DO VACATE.

IF THE VACATION WERE APPROVED, THAT'S KIND OF WHAT THEY HAVE IN MIND FOR THESE TWO BLOCKS, AND I'LL TAKE ANY QUESTIONS THAT YOU MAY HAVE.

OKAY.

COUNCIL, QUESTIONS FOR BRADY? NO.

OK, THANK YOU, BRADY.

THANK YOU.

AT THIS TIME, WE'LL OPEN THE PUBLIC HEARING.

IF YOU WISH TO MAKE A COMMENT DURING THIS PUBLIC HEARING, PLEASE COME FORWARD, STATE YOUR NAME AND IF YOU LIVE WITHIN THE CITY OF AMARILLO CITY LIMITS, YOU WILL HAVE THREE MINUTES.

DO WE HAVE ANYONE THAT WISHES TO SPEAK ON OR AGAINST THIS ITEM? NONE.

HOW CLOSE THE PUBLIC HEARING.

AND AS FOR THE MOTION, I'D LIKE TO MAKE A MOTION I MOVE TO ADOPT ORDINANCE 7928 VACATING AND ABANDONING A 24 000 SQUARE FOOT PORTION OF PUBLIC RIGHT OF WAY IN THE VICINITY OF THE SOUTHWEST 14TH AVENUE AND SOUTH TYLER STREET.

SAVING ACCEPT A PUBLIC UTILITY EASEMENT.

OK, I HAVE A MOTION BY COUNCIL MEMBER STANLEY AND A SECOND BY COUNCIL MEMBER SMITH.

ANY FURTHER QUESTIONS? OK.

ALL THOSE IN FAVOR BY SIGN OF SAYING AYE.

AYE.

ALL THOSE OPPOSED? OK.

THIS ITEM PASSES WITH A 4-0 VOTE.

[3.D. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7929]

MOVING ON TO AGENDA ITEM 3D, PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NUMBER 7929.

MR. CITY MANAGER? HI MAYOR.

THIS IS THE FIRST OF NINE PIDS THAT WE'RE GOING TO CONSIDER TODAY.

SO BEFORE KELLY SHAW, WHO MANAGES ALL OF OUR PIDS CUSTOMER SERVICE COORDINATOR

[01:50:04]

OR DEVELOPMENT CUSTOMER SERVICE COORDINATOR, GETS ROLLING, I JUST WANT TO WALK THROUGH.

WE'VE DONE THIS LAST TWO OR THREE YEARS AND IT'S WORKED REALLY WELL.

THESE ARE A LOT OF INFORMATION WE'RE GOING TO PRESENT, AND THERE'S A NUMBER OF NINE DIFFERENT PUBLIC HEARINGS, NINE DIFFERENT MOTIONS IN SECONDS AND NINE DIFFERENT VOTES.

SO WHAT WE'RE GOING TO DO IS PRESENT A ONE PAGE SLIDE FOR EACH PID INDIVIDUALLY.

KELLY WILL GO OVER THE DETAILS, HIT ANY HIGH POINTS OR NOTABLE TOPICS FOR THOSE PIDS ANSWERING QUESTIONS COUNCIL HAS ON THOSE BIDS, THEN MAYOR PRO TEM, YOU'LL OPEN A PUBLIC HEARING HERE.

ANY COMMENTS THAT ANY INPUT THAT THE PUBLIC HAS CLOSED PUBLIC HEARING COMMENTS FROM COUNCIL MOTIONS SECOND VOTE AND THEN WE'LL MOVE ON TO THE NEXT SLIDE FOR THE NEXT PID.

SO WE'LL KNOCK THEM OUT IN A VERY SYSTEMATIC WAY THAT ALSO ADDRESSES ALL OF THE REQUIRED ACTIONS THAT WE NEED TO TAKE TO BE ABLE TO PROVE THEIR BUDGETS AND BE ABLE TO MOVE INTO OUR BUDGET IN OCTOBER OF 2021.

HMM.

SO IF YOU'D LIKE, I CAN GO OUT AND HAND IT TO TO KELLY TO START OFF WITH TOWN SQUARE PIT.

YES, IT WOULD BE PERFECT.

OK.

SO THANK YOU, MAYOR PRO TEM AND COUNCIL FOR LETTING ME SPEAK TO YOU TODAY ON THIS CITY MANAGER, EXACTLY.

OR I'LL TRY TO GO THROUGH THESE JUST AS QUICKLY AS POSSIBLE.

I DO YOU HAVE TO HIT A COUPLE OF THINGS.

JUST STATE LAW REQUIRES US TO HIT SOME OF THE ASSESSMENT POINTS AND THOSE TYPES OF THINGS.

SO STARTING WITH TOWN SQUARE MS. PUBLIC HEARINGS TO CONSIDER THE 21-22 ASSESSMENT BUDGET AND FIVE YEAR SERVICE PLAN, THE TOWN SQUARE ASSESSMENT IS DETERMINED BY APPLYING A RATE OF ZERO POINT ONE ONE ONE TO A THE SQUARE FOOTAGE OF A LOT.

THIS IS THE SAME ASSESSMENT RATE AS IT WAS LAST YEAR.

THE TOTAL ASSESSMENTS FOR THE TOWN SQUARE PID IS PROJECTED TO BE ONE HUNDRED AND SIXTY SIX THOUSAND ONE HUNDRED AND SIXTY FOUR DOLLARS.

TOTAL EXPENSES PROJECTED TO BE EIGHTY NINE THOUSAND FOUR HUNDRED AND NINETY FOUR DOLLARS.

AS FAR AS THE FIVE YEAR PLAN, GIVING THE TIMING OF THE IMPROVEMENTS AND ASSESSMENT REVENUES, THE CURRENT ASSESSMENT RATE IS MORE THAN ADEQUATE TO COVER ANY MAINTENANCE OR EXPENSES THAT THE PIT IS FORESEEN TO HAVE.

THE BOARD MET ON JUNE 15.

ALL OF OUR PUBLIC IMPROVEMENT DISTRICTS HAVE AN ADVISORY BOARD.

THE TOWN SQUARE ADVISORY BOARD MET JUNE 15TH AND UNANIMOUSLY RECOMMENDED TO APPROVE THIS ANNUAL BUDGET AND FIVE YEAR SERVICE PLAN.

OK.

