THANK YOU SO MUCH, WE APPRECIATE THOSE WORDS AND WE APPRECIATE THE TIME YOU SPENT TO BE WITH US TODAY. THANK YOU SO MUCH. THANK YOU. THE NEXT THING ON OUR AGENDA IS PUBLIC ADDRESS, AND WE DO HAVE ONE PERSON [PUBLIC ADDRESS] SIGNED UP TO SPEAK TODAY, SO STEPHANIE IF YOU'LL ADD THEM TO OUR PANEL, PLEASE. MAYOR, WE HAVE MERCY MURGUÍA SIGNED UP AND MERCY YOU SHOULD BE ABLE TO SPEAK AT THIS TIME. AND JUST A REMINDER, BE A TOPIC THAT'S ON THE AGENDA TODAY. PLEASE. ABSOLUTELY, JUST CONFIRMING YOU CAN HEAR ME OK? YES, WE CAN HEAR YOU. PERFECT. THANK YOU AGAIN. AGAIN THANK YOU, STEPHANIE, FOR THE INTRODUCTION THIS IS COMMISSIONER MERCY MURGUÍA. AND I'M SPEAKING SPECIFICALLY ON A NON CONSENT ITEM 3A ORDINANCE 7866 ORDERING A SPECIAL ELECTION FOR NOVEMBER 3RD 2020 TO VOTE ON PROPOSED AMENDMENTS TO THE AMARILLO CITY CHARTER. I WANTED TO GIVE JUST A COUPLE OF COMMENTS AND I WILL ABSOLUTELY BE MINDFUL OF MY TIME MAYOR. SO THANK YOU FOR ALLOWING ME THE FORUM. I WANTED TO START WITH JUST A QUICK THANK YOU TO THE CITIZENS COMMITTEE. I DEFINITELY KNOW ON A PERSONAL LEVEL THE AMOUNT OF EFFORT THAT IT TAKES TO GO THROUGH THIS LEVEL OF DETAIL. AND THE CITIZENS COMMITTEE REALLY DID YEOMAN'S JOB OF GOING THROUGH THAT DETAIL. AND SO I WANTED TO PUBLICLY COMMEND THEM AND THANK THEM FOR THEIR WORK AND THEIR FINAL PROPOSAL THAT THEY'VE GIVEN TO THE CITY COUNCIL. I WANT TO SPECIFICALLY CALL OUT TWO ITEMS THAT I THINK WERE FAILED TO BE ADDRESSED. ONE, THE CURRENT SIZE OF THE COUNCIL. SECOND IS THE DISTRICT REPRESENTATION ON THE COUNCIL. SO EACH OF YOU SHOULD HAVE RECEIVED A TWO PAGE DOCUMENT FROM ME SPECIFICALLY. REALLY TO GIVE A RECAP, I, OF COURSE, DID NOT WANT TO SURPRISE IN TERMS OF GIVING PUBLIC COMMENT, BUT I DO THINK THIS PARTICULAR ISSUE REALLY GOES BACK TWENTY TO TWENTY FIVE YEARS IN OUR COMMUNITY. AND I WANTED TO GIVE A PUBLIC COMMENT. I REQUESTED THE CITY THAT THIS COMMITTEE WORKED OFF TO GIVE THEIR OTHER RECOMMENDATIONS, JUST REALLY TRYING TO COMPARE APPLES TO APPLES AND REALLY TWO ENDS OF THE SPECTRUM. ONE WAS HOUSTON, ROUGHLY TWO POINT ONE MILLION CITIZENS IN THAT COMMUNITY AND THEN BRYAN AROUND SEVENTY SIX THOUSAND. SO I'LL JUST TALK JUST A LITTLE BIT ABOUT BRYAN, BECAUSE THAT'S ON THE SMALLER END OF THE SPECTRUM. AND EVEN AT THAT SIZE OF CITY, YOU SEE MORE COUNCIL MEMBERS THAN WHAT WE HAVE CURRENTLY AND YOU SEE DISTRICT REPRESENTATION. THAT IS A VERY COMMON THEME THAT OBVIOUSLY WE SEE CURRENTLY. AND THEN THE SECOND PAGE OF MY DOCUMENT AND AGAIN, YOU SHOULD HAVE RECEIVED THAT IS MORE OF A COMPARISON OF WHAT I CALL KIND OF A LIKE TO LIKE REALLY THE FRAMEWORK AROUND THAT IS THE POPULATION OF THOSE CITIES. SO CITIES LIKE SIZE OF AMARILLO AND YOU WILL SEE ON THAT DOCUMENT THAT AMARILLO STILL HAS THE FEWEST MEMBERS ON THE COUNCIL AND WE ARE ONE OF FEW LEFT WITH ONLY AN AT LARGE [INAUDIBLE]. SO I WANTED TO PUBLICLY CALL THAT OUT. AND AGAIN, I DID WANT TO PROVIDE THAT DOCUMENTATION IN ADVANCE AND ENCOURAGE THE COUNCIL TO DISCUSS THOSE TWO KEY ITEMS BEFORE FORMALLY ADOPTING CHARTER CHANGES. WE KNOW THAT THESE LEVEL OF CHANGES DO REQUIRE CHARTER SUPPORT, CHARTER CHANGE SUPPORT, AND THAT PARTICULAR TOPIC OBVIOUSLY DOES NOT COME AROUND OFTEN. SO THOSE ARE ALL OF MY COMMENTS. AND THANK YOU AGAIN FOR YOUR TIME AND FOR THE WORK THAT YOU DO TO REPRESENT OUR CITY. THANK YOU. STEPHANIE. ANY OTHER PEOPLE SIGNED UP THAT WE NEED TO INCLUDE ON THE PANEL TODAY? NO, MA'AM, THERE ARE NO OTHER COMMENTERS TODAY. OK, THANK YOU VERY MUCH. [A. Review agenda items for regular meeting and attachments] WE'LL MOVE ON THEN TO AGENDA 1A REVIEW OF THE AGENDA ITEMS FOR THE REGULAR MEETING AND ATTACHMENTS. WE DO HAVE QUITE AN EXTENSIVE CONSENT AGENDA TODAY, COUNCIL. SO IS THERE ANYTHING THERE THAT YOU NEED FURTHER EXPLANATION OR YOU HAVE QUESTIONS ON UP FRONT BEFORE WE GET TO THAT? MAYOR, I DO NOT. SEEING NOBODY. OK. I THINK ELAINE OR COUNCIL MEMBER HAYS HAS ONE. OH YOU DO HAVE YOUR HAND UP. THANK YOU, JARED. YES ELAINE. AND WE CAN HANDLE IT NOW OR WHEN WE GET TO THAT. BUT I DID WANT JUST A BRIEF UPDATE ON ITEM H. I KNOW THAT IS AN EXTENSION ON THE TIMELINE, BUT I WOULD BE VERY INTERESTED IN JUST HEARING KIND OF WHERE WE ARE ON THAT PROJECT, WHERE THEY ARE ON THAT PROJECT. JARED IS THAT SOMETHING THAT ANDREW COULD GIVE REAL QUICK. YES, MA'AM. I'M SURE HE CAN. ANDREW, CAN YOU GO AHEAD AND GIVE US A BRIEF UPDATE ON THAT AND THEN ALLOW COUNCIL TO ASK ANY QUESTIONS THEY GOT. OF COURSE. SO AS FAR AS THE STATUS OF THEIR PROJECT, THEY WERE ABLE TO GET A PERMIT ISSUED ON JUNE 2ND, BUT THEY WEREN'T ABLE TO START ACTUALLY MOVING DIRT ON THE PROJECT UNTIL AFTER JULY [00:10:01] 4TH. SO THEY HAVE EXPERIENCED A LITTLE BIT OF DELAYS WITH THE CONSTRUCTION PROCESS. SO THEY WERE INTERESTED IN GETTING THIS EXTENSION AS TO ALLOW JUST A LITTLE MORE TIME TO MAKE SURE THEY MET, MET THE DEADLINES. THE ORIGINAL AGREEMENT CALLS FOR A CMO BY FEBRUARY 28TH. THIS NEW ONE WOULD ALLOW AN EXTENSION TO AUGUST 31ST, BUT THEY STILL ANTICIPATE BEING DONE AROUND MARCH. SO REALLY, THIS IS GOING TO GIVE A LITTLE FLEXIBILITY, NOT KNOWING HOW COVID IS GOING TO AFFECT CONSTRUCTION TIMELINES AND THE LIKE. SO BUT YES, THEY'RE THEY'RE MOVING RIGHT ALONG AND THEY'RE VERY EXCITED TO SEE DIRT MOVING AND SEEING THE PILES OF DIRT THERE ON AMARILLO BOULEVARD. SO IT IS FULL STEAM AHEAD. THANK YOU, ANDREW. I JUST DEFINITELY WANTED TO HEAR THAT THAT UPDATE. I MEAN, THIS IS JUST ONE OF THE IT'S JUST THE EPITOME OF THE TYPE OF PROJECT THEY DON'T COME ALONG A LOT. JUST MEET SO MANY OF THE THE GOALS THAT WE HAVE IN OUR NEIGHBORHOOD REDEVELOPMENT PROGRAMS AND, YOU KNOW, THE COMBINATION OF JOBS, NEW CONSTRUCTION, THE GENERATION OF A PRODUCT THAT IS ACTUALLY GOING TO THAT'S NEEDED BY OTHER BUSINESSES LOCALLY AS WELL AS. AND THEN A BUSINESS THAT BESIDES THE JOBS THAT ARE CREATED, THE SALES TAX COLLECTIONS THAT ARE CREATED AS WELL. AND SO JUST A WIN WIN ON SO MANY FRONTS. SO EXCITED TO HEAR THEIR UPDATE AND THAT THEY'RE MOVING ON. THANK YOU FOR THAT. YES MA'AM. ABSOLUTELY. ANY OTHER ITEMS, COUNCIL, THAT YOU NEED FURTHER EXPLANATION ON? OK, HEARING NONE LET'S MOVE ONTO ITEM 1B A CORONA VIRUS UPDATE. [B. Coronavirus Update] WE'VE GOT CASIE STOUGHTON ONLINE TO GIVE US THE UPDATE AND THEN ANSWER ANY QUESTIONS FROM COUNCIL ON CORONA VIRUS. WE DON'T HAVE ANYONE ELSE PLANNED TO SPEAK, BUT WE DEFINITELY HAVE ALL THE PEOPLE ONLINE TO ANSWER ANY QUESTIONS OR RESPOND TO ANY COMMENTS FROM COUNCIL. SO, CASIE TAKE IT AWAY. THANK YOU, GLAD TO BE BACK HERE IN THE OFFICE. AS OF TODAY THERE ARE A TOTAL OF FOUR THOUSAND NINE HUNDRED AND TWENTY FOUR CASES OF COVID-19 IN OUR COMMUNITY. THREE THOUSAND FOUR HUNDRED AND NINETEEN CASES IN POTTER COUNTY. AND ONE THOUSAND FIVE HUNDRED AND FIVE CASES IN RANDALL COUNTY. WE HAVE A TOTAL OF FOUR THOUSAND FORTY EIGHT RECOVERIES. FIFTY NINE DEATHS IN POTTER AND RANDALL COUNTIES, WHICH LEAVES US WITH A TOTAL OF EIGHT HUNDRED AND SEVENTEEN ACTIVE CASES. THE ACTIVE CASES HAVE CERTAINLY PICKED UP OVER THE LAST FEW WEEKS. EACH OF THE CASES DO REPRESENT A UNIQUE INDIVIDUAL. HOSPITALIZATION DATA INCLUDES FIFTY NINE TOTAL COVID PATIENTS IN OUR TWO AREA HOSPITALS FOR A HOSPITALIZATION RATE OF 7.22 PERCENT. TOTAL ADULT BED UTILIZATION IS AT 70 PERCENT. VENTILATOR UTILIZATION IS AT 51 PERCENT. AND TOTAL, ICU UTILIZATION IS AT 78 PERCENT. THE NUMBERS ARE HIGHER THAN IN WEEKS PAST. IT'S CRITICAL FOR OUR COMMUNITY TO CONTINUE TO WEAR MASKS, MAINTAIN SOCIAL DISTANCING AND PRACTICE GOOD HAND WASHING TO PROTECT OUR HEALTH CARE CAPACITY AND THE HEALTH CARE WORKFORCE. THE PUBLIC HEALTH DRIVE THRU REMAINS OPERATIONAL. THE COMMUNITY CAN CALL THREE SEVEN EIGHT SIX THREE ZERO ZERO TO BE DIRECTED TO THE TEST SITE. SINCE OPENING MARCH 27TH, WE TESTED OVER SIX THOUSAND FIVE HUNDRED AND FIFTY FIVE INDIVIDUALS. SO THAT IS A SUCCESS. WE ARE WORKING WITH EACH OF THE FIVE SCHOOL DISTRICTS ON METHODS AND RECOMMENDATIONS TO KEEP OUR CHILDREN AND STAFF SAFER WITH THE RETURN OF SCHOOLS. WE APPRECIATE THE EFFORTS OF EACH OF THE SCHOOL DISTRICTS. THIS WILL BE AN IMPORTANT TIME IN OUR COMMUNITY AS IT WILL BE ONE OF THE FIRST TIMES WE'VE SEEN LARGE GATHERINGS, ESPECIALLY GATHERINGS OF THIS SIZE. PREVENTION, AGAIN, WILL BE THE KEY TO KEEPING OUR COMMUNITY HEALTHY. THE STAFF AT PUBLIC HEALTH CONTINUE TO WORK THROUGH CONTACT INVESTIGATIONS. WE DO APPRECIATE THE TEAM IN ENVIRONMENTAL HEALTH WHO OFFER THEIR EXPERTISE AND ASSISTANCE AT A MOMENT'S NOTICE. WE DO CONTINUE TO WORK THROUGH COMMUNITY SPREAD WITH CLUSTERS AS OPPOSED TO LARGE OUTBREAKS. AND THAT'S THE REPORT I HAVE TODAY. QUESTIONS FROM THE COUNCIL. CASIE DO YOU HAVE, AGAIN, THE CASES IN THE HOSPITAL. CAN YOU GIVE THOSE NUMBERS. THERE'S FIFTY NINE CASES IN THE HOSPITALS. OK, THANK YOU. [00:15:04] ANYTHING ELSE FOR CASIE. OKAY. CASIE. THANK YOU VERY MUCH. MAYOR I KNOW WE HAVE OTHER THINGS GOING ON THAT ARE CORONA VIRUS RELATED, SPECIFICALLY WITH REGARD TO ASSISTANCE GRANTS. I KNOW DR. SAUER HAS BEEN WORKING ON THAT SPECIFICALLY. I DIDN'T KNOW IF DR. SAUER WANTED TO TOUCH ON THAT REAL QUICK, BECAUSE WE'VE GOT ANOTHER PROGRAM COMING OUT PRETTY SOON THAT HE'S BEEN WORKING ON WITH STAFF. YEAH LET ME GO THROUGH, I'LL JUST TOUCH THAT REAL QUICK. SO FAR THE ONE THAT WE HAVE ALREADY RELEASED, THE REIMBURSEMENT PROGRAM FOR DIRECT REIMBURSEMENT FOR COSTS THAT DIFFERENT BUSINESSES HAVE HAD. THAT PROGRAM GIVES PEOPLE OR BUSINESSES THE OPPORTUNITY TO BE REIMBURSED FOR ACTUAL RECEIPTS THAT THEY'VE SUBMITTED UP TO FIVE THOUSAND DOLLARS. AND SO WE'VE HAD FIFTY NINE ENTITIES SUBMIT SO FAR FOR A TOTAL OF ONE HUNDRED AND TWELVE THOUSAND DOLLARS PLUS. SO THAT'S AN AVERAGE OF ABOUT NINETEEN HUNDRED DOLLARS PER SUBMISSION. SO FORTY SEVEN OF THEM HAVE BEEN REVIEWED SO FAR AND FORTY TWO OF THEM HAVE BEEN PAID AND WE HAVE PAID OUT SEVENTY SIX THOUSAND SIX HUNDRED AND SIXTY THREE DOLLARS SO FAR. SO THERE'S STILL A LOT OF ROOM THAT'S COMING OUT OF THE CARE FUNDS THAT COME TO THE CITY. AND SO THERE'S STILL MUCH MORE ROOM AND THOSE CAN BE CONTINUED TO BE SUBMITTED UNTIL DECEMBER THE 30TH. AND THEY ARE FOR ANY EXPENSES THAT YOU MAY HAVE ACQUIRED BECAUSE OF THAT LIKE PPE EQUIPMENT, SHIELDS, ALL OF THOSE DIFFERENT KINDS OF THINGS. YOU CAN YOU HAVE THE ABILITY TO HAVE THOSE REIMBURSED. SO STARTING IT WAS ANNOUNCED LAST WEEK. ANDREW ANNOUNCED IT ABOUT THE CORONA RELIEF VIRUS GRANT FOR SMALL BUSINESSES. SO IT'S A GRANT THAT'S UP TO TEN THOUSAND DOLLARS. WHENEVER HE TALKED ABOUT IT LAST WEEK THE INTENTION WAS TO HAVE THAT ONLINE AND AVAILABLE AS OF TODAY, BUT THEY'RE STILL FINISHING UP JUST SOME FINAL FINE TUNING ON THE ACTUAL APPLICATION AND GETTING EVERYTHING DONE AS FAR AS GETTING IT