COUNCIL, DO YOU HAVE ANY QUESTIONS FOR KELLY? NO, OK, AT THIS TIME, I WILL OPEN THE PUBLIC, THE PUBLIC HEARING.

IF YOU WISH TO MAKE A COMMENT DURING THIS PUBLIC HEARING, PLEASE COME FORWARD, STATE YOUR NAME AND IF YOU LIVE WITHIN THIS AMARILLO CITY OF CITY LIMITS, YOU HAVE THREE MINUTES.

IS THERE ANYONE THAT WISHES TO SPEAK ON OR AGAINST THIS ITEM, SEEING NO ONE, I WILL CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.

I'LL MOVE TO ADOPT 7929 WITHIN THE TOWN SQUARE PUBLIC IMPROVEMENT DISTRICT TO KEEP THE PROPERTY ASSESSMENT RATES AT ELEVEN POINT ONE ONE CENTS PER SQUARE FOOT FOR A TOTAL ASSESSMENT OF ONE HUNDRED SIXTY SIX THOUSAND ONE HUNDRED SIXTY FOUR DOLLARS, ALONG WITH THE SERVICE PLAN COVERING A FIVE YEAR PERIOD.

GARY, I HAVE A MOTION FROM COUNCIL MEMBER SMITH TO HEAR SECOND SECOND.

I HAVE A SECOND FROM COUNCIL MEMBER SAUER.

ALL THOSE IN FAVOR.

AYE.

ALL THOSE OPPOSED? OK, PASSES WITH A 4-0 VOTE COUNCIL, IS EVERYONE OK? OR DO YOU NEED A BREAK AT THIS PARTICULAR MOMENT? FUN.

JUST KEEP GOING.

ALL RIGHT, WE'LL KEEP GOING.

[3.E. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7930]

MOVING ON TO AGENDA ITEM 3E, IT'S A PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NUMBER 7930.

KELLY? THANK YOU, MAYOR PRO TEM.

THIS PUBLIC HEARING IS TO CONSIDER THE 21-22 POINT LIST ASSESSMENT IN FIVE YEAR ANNUAL BUDGET AND FIVE YEAR SERVICE PLAN.

POINT WAS ASSESSMENT IS DETERMINED BY DIVIDING THE TOTAL COST OF THE EXPENSES BETWEEN PROPERTY OWNERS, ACCORDING TO THE TOTAL PERCENTAGE OF THE PROPERTY OWNED WITHIN THE PUBLIC IMPROVEMENT DISTRICT.

THIS ASSESSMENT METHOD IS THE SAME AS LAST YEAR.

IT'S BEING PROJECTED THAT TOTAL ASSESSMENTS, WHICH HAVE BEEN THE SAME FOR SEVERAL YEARS, ACTUALLY TOTAL ASSESSMENTS WOULD EQUAL FIFTY TWO THOUSAND DOLLARS.

SO DEPENDING ON WHAT PORTION OR WHAT PERCENTAGE OF THE PROPERTY YOU OWNED WITHIN

[01:55:03]

THAT PID, YOU WOULD APPLY THAT SAME PERCENTAGE TO THAT $52000.

THE TOTAL EXPENSES ARE PROJECTED TO BE FIFTY THREE THOUSAND TWO HUNDRED AND EIGHT DOLLARS.

AS FAR AS THE FIVE YEAR SERVICE PLAN, THE CURRENT ASSESSMENT REVENUES ARE ADEQUATE TO COVER THE MAINTENANCE COSTS AS WELL AS MAINTAINING ADEQUATE RESERVES.

JUST TO MENTION, THOSE RESERVES ARE IMPORTANT BECAUSE THEY LOST SEVERAL TREES NOT TOO LONG AGO AND HAD TO REPLACE A LOT OF TREES.

AND SO IT'S NICE TO HAVE THOSE RESERVES IN THAT BUDGET.

SO THAT'S IMPORTANT.

THERE ARE BOARD MET ON JUNE 2ND AND UNANIMOUSLY RECOMMENDED APPROVAL OF THE PROPOSED BUDGET IN THE FIVE YEAR SERVICE PLAN.

THANK YOU, KELLY.

QUESTIONS, COUNCIL? OK, AT THIS TIME, WE'LL OPEN A PUBLIC HEARING.

IF YOU WISH TO MAKE A COMMENT DURING THIS PUBLIC HEARING, PLEASE COME FORWARD, STATE YOUR NAME AND IF YOU LIVE WITHIN THE AMARILLO CITY LIMITS, YOU WILL HAVE THREE MINUTES.

IS THERE ANYONE THAT WISHES TO SPEAK ON OR AGAINST THIS ITEM? SEEING NONE, I'LL CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.

MAYOR PRO TEM, I MOVE TO ADOPT ORDINANCE 7930 WITHIN THE POINT WEST PUBLIC IMPROVEMENT DISTRICT TO KEEP THE PROPERTY OWNER ASSESSMENTS AT A TOTAL OF $52000.

ALONG WITH THE SERVICE PLAN COVERING A FIVE YEAR PERIOD.

THANK YOU.

I HAVE A MOTION FROM COUNCIL MEMBER SAUER.

DO I HAVE A SECOND? COUNCIL MEMBER SMITH? THANK YOU.

ALL THOSE IN FAVOR, PLEASE SAY AYE.

AYE.

ALL THOSE OPPOSED? MOTION PASSES WITH A 4-0 VOTE.

[3.F. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7931]

MOVING ON TO THE NEXT ITEM ON THE AGENDA, WHICH IS ITEM, IF IT'S A PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NUMBER 7931, KELLY, THANK YOU, MAYOR PRO TEM.

THIS PUBLIC HEARING IS TO CONSIDER THE 2021-22 ASSESSMENT FOR THE VINEYARD'S PUBLIC IMPROVEMENT DISTRICT.

THE ASSESSMENTS ARE DETERMINED BY FLAT RATE OF $50 PER LOT.

THIS IS THE SAME AS THE LAST SEVERAL YEARS, SO NO CHANGE IN THE ASSESSMENT RATE.

TOTAL ASSESSMENTS ARE PROJECTED TO BE TEN THOUSAND FOUR HUNDRED AND FIFTY DOLLARS.

TOTAL EXPENSES ARE PROJECTED TO BE TEN THOUSAND THREE HUNDRED AND EIGHTY NINE DOLLARS.

THE FIVE YEAR PLAN, GIVEN THE FIVE YEAR PLAN, THE TIMING OF ADDITIONAL IMPROVEMENTS AND LOTS IN THE FUTURE, THE CURRENT ASSESSMENT REVENUES ARE MORE THAN ADEQUATE TO COVER ANY EXPENSES OR AS WELL AS MAINTAIN ADEQUATE RESERVES.

THEIR BOARD MET ON JUNE 3RD AND ALSO UNANIMOUSLY RECOMMENDED APPROVAL OF THE PROPOSED BUDGET AND FIVE YEAR SERVICE PLAN.

OKAY, THANK YOU, KELLY.

HAVE ANY QUESTIONS, COUNCIL? NO? OK, AT THIS TIME, WE'LL OPEN A PUBLIC HEARING.

IF YOU WISH TO MAKE A COMMENT DURING THIS PUBLIC HEARING, PLEASE COME FORWARD, STATE YOUR NAME.

AND IF YOU LIVE WITHIN THE AMARILLO CITY LIMITS, YOU'LL HAVE THREE MINUTES.

IS THERE ANYONE PRESENT THAT WISHES TO SPEAK ON OR AGAINST THIS ITEM? OK, SIR, IF YOU'LL COME UP TO THE PODIUM.

I'M DOUGLAS JOHNSON, I LIVE AT 1105 RIESLING WAY.

I'M IN THE VINEYARDS.

I JUST WANT TO KNOW IF THERE'S ANY FUNDS LEFT OVER, WHAT HAPPENS TO THEM ? WHO CONTROLS THE FUNDS AND WHO CONTROLS WHAT IMPROVEMENTS NEED TO BE MADE? OK, THANK YOU, SIR.

KELLY, WOULD YOU LIKE TO ADDRESS THAT? AS FAR AS WHAT HAPPENS TO ANY OF THE PID REVENUES THAT ARE LEFT OVER, THEY REMAIN IN A SURPLUS FUND AND THEY REMAIN THERE.

THEY COLLECT A SMALL AMOUNT OF INTEREST, BUT THEY REMAIN IN THE FUND BALANCE.

THOSE FUNDS THEN CAN BE USED AS NEEDED.

SOME OF THE OPTIONS THAT HAVE BEEN USED BEFORE THAT ONCE A SURPLUS FUND GETS BIG ENOUGH, IT'S POSSIBLE TO REIMBURSE THOSE FUNDS TO THE PROPERTY OWNERS OR MAYBE REDUCE THE ASSESSMENT AMOUNTS AND USE THOSE SURPLUS FUNDS TO FUND THE MAINTENANCE OF THE IMPROVEMENTS AS FAR AS WHO CONTROLS THE FUNDS.

ULTIMATELY, THE CITY COUNCIL CONTROLS THE FUNDS, BUT THAT'S WHY THE CITY COUNCIL CHOSE IN THE BEGINNING TO CREATE ADVISORY BOARDS FOR EACH OF OUR PUBLIC IMPROVEMENT DISTRICTS.

SO THE CITY COUNCIL ALWAYS LISTENS TO THE RECOMMENDATION OF THE ADVISORY BOARDS ON ANY IMPROVEMENTS NEEDED AND THAT KIND OF THING.

THAT'S WHY IT'S ALWAYS IMPORTANT FOR THESE BOARDS TO MEET PRIOR TO THESE TYPE MEETINGS TO GIVE THEIR RECOMMENDATIONS.

THEY'RE THE ONES THAT LIVE OUT THERE.

THEY HAVE TO BE RESIDENTS OUT THERE.

SO THEY'RE VERY FAMILIAR WITH THE IMPROVEMENTS AS FAR AS WHAT KIND OF IMPROVEMENTS CAN BE

[02:00:01]

MADE.

A LOT OF OUR DEVELOPERS WHO ARE STILL DEVELOPING THE SUBDIVISIONS, THEY HAVE PLANS FOR DEVELOPMENTS AND IMPROVEMENTS WITHIN THOSE DEVELOPMENTS, LIKE MEDIANS AND LANDSCAPE MEDIANS, ENTRYWAYS, THOSE KINDS OF THINGS THAT ALL HAS TO BE BALANCED WITH THE AMOUNT OF REVENUES THAT ARE COMING IN AND WHAT CAN BE PAID FOR.

AS FAR AS MAINTENANCE, THAT KIND OF THING.

SO IT'S REALLY UP TO THE DEVELOPER ON WHAT GETS DONE AS FAR AS IMPROVEMENTS ONCE THE DEVELOPERS OUT OF THE PICTURE.

THEN IT'S UP TO THE ADVISORY BOARD AND THE RESIDENTS, WHAT THEY WANT, WHAT THEY WANT DONE.

THEN THOSE RECOMMENDATIONS COME HERE BEFORE THE COUNCIL.

THAT ANSWER ALL YOUR QUESTIONS.

AND IF ANYBODY HAS ANY ANY QUESTIONS AFTER WE FINISH UP, KELLY IS GOING TO BE AVAILABLE TO TALK TO ANYBODY, ANSWER ANY QUESTIONS ANYBODY HAS ABOUT ANY OF THE PIT OPERATIONS OR ANY DETAILED QUESTIONS YOU GOT.

SURE.

THANK YOU.

I THINK I SAW TWO OTHER HANDS OF INDIVIDUALS THAT MAY WANT TO SPEAK.

ON THE VINEYARDS? YES, COME ON UP.

THANK YOU.

GOOD AFTERNOON.

I'M JEFF QUINLAN.

I WAS FIRST CITY BUILDING INSPECTOR IN THE VINEYARDS WHEN WE STARTED AND I LIVED THERE.

I'VE LIVED THERE A LITTLE OVER FOUR YEARS NOW AND OUR ENTRANCE IS DEPLORABLE RIGHT NOW.

I COULDN'T SAY ANY OTHER WORD TO DESCRIBE IT, SO I'M NOT REALLY SURE I WORK FOR THE DEVELOPER.

THE BUILDER I LEFT THE CITY, WENT TO WORK FOR HIM, HAD A WONDERFUL TIME, WONDERFUL RELATIONSHIP.

BUT WHOEVER'S DOING THE SUBCONTRACTING ON WHATEVER WAS REQUIRED IN OUR ENTRANCE BECAUSE THAT'S THE ONLY COMMON AREA WE HAVE AND IT'S A MESS AND REALIZING THE YEAR THAT WE'VE HAD THE WINTER THAT WE HAD.