AVAILABLE ON THE WEBSITE. AND SO IT SHOULD BECOME LIVE TOMORROW. AND JUST TO KIND OF TOUCH ON THAT REAL QUICK, IT'S UP TO TEN THOUSAND DOLLARS PER ENTITY. AND HERE'S THE BASIC THINGS THAT HAVE TO HAPPEN. THE BUSINESS PRIMARY LOCATION MUST BE PHYSICALLY IN THE CITY LIMITS OF AMARILLO. THE BUSINESSES WILL BE 50 OR FEWER FULL TIME EQUIVALENT EMPLOYEES. YOU'LL ONLY SUBMIT ONE APPLICATION FOR THAT. THE BUSINESS IS GOING TO THEN CERTIFY THAT THEY'RE IN GOOD STANDING WITH THE CITY. THEY'RE ALSO GOING TO CERTIFY THAT THEY HAVE NOT USED ANY OTHER FEDERAL FUNDS LIKE PPE I MEAN, PP THE TRIPLE P PROGRAM THAT'S BEEN OUT THERE FEDERALLY. I THINK IT'S GOING TO BE A REALLY GOOD OPPORTUNITY FOR PEOPLE TO JUST IT'S A REAL STRAIGHTFORWARD, EASY FORM FOR THEM TO FILL OUT. IT SHOULD BECOME AVAILABLE TOMORROW ON AMARILLOALERTS.COM, AND THAT WHOLE PACKET WILL BE AVAILABLE FOR THEM. IT'LL BE EASY FOR THEM TO FILL OUT. AND SO THERE'S ABOUT FIVE HUNDRED AND FIFTY THOUSAND AVAILABLE FOR THAT ONE. SO WE'RE TALKING THAT THERE WOULD BE UP TO 50 PLUS BUSINESSES THAT WOULD HAVE THAT OPPORTUNITY TO GET A GRANT, WHICH BASICALLY MEANS YOU'RE NOT GOING TO HAVE TO ONCE YOU HAVE QUALIFIED FOR IT, YOU GET THE GRANT, YOU WON'T HAVE TO NECESSARILY GO BACK AND THEN HAVE TO FILL OUT ANY QUALIFYING WORK AFTER IT'S BEEN DONE. COMMITTEE'S BEEN SET UP BY THE CHAMBER OF COMMERCE. GARY MOLBERG AND JASON HARRISON HAVE HELPED ME PUT TOGETHER A COMMITTEE. THERE'S 12 ON THAT COMMITTEE. THEY COME FROM ALL DIFFERENT PARTS OF THE TOWN HISPANIC CHAMBER, THE AFRICAN-AMERICAN CHAMBER, TEXAS WORKFORCE, BETTER BUSINESS BUREAU, AMARILLO ECONOMIC DEVELOPMENT, AMARILLO AREA FOUNDATION, AND I'M SURE I'M MISSING SOME OF THEM, SO RIGHT OFF THE TOP OF MY HEAD. SO THEY'RE GOING TO GO THROUGH AND TAKE A LOOK AT THESE GRANTS AND THAT WILL START I THINK PROBABLY THAT PART WON'T START BEING REIMBURSED FOR ANOTHER WEEK OR TWO AS APPLICATIONS COME IN. AND THEN THEY'LL GO THROUGH THOSE AND THEY'LL START MAKING THE DECISIONS ON WHO RECEIVES THE GRANTS. SO I THINK IT'S PRETTY EXCITING, IT GIVES AN OPPORTUNITY FOR US TO BE ABLE TO GIVE PEOPLE SOME HELP. I MEAN, THERE'S LOTS OF BUSINESSES THAT HAVE REALLY TAKEN A HIT AS FAR AS ECONOMICALLY. AND THIS IS JUST IT'LL BE A VERY SIMPLISTIC WAY FOR THEM TO BE ABLE TO TO [00:20:03] GET SOME SOME REIMBURSEMENT, HELP SOME MONEY TO HELP THEM WITH THEIR BUSINESSES. THANK YOU. ANY QUESTIONS ABOUT THAT COUNCIL? WE REALLY APPRECIATE YOUR WORK ON THAT. WE AGREE EVERY LITTLE BIT HELPS, EVERY BIT THAT WE CAN HELP, WE WANT TO BE HELPING. OK, JARED, ANYTHING ELSE ON CORONA VIRUS? NO, MA'AM, THAT'S IT. OK, MOVING ON TO ITEM 1C AN UPDATE ON JOE TACO DOWNTOWN LOCATION. [C. Joe Taco Downtown] ALL RIGHT. THEY ARE AT A GOOD POINT RIGHT NOW AND THAT THEY'RE SERVING FOOD AND OPEN TO CUSTOMERS. BUT I WANTED ANDREW FREEMAN TO GIVE YOU A QUICK UPDATE OR ANTHONY, WHICHEVER ONE IS APPROPRIATE ON ON JOE TACO AND WHERE THEY'RE AT RIGHT NOW. SURE, LET ME SHARE MY SLIDE REAL QUICK. KIND OF GAVE IT AWAY RIGHT THERE, DIDN'T HAVE IT ON THE FIRST SIDE, SO ALREADY GOT A PREVIEW. SO JOE TACO AS EVERYBODY KNOWS, IS THE FIRST TENANT HAS LOCATED IN THE PARKING GARAGE, DOWNTOWN RETAIL PARKING GARAGE OWNED BY THE CITY AND COORDINATED BY THE LOCAL GOVERNMENT CORPORATION. THEY TOOK JUST UNDER 5000 SQUARE FEET OF 24000 THAT WE HAD AVAILABLE. IT'S A SIX YEAR COMMERCIAL LEASE THAT WAS APPROVED IN OCTOBER WITH CONSTRUCTION THAT STARTED EARLY THIS YEAR. THE FIRST GOAL WAS INITIALLY TO BE OPEN MAY 1ST, BUT THEY DID HAVE A FEW DELAYS IN THE CONSTRUCTION PROCESS. SO WE WERE ABLE TO AMEND THE AGREEMENT THROUGH THE LGC, CONSIDERING THAT. IT HAD A NEW COMMENCEMENT DATE OF AUGUST 1ST. BUT THEY WERE ACTUALLY ABLE TO GET THEIR CFO A LITTLE BIT EARLY AND IT WAS ISSUED ON JULY 14TH AND THEIR GRAND OPENING TOOK PLACE ON FRIDAY, JULY 17TH, JUST A COUPLE WEEKS AGO. SO I WANTED TO SHOW JUST A LITTLE BIT OF THE PICTURES HERE. THIS IS WHEN THEY FIRST GOT STARTED. AND THEY'RE WORKING ON THE PLUMBING BUT YOU CAN TAKE THE PLUMBING OUT. YOU BASICALLY HAD A DIRT FLOOR, SO THEY STARTED WITH AN EMPTY SHELL TO WORK ON THEIR PROJECT. HERE'S ANOTHER VIEW LOOKING OUT ON BUCHANAN OUTSIDE THE WINDOWS THERE. HERE'S THE AFTER PHOTOS. THIS IS THEIR SEATING AREA, LOOKING OUT ON TO BUCHANAN, WHERE THEY HAVE THE GARAGE DOOR WINDOWS THAT OPEN UP THERE ON THE EAST SIDE. YOU CAN SEE THEY'RE ORDERING ORDERING SCREENS THERE THAT YOU WALK STRAIGHT INTO FROM THE FRONT DOOR. THERE'S A HALLWAY YOU WALK INTO AND I WANT TO SHOW THE [INAUDIBLE] ON THE RIGHT, ACTUALLY PRETTY UNIQUE FOR THE BUILDING. THEY HAD TO GO PICK UP WINDOW ON THE OUTSIDE. SO PERFECT TIMING WITH COVID AND TRYING NOT TO GO INTO BUSINESS YOU CAN JUST WALK UP TO THE WINDOW AND PICK UP YOUR FOOD TO GO. SO THIS ALL OPENED UP JUST A COUPLE OF WEEKS AGO. HERE'S A LOOK AT THE OUTSIDE. THEY ARE STILL FINALIZING THEIR SIGNAGE, SO THEY'LL ACTUALLY HAVE A SIGN HERE ON THE CORNER WITH THE JOE TACO LOGO ON IT. AND THE LAST PICTURE IS FROM JUST VIEWING IT FROM SOUTH ON BUCHANAN. SO THAT'S KIND OF THE HIGHLIGHTS. WE'RE EXCITED TO SEE THAT THEY'VE OPENED UP AND LOOK FORWARD TO MORE INTEREST IN THE NECESSARY RETAIL SPACE THAT WE HAVE TO FILL. AND WE'D BE HAPPY TO ANSWER ANY QUESTIONS YOU ALL MIGHT HAVE. QUESTIONS COUNCIL. NOT A QUESTION, JUST GLAD TO SEE IT OPEN, IT LOOKS FANTASTIC AND WISH THEM GREAT SUCCESS. NOW, I WOULD SAY MINUS FIVE, ANDREW, FOR BRINGING A PRESENTATION ON JOE TACO AND NOT BRINGING CHIPS AND HOT SAUCE FOR US, BUT OTHER THAN THAT. I KNOW. IF WE CAN ONLY START HAVING MEETINGS IN PERSON AGAIN, WE GOT ANOTHER LUNCH OPTION DOWNTOWN. YES, EXACTLY. OK, READY TO MOVE ON THEN TO ITEM 1D. [D. Discuss Convention and Visitor Council] ANDREW, THANK YOU. THE DISCUSSION ON THE CONVENTION AND VISITORS COUNCIL. JARED. RIGHT, WE HAVE BEEN WORKING WITH THE CONVENTION AND VISITORS COUNCIL, ALONG WITH THE CHAMBER OF COMMERCE, TO ADDRESS IMPACTS, FUNDING IMPACTS AND OTHER THINGS FROM CORONA VIRUS. ONE OF THE CHALLENGES WE HAVE IS THAT THAT HAS HAD A SIGNIFICANT IMPACT ON HOTEL OCCUPANCY, TAX REVENUE. SO AS WE LOOKED TOWARD NEXT YEAR'S BUDGET TO MAKE SURE THAT THE CDC CAN BE AS EFFECTIVE AS POSSIBLE. ONE OF THE THINGS WE ALSO DID WAS RESEARCH OTHER CITIES AND HOW THEY HANDLE CONVENTION AND VISITORS ALONG WITH THEIR CHAMBERS OF COMMERCE. WE HAVE GREAT CHAMBER OF COMMERCE HERE. WE'VE HAD GREAT WORK WITH THEM. THEY'VE BEEN MANAGING THE CONVENTION VISITORS COUNCIL SINCE 1982. I BELIEVE IT COULD HAVE BEEN 84 EITHER WAY IT'S BEEN A LONG TIME. ONE OF THE THINGS THAT'S CHANGED IN THAT PERIOD OF TIME IS THAT ALL OF THE CITIES OUR SIZE, THEY HAVE THEIR CONVENTION AND VISITORS COUNCILS AS A STANDALONE ENTITY. SO WE WERE LOOKING TO USE THIS AS AN OPPORTUNITY TO, ONE, SET THE CONVENTION VISITORS [00:25:06] COUNCIL UP TO BE ABLE TO TAKE ADVANTAGE OF THE ECONOMIES OF SCALE THAT THE CITY CAN PROVIDE FROM AN ADMINISTRATIVE STANDPOINT IN ORDER TO BE ABLE TO MAXIMIZE THEIR FINANCIAL EFFECTIVENESS, ESPECIALLY AS THEY GO THROUGH THIS NEXT YEAR. THAT'S GOING TO BE CONTINUED TO SHOW A VERY LIKELY AT LEAST OUR PROJECTIONS SHOW IT'S GOING TO CONTINUE TO PROVIDE DIMINISHED REVENUES ON THE HOTEL OCCUPANCY TAX SIDE. WE HAVE PLENTY OF REVENUE TO TAKE CARE OF THE OPERATIONS THAT WE HAVE TO, INCLUDING CVC, THE CIVIC CENTER AND ALL DEBT SERVICE ASSOCIATED WITH DOWNTOWN PROJECTS. THAT SAID, WE WANT TO MAKE SURE TO SET THEM UP AS EFFECTIVE AND PRODUCTIVE AS THEY CAN POSSIBLY BE GOING FORWARD. SO WE'RE WORKING ON ON DOING THAT. WE'VE NOTIFIED THE CHAMBER OF COMMERCE AND GARY MOLBERG AND THE REST OF THE TEAM OVER AT THE CHAMBER HAVE BEEN GREAT PARTNERS THROUGH THIS PROCESS, EVALUATING OUR OPTIONS. SO WE'RE GOING TO CONTINUE TO HAVE A VERY PRODUCTIVE RELATIONSHIP WITH THE CHAMBER OF COMMERCE AND DON'T WANT ANYBODY TO MISUNDERSTAND WHAT WE'RE WORKING ON HERE. BUT AS WE MOVE FORWARD, WE WILL BE WORKING THROUGH ORGANIZING, STANDING UP THE CVC , THE CONVENTION VISITORS COUNCIL AS A STANDALONE ENTITY, INCORPORATING THEM AS A STANDALONE ENTITY. AND PUTTING TOGETHER THEIR BYLAWS, SETTING UP HOW THE BOARD IS APPOINTED, THINGS LIKE THAT . AND ALSO WORKING THROUGH THE FINANCES OF HOW THEY'RE GOING TO PAY FOR THEIR STAFF AND PAY FOR THEIR, YOU KNOW, ALL THE OTHER THINGS THAT ARE GOING TO BE A PART OF BEING A STANDALONE ENTITY. SO WE ANTICIPATE GETTING ALL THAT DONE PRIOR TO THE OCTOBER 1, BEGINNING OF THE FISCAL YEAR. AND WE'RE STILL WORKING THROUGH THAT THOSE ISSUES, THOUGH. SO I WANTED TO MAKE SURE THAT COUNCIL HAD AN OPPORTUNITY TO ASK ANY QUESTIONS, MAKE ANY STATEMENTS THEY WANTED IN REGARD HERE, STILL WORKING THROUGH THE ORGANIZATIONAL STRUCTURE. WE HAVE A COUPLE OF OPTIONS THERE, EITHER HAVING THE CVC VIA CITY DEPARTMENT, OR STANDING IT UP AS A STANDALONE ENTITY. EITHER WAY, THEY WILL BE INCORPORATED AS AN ENTITY THAT IS WHERE THE BOARD MEMBERS ARE APPOINTED BY COUNCIL, SIMILAR TO THE AMARILLO ECONOMIC DEVELOPMENT CORPORATION AS FAR AS THAT GOES. BUT WE'RE WORKING WITH OTHER CITIES TO GET THEIR ORGANIZATIONAL STRUCTURES, TO MAKE SURE THAT WE'RE NOT UNNECESSARILY REINVENTING THE WHEEL. WE WANT TO TAKE ADVANTAGE OF THE VERY BEST MODELS THERE ARE OUT THERE OR EFFICIENT, EFFECTIVE OPERATIONS OF CONVENTION OF VISITORS COUNCILS IN COMMUNITIES OUR SIZE WITH THE AMOUNT OF HOTEL TRAFFIC THAT WE HAVE AND THE NEED FOR MARKETING OUR ATTRACTIONS. OUR UTILITY HAS A PLACE FOR PEOPLE TO STAY AND AND SPEND THE NIGHT. SO WITH THAT SAID, THERE'S STILL A LOT OF WORK YET TO BE DONE. BUT I WANTED TO GIVE COUNCIL AN OPPORTUNITY TO ASK ANY QUESTIONS THEY HAVE. QUESTIONS. AND WE ALSO HAVE KASHION SMITH AS THE ACTING OR INTERIM EXECUTIVE DIRECTOR TO ANSWER ANY QUESTIONS FROM A CONVENTION VISITORS COUNCIL STANDPOINT. KASHION ANYTHING YOU WANT TO ADD TO THAT REPORT? YOU KNOW, I JUST KIND OF THE THEME OF OUR OFFICE THOROUGH THIS HAS BEEN THAT WHENEVER YOU'RE MET WITH GREAT CHALLENGES, THAT GIVES YOU GREAT OPPORTUNITIES TO MAKE CHANGE AND FIND GROWTH OPPORTUNITIES. SO THAT'S WHAT WE'RE LOOKING AT THIS AS. AND I THINK IT WILL HELP US DEFINE US AS AN OFFICE AND REALLY STICK TO OUR MISSION. SO WE'RE VERY POSITIVE ABOUT THE CHANGES AND WHAT IT WILL DO FOR US MOVING FORWARD. COUNCIL ANY QUESTIONS ABOUT THAT? MAYOR, I WOULD ADD FROM THE CVC MEETING LAST WEEK WHEN KASHION PRESENTED IT AND THERE WERE A COUPLE OF FELT REALLY GOOD OPPORTUNITIES FOR FEEDBACK AND ONE IN THE CONVERSATION OF THE CITY DEPARTMENT VERSUS A STAND ALONE. THERE WAS DEFINITELY SEVERAL OPINIONS EXPRESSED IN PREFERENCE FOR THE STAND ALONE. AND THE CITY MANAGER GAVE AN EXAMPLE LIKE THE EDC, THE LGC IS ANOTHER ENTITY THAT IT'S A STANDALONE, IT OPERATES UNDER