BUT IT'S BEEN OVER SIX MONTHS NOW AND NOTHING'S BEEN DONE WITH OUR PAMPAS GRASS, OUR DESERT WILLOWS.

AND AGAIN, IT'S AN ENVIRONMENT THAT IS MORE OF A SOUTHWEST THEME.

BUT THERE HAS BEEN NOTHING DONE AND AS NEIGHBORS WHO WE WALK OUR DOGS EVERY NIGHT AND WE PICK UP TRASH.

WE WERE REALLY A VERY ORGANIZED DEVELOPMENT AND WE COMMUNICATE A LOT.

BUT OUR ENTRANCE IS WHAT WE HAVE UNDERSTOOD THAT THAT'S WHAT WE'RE PAYING FOR TO BE MAINTENANCE.

AND I KNOW IT'S OUTSOURCED FROM THE CITY.

IT'S NOT THE CITY'S FAULT, BUT IT'S REALLY IN BAD SHAPE.

OKAY.

ALL RIGHT.

THANK YOU, MR. QUINLAN.

THANK YOU.

WAS THERE ONE OTHER PERSON THAT WANTED TO SPEAK IF YOU'LL COME TO THE PODIUM PLACE? VIRGINIA KEYES, I ALSO AM A VINEYARD RESIDENT, IN ADDITION TO WHAT JEFF SAID, WE HAVE A TREE FARM OUT THERE THAT THE DEVELOPER WILL TELL YOU IS FOR OUR AREA ONLY.

IT'S IN A COMMERCIAL AREA BUT IS IN A RESIDENTIAL AREA, BUT IT'S ACTUALLY COMMERCIAL.

THEY HAVE SOLD ME A TREE THAT WASN'T INCLUDED.

THEY WILL BRING THEIR TRAILER IN AND GET TREES FOR ANOTHER JOB THEY HAVE ELSEWHERE.

THE WEEDS IN THAT TREE FARM ARE ABOUT THIS TALL.

AND SO WE HAVE A TREE FARM THERE THAT IS ACTUALLY COMMERCIAL AND IT NEEDS TO BE MOWED AND WE'VE COMPLAINED AND CAN'T SEEM TO GET ANYTHING DONE.

THANK YOU.

THANK YOU.

I APPRECIATE THAT COMMENT.

IS THERE ANYONE ELSE WISHING TO SPEAK? OK.

IF NOT, I'LL CLOSE THE PUBLIC HEARING AT THIS TIME.

THANK YOU TO MR. JOHNSON, MR. QUINLAN AND MS. KEYES REALLY APPRECIATE THOSE COMMENTS.

AND SO WE CAN WORK WITH KELLY SHAW AND HE CAN GIVE YOU SOME GUIDANCE.

SO THANK YOU ALL.

ALL RIGHT, AT THIS PARTICULAR TIME, WE HAVE ALREADY CLOSED THE PUBLIC HEARING, SO I'LL ASK FOR A MOTION A MOVE TO ADD UP ORDINANCE 7931 WITHIN THE VINEYARD'S PUBLIC IMPROVEMENT DISTRICT TO KEEP THE PROPERTY OWNER ASSESSMENT RATES AT $50 PER LOT FOR A TOTAL ASSESSMENT OF TEN THOUSAND FOUR HUNDRED AND FIFTY DOLLARS, ALONG WITH THE SERVICE PLAN COVERING THE FIVE YEAR PERIOD.

SO THANK YOU.

THANK YOU.

COUNCIL MEMBER SMITH FOR THE MOTION AND COUNCIL MEMBER COLE STANLEY FOR THE SECOND.

ANY OTHER QUESTIONS? YEAH, I GOT A BUNCH.

OKAY.

SO HOW DO WE SEE TO IT? BECAUSE I ASSUME NOW THAT'S FALLING ON OUR RESPONSIBILITY TO SEE TO IT THAT THINGS ARE FULFILLED, THAT ARE SUPPOSED TO BE FULFILLED? OR IS IT THE RESPONSIBILITY OF THEIR HOMEOWNERS ASSOCIATION OR WHATEVER OR THEIR ADVISORY BOARD? HOW CAN A PID GET IN THIS CONDITION? TWO SEPARATE QUESTIONS HERE.

ONE IS AS A CODE ISSUE AND WITH REGARD TO THE ZONING OF THE PROPERTY, HOW IT'S BEING MAINTAINED ON THE TREE PROPERTY.

WITH REGARD TO THE ENTRANCE, IT'S GOING TO BE THE BOARD'S DECISION ON HOW THEY WANT TO GO FORWARD WITH IT BECAUSE ALL WE DO IS AUTHORIZE THE AND FOLLOW THROUGH WITH THE

[02:05:04]

RECOMMENDATIONS FOR EXPENDITURES THAT THEY MAKE.

KELLY? WELL, WHAT WE WOULD DO IS IN ANY PID WE WOULD DO HANDLE THIS THE SAME WAY.

WHAT WE WOULD NEED TO DO IS, FIRST OF ALL, ME HEARING THAT FIRST OF ALL, WITH THE ENTRANCE, NOT ONLY JUST THAT ENTRANCE, BUT THE FRONTAGE ALONG BROADWAY THERE, THERE ARE SOME ISSUES THERE WITH MAINTENANCE.

THE DIFFICULTY WITH THAT IS THAT STREET IS ACTUALLY TXDOT RIGHT-OF-WAY AND THEY'RE VERY PARTICULAR ABOUT WHAT CAN AND CAN'T BE DONE IN THEIR RIGHT-OF-WAY.

SO THERE'S ALWAYS SORT OF A GIVE AND TAKE THERE ABOUT HOW THAT, FROM THE FENCE OUT TO THE ROAD, IS MAINTAINED.

STILL WORKING ON THAT.

AS FAR AS THE ENTRYWAY FEATURES THEMSELVES? WELL, WHAT I WILL DO IS I'LL GO GET WITH THE DEVELOPER TO LET HIM KNOW THAT ALSO, BUT TALK WITH THE ADVISORY BOARD MEMBERS.

TELL THEM WHAT WE'VE HEARD.

ALSO GET WITH THE LANDSCAPE MAINTENANCE CONTRACTOR AND GET WITH THEM AND LET THEM KNOW WHAT WE'VE HEARD.