THE UMBRELLA OF THE CITY. BUT THAT WOULD FALL UNDER THAT TYPE OF EXAMPLE AS WELL. AND PART FOR INDEPENDENCE, PART FOR EASE OF OPERATION AND PART FOR JUST PERCEPTION THAT THERE IS IS A SENSE OF IF IT'S A CITY DEPARTMENT, IT'S A LITTLE BIT MORE BUREAUCRATIC, MAYBE A LITTLE MORE RED TAPE, JUST NOT A SEPARATE VOICE. AND SO I DID WANT TO PASS ALONG SEVERAL OF THE BOARD MEMBERS PREFERENCE TO LOOK AT THE OPTION ON THE STANDALONE. THE SECOND WAS RELATED TO INCORPORATING ALSO AT THIS TIME, A NAME CHANGE BACK IN 1982 WHEN IT MOVED OUT FROM THE CITY UNDER THE UMBRELLA OF THE CHAMBER, IT WENT FROM A CBB TO A CVC [00:30:02] AND APPARENTLY JUST, YOU KNOW, JUST LANGUAGE, LOGISTICS, JUST THAT CONVERSATION, APPARENTLY WHEN THEY'RE SOMETIMES TRYING TO BOOK EVENTS, HAVE CONVERSATIONS WITH OTHER AGENCIES AROUND THE CITY, IT'S LIKE I MEAN, THE STATE OR NATIONAL, VERY FEW OTHER TOURISM FOCUSED AGENCIES AND DEPARTMENTS ARE A CVC. SO I THINK THAT THAT IS SOMETHING THEY'RE LOOKING AT THAT TIME AS WELL TO REVERT BACK TO BEING A CBB. AND IT HELPS AT LEAST REMOVE ONE HURDLE HURDLE OF TRYING TO EXPLAIN WHAT YOU ARE. I THINK THAT'S A GREAT POINT COUNCIL MEMBER HAYS. IN MY EXPERIENCE, I HAVE NEVER WORKED WITH A CONVENTION VISITORS ORGANIZATION THAT WASN'T A CONVENTION AND VISITORS BUREAU, WHICH IS WHAT THE CVB STANDS FOR. SO THAT WILL ENABLE US TO IF COUNCIL FEELS IT'S APPROPRIATE BECAUSE WE'RE GOING TO BE WORKING WITH COUNCIL TO CREATE THESE ARTICLES OF INCORPORATION. BUT IT WILL ADDRESS ONE OF THE LANGUAGE DIFFERENCES THAT WE HAVE BETWEEN OTHER COMMUNITIES AND OTHER ENTITIES THAT WORK WITH CONVENTION VISITORS ORGANIZATIONS TO SET UP CONVENTIONS TO BOOK BLOCKS OF ROOMS FOR DIFFERENT EVENTS AND THINGS LIKE THAT. SO IT WILL I THINK IT WILL ASSIST US. IT'S A GREAT POINT. THANKS FOR ADDING THAT ELAINE. WE APPRECIATE HEARING THAT COMMENTARY. ANY OTHER COMMENTS OR QUESTIONS FROM THE COUNCIL? OK, WELL, KASHION, THANKS FOR JOINING US TODAY, AND WE LOOK FORWARD TO WORKING WITH YOU ON SETTING THE CVC, MAYBE THE CVB UP FOR WHAT WE KNOW WILL BE LOTS OF FUTURE SUCCESS. WELL, THANK YOU ALL FOR YOUR SUPPORT DURING THIS TIME. OK, SO AT THIS TIME, WE'LL MOVE ON TO ITEM 1E WHICH IS REQUEST FUTURE AGENDA ITEMS OR REPORTS FROM THE CITY MANAGER. DOES ANYBODY ON THE COUNCIL HAVE ANYTHING? NO, MAYOR, I DO NOT. OK, NOT HEARING ANYTHING, WE'RE READY TO MOVE ON TO AGENDA ITEM NUMBER TWO, THE CONSENT [2. CONSENT ITEMS] AGENDA, ANYTHING THERE THAT NEEDS TO BE PULLED OFF FOR FURTHER DISCUSSION OR QUESTIONS? IF NOT, I'D ENTERTAIN A MOTION. MAYOR, I MOVE THAT THE CONSENT AGENDA BE APPROVED AS PRESENTED. IT'S BEEN MOVED BY COUNCIL MEMBER POWELL AND SECONDED BY COUNCIL MEMBER SAUER TO APPROVE THE ITEMS ON THE CONSENT AGENDA. ALL OF THOSE IN FAVOR, PLEASE RAISE YOUR HAND. I SEE FIVE HANDS, SO THAT PASSES WITH THE 5 0 VOTE. MOVING ON TO ITEM [A. CONSIDERATION OF ORDINANCE NO. 7866 -- ORDERING A SPECIAL ELECTION ON NOVEMBER 3, 2020 TO VOTE ON PROPOSED AMENDMENTS TO THE AMARILLO CITY CHARTER; PROVIDING FOR A JOINT ELECTION: AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH ELECTION: (Contact: Kevin Starbuck, Deputy City Manager) This is the first reading of an ordinance calling a special election to be held in the City of Amarillo, Texas on November 3, 2020 and resolving other matters incident and related thereto.] 3A IS TO CONSIDER ORDINANCE NUMBER 7866 WITH REGARD TO A SPECIAL ELECTION ON NOVEMBER 3RD TO VOTE ON PROPOSED AMENDMENTS TO THE AMARILLO CITY CHARTER. JARED, DO WE HAVE A PRESENTATION ON ITEM 3A? WE DON'T HAVE A PRESENTATION. WE DO HAVE JUST A QUICK SUMMARY. WE'VE HAD A NUMBER OF DISCUSSIONS ON THESE ITEMS, BUT IN A ORDINANCE 7866 WE'RE TALKING ABOUT PROPOSITIONS TWO AND THREE. NOW, THIS ASSUMES THAT ITEM F. THAT'S A FUTURE ITEM ON THE AGENDA WILL PASS. IF ITEM F WHICH IS CURRENTLY CALLED PROPOSITION ONE, WHICH IS TO DISCUSS THE BOND ELECTION THAT HAS BEEN POSTPONED FROM MAY TO NOVEMBER. IF THAT DID NOT PASS, IF THE COUNCIL DID NOT CHOOSE TO GO FORWARD WITH THAT THAN THESE WOULD BE PROPOSITION ITEMS ONE AND TWO AND WE'D HAVE TO MODIFY THAT. BUT I JUST WANTED TO EXPLAIN TO YOU RIGHT OFF THE BAT WHY THEY ARE CURRENTLY LISTED AS PROPOSITION ITEMS TWO AND THREE. THESE ARE FOR A VOTE ON AMENDING THE CITY'S CHARTER FOR TWO SPECIFIC ITEMS. PREVIOUSLY AND LAST WEEK THEY WERE THREE ITEMS BECAUSE WE HAD BEEN DISCUSSING PROPOSITION TWO, WHICH IS NOW THE COMBINATION OF COUNCIL TERM, EXTENDING THE COUNCIL TERM AND STAGGERING THE ELECTIONS. THE LANGUAGE ACCOMPLISHES BOTH OF THOSE. WE HAD PREVIOUSLY DISCUSSED THOSE AS TWO SEPARATE ITEMS. HOWARD MADE THE COMMENT OR COUNCIL MEMBER SMITH MADE THE COMMENT THAT WHY ARE WE ASKING THEM AS TWO SEPARATE ITEMS. BECAUSE WE DON'T WANT ONE IF WE DON'T HAVE THE OTHER. SO THE CHALLENGE TO LEGAL WAS, IS THIS SOMETHING THAT IT LOGICALLY IT GOES TOGETHER. SO IS THIS SOMETHING THAT BY THE RULES OF HOW WE SET UP OUR CHARTER AND HOW CHARTER ELECTIONS ARE DONE CAN BE COMBINED. SO WE DID THAT RESEARCH BRYAN MCWILLIAMS AND HIS LEGAL TEAM DID A GREAT DEAL OF WORK ON THAT. AND THE SOLUTION IS VERY SIMPLE AND VERY ELEGANT. YES, WE CAN COMBINE THOSE TWO AS ONE ITEM. [00:35:03] SO PROPOSITION 2 ASKS THE QUESTION ABOUT WHETHER OR NOT WE SHOULD EXTEND OUR TERMS AND MOVE TO STAGGERED ELECTIONS. SO THE TERMS WOULD GO FROM TWO YEAR TERMS TO 4 YEAR TERMS AND TWO OF THE COUNCIL MEMBERS AND THE MAYOR WOULD BE ELECTED IN ONE OF THOSE ELECTIONS THAT OCCUR EVERY TWO YEARS FOR A FOUR YEAR TERM. AND THE OTHER TWO COUNCIL MEMBERS WOULD BE ELECTED IN THE OTHER ELECTION THAT OCCURS EVERY TWO YEARS FOR FOUR YEAR TERMS. THE OTHER ITEM WAS THE PROPOSITION NUMBER THREE DEALS WITH THE FREQUENCY OF COUNCIL MEETINGS, AND IT JUST ASKS THE QUESTION IF THE COUNCIL SHOULD MEET A MINIMUM OF 24 TIMES PER YEAR. WHAT THIS DOES IN PRINCIPLE IS ALLOW THE COUNCIL TO MEET EVERY OTHER WEEK INSTEAD OF EVERY WEEK. SO IT WOULD ALLOW THE COUNCIL TO HAVE ON AVERAGE TWO MEETINGS A MONTH. THERE WILL BE MONTHS WHERE WE HAVE MANY MORE MEETINGS THAN THAT. FOR EXAMPLE, WHEN WE HAVE BUDGET HEARINGS AND THINGS LIKE THAT AND THERE COULD BE MONTHS WHERE WE HAVE LESS, WE ONLY HAVE ONE MEETING, FOR EXAMPLE, CHRISTMAS. IF THE WEEK OF CHRISTMAS FALLS NEAR A OTHERWISE SCHEDULED COUNCIL MEETING. SO WHEN WE'RE MEETING ON THE SECOND AND FOURTH TUESDAYS OF EVERY MONTH, THAT WOULD BE VERY LIKELY, ALMOST CERTAIN THAT YOU WOULD HAVE A CONFLICT WITH CHRISTMAS AND WITH THANKSGIVING. BUT THAT WOULD STILL ALLOW US TO MEET A MINIMUM OF TWENTY FOUR TIMES PER YEAR. THAT IS A VERY HIGH LEVEL AND VERY BRIEF EXPLANATION. IS THERE ANY QUESTION COUNCIL HAS OR ANYTHING THAT BRYAN CAN EXPLAIN ON PROPOSITION NUMBER TWO OR THREE WITH REGARD TO THE CHARTER AMENDMENTS? AND I SHOULD ALSO ADD THAT WITH REGARD TO COMMISSIONER MURGUIA'S COMMENTS ABOUT SINGLE MEMBER DISTRICTS, THE SUBCOMMITTEE DID DISCUSS SINGLE MEMBER DISTRICTS AND IT WAS A SOMEWHAT LENGTHY DISCUSSION. AND DURING THAT DISCUSSION, IT WAS THE CONSENSUS OF THE GROUP WAS THAT THIS IS NOT THE RIGHT TIME TO DO IT BECAUSE WE'RE ABOUT TO HAVE A CENSUS. AND IF WE'RE GOING TO LOOK AT THAT ITEM AND THEY DIDN'T SAY THAT, WE SHOULDN'T EVER LOOK AT THAT ITEM. THEY JUST SAID IF WE'RE GOING TO LOOK AT THAT, WE NEED TO BE WELL INFORMED WITH THE CENSUS DATA, THE UPDATED CENSUS DATA THAT'S TAKING PLACE RIGHT NOW. SO WE'LL HAVE THAT DATA BY THE END OF 2021 OR SO. SO THEY FELT THAT IT WOULD BE APPROPRIATE IF WE'RE GOING TO LOOK AT THAT, TO LOOK AT IT ONCE WE HAVE FRESH CENSUS DATA. AND JARED FAIR TO SAY ALSO THAT THEY HAVE THE SAME DISCUSSION ON COUNCIL SIZE AND ARRIVED AT THE SAME CONCLUSION. YES MA'AM. IF IT WASN'T PART OF THEIR REPORT, BUT IT WAS PART OF THEIR DISCUSSION. AND AGAIN, THEY TIED BACK INTO CENSUS DATA AND KNOWING THAT THAT WOULD BE VERY RELEVANT TO HAVING THAT CONVERSATION. BUT THEY WERE NOT WILLING TO WAIT ON THESE OTHER CHANGES WHILE THEY WERE WAITING ON CENSUS DATA. SO THAT'S WHERE THAT REPORT CAME FROM THEM ON RECOMMENDING THE CHANGES THAT ARE CURRENTLY PROPOSED IN ORDINANCE NUMBER 7866. THAT'S EXACTLY CORRECT. MAYOR. YES, I WOULD ALSO COMMENT ON THAT AS WELL, THAT IT WOULD ABSOLUTELY MAKES SENSE TO GET THIS CENSUS DATA. AND ONE OF THE OTHER THINGS THAT I HAD A CONCERN, IF WE WERE IF THE COMMITTEE WAS RECOMMENDING THAT FOR THIS PARTICULAR UPCOMING ELECTION, THAT I WAS CONCERNED ABOUT THE TIME THAT I FEEL LIKE WE NEED ADEQUATE TIME AS A COMMUNITY WHEN THIS ISSUE COMES BACK UP AGAIN, BECAUSE I BELIEVE IT WILL. I THINK IT IS SOMETHING THAT SIZE THE SINGLE MEMBER AT LARGE. IT IS AN ONGOING CONVERSATION BUT WE NEED TO BE ABLE TO HAVE A GREAT DEAL OF PUBLIC ENGAGEMENT. FOCUS ON THAT. AND THIS WE IN THE TIMING, COVID 19, SHORTENED THE TIME THAT THE COMMITTEE WAS ABLE TO WORK ON THIS, BRING PRESENTATIONS FOR US TO THEN HAVE A DEADLINE TO HAVE IT ON THE NOVEMBER ELECTION. I DON'T WANT THAT TOPIC RUSHED. I WANT US TO GIVE IT THOUGHTFUL CONSIDERATION. AND IT'S ALSO GOING TO BE A VERY CROWDED BALLOT. AND SO I DO SUPPORT THESE MORE SIMPLE FOR THIS SHORT TERM, THE THINGS THAT WE CAN ALLOW THE CITY TO WEIGH IN ON, THINGS THAT I CONSIDER MORE HOUSEKEEPING POLICIES, AS OPPOSED TO A DEEPER CONVERSATION ON A BIGGER ISSUE AT THIS TIME. ANY OTHER THOUGHTS OR QUESTIONS? THANK YOU COUNCILWOMAN HAYS. AND SOMEWHAT THE SAME THING THAT ELAINE JUST SAID IS I WAS LOOKING AT IT MORE ALONG THESE [00:40:03] LINES. I DO THINK THAT THOSE ISSUES DO NEED TO BE ADDRESSED. AND SO I REALLY FEEL LIKE THIS IS BASICALLY TAKING THE FIRST SWIPE AT WHAT NEEDS TO BE CHANGED IN THE CHARTER. AND THIS IS NOT THE LAST TIME THAT WE'RE GOING TO LOOK AT IT. IT'S GOING TO COME BACK UP ON A CONSISTENT BASIS UNTIL WE HAVE EVERYTHING EXACTLY WHERE WE WANT IT. AND I THINK THAT THIS IS A GREAT START. YOU PICK OUT SOME OF THE SIMPLISTIC THINGS THAT NEED TO BE DEALT WITH AND WE DEAL WITH THEM EARLY. THEY'RE EASY CHANGES. THEY'RE NOT GOING TO BE CONFLICTING TYPE SITUATIONS THAT WE'RE GOING TO HAVE TO WORK OUR WAY THROUGH WITH THE COMMUNITY. AND SO I THINK IT'S A GREAT WAY TO START. I THINK COMMISSIONER MURGUIA HAS DEFINITELY HAS SOME GOOD IDEAS ABOUT THAT. AND I DO THINK THAT WE WILL HAVE TO ADDRESS THEM IN THE FUTURE. BUT I LIKE THE FACT THAT WE ARE STARTING WITH THINGS THAT ARE SIMPLISTIC, EASY FOR US TO MAKE A DECISION ON. THEY'RE GOING TO PROVE TO BE IMMEDIATELY FRUITFUL. AND SO I THINK THE WAY THAT OUR COMMITTEE BROUGHT THINGS BACK TO US WAS EXCELLENT. I SHOULD ALSO SAY, MAYOR, YOU KNOW FROM MY STANDPOINT AND FROM OUR LEGAL DEPARTMENT STANDPOINT AND FROM THE CITY MANAGER'S OFFICE, YOU KNOW, SOMETIMES WE LIKE TO THINK THAT WE REALLY THINK THINGS THROUGH AND MAYBE OVERTHINK SOMETIMES. BUT I REALLY WANT TO COMMEND COUNCIL MEMBER SMITH FOR JUST IT SEEMS OBVIOUS NOW, BUT IT WAS AN IDEA THAT NOBODY HAD. AND COUNCIL MEMBER SMITH JUST SAID, WHY DON'T WE COMBINE THOSE THINGS? THEY'RE THE SAME THEY'RE INEXTRICABLY LINKED. HAVE Y'ALL THOUGHT ABOUT THAT AND YOU KNOW, TO MY CHAGRIN, NO, WE HADN'T, BUT IT WAS JUST SUCH AN ELEGANT SOLUTION. SO I REALLY DID WANT TO THROW THE COMMEND COUNCIL MEMBER SMITH FOR THAT. AND THEN ALSO LEGAL'S WORK TO VALIDATE THE IDEA AND ENSURE THAT IT MET STATE STATUTE WITH REGARD TO HOW CHARTERS ARE CREATED AND OUR EXISTING CHARTER. SO THANK YOU FOR THAT. I AGREE. LET ME SAY THANK YOU, BUT ALSO WE NEED TO COMMEND BRYAN MCWILLIAMS AND HIS STAFF ON REALLY STUDYING IT AND GOING ALONG WITH THE TWO BALLOT MEMBERS RATHER THAN THE THREE. APPRECIATE THAT. YEAH OUR LEGAL DEPARTMENT GAVE US A YES AND ANSWER. THEY DID. THERE WE GO. OK, ANY FURTHER QUESTIONS OR DISCUSSION ON THE LANGUAGE THAT YOU HAVE IN FRONT OF YOU FOR ORDINANCE 7866. IF NOT THEN DO WE HAVE A MOTION FOR ITEM 3A. YES MAYOR, WE DO. I MOVE TO ADOPT ORDINANCE NUMBER SEVENTY EIGHT SIXTY SIX, ORDERING A SPECIAL ELECTION ON NOVEMBER 3RD 2020 TO VOTE ON PROPOSED AMENDMENT TO THE AMARILLO CITY CHARTER, PROVIDING FOR A JOINT ELECTION AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH AN ELECTION. SECOND. IT'S BEEN MOVED BY COUNCIL MEMBER POWELL AND SECONDED BY COUNCIL MEMBER SMITH TO APPROVE ORDINANCE NUMBER SEVENTY EIGHT, SIXTY SIX. FURTHER QUESTIONS OR DISCUSSION FROM THE COUNCIL. HEARING NONE ALL OF THOSE IN FAVOR, PLEASE RAISE YOUR HAND. I SEE 5 HANDS AND THAT ORDINANCE WILL PASS WITH A 5 0 VOTE. ITEM 3 B IS CONSIDERATION OF ORDINANCE NUMBER 7867. [B. CONSIDERATION OF ORDINANCE NO. 7867: (Contact: Juliana Kitten, Director of Community Development) This item is the first reading to consider an ordinance amending the Amarillo Municipal Code: Chapter 2-6, modifying Article XII, Section 2-6-96, related to the Community Development Advisory Committee (CDAC).] MR. CITY MANAGER. MAYOR WE HAD A WORK SESSION ON THIS LAST WEEK, BUT WE DEALT WITH IT EVERY YEAR WE'VE TRIED TO CONSTITUTE ALL OF OUR BOARDS AND COMMISSIONS THROUGHOUT MY ENTIRE TIME AND YOUR ENTIRE TIME ON COUNCIL. IT'S CONTINUOUSLY BEEN A CHALLENGE. RECENTLY, JULIANA KITTEN, DIRECTOR IN COMMUNITY DEVELOPMENT, HAS BEEN WORKING ON A WAY TO SIMPLIFY. THE WAY WE WERE CONSTITUTING THAT BOARD WAS MORE COMPLICATED THAN WHAT THE FEDERAL FUNDING AUTHORITIES REQUIRE. SO WE HAVE PROVIDED YOU WITH A SIMPLIFIED WAY TO FILL THAT COMMITTEE. JULIANA, WOULD YOU GO AHEAD AND WALK US THROUGH THAT BRIEFLY? JUST RECAP EVERYTHING THAT WE TALKED ABOUT LAST WEEK AND THEN ANSWER THE QUESTIONS COUNCIL'S GOT. YES, SIR. ABSOLUTELY. CAN YOU HEAR ME? YES. OK, GREAT. ALL RIGHT. HELLO, MAYOR, CITY MANAGER AND COUNCIL. GREAT TO BE HERE WITH YOU. SO ESSENTIALLY, WE HAVE GONE FROM HAVING TO HAVE VERY SPECIFIC REQUIREMENTS IN TERMS OF ACTUAL ZIP CODES WITHIN THE TARGET AREA TO INSTEAD HAVING THE [00:45:04] MAJORITY OF MEMBERS ON THE COMMITTEE BEING FROM THE TARGET AREA, BUT NOT ONE SPECIFIC ZIP CODE. AND THEN ALSO WE WILL HAVE THREE MEMBERS AT LARGE. WE ALSO HAVE PUT IN THEIR PREFERRED EXPERIENCE OR VOLUNTEER SHOWN COMMITMENT TO WORKING WITH PEOPLE OF LOW AND MODERATE INCOME AND THEN ALSO CHANGING THE TERMS TO MORE MATCH THE OTHER BOARDS AND COMMISSIONS. OKAY ANY QUESTIONS, COUNCIL, I KNOW THIS IS SOMETHING WE DID TALKED ABOUT LAST WEEK, BUT IF YOU THOUGHT ABOUT IT AND HAD SOMETHING YOU WANTED TO PUT OUT TO JULIANA OR HER TEAM, NOW'S THE TIME. OK, NOT HEARING ANYTHING, SO JULIANA THANK YOU VERY MUCH FOR YOUR WORK ON THIS. DO WE HAVE A MOTION ON ITEM THREE B? YES, MAYOR, WE DO. I MOVE TO ADOPT ORDINANCE NUMBER 7867, WHICH IS AMENDING THE AMARILLO MUNICIPAL CODE CHAPTER 2-6 MODIFYING ARTICLE 12, SECTION 2-6-96 RELATED TO THE COMMUNITY DEVELOPMENT ADVISORY COMMITTEE. SECOND. SO MOVED BY COUNCILWOMAN POWELL AND SECONDED BY COUNCIL MEMBER SAUER TO APPROVE ORDINANCE NUMBER 7867. DO WE HAVE ANY FURTHER QUESTIONS OR DISCUSSION ABOUT IT? MAYOR WE MIGHT TAKE THIS OPPORTUNITY TO JUST REMIND THE PUBLIC WHEN WE WILL START TAKING APPLICATIONS FOR THIS BOARD [INAUDIBLE] APPOINTMENTS ARE MADE. OK, THANK YOU. THE APPOINTMENTS ARE MADE USUALLY THE SECOND OR THIRD WEEK IN NOVEMBER AND APPLICATIONS OPEN AROUND THE FIRST WEEK IN OCTOBER. SO IF YOU'RE A CITIZEN INTERESTED IN SERVING ON THIS PARTICULAR BOARD, WE ABSOLUTELY WOULD LIKE TO HAVE YOU OR IF YOU WANT TO SERVE ON ANOTHER BOARD. RIGHT ANY BOARD OF COMMISSION WE HAVE. THE APPLICATION PERIOD IS THE SAME. BUT ARE WE ANTICIPATING DOING THESE OPENINGS ON A DIFFERENT TIME FRAME? JULIANA? CAN YOU HELP US WITH THAT. SURE. ACTUALLY, WE DO HAVE A NEED FOR FOUR MEMBERS THAT NEED TO BE APPOINTED AT THIS POINT. SO AND THEN I THINK IN TERMS OF THE TIME FRAME, IF WE SWITCH IT TO WHAT IS STANDARD FOR THE OTHER BOARDS AND COMMISSIONS, THEN I THINK IT WILL BE MORE SIMILAR MOVING FORWARD. SO I HEAR YOU SAYING THAT FOR THESE FOUR OPENINGS, LEAVE THEM ON THE SAME TIME FRAME AS ALL THE OTHER APPOINTMENTS. YES, MA'AM. JULIANA DO WE NEED TO HAVE THOSE OUT OF CYCLE, DO WE NEED TO HAVE THOSE APPOINTMENTS MADE PRIOR TO. DO WE NEED THEM RIGHT NOW? GO AHEAD KEVIN. THIS IS KEVIN STARBUCK DEPUTY CITY MANAGER. JUST TO CLARIFY, THE SECOND READING OF THIS ORDINANCE WILL BE ON AUGUST 11TH, WHICH WOULD BE THE FINAL APPROVAL, AND THEN WE WOULD LOOK TO HAVE COUNCIL MAKE THOSE INTERIM APPOINTMENTS. [INAUDIBLE] THE AUGUST, I BELIEVE 28TH MEETING, WHICH I THINK IS THAT LAST TUESDAY OF AUGUST. THE REASON WE WOULD NEED THESE INTERIM APPOINTMENTS TO CONSTITUTE THIS PARTICULAR COMMITTEE IS THERE ARE SOME WORK RELATED TO THE APPROVAL OF SOME OF THE CDBG GRANTS THAT WILL TAKE PLACE PRIOR TO THE NORMAL CYCLE OF APPOINTMENTS THAT WOULD TAKE PLACE IN THE OCTOBER NOVEMBER TIMEFRAME. SO WE WILL NEED THAT INTERIM APPOINTMENT OF SOME BOARD MEMBERS TO ALLOW THAT COMMITTEE TO DO ITS WORK RELATED TO THE CDBG PROGRAM IN THE INTERIM UNTIL WE CAN GET TO THAT POINT. ONE OF THE UPSIDES TO THIS IS THAT ALL OF OUR CURRENT MEMBERS, THEIR TERMS WOULD EXPIRE AT THE END OF 2020. SO THIS WOULD ALLOW US THE OPPORTUNITY TO POTENTIALLY BUILD IN SOME OF THESE STAGGERING UP TERMS AMONG THE COMMITTEE MEMBERS WITH THIS INTERIM APPOINTMENT AND THEN EITHER REAFFIRMING THE CURRENT MEMBERS OR LOOKING FOR NEW MEMBERS ONTO THE COMMITTEE MOVING FORWARD. THANK YOU FOR THAT EXPLANATION, KEVIN. SO IF THEY ARE INTERESTED IN SERVING, IS THE APPLICATION CURRENTLY UP ON THE CITY'S WEBSITE? IF THEY CONTACT THE CITY SECRETARY, WE WILL GET THEM AN APPLICATION AND GET THEIR INFORMATION. I KNOW WE HAVE HEARD FROM A COUPLE OF INDIVIDUALS BASED ON OUR COMMUNICATION TO THE COUNCIL LAST WEEK RELATED TO THIS PARTICULAR BOARD. SO IF THEY SIMPLY CONTACT THE CITY SECRETARY, WE WILL GIVE THEM THE NECESSARY INFORMATION SO THAT WE CAN COLLECT THAT APPLICATION TO PRESENT TO COUNCIL LATER IN THE MONTH OF AUGUST. OK, THANK YOU. [00:50:04] AND I WOULD ALSO SAY IF ANYBODY WANTS TO CALL THE CDBG, THEY'RE GOING TO ROUTE THEM TO THE CITY SECRETARY. SO THERE'S A LOT OF PLACES YOU CAN CALL AND END UP WITH THE RIGHT PERSON TO SPEAK WITH TO HELP YOU GET YOUR APPLICATION AND MAKE SURE THAT YOU'RE CONSIDERED FOR APPOINTMENT TO THIS COMMITTEE. AS PART OF THIS, WE HAVE ALSO PULLED THE PREVIOUS APPLICATIONS OF PEOPLE WHO HAVE EXPRESSED INTEREST IN THIS PARTICULAR COMMITTEE AND WE WILL BE VERIFYING WHETHER THEY STILL HAVE INTEREST OR NOT AND CAN INCLUDE THAT IN THE PRESENTATION OF CANDIDATES TO THE COUNCIL. THANK YOU. ANYTHING ELSE ON THAT? OK, AT THIS TIME, THEN WE WILL CALL FOR A VOTE ON THE MOTION. ALL OF THOSE IN FAVOR, PLEASE RAISE YOUR HAND. I SEE 5 HANDS THAT MOTION WILL PASS WITH A 5 0 VOTE. [C. CONSIDERATION OF ORDINANCE NO. 7868: (Contact: Anthony Spanel, Environmental Health Director) This item considers recommended changes to Chapter 14-3 Alcoholic Beverages that will reduce the regulatory burden on businesses applying for an Alcoholic Beverage license.] ITEM 3 C IS CONSIDERATION OF ORDINANCE NUMBER 7868. MR. CITY MANAGER. ALL RIGHT. WE'RE GOING TO HAVE ANTHONY SPANEL, DIRECTOR OF ENVIRONMENTAL HEALTH PRESENT THE ITEM WHICH DEALS WITH HOW A BUSINESS GETS AN ALCOHOLIC BEVERAGE LICENSE. ANTHONY. THANK YOU, JARED. GOOD AFTERNOON, MAYOR AND COUNCIL. I'M GOING TO SHARE MY SCREEN REAL QUICK. JUST TO GIVE A BRIEF REMINDER OF WHAT WE'RE DISCUSSING HERE TODAY, THIS REVISION IS AN ADMINISTRATIVE REVISION TO REDUCE THE REGULATORY BURDEN ON BUSINESSES TRYING TO ACHIEVE AN ALCOHOLIC BEVERAGE LICENSE. THIS WILL MOVE OUR PROGRAMMATIC ACTIVITIES MORE IN LINE WITH THE RULES THAT GOVERN THEM. IT'S A PRETTY MINOR REVISION IF YOU HAVE ANY QUESTIONS OR CONCERNS I'M HAPPY TO ADDRESS THOSE AT THIS TIME. COUNCIL, ANY QUESTIONS FOR ANTHONY. OKAY. THANK YOU, ANTHONY. DO WE HAVE A MOTION ON THIS ITEM. YES MAYOR WE DO. I MOVE TO APPROVE ORDINANCE NUMBER SEVENTY EIGHT SIXTY EIGHT TO AUTHORIZE THE RECOMMENDED CHANGES TO CHAPTER 14, DASH THREE ALCOHOLIC BEVERAGES THAT WILL REDUCE THE REGULATORY BURDEN ON BUSINESSES APPLYING FOR AN ALCOHOLIC BEVERAGE LICENSE. THANK YOU. SECOND. IT'S BEEN MOVED BY COUNCIL MEMBER POWELL, AND I THINK I HEARD A SECOND FROM COUNCIL MEMBER SMITH TO APPROVE ORDINANCE SEVENTY EIGHT SIXTY EIGHT. ANY CONCERNS, QUESTIONS, DISCUSSION FROM THE COUNCIL? ALL THOSE IN FAVOR OF THE MOTION, PLEASE RAISE YOUR HAND. THAT PASSES WITH THE 5 0 VOTE. [D. CONSIDERATION OF ORDINANCE NO. 7869: (Contact: Anthony Spanel, Environmental Health Director) This item is the first reading to consider a revision to Chapter 8-5-23 Public and Environmental Health. This revision will authorize any peace officer to enforce certain health and safety regulations without the necessity, delay, and cost of summoning a Health Officer.] ITEM THREE D IS CONSIDERATION OF ORDINANCE NUMBER 7869. MR. CITY MANAGER. MAYOR WE'RE ALSO GOING TO HAVE ANTHONY SPANEL ON THIS ITEM, WHICH IS A MODIFICATION OF OUR CODE TO ALLOW THE POLICE DEPARTMENT TO ASSIST THE ENVIRONMENTAL HEALTH DEPARTMENT WITH ENFORCEMENT OF CERTAIN RULES AFTER HOURS. SO, ANTHONY, TAKE IT AWAY. THANK YOU ONCE AGAIN. LET ME SHARE MY SCREEN ONE MORE TIME HERE. THE SECOND REVISION I'M PRESENTING TO TODAY IS A MINOR AGAIN ADMINISTRATIVE UPDATE THAT WILL ALLOW APD TO HELP US ENFORCE CERTAIN ENVIRONMENTAL HEALTH REGULATIONS AFTER HOURS, JUST LIKE THE CITY MANAGER MENTIONED, THERE SPECIFICALLY OUR MOBILE FOOD UNITS PARKING AFTER HOURS AND OUR FACILITIES THAT OPERATE AFTER HOURS KEEPING THEIR DOORS CLOSED. THOSE ARE THE TWO MINOR REVISIONS. AND I DO HAVE THE SUPPORT OF POLICE CHIEF BIRKENFELD ON TAKING THIS TO COUNCIL TODAY AS WELL. FROM AN ENVIRONMENTAL HEALTH STANDPOINT COUNCIL, JUST TO REMIND EVERYONE. THE PRIMARY REASON THAT WE WANT TO MAKE SURE THAT BUSINESSES THAT SERVE FOOD AND WATER OR FOOD AND BEVERAGES AT ANY TIME KEEP THE DOORS CLOSED IS TO PROHIBIT AND REDUCE THE TRANSMISSION OF DIFFERENT VECTORS INTO THE FACILITY. I SEE VECTOR TALKING ABOUT FLIES, BUGS, THINGS LIKE THAT. AND ON THE FOOD TRUCK ISSUE IT'S JUST TO ENSURE THAT FOOD TRUCKS ARE PARKING IN PRIVATE PARKING SPACES OR ON PRIVATE LOTS INSTEAD OF IN PUBLIC RIGHTS OF WAY TO PROVIDE THEIR SERVICES. WELL SAID, THANK YOU VERY MUCH. ANY QUESTIONS FOR ANTHONY. OKAY. THANK YOU. IF WE HAVE A MOTION ON ORDINANCE 7869. YES, MAYOR WE DO. I MOVE TO ADOPT ORDINANCE NUMBER SEVENTY EIGHT SIXTY NINE, APPROVING THE REVISION TO AUTHORIZE ANY POLICE OFFICER TO ENFORCE CERTAIN HEALTH AND SAFETY REGULATIONS WITHOUT THE [00:55:03] NECESSITY, DELAY AND COST OF SENDING A HEALTH OFFICER. IT'S BEEN MOVED BY COUNCIL MEMBER POWELL, SECONDED BY COUNCIL MEMBER SAUER TO APPROVE ORDINANCE NUMBER 7869. ANY FURTHER DISCUSSION OR QUESTIONS FROM THE COUNCIL? OK, HEARING NONE ALL OF THOSE IN FAVOR OF THE MOTION, PLEASE RAISE YOUR HAND. I SEE FIVE HANDS THAT PASSES WITH A 5 0 VOTE. [E. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 7870: (Contact: Andrew Freeman, Managing Director - Planning and Development Services) This item is conducts a public hearing and is the first reading of an ordinance rezoning Lots 11 and 12, Block 5, Roy Lindsey's Addition, in Section 172, Block 2, A.B.&M. Survey, Randall County, Texas, plus one half of all bounding streets, alleys, and public ways to change from Residential District 2 to General Retail District. (Vicinity: I-27 and Washington Street) Applicant/s: Bo Wulfman for South Washington St. Ltd.] ITEMS 3E IS A PUBLIC HEARING, SO IF YOU ARE WATCHING TODAY AND WANT TO SPEAK WITH REGARD, WHEN WE CALL THE PUBLIC HEARING, YOU MIGHT GO AHEAD AND CALL IN AS INSTRUCTED THERE ON THE AGENDA, MR. CITY MANAGER. ALL RIGHT, AS JUST SAID PUBLIC HEARING AND ITEM TO DISCUSS A REZONING. ANDREW FREEMAN OUR MANAGING DIRECTOR OF PLANNING AND DEVELOPMENT SERVICES HERE TO PRESENT THE ITEM. ANDREW. YES, SO TODAY'S ORDINANCE NUMBER 7870, IT'S A REQUEST TO REZONE TWO LOTS IN THE ROY LINDSEY'S ADDITION IN THE VICINITY OF I 27 AND WASHINGTON STREET. [INAUDIBLE] ON THE NORTHEAST CORNER OF THAT INTERSECTION FROM RESIDENTIAL DISTRICT 2 TO GENERAL RETAIL. SO IT'S APPROXIMATELY 0.33 ACRES. SO TWO SMALLER LOTS LOCATED THERE. THE ADJACENT ZONING IS RESIDENTIAL ONE, RESIDENTIAL TWO AND GENERAL RETAIL. THE GENERAL RETAIL IS ACTUALLY SOUTH OF THERE, SEPARATED BY I 27. LOOKING AT THE COMPREHENSIVE PLAN, IT DOES HAVE A FUTURE LAND USE OF GENERAL RESIDENTIAL. AND THEN I'LL DISCUSS HERE AS I SHOW YOU SOME OF THE AERIALS ON THE MAP SO YOU CAN GET A FEEL FOR THAT AREA. PLANNING AND ZONING DID HEAR THIS CASE ON JULY SIX AND DID RECOMMEND THE CHANGE WITH A FOUR ONE VOTE TO CHANGE FROM R2 TO GENERAL RETAIL. SO YOU CAN SEE HERE ON THE ZONING MAP THAT JUST TO THE WEST IS RESIDENTIAL ONE ZONING TO THE EAST IS THE RESIDENTIAL 2 AND THE TWO SMALLER TRACKS HIGHLIGHTED THERE ARE THE ONES IMPACTED BY THE ZONING CHANGE, REQUESTING GENERAL RETAIL. WHEN STAFF PRESENTED THE ITEM TO PLANNING AND ZONING IT WAS SUGGESTED THAT MAYBE A LESS INTENSIVE OFFICE OR NEIGHBORHOOD SERVICES USE MIGHT BE MORE APPROPRIATE FOR THAT INTERSECTION JUST BASED ON THE VICINITY OF THE RESIDENTIAL IN THAT AREA. YOU CAN SEE HERE ON THE AERIAL, THERE IS AN ALLEY HERE SEPARATING THE TWO HOMES TO THE EAST, BUT IT IS DIRECTLY ADJACENT TO HOMES TO THE NORTH AND THE WEST. PART OF THE DISCUSSION WITH THE PLANNING AND ZONING COMMISSION THAT IT IS A SMALLER SITE. SO THERE'S GOING TO BE LESS IMPACT BASED ON WHAT IS DEVELOPED THERE. IT IS, I BELIEVE THE LAST INTERSECTION ALONG I 27 THAT HASN'T SEEN GENERAL RETAIL OR LIGHT COMMERCIAL SURROUNDING THE INTERSECTION. YOU CAN SEE JUST TO THE SOUTH THERE WERE SONIC [INAUDIBLE] AND SOME OTHER GENERAL RETAIL HAS ALREADY TAKEN PLACE TO THE SOUTH. THIS IS JUST ONE OF THOSE AREAS WITH THE CONSTRUCTION OF I 27 COMING THROUGH IN THE EARLY 80S, AND THAT WAS COMPLETED. MOST OF THESE HOMES TO THE NORTH WERE BUILT IN THE 40S. SO THEY WERE THEY WERE IMPACTED BY THAT COMING THROUGH WITH THAT DEVELOPMENT. HERE'S A 3-D VIEW OF THE LOT. SO YOU CAN SEE ABOUT THE SIZE OF WHAT'S BEING PROPOSED. AND SO STAFF DID RECOMMEND AT THE TIME NOT NOT RECOMMENDING GENERAL RETAIL. THEY DID RECOMMEND SOMETHING LIKE NEIGHBORHOOD SERVICES OR OFFICE, BUT P&Z DID FEEL COMFORTABLE JUST BASED ON THE SURROUNDING USES, THE UNIQUENESS SIZE OF THE TRACT AND WHAT'S DEVELOP IN THAT AREA THAT MOST LIKELY WOULDN'T HAVE A MAJOR IMPACT IF WE DID MOVE FORWARD WITH GENERAL RETAIL FOR THIS SITE. I'D BE HAPPY TO ANSWER ANY QUESTIONS YOU MIGHT HAVE BEFORE THE PUBLIC HEARING. WE DID SEND OUT NOTICES WHAT THE TWO HUNDRED FEET REQUIREMENT. WE DO NOT RECEIVE ANY COMMENTS OR ATTENDANCE AT THE MEETING OTHER THAN THE APPLICANT'S REPRESENTATIVE. QUESTIONS FOR ANDREW, COUNCIL. OK, SO I'LL JUST THIS IS KIND OF LIKE WHAT WE WENT THROUGH, WHAT WAS IT, A YEAR AGO UP THE STREET, CLOSE TO RIGHT. YES. CORRECT. BECAUSE I'VE SLEPT SINCE THEN, WOULD YOU KIND OF GO THROUGH AND KIND OF TELL ME THE DIFFERENCE BETWEEN WHAT THE GENERAL RETAIL IS IN THAT OTHER ONE THAT WAS ORIGINALLY SUGGESTED TO THE PLANNING AND ZONING. NEIGHBORHOOD SERVICES. [01:00:02] YES SIR. SO IT HAD LESS OF THE INTENSE USES, SO IT WOULDN'T ALLOW THINGS LIKE A LIQUOR STORE IN IT, IT WOULD ALLOW A RESTAURANT, BUT NOT THE DRIVE-IN TYPE, LIKE A SONIC DRIVE THRU. AND THEN JUST SOME OF IT'S MORE MORE OFFICE AND LOW INTENSE RETAIL THAT WOULD BE ALLOWED. ONE THING TO KEEP IN MIND IS WE ARE WORKING ON THE ZONING CODE REWRITE, AND PART OF THAT PROPOSAL IS TO TAKE OUT SOME OF THE MORE INTENSE GENERAL RETAIL USES AND PUT THOSE INTO THE LIGHT COMMERCIAL. SO LONG TERM, IT WOULD ALSO MAYBE NOT HAVE AS MUCH OF AN IMPACT AS WHAT'S ALLOWED IN OUR CURRENT CODE. AND THAT PROJECT SHOULD BE COMPLETED BY THE END OF THE YEAR. BUT THAT WAS PART OF WHAT STAFF RECOMMENDATION ALSO, KNOWING WHAT WE WENT THROUGH TO THE NORTH, SOMEWHAT SIMILAR SITUATION THAT ONE HAD, I THINK JUST RESIDENCES TO THE EAST. THIS ONE HAS IT TO THE NORTH, WEST AND EAST. BUT IT DOES HAVE A MAJOR DECIDING FACTOR IN THE INTERSTATE BEING RIGHT THERE AT THAT INTERSECTION AND UNLIKELY TO SEE SOMEONE DEVELOP RESIDENTIAL ON THE PROPERTY. AND ALSO, I THINK SOMETHING THAT WE'VE GOT DIFFERENT IN THIS ONE IS WE HAD A GROUP OF INDIVIDUALS THAT DID HAVE AN ISSUE WITH THAT AND WE HAD NOBODY THAT HAS AN ISSUE WITH THIS ONE. CORRECT. YES, THERE WERE HOMEOWNERS IN THAT AREA. THIS ONE IS MOSTLY A RENTAL AREA. MOST OF THESE HOMES ARE DIFFERENT OWNERSHIP THAN WHO'S LIVING THERE. SO THEY WOULDN'T RECEIVE TECHNICALLY THE NOTICE TO THEM DIRECTLY. OK, SO YOU DID MAKE A COMMENT EARLIER ABOUT A LIQUOR STORE OR WHATEVER, IS THAT 200 FEET WITHIN THAT CHURCH THAT'S OVER THERE? IT WOULD BE PROBABLY PRETTY CLOSE. YEAH, THAT MIGHT BE A FACTOR AS WELL, WE'D HAVE TO MEASURE IT. SO IF SOMEBODY DOES PURCHASE THIS AND THEY WANT TO DO SOMETHING THERE, THEN THEY WOULD PROBABLY BE IN FRONT OF US AGAIN FOR A VARIANCE FOR A LIQUOR LICENSE OR SPEAKERS]. POSSIBLE. YEAH, THAT CAN BE LIKELY FOR IT COULD BE FOR A GAS STATION OR A RESTAURANT WANTING TO GET A LIQUOR LICENSE. A NUMBER OF DIFFERENT SCENARIOS. WE WOULD HAVE TO MEASURE THAT AND SEE. OK, AT THIS TIME, I'M GOING TO GO AHEAD AND OPEN A PUBLIC HEARING ON THIS MATTER. ANYONE WHO WANTS TO SPEAK FOR, ON OR AGAINST THIS MATTER SHOULD CONTACT THE INFORMATION ON THE AGENDA AND CALL IN TO PARTICIPATE ON THE PANEL. STEPHANIE, DO WE HAVE ANY CALLERS AT THIS TIME? THERE IT IS RIGHT THERE YOU CAN SEE IT ON THE SCREEN. I DON'T BELIEVE WE DO. IF YOU ARE AN ATTENDEE AND YOU WISH TO SPEAK ON THIS ITEM, IF YOU'LL CLICK YOUR RIGHT HAND BUTTON OR PRESS STAR NINE, IF YOU'RE CALLING FROM A TELEPHONE. I DO NOT SEE ANYBODY THAT WISHES TO SPEAK MAYOR. OK, THANK YOU. WE WILL CLOSE THE PUBLIC HEARING ON THIS ITEM AND ENTERTAIN A MOTION. YES MAYOR I MOVE TO ADOPT ORDINANCE NUMBER SEVENTY EIGHT SEVENTY REZONING LOTS FROM A RESIDENTIAL DISTRICT 2 TO GENERAL RETAIL DISTRICT IN THE VICINITY OF I 27 AND WASHINGTON STREET. SECOND. IT'S BEEN MOVED BY COUNCIL MEMBER POWELL AND SECONDED BY COUNCIL MEMBER SAUER TO APPROVE ORDINANCE NUMBER 7870. ANY FURTHER QUESTIONS OR DISCUSSION FROM THE COUNCIL ON THE MOTION. YES SO RIGHT NOW IT'S RESIDENTIAL. I HAVE NO OPPOSITION TO A CHANGE. I MEAN, IT MAKES SENSE THAT ON THAT CORNER, RIGHT BY I 27 WE'RE NOT GOING TO HAVE INTEREST IN PEOPLE WANTING TO BUILD A HOME RIGHT THERE, BUT USING IT IN SOME OTHER FORM. BUT SO IF ANDREW CAN CLARIFY. SO DID OUR STAFF MAKE THE RECOMMENDATION? WE HAVE A LITTLE BIT MORE RESTRICTION THERE, WHICH WOULD BE THE OFFICE OR NEIGHBORHOOD SERVICES AND DENY THIS GENERAL RETAIL ZONING. BUT THE P&Z BOARD HAS VOTED IN SUPPORT OF IT. SO I JUST WANT TO CLARIFY THAT STAFF OPPOSED THIS APPLICATION. BUT THE P&Z BOARD HAS VOTED IN FAVOR OF IT. AND CAN YOU REMIND ME WHAT THE VOTE WAS? THE VOTE WAS 4 1 IN FAVOR OF IT. BUT YES, STAFF MAKES A RECOMMENDATION. THE RECOMMENDATION WAS DENY THE GR WITH THE SUGGESTION THAT OFFICE OR NEIGHBORHOOD SERVICE WOULD BE PREFERRED IF THEY WERE TO CHANGE THE ZONING, BUT P&Z FELT COMFORTABLE WITH IT AS [01:05:02] PRESENTED AND WITH THE FEEDBACK THEY HEARD FROM THE APPLICANT AT THE TIME AS FAR AS WHAT THEIR THOUGHTS WERE. AND STATE, AGAIN, OUR CHANGES IN OUR PLANNING AND ZONING, IF THIS WERE IN THE LESS RESTRICTIVE IN THIS GENERAL RETAIL, IT COULD IN EFFECT BE LIGHT INDUSTRIAL IN THIS CORNER. OR THE GENERAL RETAIL. THAT AS WE MAKE THOSE CHANGES, IF WE APPROVED GENERAL RETAIL, IT COULD BE A SEMI LIGHT INDUSTRIAL. NO IF WE APPROVE GENERAL RETAIL WITH THE ZONING CHANGES, THERE SHOULD BE MORE USES TAKEN OUT OF THAT CATEGORY AND PUT TO A HIGHER, RESTRICTED CATEGORY. SO SOME OF THOSE THAT ARE CURRENTLY ALLOWED MAY ONLY BE ALLOWED IN LIGHT COMMERCIAL OR HEAVY COMMERCIAL IN THE FUTURE. SO IT ACTUALLY SHOULD PROTECT IT BETTER AFTER THE ZONING CODE REWRITE. OKAY. AS OPPOSED TO RIGHT NOW WHERE THEY MIGHT HAVE A FEW MORE USES THAT WON'T BE INCLUDED IN THE FUTURE. OK. AND MAYOR, I WOULD JUST ALSO HIGHLIGHT THAT, AS MENTIONED, NOTICES GO OUT. BUT THOSE ARE THERE ARE A LOT OF RENTAL PROPERTIES. THE NOTICES GO TO THE OWNERS AND THERE WAS NO OPPOSITION. BUT THE PEOPLE WHO ACTUALLY LIVE CLOSE TO THAT WOULD BE MORE IMPACTED THAN THE OWNERS. AND I MEAN, IT IS WHAT IT IS, BUT IT JUST MEANS THAT THE PEOPLE WHO ACTUALLY WOULD BE THE MOST IMPACTED REALLY DON'T HAVE AN OPPORTUNITY TO WEIGH IN ON THEIR