AND SO FROM THAT POINT, IT'S UP TO THEM BASICALLY TO GO AHEAD AND TAKE CARE OF THAT.

THEY HAVE FUNDS TO DO THAT, SO WE NEED TO CHECK ON THAT.

BUT ULTIMATELY, IT'S BASICALLY THE PID ADVISORY BOARD WORKING WITH THEIR CONTRACTOR ON GETTING THOSE KINDS OF THINGS TAKEN CARE OF.

THE TREE FARM.

WE DID GET A CALL OR I RECEIVED A CALL ABOUT THAT AND TALKED TO THE DEVELOPER.

IT'S ZONED AGRICULTURE.

SO A TREE FARM ACTUALLY ZONING WISE, IT COULD BE THERE.

IF THERE'S OVERGROWN WEEDS OR SOMETHING, THAT COULD BE A CODE ISSUE THAT WE CAN HAVE SOMEBODY GO OUT AND LOOK.

WHEN I ASKED THE DEVELOPER WHAT HE WAS USING THE TREES FOR, THOUGH, HE INFORMED ME THAT THOSE TREES WERE FOR THE PROPERTY OWNERS AND LOTS OUT THERE.

IF THERE'S BUSINESS BEING CONDUCTED ELSEWHERE, THAT'S DIFFERENT.

BUT I CAN CHECK INTO THAT IN MORE DETAIL IF I NEED TO, WHICH I WILL.

BUT THAT'S HOW WE WOULD HANDLE THOSE COMMENTS.

WELL, THIS IS KIND OF I MEAN, I JUST THINK LIKE THIS WHOLE SITUATION IS A LITTLE BIT ODD COMPARED TO ANY OTHER YEAR THAT I'VE THIS IS FIFTH YEAR ON COUNCIL TO GO THROUGH THESE PIDS.

THIS IS THE FIRST TIME I'VE EVER SAT HERE AND LISTEN TO.

IT SEEMED LIKE SOMETHING'S JUST BEING TOTALLY NOT BEING DONE.

I MEAN, WHEN WE WERE LIVING IN THE GREENWAYS, WHICH WE DON'T ANYMORE, THEY WERE ALWAYS OUT THERE WORKING ALL THE TIME.

THEY HAD THINGS ALL PLANNED.

IT WAS, THAT WAS PART OF THE IDEA TO BE IN THE PID WAS THAT YOU HAD ALL OF THOSE THINGS TAKEN CARE OF.

SO IT'S A LITTLE DISAPPOINTING TO HEAR THAT WE'VE GOT.

A FIRST TIME, WE'VE GOT THREE PEOPLE ON ONE PARTICULAR PID, AND THEY'RE.

WELL, WE JUST RECENTLY PUT SOME INFORMATION ON OUR WEBSITE TO GET MORE INFORMATION OUT THERE ABOUT OUR PUBLIC IMPROVEMENT DISTRICTS.

THAT INCLUDES A CONTACT NUMBER, YOU KNOW, AND YOU CAN ALWAYS CALL DEVELOPMENT SERVICES IF YOU HAVE ANY KIND OF A COMPLAINT WITH A PID.

AND BE HONEST WITH YOU, IT'S WE HAVE HAD COMPLAINTS BEFORE AND WE SOMETIMES IRRIGATION HAS BEEN LEFT ON OR, YOU KNOW, THE SENSORS AREN'T WORKING AND IT'S WATERING.

AND DURING A RAINSTORM, WE'VE HAD GEYSERS SHOOTING UP WITH THE CONTRACTOR KNOCKING OFF ROADERS.

SO IT'S NOT UNCOMMON TO HAVE COMPLAINTS, BUT IF SOMETHING LIKE THAT JUST LOOKS LIKE IT'S BEING NEGLECTED, I THINK THAT'S A LITTLE DIFFERENT.

AND SO JUST NEED TO GET WITH THE THE ADVISORY BOARD AND THE CONTRACTOR AND SEE WHAT'S GOING ON.

THANK YOU, COUNCIL MEMBER SAUER.

THAT'S A GOOD QUESTION.

ANY OTHER QUESTIONS? OK, IF NOT, I'LL CALL FOR THE QUESTION.

ALL THOSE IN FAVOR SAY AYE.

AYE.

ALL THOSE OPPOSED? THIS ITEM PASSES WITH A 4-0 VOTE.

[3.G. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7932]

MOVING ON TO AGENDA ITEM 3G, WHICH IS A PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NUMBER 7932.

KELLY? THANK YOU.

MAYOR PRO TEM.

THIS IS A PUBLIC HEARING TO CONSIDER THE QUAIL CREEK PID 2021-22 ASSESSMENT THAT ASSESSMENTS DETERMINED BY A FLAT RATE AS WELL.

THE RATE IS THREE HUNDRED AND FIFTY DOLLARS PER LOT.

THERE IS NO CHANGE IN THE ASSESSMENT THIS YEAR.

THE TOTAL ASSESSMENTS ARE BEING PROJECTED TO BE TOTAL TEN THOUSAND ONE HUNDRED AND FIFTY DOLLARS.

THE TOTAL EXPENSES ARE PROJECTED TO BE TEN THOUSAND EIGHT HUNDRED AND FIFTY SIX DOLLARS.

AS FAR AS THE FIVE YEAR PLAN, THE CURRENT ASSESSMENT REVENUE IS ADEQUATE TO

[02:10:01]

COVER MAINTENANCE COSTS AT THIS TIME.

THEIR SURPLUS IS GETTING IS DWINDLING DOWN, SO THAT MAY BE SOMETHING THEY'RE GOING TO HAVE TO LOOK AT IN THE NEXT FEW YEARS.

BUT THAT'S SOMETHING THAT WE LOOK AT EVERY YEAR WITH THE BOARD.

BUT CURRENTLY THE ASSESSMENT REVENUE IS ADEQUATE TO COVER THE MAINTENANCE COSTS.

THEIR BOARD MET ON MAY 25TH AND UNANIMOUSLY RECOMMENDED APPROVAL OF THE BUDGET AND FIVE YEAR SERVICE PLAN IS PRESENTED.

OKAY, THANK YOU.

ANY QUESTIONS, COUNCIL? DO THE BOARDS JUST MEET ONCE A YEAR? THEY CAN MEET AS MANY TIMES AS THEY WANT, BUT THEY'RE REQUIRED TO AT LEAST MEET ONCE A YEAR TO LOOK AT A BUDGET AND PASS A BUDGET.