CONCERNS OR PREFERENCES FOR DEVELOPMENT IN THAT SPACE. SO IN GENERAL, I'M JUST I MEAN, WE'RE FIXING TO TAKE A VOTE, BUT IN GENERAL I'M EXPRESSING I SUPPORT WHAT THE STAFF RECOMMENDATION WAS AND MORE OF THE NEIGHBORHOOD AND OFFICE USE FOR THIS. AND I DO NOT SUPPORT THE BROADER EXPANSION INTO GENERAL RETAIL FOR THIS SPACE. OKAY THANK YOU. ANY OTHER COMMENTS? QUESTIONS? OKAY. WE'LL CALL FOR THE VOTE. ALL OF THOSE IN FAVOR OF THE MOTION, PLEASE RAISE YOUR HAND. OKAY I SEE 4 HANDS, ALL OF THOSE OPPOSED. I SEE ONE, SO THAT MOTION WILL PASS FOUR TO ONE. SO MOVING ON TO ITEM THREE F. [F. CONSIDER RESOLUTION - AMENDING AND RESTATING A RESOLUTION CALLING A BOND ELECTION TO BE HELD IN THE CITY OF AMARILLO, TEXAS; MAKING PROVISION FOR THE CONDUCT OF A JOINT ELECTION; AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH ELECTION: (Contact: Laura Storrs, Assistant City Manager) Discussion and consideration of a resolution amending and restating a resolution calling a bond election to be held in the City of Amarillo, Texas on November 3, 2020 and resolving other matters incident and related thereto.] CONSIDER A RESOLUTION AMENDING OR RESTATING A RESOLUTION CALLING A BOND ELECTION TO BE HELD IN THE CITY OF AMARILLO, TEXAS, MAKING PROVISION FOR THE CONDUCT OF A JOINT ELECTION AND RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH ELECTION. MR. CITY MANAGER. THIS IS THE ITEM WE REFERENCED IN ITEM A.. SO THIS IS PROPOSITION ONE OR WILL BE PROPOSITION ONE, AND THIS IS DISCUSSING BOND ELECTION FOR CITY FACILITIES, FOR A CIVIC CENTER AND ARENA, RENOVATION AND EXPANSION OF OUR CIVIC CENTER AND CONSTRUCTION OF A NEW ARENA RIGHT NEXT DOOR TO AND ADJACENT TO THE RENOVATED AND EXPANDED CIVIC CENTER. THE ITEM WAS ORIGINALLY CONSIDERED AND VOTED TO BE PLACED ON THE ELECTION FOR MAY OF THIS YEAR, WAS POSTPONED. AND PER GOVERNOR'S GUIDANCE WAS ALLOWED TO BE PUSHED TO THE SUBSEQUENT ELECTION, WHICH WAS NOVEMBER, AND THAT WAS DUE TO THE IMPACTS ASSOCIATED WITH CORONA VIRUS. TO GIVE A REAL BRIEF OVERVIEW. THIS HAS BEEN IN FRONT OF YOU MANY TIMES OVER THE COURSE OF THE LAST YEAR. TO GIVE A VERY BRIEF OVERVIEW, WE HAVE DEPUTY CITY MANAGER KEVIN STARBUCK. WE ALSO HAVE ASSISTANT CITY MANAGER LAURA STORRS TO PROVIDE ADDITIONAL ANSWER ANY ADDITIONAL QUESTIONS YOU HAVE ON FINANCING AND OTHER FINANCIAL QUESTIONS YOU MIGHT HAVE ON THE PROJECT. KEVIN. THANK YOU, MAYOR AND COUNCIL. JUST TO REITERATE, THIS IS AN AMENDED RESOLUTION THAT WOULD CALL THE ELECTION FOR TO BE CONDUCTED IN NOVEMBER AS PART OF THE GENERAL ELECTION. THE PROPOSITION ITSELF STAYS THE SAME, BUT THE VOTER INFORMATION HAS BEEN UPDATED AND IS ALLOWED TO BE UPDATED PER THE GOVERNOR'S ORDER. AND THAT UPDATE IS PRIMARILY ADDRESSING REDUCTIONS IN THE INTEREST RATES FOR DEBT ISSUANCES. AND I THINK THAT'S PROBABLY A WORTHY POINT TO COVER IS WHAT ADJUSTMENTS WE HAVE GOTTEN FROM OUR BOND COUNCIL. AND FROM THAT, I THINK LAURA WOULD BE BEST TO KIND OF JUST REVIEW OUR PROPERTY TAX [01:10:05] IMPACTS RELATED TO THIS PROJECT. THANK YOU, KEVIN. SO THERE WERE A FEW FACTORS THAT HAVE CHANGED FROM A FINANCIAL STANDPOINT SINCE THE FEBRUARY TIME FRAME WHEN THE ORIGINAL BOND ELECTION WAS CALLED. AND AS MENTIONED BEFORE, THE TWO FACTORS THAT HAVE REALLY CHANGED IS INTEREST RATES HAVE CONTINUED TO GO DOWN. AND ALSO, WE RECEIVED CERTIFIED VALUES FROM THE POTTER RANDALL APPRAISAL DISTRICT LAST WEEK. AND FORTUNATELY, THOSE APPRAISED VALUES HAVE RISEN. AND SO AS APPRAISAL VALUES RISE, YOU DON'T NEED QUITE AS MUCH OF A TAX RATE TO SUPPORT THE SAME SIZE OF AN ISSUANCE. AND SO I THINK WHAT'S BEEN DISCUSSED WITH COUNCIL AND WANTED JUST TO UPDATE BRIEFLY ON THIS WERE TWO SCENARIOS. THE FIRST ONE WOULD BE IF THE FULL PROJECT AND ALL THE DEBT ASSOCIATED WAS ISSUED UPFRONT FOR A TOTAL OF TWO HUNDRED AND NINETY FIVE MILLION. SO THE BOND ELECTION PIECE AND THEN ALSO SOME CERTIFICATES OF OBLIGATION, IT WOULD BE 13 .08 CENTS. NOW I KNOW ANOTHER QUESTION THAT COUNCIL HAD EXPRESSED OR HAD REALLY WEIGHED IN ON WAS POTENTIALLY STAGGERING THE ISSUANCE OF DEBT ASSOCIATED WITH THIS PROJECT. THE RULE OF THUMB IS THAT IF THE FUNDS CAN BE SPENT OR NINETY FIVE PERCENT OF THE FUNDS CAN BE SPENT WITHIN THREE YEARS OF THE ISSUANCE OF THE DEBT, THEN IT'S GOOD. IT'S OK TO GO AHEAD AND ISSUE IT ALL UP FRONT. TO BE SAFE, THOUGH, WE COULD LOOK AT STAGGERING THE ISSUANCE SO WE WOULD DO SEVENTY FIVE PERCENT OF THE GO BONDS IN THE FIRST YEAR AND ALL OF THE CERTIFICATES [INAUDIBLE] OBLIGATION. AND THEN WE WOULD DO THE REMAINING TWENTY FIVE PERCENT OF THE GO BONDS TWO YEARS LATER. WITH THAT, THAT WOULD CHANGE THE OVERALL ESTIMATED TAX RATE IMPACT TO 13.30 CENTS. SO THERE'S NOT A HUGE DIFFERENCE BETWEEN DOING IT THOSE TWO DIFFERENT WAYS. I THINK THERE ARE CERTAINLY ARGUMENTS BOTH WAYS. SO IT WOULD BE JUST KIND OF UP TO COUNCIL'S DISCRETION ON HOW THEY WANTED TO PROCEED WITH THAT. AND THOSE ARE NOT ITEMS THAT HAVE TO BE DECIDED TODAY. THIS IS JUST FOR YOUR INFORMATIONAL PURPOSES, LOOKING AT THOSE TWO DIFFERENT SCENARIOS. LAURA I MAY HAVE MISUNDERSTOOD YOU RIGHT THERE. YES. BUT I JUST WANT TO CLARIFY, IF WE ISSUED THAT ALL AT ONCE SUCCESSFULLY, THE ACTUAL IMPACT WOULD BE 13.08 CENTS. YES. IF WE STAGGERED IT, IT WOULD BE 13.3 CENTS. SO THERE'S 22 ONE HUNDREDTHS DIFFERENCE OF A PENNY BETWEEN THE TWO OPTIONS. YES. SO THERE IS [INAUDIBLE]. I THOUGHT YOU MIGHT HAVE SAID 13.03. INSTEAD OF 13.3. SO I'M SORRY IF I SAID THAT WRONG. THANK YOU YES. SO .22 DIFFERENCE OF A PENNY. SO I KNOW WE'RE TALKING ABOUT A LOT OF DECIMALS HERE, BUT THAT'S THE DIFFERENCE. IT'S A VERY SMALL DIFFERENCE BETWEEN THE TWO OPTIONS. EITHER IT WAS BECAUSE I THINK I WROTE IT DOWN WRONG, BUT IT'S NOT 13.08. BUT I MEAN, BECAUSE THE FIRST ONE SHOULD BE LARGER IF WE ISSUE IT ALL AT ONCE IS 13.8. AND IF WE STAGGER, IT IS 13.3. YES MA'AM. YEAH. IT'S ACTUALLY LARGER IF YOUR ISSUE IT STAGGERED BECAUSE IT DOES ASSUME A SLIGHT INCREASE TO INTEREST RATES OVER TIME. AND SO LET ME TELL YOU JUST FOR YOUR KNOWLEDGE, OUR FINANCIAL ADVISORS BUILT THESE ASSUMPTIONS BASED ON CURRENT INTEREST RATES PLUS TWENTY FIVE BASIS POINTS OR THE FIRST ISSUANCE, WHETHER THAT'S ALL OF IT, OR SEVENTY FIVE PERCENT. AND THEN THEY ALSO ASSUMED IF WE WAITED TWO YEARS TO DO THE REMAINING TWENTY FIVE PERCENT OF THE DEBT ISSUANCE, THEY ASSUMED CURRENT RATES PLUS SEVENTY FIVE BASIS POINTS. SO NOT A LOT OF A CHANGE BUT ABOUT A 50 BASIS POINTS DIFFERENCE, ASSUMING THAT OVER TIME INTEREST RATES MAY SLIGHTLY RISE. SO THAT'S WHY THE SECOND SCENARIO IS STAGGERING. IT WOULD ACTUALLY PRODUCE JUST A SLIGHTLY LARGER IMPACT ON THE TAX RATE. OK. I WANTED TO SHARE THAT JUST TO GIVE YOU SOME VISIBILITY ON WHAT WE'RE SEEING WITH REGARD TO INTEREST RATES, WHAT'S CHANGED WITH REGARD TO WHAT WE HAD INITIALLY PROPOSED IN MAY OF [01:15:04] THIS YEAR, WHICH WAS OVER TWO CENTS HIGHER THAN WHERE WE SEE THE IMPACT TO TAXPAYERS RIGHT NOW BECAUSE OF THE IMPACTS OF CORONA VIRUS AND THE IMPACTS ON CONSTRUCTION PROJECTS AND INTEREST RATES, THINGS LIKE THAT. THE ELECTION, AS IT'S PROPOSED RIGHT NOW, WILL ALLOW YOU THE FLEXIBILITY TO MAKE THIS DECISION THAT WE'RE TALKING ABOUT, WHETHER TO ISSUE IT ALL AT ONCE OR TO STAGGER IT BASED ON THE CURRENT FINANCIAL CONDITIONS AT THE TIME THAT WE MAKE OUR FIRST ISSUANCE. SO YOU'RE NOT LOCKED IN. BUT WE WANTED TO ILLUSTRATE TO YOU THAT YOU DO HAVE OPTIONS AND THOSE OPTIONS ARE VERY CLOSE TO EACH OTHER FROM A FINANCIAL IMPACT TO OUR COMMUNITY. BUT YOU WILL HAVE FLEXIBILITY TO MAKE THAT DECISION AT THE TIME YOU ISSUE THE DEBT. AND SO, LAURA, WOULD YOU RESTATE FROM OUR ORIGINAL PROPOSAL THAT WOULD HAVE BEEN ON THE BALLOT IN MAY BEING THE TAX RATE AND THE CORRESPONDING ANNUAL COST PER HUNDRED THOUSAND DOLLAR HOME COMPARED TO NOW INSTEAD OF TALKING PENNIES, LET'S TALK WHAT'S IT IN DOLLARS. ABSOLUTELY. AND I MAY SHARE THIS A LITTLE BIT WITH KEVIN BECAUSE I THINK HE'S GOT THOSE INITIAL AMOUNTS HANDY. SO, KEVIN, WOULD YOU MIND SHARING THE INITIAL NUMBERS AND THEN IT MIGHT BE EASIER TO TALK ABOUT THE INITIAL NUMBERS FIRST AND THEN WE CAN WALK THAT FORWARD TO HOW THAT'S CHANGED TO THIS TIME FRAME. DO YOU MIND, KEVIN, ON THAT? NO. SO ORIGINALLY IN THE MAY TIMEFRAME, AS WE WERE PURSUING THE CALLING OF THE ELECTION AND BASED ON THE FINANCIAL DATA THAT WE HAD AT THAT TIME, IT WAS A 15.1 CENT TAX IMPACT FOR THE TOTAL PROJECT, WHICH EQUATES OUT TO ONE HUNDRED FIFTY DOLLARS AND TEN CENTS PER ANNUALLY PER ONE HUNDRED THOUSAND DOLLAR VALUATION. WITH THE NEW UPDATED INTEREST RATES, AS LAURA INDICATED, THE INTEREST RATE WOULD BE IF IT'S ALL ISSUED AT ONCE, 13.08 CENTS, WHICH WOULD EQUATE TO ONE HUNDRED AND THIRTY DOLLARS AND EIGHTY TWO CENTS ANNUALLY PER ONE HUNDRED THOUSAND DOLLAR VALUATION. IF THAT DEBT WAS EXTENDED TO BE ISSUED OVER A THREE YEAR PERIOD AS AN ALTERNATIVE, THE INTEREST RATE WOULD BE SLIGHTLY HIGHER AT 13.3 CENTS, WITH A HUNDRED AND THIRTY TWO DOLLARS AND 99 CENT ANNUAL IMPACT ON PROPERTY TAX VALUES. ONE OF THE QUESTIONS THAT MANY PEOPLE WILL ASK IS HOW DOES THAT EQUATE TO MY TOTAL TAX BILL. AND THE ANALYSIS OF THAT, DEPENDING ON WHAT SCHOOL DISTRICT AND WHAT COUNTY YOU LIVE IN IS, IT WILL RESULT IN ANYWHERE FROM A 5.09 PERCENT INCREASE ON YOUR OVERALL TAX BILL TO A 5.9 PERCENT INCREASE ON YOUR TOTAL TAX BILL. SO IT DOES DEPEND ON WHAT SCHOOL DISTRICT AND WHAT COUNTY YOU LIVE IN AS TO HOW MUCH OF AN INCREASE ON YOUR OVERALL TAX BILL IT WOULD BE FOR PROPERTY TAXES. BUT IT IS SOMEWHERE JUST SLIGHTLY NORTH OF FIVE PERCENT TO JUST UNDER SIX PERCENT THAT YOU WOULD SEE INCREASED ON YOUR PROPERTY TAXES RELATED TO THIS PROJECT IF APPROVED. KEVIN YOU WILL PROBABLY HAVE A BETTER RECOLLECTION AND REMEMBER THIS BUT I REMEMBER IN OUR CONVERSATIONS WHEN WE LOOK AT THE VALUES OF HOMES IN AMARILLO, IF WE WERE DOING PROJECTIONS ON A HOME OF ONE HUNDRED AND FIFTY THOUSAND IT'S COVERED LIKE ABOUT 80 PERCENT OF OUR HOMES, IT WAS DO YOU REMEMBER WHAT THAT NUMBER WAS? YES MA'AM. I KNEW IT WAS A PRETTY A VALUATION OF ONE HUNDRED AND FIFTY THOUSAND DOLLARS, THAT IT WAS EITHER GOING TO BE THAT AMOUNT OR LOWER FOR THE VAST MAJORITY OF OUR HOMES. WAS IT THE 80 DO YOU REMEMBER. YES MA'AM. AS WE DID AN ANALYSIS OF THAT AND HONESTLY, THIS WAS AN ANALYSIS THAT WAS BROUGHT FORWARD BY OUR EXECUTIVE COMMITTEE. THIS WAS SOMETHING THAT THEY FELT VERY IMPORTANT TO LOOK AT, IS ONE HUNDRED THOUSAND DOLLAR VALUATION IS USED AS A COMMON DENOMINATOR TO EQUATE WHAT THE PROPERTY TAX IMPACT WOULD BE FOR A PROPERTY OWNER. SO IN EFFECT, IF YOU HAVE A 250,000 DOLLAR HOME, YOU MULTIPLY BY 2.5. IF YOU HAVE A 75,000 DOLLAR HOME, YOU MULTIPLY IT BY .75 AND YOU CAN MAKE THAT DETERMINATION. BUT OUR EXECUTIVE COMMITTEE IDENTIFIED THAT IN POTTER RANDALL COUNTIES 80 PERCENT OF THE HOMES IN POTTER RANDALL COUNTIES HAVE A EVALUATION OF TWO HUNDRED FIFTY THOUSAND OR LESS. SO THAT TWO HUNDRED FIFTY THOUSAND NUMBER GIVES YOU AN INDICATION OF WHAT 80 PERCENT OF THE HOMES IN AMARILLO'S TAX IMPACT WOULD BE. [01:20:01] AND JUST TO CLARIFY THAT WITH THE TWO PROPOSED TAX RATES. SO WE'RE KIND OF DISCUSSING RELATED TO THE PROJECT, THE ALL UP FRONT, THE 13.08 CENT INCREASE ON PROPERTY TAXES ON A 250,000 DOLLAR HOME WOULD BE 327 DOLLARS AND FOUR CENTS. IF IT'S ALL ISSUED OR IT'S ISSUED OVER A THREE YEAR PERIOD, THAT 13.3 CENTS, THAT INCREASES IT BY ABOUT FIVE DOLLARS TO 332 DOLLARS AND 47 CENTS. SO THAT'S WHAT THE OVERALL TAX RATE IN OR THE PROPERTY TAX IMPACT WOULD BE BASED ON A TWO HUNDRED FIFTY THOUSAND DOLLAR HOME. SO WE DO HAVE THAT INFORMATION. THANK YOU. AND THEN I JUST WANT TO POINT OUT FROM ALL THE CALCULATIONS YOU'RE DOING, THE BOTTOM LINE IS THAT THE NUMBERS ARE LOWER THAN WHAT WE TALKED ABOUT IN MAY, WHETHER WE ISSUED ALL THE DEBT UP FRONT OR IF WE USE ASSUMPTIONS THAT WE WOULD STAGGER IT WITH AN ANTICIPATION BUT STILL JUST A GUESSTIMATE THAT INTEREST RATES WOULD HAVE RISEN IN A TWO YEAR PERIOD. EITHER OF THOSE CALCULATIONS, AS OF RIGHT NOW, WHAT WE WERE ORIGINALLY TALKING ABOUT IN MAY TO OUR TAXPAYERS HAS GONE DOWN FOR THE SAME SCOPE, FOR THE SAME PROJECT. CORRECT. AND KEVIN, JUST TO CONFIRM ALSO THAT NONE OF THAT WOULD APPLY TO THE TAXPAYER WHOSE TAXES ARE FROZEN BECAUSE THEY'RE AGED 65 OR OLDER. COULD YOU EXPLAIN THAT FOR US? THAT IS CORRECT. SO MANY YEARS AGO, VOTERS APPROVED A PROPERTY TAX FREEZE FOR PEOPLE WHO ARE 65 OR OLDER WHO HAD IDENTIFIED OR SPECIFIC DISABILITIES AND MET SOME DISABILITY REQUIREMENTS PER THE IRS CODE AND THE LIKE. SO WITH THOSE PROPERTY TAXES FROZEN FOR THAT AGE GROUP AND FOR THOSE SPECIFIC REQUIREMENTS, THIS PROJECT HAS NO IMPACT ON YOUR PROPERTY TAXES. SO THE PROPERTY TAX RATE YOU'RE PAYING TODAY, IF THIS PROJECT IS APPROVED, WOULD BE THE SAME TODAY AS IT IS ONCE THE PROJECT IS APPROVED AND DEBT IS ISSUED. SO THERE WOULD BE NO INCREASE ON YOUR PROPERTY TAXES RELATED TO THIS PROJECT. MAYOR, I WOULD ALSO JUST POINT OUT THAT WHEN WE HAD MULTIPLE CONVERSATIONS FOR SEVERAL MONTHS RELATED TO THIS PROJECT, THERE WERE CONCERNS ABOUT THE PRICE, OBVIOUSLY THE COST IMPACT. BUT THE BIGGEST OPPOSITION THAT WAS VOICED WAS RELATED TO WANTING TO MOVE IT TO NOVEMBER TO HAVE A LARGER TURNOUT. AND AND SO I WOULD JUST SAY THAT THROUGH COVID-19 THAT OPPOSITION, IT HAS BEEN ACCOMPLISHED, THAT IT WOULD ADDRESS ONE OF THE THE MOST FREQUENTLY VOICED OPPOSITION TO HAVING THE ELECTION IN MAY WAS TO HAVE A LARGER POTENTIAL NUMBER OF TAXPAYERS WEIGH IN. AND THAT IS WHAT WE ARE CONSIDERING AT THIS POINT. AND IT ACTUALLY ADDRESSES AND ANSWERS ONE OF THOSE PREVIOUS CONCERNS. I HAD A CITIZEN ASK THIS MORNING IF WE WERE ANTICIPATING RAISING TAXES IN ORDER TO COVER COVID SHORTFALLS, AND I THINK JUST THE QUICK SHORT ANSWER IS, I'M NOT HEARING THAT IN A RECOMMENDATION FROM CITY MANAGER OR STAFF AT THIS TIME DUE TO THE QUICK ACTION THAT THEY TOOK TO FREEZE HIRING AND SOME OF THE SUMMER PROGRAMMING CHANGES THAT THEY MADE. SO I THINK THAT'S A QUESTION THAT I WANT TO JUST GET OUT THERE THAT WE RECOGNIZE THAT THERE'S A TAX INCREASE ON THE BALLOT FOR NOVEMBER AND WE'LL BE APPROACHING THE BUDGET, WHICH WE'RE DOING BUDGET TALKS NEXT WEEK WITH THAT IN MIND. SO I CAN'T SPEAK FOR THE WHOLE COUNCIL ON THAT. BUT JUST TO SPEAK TO THAT AS AN ISSUE I THINK THE DIRECTION WE'RE TRYING TO HEAD IN IS ALWAYS, WHICH IS TRY NOT TO RAISE TAXES IN THE BUDGET SESSION. OTHER CONCERNS, COUNCIL OR QUESTIONS FOR KEVIN OR LAURA. LET ME ASK A QUESTION. ASSUMING THE BOND ISSUE WE WILL SAY PASSES IN NOVEMBER, WHEN WOULD WE SELL? NOVEMBER, DECEMBER. [01:25:03] SO COUNCIL MEMBER SMITH OBVIOUSLY, THERE'S A LOT OF COMPONENTS RELATED TO THAT, BUT WE WOULD LOOK AT ISSUING DEBT EARLY IN PROBABLY 2021 AS AN INITIAL ISSUANCE OF DEBT OR THE TOTAL ISSUANCE OF DEBT, DEPENDING ON THE DIRECTION FROM COUNCIL. PART OF THAT IS THAT THE FIRST PHASE OF THIS PROJECT WOULD BE TO IMMEDIATELY INITIATE THE DESIGN WORK ON THE CIVIC CENTER PROJECT. SO THE NEW ARENA, THE EXPANDED CONVENTION CENTER, THE REMODEL OF THE CONVENTION CENTER SPACE CONFERENCE SPACE, THE REMODEL OF THE SANTA FE BUILDING AND RENOVATION OF THAT FACILITY, THE CONSTRUCTION OF A PARKING GARAGE. SO ALL OF THOSE COMPONENTS WOULD IMMEDIATELY MOVE FORWARD, INCLUDING THE RELOCATION OF CITY SERVICES TO MAKE WAY FOR THE NEW ARENA. SO WE WOULD LOOK TO ISSUE DEBT PROBABLY IN EARLY 2021 TO SUPPORT THIS PROJECT. AND THEN IT BECOMES A QUESTION OF WHETHER IT'S PHASED OVER THAT THREE YEAR PERIOD OR ISSUED ALL UPFRONT AS PART OF THE INITIAL ISSUANCE. SO MY SECOND QUESTION IS, IF WE DO THIS IN JANUARY THEN THIS 13.08 CENTS COULD BE SUBJECT TO CHANGE BECAUSE RATES COULD BE DIFFERENT. YES, THAT IS CORRECT. I THINK EVERYONE'S HEARING RATES MAY STAY LOW FOR A LITTLE WHILE. SO WE'RE HOPEFUL THAT THEY'RE GOING TO STAY LOW THROUGH THE TIME THAT WE ISSUE SOMETHING EARLY IN 2021. AND I THINK MAYBE A FOLLOW UP WITH WHAT YOU'RE SAYING, COUNCIL MEMBER SMITH AS WELL IS THIS RATE IF THIS IS APPROVED, IF THIS PROPOSITION IS APPROVED, THE RATE WOULD NOT IMPACT THE PROPERTY TAX BILLS UNTIL THE 2021 PROPERTY TAX BILLS AND THOSE ARE NOT DUE UNTIL 2022. SO IT WOULD NOT BE THE UPCOMING PROPERTY TAX BILLS THAT WOULD BE AFFECTED. IT WOULD BE THE ONES NEXT CALENDAR YEAR THAT ARE MAILED OUT TOWARDS THE END OF 2021. I UNDERSTAND THAT. AND SO MAYBE THE RATES WOULD BE EVEN LOWER IN JANUARY. WE CAN HOPE. FROM THAT WORKING WITH OUR BOND COUNCIL, THEY ARE VERY CONSERVATIVE IN THEIR ESTIMATES. THEY DON'T WANT TO PROVIDE US THE INFORMATION THAT WOULD PUT US IN A POSITION WHERE WE INDICATE ONE NUMBER AND THEN MISSED THE MARK BY A SIGNIFICANT MARGIN. SO THEY ARE VERY CONSERVATIVE IN THEIR APPROACH OF HOW THEY COMMUNICATE THAT. THEY ARE CONSTANTLY ANALYZING WHAT THEY BELIEVE THE TRENDS ARE IN THE MARKET TO ENSURE THAT THEY PROTECT THE CITY FROM COMMUNICATING INCORRECT INFORMATION TO POTENTIAL VOTERS AND THE LIKE. SO IT IS FROM THAT PERSPECTIVE THAT OUR BOND COUNCIL DOES CERTAINLY WHILE THERE'S ALWAYS RISK IN PROPERTY OR INTEREST RATES CAN CHANGE. THEY TAKE A VERY CONSERVATIVE APPROACH TO HOW THEY FORECAST THIS INFORMATION TO TO ASSIST US IN DEVELOPING THESE MODELS TO COMMUNICATE TO YOU AND TO THE VOTER. THANK YOU. I'M GLAD YOU ASKED THAT QUESTION, HOWARD. IT'S A GOOD ONE SO THAT WE ALL UNDERSTAND WHERE THOSE ESTIMATES COME FROM AND JUST HOW MUCH EXPOSURE DO WE HAVE ONCE WE PUT IT ON THE BALLOT THAT WAY OF THOSE RATES CHANGING. OK, ANY OTHER QUESTIONS? THOUGHTS FOR KEVIN AND LAURA. OK, I WILL JUST REMIND EVERYONE THAT ONCE WE PAUSED THIS PUSHED THE ELECTION FROM MAY TO NOVEMBER, WE DID RECONVENE THE EXECUTIVE COMMITTEE THAT WAS MADE UP OF CITIZENS WHO SPENT NOW REALLY TWO YEARS STUDYING THIS ISSUE, RECONVENED THEM TWICE TO GET THEIR OPINIONS ON WHETHER OR NOT THIS SHOULD MOVE FORWARD IN NOVEMBER AND ACROSS THE BOARD, EVERYONE HAS CONCERNS ABOUT ASKING VOTERS TO TAKE ON A FINANCIAL OBLIGATION ON THE HEELS AND IN THE MIDST OF COVID. BUT AS THAT CITIZEN'S COMMITTEE DISCUSSED IT AND JUST THOUGHT FORWARD THAT THIS IS A THREE YEAR PROJECT THAT REALLY HAS BEEN LOTS OF YEARS IN THE MAKING, IT WILL TAKE SEVEN YEARS FOR THE CIVIC CENTER TO STABILIZE ONCE IT DOES COME ONLINE AND ONCE IT COMES ONLINE, IT [01:30:04] ACTUALLY WILL THE NEW CIVIC CENTER WILL SAVE MONEY COMPARED TO WHAT THE CURRENT CIVIC CENTER COSTS US TO OPERATE. THERE WERE A LOT OF DISCUSSIONS AND FACTORS IN THERE ABOUT DOES ANYONE HAVE A CRYSTAL BALL THAT WOULD TELL US THE EXACT RIGHT TIME TO BRING THIS. AND OF COURSE, NO ONE KNOWS THAT. BUT I DID WANT TO POINT OUT THAT ORIGINAL GROUP OF CITIZENS THAT SPENT SO MUCH TIME RESEARCHING ALL OF THE OPTIONS, UNDERSTANDING THE INNER WORKINGS OF THE CIVIC CENTER AND THE NEEDS THAT ARE THERE, AND THEY'RE THE COMMITTEE THAT SPENT SO MUCH TIME VISITING WITH THE CONSULTANTS ABOUT THIS ISSUE, CAME BACK WITH A RECOMMENDATION THAT WE DO MOVE FORWARD WITH THIS IN NOVEMBER. AND PART OF THAT WAS THE CHANGE IN COST DUE TO THE DROP IN INTEREST RATES, MEANING WE CAN DO THIS PROJECT AT THIS TIME FOR LESS MONEY THAN WE'VE EVER BEEN ABLE TO DO IT BEFORE. SO. WITH ALL OF THAT SAID, I APPRECIATE THE PRESENTATION FROM KEVIN AND LAURA, ARE THERE ANY OTHER QUESTIONS THOUGHTS TO POINT OUT BEFORE WE MAKE A MOTION? YEAH, I'VE GOT ONE MORE THOUGHT. I WANT TO GO BACK TO THE SAME TO A DIFFERENT GROUP OF PEOPLE 50 YEARS AGO AND THE DECISIONS THAT THEY MADE TO BUILD THE CITY IN THE FACE OF WHAT THEY THOUGHT WAS A PRETTY SIGNIFICANT HEADWIND, THE ANNOUNCEMENT OF THE CLOSURE OF THE AIRBASE. SEVERAL OTHER THINGS WERE HAPPENING THAT WAS POTENTIALLY GOING TO DRY UP THE CITY OF AMARILLO WAS EVEN WHAT WAS EVEN SPOKEN AT THAT POINT IN TIME. AND IN THE FACE OF THAT, THEY REALIZED THAT THEY HAD TO DO SOME THINGS TO GET AMARILLO KICK STARTED AND BACK GOING AGAIN. AND IT WAS A VERY CRUCIAL, IMPORTANT MOVE THAT HAS HAD SIGNIFICANT REPERCUSSIONS ON THE CITY OVER THE PAST 50 YEARS. AND NONE OF THOSE HAVE BEEN BAD REPERCUSSIONS. AND I WOULD SAY AT THIS POINT IN TIME THAT WE ARE FACING THE SAME TYPE STRING OF HEADWINDS. AND AMARILLO NEEDS THIS JUST AS BADLY AS AMARILLO NEEDED IT BACK THEN. AND THEIR DIFFERENCE WAS THEY TORE DOWN MUNICIPAL AUDITORIUM. THEY DIDN'T HAVE ANYTHING AT ALL FOR THAT PERIOD OF TIME. CURRENTLY, WE WILL HAVE THE CIVIC CENTER THAT WE WILL STILL BE ABLE TO FUNCTION OUT OF FOR THE NEXT THREE YEARS AS WE GET THIS ONLINE. AND SO ACTUALLY, WE'RE IN A MUCH BETTER POSITION IF YOU EVEN WANT TO CONSIDER IT THAT WAY. BUT IT IS AS CRUCIAL TO US NOW IN MOVING FORWARD AS IT WAS CRUCIAL TO THEM 50 YEARS AGO. AND I THINK IT'S REAL IMPORTANT THAT WE DO EVERYTHING WE CAN TO HELP SEE THIS COME TO FRUITION. ANY OTHER THOUGHTS. THANK YOU EDDY. I'D LIKE TO SAY SOMETHING, I KNOW MAYOR YOU SAID THAT THE PRESIDENT SAYS THE CIVIC CENTER COMMITTEES WORK FOR THREE YEARS. I THINK IT'S BEEN CONSIDERED FOR MUCH LONGER THAN THAT IN RECENT TIMES. AND SO BUT IN THIS COMMITTEE'S WORK, PROBABLY NOT THAT LONG. AND SO I AGREE WITH EDDY. THE NEED IS NOT GOING TO GO AWAY, SO WE NEED TO JUMP OUT THERE AND DO IT. IT IS INTERESTING TO BE DOING INFRASTRUCTURE PROJECTS AT THIS TIME, I HEAR A LOT OF CONVERSATION OUT OF WASHINGTON, D.C. ABOUT THE NEED TO INVEST IN INFRASTRUCTURE PROJECTS. AND THIS IS ABSOLUTELY THAT AT OUR LOCAL LEVEL. AND IT IS A PRICE TAG, BUT IT IS OURS TO BENEFIT FROM. AND I JUST THINK IT'S TIME TO PUT IT IN FRONT OF THE VOTERS AND LET THE VOTERS DECIDE. ANYTHING ELSE. TO HOWARD'S COMMENT, I DON'T