OKAY.

THE ONLY REASON I'M ASKING THAT IS, YOU KNOW, I'VE BEEN LISTENING TO THE DATE YOU'VE BEEN SAYING SO FAR, LIKE THIS ONE'S THE FURTHEST ONE AWAY SO FAR, BUT THEY'RE ALL BEEN IN JUNE.

SO THAT'S, YOU KNOW, THAT'S QUITE A WHILE SINCE NOW.

SO I WAS JUST CURIOUS HOW OFTEN SOME MEET.

SOME MEET, VERY SOME ONLY MEET ONCE A YEAR.

THE SMALLER ONES, BASICALLY SOME OF OUR LARGER ONES MEET SEVERAL TIMES A YEAR.

OK.

JUST CURIOUS.

THANK YOU.

OKAY.

ANY OTHER QUESTIONS? AT THIS TIME, WE'LL OPEN A PUBLIC HEARING.

IF YOU WISH TO MAKE A COMMENT DURING THIS PUBLIC HEARING, PLEASE COME FORWARD, STATE YOUR NAME.

AND IF YOU LIVE WITHIN THE AMARILLO CITY LIMITS, YOU WILL HAVE THREE MINUTES.

IS THERE ANYONE WISHING TO SPEAK FOR OR AGAINST THIS ITEM? SEEING NONE, I'LL CLOSE THE PUBLIC HEARING AND I'LL ASK FOR THE MOTION.

I'D LIKE TO MAKE A MOTION TO ADOPT ORDINANCE 7932, WITHIN THE QUAIL CREEK PUBLIC IMPROVEMENT DISTRICT TO KEEP THE PROPERTY OWNER ASSESSMENT RATES AT THREE HUNDRED AND FIFTY DOLLARS PER LOT FOR A TOTAL ASSESSMENT OF TEN THOUSAND ONE HUNDRED AND FIFTY DOLLARS, ALONG WITH THE SERVICE PLAN COVERING A FIVE YEAR PERIOD.

THANK YOU.

COUNCIL MEMBER STANLEY, DO I HAVE A SECOND? SECOND.

OK, I HAVE A SECOND FROM COUNCIL MEMBER SAUER.

ALL THOSE IN FAVOR BY SAYING AYE.

AYE.

ALL THOSE OPPOSED? THAT PASSES WITH A 4-0 VOTE.

[3.H. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7933 ]

MOVING ON TO AGENDA ITEM 3H, WHICH IS A PUBLIC HEARING IN CONSIDERATION OF ORDINANCE NUMBER 7933.

KELLY? THANK YOU, MAYOR PRO TEM.

THIS PUT THIS PUBLIC HEARINGS TO CONSIDER THE [INAUDIBLE] PUBLIC IMPROVEMENT DISTRICT 2021-22 ASSESSMENT.

THE ASSESSMENT FOR THE [INAUDIBLE] PID IS CALCULATED BY USING A FLAT RATE FOR EACH LOT.

THE LOT RATE IS SIX HUNDRED AND SEVENTY FIVE, OR I'M SORRY, SIX HUNDRED AND SEVENTY NINE DOLLARS.

AGAIN, THIS IS NO CHANGE.

THEY'VE HAD THE SAME ASSESSMENT AMOUNT FOR MAYBE 10 YEARS.

TOTAL ASSESSMENTS BEING PROJECTED TO BE SIXTEEN THOUSAND TWO HUNDRED AND NINETY SIX DOLLARS.

TOTAL EXPENSES BEING PROJECTED TO BE TWENTY THOUSAND FIVE HUNDRED AND FORTY THREE DOLLARS AS FAR AS THE FIVE YEAR SERVICE PLAN.

THE CURRENT ASSESSMENT REVENUE IS ADEQUATE TO COVER MAINTENANCE COSTS AT THIS TIME.

I JUST WANTED TO POINT OUT THE DIFFERENCE THERE.

THE TOTAL ASSESSMENTS ARE ABOUT $16000 IN EXPENSES OR $20000, SO ONCE AGAIN THEY'RE USING UP.

THEY BUILT UP QUITE A BIT OF SURPLUS, BUT THEY'RE DOING QUITE A BIT OF MAINTENANCE LATELY.

SO THAT'S SORT OF EATING INTO THEIR SURPLUS.

SO THEY WE MIGHT NEED TO LOOK AT THAT ALSO HERE IN A FEW YEARS.

THEIR BOARD MET MAY 18TH AND UNANIMOUSLY RECOMMENDED APPROVAL OF THE PROPOSED BUDGET AND FIVE YEAR SERVICE PLAN.

OKAY, THANK YOU, KELLY.

COUNCIL, DO YOU HAVE ANY QUESTIONS FOR KELLY? OK.

AT THIS TIME, I'LL OPEN A PUBLIC HEARING.

IF YOU WISH TO MAKE A COMMENT DURING THIS PUBLIC HEARING, PLEASE COME FORWARD, STATE YOUR NAME.

AND IF YOU LIVE WITHIN THE AMARILLO CITY LIMITS, YOU'LL HAVE THREE MINUTES.

IS THERE ANYONE THAT WISHES TO SPEAK FOR OR AGAINST THIS ITEM? SEEING NONE, I WILL CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.

MAYOR PRO TEM, I MOVE TO ADOPT ORDINANCE NUMBER 79336 WITHIN THE [INAUDIBLE] PUBLIC IMPROVEMENT DISTRICT TO KEEP THE PROPERTY OWNER ASSESSMENT RATES AT SIX SEVENTY NINE PER LOT FOR A TOTAL ASSESSMENT OF SIXTEEN THOUSAND TWO HUNDRED AND NINETY SIX DOLLARS, ALONG WITH THE SERVICE PLAN COVERING A FIVE YEAR PERIOD.

I HAVE A MOTION FROM COUNCIL MEMBER SAUER.

DO I HAVE A SECOND? SECOND.

SECOND FROM COUNCIL MEMBER SMITH.

ALL THOSE IN FAVOR SAY AYE.

AYE.

ALL THOSE OPPOSED.\ THIS ITEM PASSES WITH A4-0 VOTE.

[3.I. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7934]

MOVING ON TO AGENDA ITEM 3I, PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NUMBER 7934.

KELLY? THANK YOU.