KNOW THE TIME PERIOD, BUT I KNOW THAT THERE HAVE BEEN FOUR NEEDS ASSESSMENTS PRESENTED TO THREE DIFFERENT COUNCILS, THOUGH IT HAS BEEN AN ONGOING CONVERSATION FOR QUITE A WHILE. AND IT CERTAINLY DIDN'T JUST BEGIN IN THE LAST THREE YEARS. AND AS YOU ALSO MENTIONED, THE NEED HAS NOT GONE AWAY. IF ANYTHING, IT HAS GOTTEN LARGER AND WE'RE STILL BACK AT A NEEDS ASSESSMENT AND EVALUATING IT TODAY. [01:35:04] GOOD POINT. OKAY WITH THAT, DO WE HAVE A MOTION ON ITEM 3 F. YES, MAYOR, WE DO. I MOVE TO APPROVE THE RESOLUTION, AMENDING AND RESTATING A RESOLUTION CALLING A BOND ELECTION TO BE HELD IN THE CITY OF AMARILLO, TEXAS. LET'S SEE HERE ON NOVEMBER 3RD, 2020 IN RESOLVING OTHER MATTERS INCIDENT AND RELATED TO SUCH AN ELECTION. SECOND. SO MOVE BY COUNCIL MEMBER POWELL AND SECONDED BY COUNCIL MEMBER SMITH TO APPROVE ITEM 3 F AS A RESOLUTION THAT WOULD CALL A BOND ELECTION. ANY FURTHER QUESTIONS OR DISCUSSION ON THIS ITEM? OK, I'LL CALL FOR A VOTE AT THIS TIME, ALL THOSE IN FAVOR OF THE MOTION, PLEASE RAISE YOUR HAND. I SEE FIVE HANDS THAT PASSES WITH A 5 0 VOTE. OK. ITEM THREE G IS TO CONSIDER A RESOLUTION DISCUSSING AND CONSIDERING A CLEAN WATER [G. CONSIDER RESOLUTION - DISCUSSION AND CONSIDERATION OF AGREEMENT: (Contact: Laura Storrs, Assistant City Manager) This item discusses and considers a Principal Forgiveness Agreement from the Clean Water State Revolving Fund with the Texas Water Development Board (TWDB).] STATE REVOLVING FUND, AGREEMENT OF PRINCIPAL FORGIVENESS, AGREEMENT WITH THE CLEAN WATER STATE REVOLVING FUND. MR. CITY MANAGER. MAYOR Y'ALL WILL RECALL THAT EARLIER THIS YEAR WE DISCUSSED A 29.5 DOLLARS MILLION ADVANCED METERING INFRASTRUCTURE PROJECT. WE HAVE WORKED FOR ABOUT A YEAR NOW OVER ACTUALLY TO WORK WITH TEXAS WATER DEVELOPMENT BOARD TO SECURE THE FUNDING FOR THAT. AS FOR THAT PROCESS, ASSISTANT CITY MANAGER FLOYD HARTMAN REPORTED SOME TIME AGO THAT THE TEXAS WATER DEVELOPMENT BOARD HAD DECIDED THAT WE WERE ELIGIBLE FOR A FORGIVENESS AGREEMENT THAT WOULD EQUAL A MILLION DOLLARS OFF THAT PROJECT. SO THE PROJECT IS NOW GOING TO BE 28.5 MILLION DOLLARS THAT WILL FINANCE THROUGH THE TEXAS WATER DEVELOPMENT BOARD AT ZERO PERCENT INTEREST WITH A MILLION DOLLARS BEING FORGIVEN. THIS IS THE RESOLUTION THAT MAKES THAT FORGIVENESS HAPPEN. SO REALLY, WE'VE TALKED ABOUT IT. THIS IS THE ACTUAL DOCUMENT THAT PUTS THE AGREEMENT IN PLACE, ALLOWING THEM TO [INAUDIBLE] THE FUNDS THAT MILLION DOLLARS OF FUNDS. WE HAVE LAURA STORRS, ASSISTANT CITY MANAGER AND CHIEF FINANCIAL OFFICER HERE TO ANSWER ANY QUESTIONS COUNCIL HAS ABOUT THAT. AND I KNOW I STOLE MOST OF YOUR THUNDER ON THAT LAURA FROM A PRESENTATION STANDPOINT, IT'S PRETTY STRAIGHTFORWARD. IT'S BEEN IN FRONT OF COUNCIL MANY, MANY TIMES. OR A NUMBER OF TIMES I DON'T WANT TO OVERSTATE THAT. ABSOLUTELY, AND I THINK, JARED YOU HAVE COVERED EVERYTHING VERY THOROUGHLY ON THAT. JUST WANTED TO MENTION THAT THE ONLY REASON THAT WE ARE BRINGING THIS SEPARATE TO COUNCIL. WE HAD TO FINALIZE THE WORDING OF THE AGREEMENT THROUGH THE TEXAS WATER DEVELOPMENT BOARD, AND IT WAS NOT QUITE FINISHED BY THE TIME WE BROUGHT THE ISSUANCE OF THE DEBT TO COUNCIL. AND SO THIS IS JUST THE FINAL PIECE TO ALLOW THAT ENTIRE PROJECT TO MOVE FORWARD AND TO ALLOW THE MILLION DOLLARS IN PRINCIPAL FORGIVENESS. AND THIS SHOULD BE THE LAST ACTION FROM THE FINANCING SIDE FOR COUNCIL. OKAY COUNCIL ANY QUESTIONS ABOUT THAT? IF NOT, THEN I WOULD ENTERTAIN A MOTION. YES, MAYOR, I MOVE THAT THE RESOLUTION BE APPROVED FOR A PRINCIPAL FORGIVENESS AGREEMENT, IN THE AMOUNT OF ONE MILLION DOLLARS FROM THE CLEAN WATER STATE REVOLVING FUND WITH THE TEXAS WATER DEVELOPMENT BOARD. SECOND. BEEN MOVED BY COUNCIL MEMBER POWELL SECONDED BY COUNCIL MEMBER SMITH TO APPROVE THIS RESOLUTION. ANY FURTHER QUESTIONS OR DISCUSSION FROM THE COUNCIL? ALL OF THOSE IN FAVOR, PLEASE RAISE YOUR HAND. OK, YOU WERE OFF CAMERA, THERE FOR A MINUTE EDDY. OKAY THAT PASSES WITH 5 0 VOTE. [H. CONSIDER PURCHASE - REAL ESTATE LOCATED AT POINT WEST PARKWAY AND EVANS STREET: (Contact: Kevin Carter, President & CEO of Amarillo EDC) This item authorizes the Amarillo EDC to execute all necessary documents for the purchase of 37.60 acres of land located at Point West Parkway and Evans Street in Amarillo. The purchase is for $4,000,000.00.] ITEM THREE H IS TO CONSIDER A PURCHASE OF REAL ESTATE LOCATED AT POINT WEST PARKWAY AND EVANS STREET. MR. CITY MANAGER. THIS IS WE HAVE KEVIN CARTER FROM THE AMARILLO ECONOMIC DEVELOPMENT CORPORATION TO SPEAK THAT AND PRESIDENT CEO. THIS IS SOMETHING THAT ALSO THAT'S BEEN IN FRONT OF YOU PREVIOUSLY. HOWEVER, I DO WANT TO ON THE CAPTION ON THE VERY LAST SENTENCE OF THE CAPTION, I JUST WANTED TO POINT OUT THAT THE PURCHASE IS FOR FOUR MILLION DOLLARS PERIOD. THE REST OF THAT SENTENCE IS ACTUALLY FOUND AT THE VERY BOTTOM OF THE AGENDA UNDERNEATH, THE LAST EXECUTIVE SESSION ITEM PLUS CLOSING COSTS AND RELATED EXPENSES. I JUST WANTED TO POINT THAT OUT, CLARIFY IT IS FOR FOUR MILLION DOLLARS PLUS CLOSING [01:40:01] COSTS AND RELATED EXPENSES. KEVIN WOULD SAY THAT DURING THIS PRESENTATION, BUT I WANTED TO MAKE SURE THAT I TIED OUR AGENDA TO THE STATEMENTS HE'S GOING TO MAKE. SO KEVIN WITHOUT FURTHER ADO TAKE IT AWAY. GOOD AFTERNOON, MAYOR COUNCIL, I PRESENT TO YOU. ITEM THREE H TO CONSIDER PURCHASE OF LAND LOCATED AT POINT WEST PARKWAY AND EVANS DRIVE. THE PURCHASE WOULD BE FOR 37.6 ACRES OR ONE MILLION SIX HUNDRED AND THIRTY SEVEN THOUSAND EIGHT HUNDRED AND FIFTY SIX SQUARE FEET IN THE POINT WEST DEVELOPMENT. THE PRICE IS FOUR MILLION DOLLARS PLUS CLOSING COSTS AND RELATED EXPENSES. THAT PRICE EQUATES TO TWO DOLLARS AND FORTY FOUR CENTS PER SQUARE FEET OR ONE HUNDRED AND SIX THOUSAND DOLLARS AND THREE HUNDRED AND EIGHTY THREE DOLLARS PER ACRE. WE HAD SMS APPRAISAL SERVICE IN LUBBOCK DO THE APPRAISAL FOR US. THE APPRAISAL VALUE CAME BACK AT EIGHT MILLION AND THIRTY THOUSAND DOLLARS ON THE APPRAISAL. AEDC BELIEVES THAT THIS PURCHASE WOULD ALLOW US TO CAPITALIZE ON THE CLOSE PROXIMITY OF THE MEDICAL, PHARMACEUTICAL AND ANIMAL HEALTH CAMPUSES IN OUR RECRUITING EFFORTS. THE AEDC BOARD VOTED 5 O TO PURCHASE THE ABOVE LAND AT THEIR JULY 20TH BOARD MEETING. AND MAYOR I WOULD LOVE FOR YOU TO CONSIDER THIS MAYOR AND COUNCIL FOR YOU TO CONSIDER THIS ITEM. DO WE HAVE ANY QUESTIONS FOR THE AEDC TEAM ABOUT THIS ITEM? YOU KNOW, LET ME GET CLEAR HERE. WE'VE AGREED TO BUY THIS FOR FOUR MILLION AND APPRAISED FOR EIGHT MILLION. THAT'S RIGHT. THAT IS CORRECT, YES, SIR, COUNCIL MEMBER SMITH. GOOD DEAL. YEAH, IT IS. THANK YOU. I JUST WANT TO SAY I'M REALLY EXCITED THAT WE'VE GOT THE OPPORTUNITY TO ALSO USE THE ECONOMIC DEVELOPMENT CORPORATION AND RECRUITING PEOPLE TO THAT MEDICAL COMMUNITY SIDE OF TOWN. I MEAN, I KNOW THEY'VE DONE AN EXCELLENT JOB WITH THE OTHER TWO AREAS THAT THEY HAVE BEEN DOING, BUT I THINK THIS OPENS A NEW DOOR FOR US, ESPECIALLY HAVING THE TECH VET SCHOOL AND HAVING THE PHARMACY SCHOOL THERE AND IN THE HOSPITAL DISTRICT. I THINK IT JUST OPENS UP A WHOLE NEW WINDOW FOR WHAT THE ECONOMIC DEVELOPMENT CORPORATION WILL BE ABLE TO RECRUIT TOWARDS AMARILLO. AND I'M REALLY EXCITED ABOUT IT. I THINK IT'S A GREAT MOVE. THANK YOU. YEAH, I WOULD SAY WITH A LITTLE BIT OF NOSTALGIA THAT WE'VE BEEN WORKING SO HARD ON THE TEXAS TECH VET SCHOOL OPPORTUNITY AND ALL ALONG, WHEN IT FIRST CAME TO OUR CITY, WHICH WAS BACK IN 15, MAYBE THE FIRST TIME THAT THE TECH ADMINISTRATION CAME AND MET WITH THE EDC ABOUT IT. THE CONCEPT WAS THAT WE WOULD DEVELOP SOME TYPE OF BUSINESS PARK OUT THERE AND THAT IT WOULD BE GREAT FOR PHARMACEUTICAL COMPANIES, GREAT FOR MEDICAL RESEARCH. AND SO YOU GUYS HAVE BEEN DILIGENTLY WORKING TOWARD THAT, NOT ONLY WORKING TO OPEN THE DOOR FOR THAT VET SCHOOL OPPORTUNITY TO HAPPEN IN THE TEXAS PANHANDLE. YOUR INVOLVEMENT IN THAT WAS PIVOTAL, BUT JUST CONTINUING WITH DILIGENCE TO EXECUTE ON THAT PLAN, EXECUTE ON THAT VISION. AND I THINK THIS IS A GREAT STEP AND WHAT A BONUS THAT IT'S COMING IN AT A VALUE WHERE YOU'RE ALREADY SHOWING A RETURN ON THE DOLLAR. I THINK THAT'S WONDERFUL. BUT I THINK WHAT YOU'RE REALLY GOING TO GET A RETURN ON IS THE VALUE OF THIS CONCEPT, SUPPORTING THE MEDICAL COMMUNITY IN AMARILLO AND ACROSS THE PANHANDLE. I THINK THERE'S A LOT OF OPPORTUNITY THERE FOR US ECONOMICALLY. AND I'M REALLY EXCITED TO SEE WHERE YOU GUYS CONTINUE TO GO AND DEVELOP THIS PROJECT. YES, MA'AM, IT GIVES US A TANGIBLE ASSET NOW TO BE ABLE TO SELL THAT WE YOU KNOW, WE COULD TALK ABOUT THAT WE HAD THIS CONCEPT. NOW WE ACTUALLY HAVE THE TANGIBLE ASSET TO GO AND SALE. AND SO WE'RE VERY EXCITED ABOUT THAT AND APPRECIATE OUR BOARD. I DO HAVE TO SAY, I APPRECIATE THE [INAUDIBLE] TEAM THAT OWN THE LAND. I CAME APRIL 1ST LAST YEAR, AND I LOOKED BACK IN APRIL 8TH OF LAST YEAR WITH DICK [INAUDIBLE] FROM POINT WEST. AND SO WE'VE BEEN WORKING ON THIS FOR A LITTLE OVER A YEAR TO TRY TO GET THIS DONE. AND SO VERY EXCITED ABOUT TODAY AND AND WHAT WHAT OUR FUTURE HOLDS IN THAT DEVELOPMENT. WELL, DEFINITELY THANK YOUR BOARD FOR ALL OF THEIR WORK ON IT, AS WELL AS EVERYBODY ON YOUR STAFF. YES, MA'AM. ANY OTHER QUESTIONS, COUNCIL, IF NOT NOW WOULD BE A GOOD TIME FOR A MOTION. [01:45:08] YES, MAYOR, I MOVE TO AUTHORIZE THE AMARILLO ECONOMIC DEVELOPMENT CORPORATION TO EXECUTE ALL NECESSARY DOCUMENTS FOR THE PURCHASE OF THIRTY SEVEN POINT SIX ZERO ACRES OF LAND LOCATED AT POINT WEST PARKWAY AND EVANS STREET IN AMARILLO, TEXAS, IN THE AMOUNT OF FOUR MILLION DOLLARS PLUS CLOSING COSTS AND RELATED EXPENSES. SECOND. WE HAVE A MOTION MADE BY COUNCIL MEMBER POWELL AND A SECOND ON THAT MOTION BY COUNCIL MEMBER SAUER. ANY FURTHER QUESTIONS OR DISCUSSION ABOUT THIS MOTION? ALL OF THOSE IN FAVOR, PLEASE RAISE YOUR HAND. I SEE FIVE HANDS THAT WILL PASS WITH THE A 5 0 VOTE. THANK YOU. THANK YOU. WE APPRECIATE IT KEVIN. THANKS FOR YOUR LEADERSHIP. GOOD JOB. CONGRATS. OK, AT THIS TIME, THAT CONCLUDES OUR REGULAR SESSION FOR THE MEETING TODAY. [EXECUTIVE SESSION: City Council may convene in Executive Session to receive reports on or discuss any of the following pending projects or matters: 1) Section 551.072 - Discuss the purchase, exchange, lease, sale, or value of real property and public discussion of such would not be in the best interests of the City's bargaining position: (a) Discuss properties located in the Central Business District. plus closing costs and related expenses.] SO IF OUR CITY ATTORNEY WOULD READ OUR EXECUTIVE SESSION, DISMISSAL LANGUAGE, PLEASE. YES MA'AM. PURSUANT TO THE TEXAS OPEN MEETINGS ACT CLOSED SESSION. THE AMARILLO CITY COUNCIL WAS ANNOUNCED ON JULY THE 28TH 2020 AT [INAUDIBLE]46 P.M.