THIS PUBLIC HEARING IS TO CONSIDER THE COLONIES PUBLIC IMPROVEMENT DISTRICT 2021-22 ASSESSMENT.

[02:15:01]

THE ASSESSMENTS DETERMINED BY APPLYING A RATE OF 10 CENTS PER SQUARE FOOT OF THE LOT.

THIS IS THERE'S NO CHANGE IN THIS ASSESSMENT RATE FROM THE PAST FEW YEARS.

TOTAL ASSESSMENTS ARE BEING PROJECTED TO TOTAL ONE OR I'M SORRY, ONE MILLION TWENTY NINE THOUSAND EIGHT HUNDRED AND NINETY FIVE DOLLARS.

TOTAL EXPENSES ARE PROJECTED TO BE ONE MILLION NINETY SIX THOUSAND FIVE HUNDRED AND THIRTY ONE DOLLARS AS FAR AS THEIR FIVE YEAR SERVICE PLAN.

THE CURRENT ASSESSMENT REVENUE IS ADEQUATE TO COVER MAINTENANCE COSTS, AS WELL AS DEBT SERVICE PAYMENTS, WHICH ARE RESULT FROM THE DEVELOPER REIMBURSEMENTS.

SO AT THIS TIME, CURRENT ASSESSMENT REVENUES ARE ADEQUATE.

THE BOARD COLONIES PID BOARD MET ON JUNE 24TH AND UNANIMOUSLY RECOMMENDED APPROVAL OF THIS BUDGET AND FIVE YEAR SERVICE PLAN.

I WILL MENTION SOMETHING ODD ON THIS ONE.

[3.J. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7935]

MOVING ON TO AGENDA ITEM 3J, WHICH IS A PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NUMBER 7935.

THANK YOU, MAYOR PRO TEM.

THIS IS A PUBLIC HEARING TO CONSIDER THE GREENWAYS PUBLIC IMPROVEMENT DISTRICT 2021-22 ASSESSMENT.

THE GREENWAYS ASSESSMENT IS BASED ON A PER LOT RATE.

DEPENDS ON WHAT TYPE A LOT YOUR LOT IS DESIGNATED AS THERE ARE FOUR DIFFERENT TYPES OF LOTS.

THERE'S A LOT, B LOT, D LOT AND C LOT, WHICH IS COMMERCIAL LOT.

JUST REAL.

BRIEFLY, THE A LOTS ARE THE LOTS THAT ARE ADJACENT DIRECTLY DIRECTLY ADJACENT TO THE PARKWAYS.

THE B LOTS ARE BASICALLY ANY OTHER LOT THAT AREN'T ADJACENT TO THE PARKWAYS.

THE D LOTS ARE THOSE LOTS THAT ARE ALONG TUSCANY DRIVE, WHICH HAVE THEIR OWN MEDIANS AND IMPROVEMENTS WITHIN THAT STREET.

SO THE A LOT ASSESSMENT THIS YEAR IS SEVEN HUNDRED AND FIFTY DOLLARS.

B LOT ASSESSMENT IS SIX HUNDRED AND TWENTY FIVE DOLLARS.

D LOT, WHICH IS ONE HUNDRED AND TWENTY PERCENT OF THE A LOT IS $900, AND COMMERCIAL ASSESSMENTS COME OUT TO ABOUT $1800 AN ACRE.

THERE IS NO CHANGE IN THESE ASSESSMENT AMOUNTS FROM LAST YEAR.

TOTAL ASSESSMENTS ARE BEING PROJECTED TO TOTAL SIX HUNDRED AND SEVENTY ONE THOUSAND TWO HUNDRED AND NINETEEN DOLLARS.

TOTAL EXPENSES ARE PROJECTED TO BE SEVEN HUNDRED AND SIXTY ONE THOUSAND SEVENTY FOUR DOLLARS AS FAR AS THEIR FIVE YEAR SERVICE PLAN.

THE CURRENT ASSESSMENT REVENUES ARE ADEQUATE TO COVER MAINTENANCE COSTS AND DEBT SERVICE PAYMENTS.

THEIR DEVELOPERS ARE AND THEIR DEVELOPERS JUST ABOUT FULLY REIMBURSED.

SO ONCE ONCE THAT'S DONE, THEN WE WON'T BE ISSUING ANY MORE BONDS FOR THEM.

THEIR ADVISORY BOARD MET ON JUNE 16TH AND UNANIMOUSLY RECOMMENDED APPROVAL OF THE BUDGET AND FIVE YEAR SERVICE PLAN THAT'S BEING PRESENTED.

OKAY, THANK YOU, KELLY.

COUNCIL, ANY QUESTIONS? AT THIS TIME, WE'LL OPEN A PUBLIC HEARING.

IF YOU WISH TO MAKE A COMMENT DURING THIS PUBLIC HEARING, PLEASE COME FORWARD, STATE YOUR NAME.

I MOVE TO THAT ORDINANCE 7935 WITHIN THE GREENWAYS PUBLIC IMPROVEMENT DISTRICT

[02:20:03]

TO KEEP THE PROPERTY OWNER ASSESSMENT RATES AT SEVEN HUNDRED AND FIFTY FOUR TYPE A LOTS, SIX TWENTY FIVE FOR TYPE B LOTS, $900 FOR TYPE D LOTS IN EIGHTEEN HUNDRED SEVENTY FIVE DOLLARS PER ACRE FOR COMMERCIAL PROPERTY, FOR A TOTAL ASSESSMENT OF SIX HUNDRED AND SEVENTY ONE THOUSAND TWO HUNDRED AND EIGHTEEN DOLLARS.

ALONG WITH THE SERVICE PLAN COVERING A FIVE YEAR PERIOD.

I HAVE A MOTION FROM COUNCIL MEMBER SMITH.

DO I HAVE A SECOND? SECOND.

I HAVE A SECOND FROM COUNCIL MEMBER SAUER.

ALL THOSE IN FAVOR BY SAYING AYE.

AYE.

ALL THOSE OPPOSED? THIS ITEM PASSES WITH A 4-0 VOTE.

[3.K. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7936]

MOVING ON TO AGENDA ITEM 3K, WHICH IS A PUBLIC HEARING IN CONSIDERATION OF ORDINANCE NUMBER 7936.

KELLY? THANK YOU, MAYOR PRO TEM.

THIS PUBLIC HEARING IS TO CONSIDER THE PINNACLE PUBLIC IMPROVEMENT DISTRICT'S 2021-22 ASSESSMENT.

THAT ASSESSMENT IS DETERMINED BY APPLYING A RATE OF SEVEN CENTS PER SQUARE FOOT OF THE LOT.

THERE'S NO CHANGE IN THIS ASSESSMENT AMOUNT.

TOTAL ASSESSMENTS ARE PROJECTED TO BE EIGHTY FIVE THOUSAND EIGHT HUNDRED AND TWENTY THREE DOLLARS.

TOTAL EXPENSES ARE PROJECTED TO BE FIFTY FOUR THOUSAND EIGHT HUNDRED DOLLARS.

AS FAR AS THEIR FIVE YEAR SERVICE PLAN, GIVING THE TIMING OF THE IMPROVEMENTS, THIS IS A BRAND NEW PUBLIC IMPROVEMENT DISTRICT.

THEY ARE RIGHT IN THE MIDDLE OF THEIR FIRST IMPROVEMENT PROJECT, ACTUALLY.

GIVEN THE TIMING OF THOSE IMPROVEMENTS IN THE CURRENT ASSESSMENT REVENUES.

IT'S MORE THAN ADEQUATE TO COVER THE MAINTENANCE AS WELL AS ESTABLISH THOSE ADEQUATE RESERVES THAT WE TALKED ABOUT.

THEIR ADVISORY BOARD MET ON MAY 21ST AND UNANIMOUSLY RECOMMENDED APPROVAL OF THE PROPOSED BUDGET FIVE YEAR SERVICE PLAN.

OKAY, THANK YOU, KELLY.

ANY QUESTIONS, COUNCIL? OK, AT THIS TIME, I'LL OPEN A PUBLIC HEARING.

IF YOU WISH TO MAKE A COMMENT DURING THIS PUBLIC HEARING, PLEASE COME FORWARD, STATE YOUR NAME.

AND IF YOU LIVE WITHIN THE AMARILLO CITY LIMITS, YOU'LL HAVE THREE MINUTES.

IS THERE ANYONE WISHING TO SPEAK FOR OR AGAINST THIS ITEM? SEEING NONE, I WILL CLOSE THE PUBLIC HEARING AND ASK FOR A MOTION.

I'D LIKE TO MAKE A MOTION TO ADOPT ORDINANCE 7936 WITHIN THE PINNACLE OF PUBLIC IMPROVEMENT DISTRICT TO KEEP THE PROPERTY OWNER ASSESSMENT RATES AT POINT ZERO SEVEN PER SQUARE FOOT FOR A TOTAL ASSESSMENT OF EIGHTY FIVE THOUSAND EIGHT HUNDRED AND TWENTY THREE DOLLARS, ALONG WITH THE SERVICE PLAN COVERING A FIVE YEAR PERIOD.

OKAY, THANK YOU.

I HAVE A MOTION FROM COUNCIL MEMBER STANLEY AND A SECOND FROM COUNCIL MEMBER SAUER.

ALL THOSE IN FAVOR BY SAYING AYE.

AYE.

ALL THOSE OPPOSED? THIS ITEM PASSES WITH A 4-0 VOTE.

THE THE NEXT AND FINAL ITEM ON TODAY'S AGENDA IS ITEM 3I, AND THAT'S A PUBLIC I'M

[3.L. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7937]

SORRY, 3L AND THAT'S A PUBLIC HEARING AND CONSIDERATION FOR ORDINANCE NUMBER 7937.

THANK YOU, MAYOR PRO TEM.

LAST BUT NOT LEAST, THIS IS OUR PUBLIC HEARING TO CONSIDER THE HERITAGE HILLS PUBLIC IMPROVEMENT DISTRICT 2021-22 ASSESSMENT.

THIS ASSESSMENT IS DETERMINED BY APPLYING A RATE OF EIGHT CENTS PER SQUARE FOOT OF THE LOT.

THERE IS NO CHANGE IN THIS ASSESSMENT RATE, EITHER.

TOTAL ASSESSMENTS ARE PROJECTED TO BE FOUR HUNDRED AND TWENTY SEVEN THOUSAND THREE HUNDRED AND SIXTY FOUR DOLLARS.

TOTAL EXPENSES ARE PROJECTED TO BE ONE HUNDRED AND FORTY THOUSAND TWO HUNDRED AND FORTY SEVEN DOLLARS.

AS FAR AS THEIR FIVE YEAR SERVICE PLAN, GIVING THE TIMING OF IMPROVEMENTS THAT ARE CURRENTLY UNDERWAY AND ALSO THE FUTURE PLANNED IMPROVEMENTS, THE CURRENT ASSESSMENT REVENUES ARE MORE THAN ADEQUATE TO COVER THE MAINTENANCE AS WELL AS ESTABLISH ADEQUATE RESERVES.

THEY'VE GOT QUITE A BIT OF RESERVES AND AGAIN, LIKE I ALLUDED TO TO THE CITIZEN OUT THERE AT THE VINEYARDS, WE THEY HAD QUITE A BIT OF SURPLUS BUILT UP, AND IT WAS ALSO SOME OF THAT SURPLUS WAS USED TO REIMBURSE THE DEVELOPER FOR SOME OF THOSE IMPROVEMENT COSTS.

SO THAT WAS ONE WAY THAT THEY USED THERE.

THE BOARD FELT, WOULD BE A GOOD USE OF THEIR RESERVES.

THE BOARD MET ON JUNE 16TH AND UNANIMOUSLY RECOMMENDED APPROVAL OF THIS BUDGET AND FIVE YEAR SERVICE PLAN.

OKAY, THANK YOU, KELLY.

COUNCIL, ANY QUESTIONS? THIS TIME WE'RE OPEN A PUBLIC HEARING.

IF YOU WISH TO MAKE A COMMENT DURING THIS PUBLIC HEARING, PLEASE COME FORWARD, STATE YOUR NAME AND IF YOU LIVE WITHIN THE AMARILLO CITY LIMITS, YOU'LL HAVE THREE MINUTES.

IS THERE ANYONE WISHING TO SPEAK FOR OR AGAINST THIS ITEM? SEEING NONE, I WILL CLOSE THE PUBLIC HEARING AND ASK FOR MOTION.

MOVE TO ADOPT ORDINANCE NUMBER 7937 WITHIN THE HERITAGE HILLS PID PUBLIC
