EVER SAW THE CITY AUDITORIUM AMARILLO WAS SO PROUD OF BEFORE WE BULLDOZED IT AND REPLACED IT WITH A CIVIC CENTER? YOU SAW IT. LORD, YOU KNOW, LORD, THAT ONLY A FEW OF US WERE AROUND WHEN THE NAYSAYERS SAID WE WOULD BANKRUPT OUR TAXPAYERS IF WE APPROVE THAT CIVIC CENTER BOND ISSUE FIVE DECADES AGO.

BUT YOU ALSO KNOW, LORD, HOW MANY OF US IN THIS ROOM HAVE ATTENDED CONCERTS, WATCHED PLAYS, DODGE HOCKEY PUCKS, SOLD OUR WARES, HELD BANQUETS TO RAISE CHARITABLE FUNDS AND EVEN PERFORMED ON THE STAGE IN THAT CENTER? AND I GUESS THE COS ARE CONSIDERED BONDS.

HAVING THE ELECTION FOR THIS BOND IN MAY IS THE MOST.

LOGICAL THING THAT THE CITY COULD POSSIBLY DO.

DO HAVING AN ELECTION DURING THE TIME YOU ELECT PRESIDENTS.

YOU END UP PEOPLE VOTE STRAIGHT BALLOTS.

THEY DON'T EVEN PAY ATTENTION TO ALL YOUR AMENDMENTS.

AND ANY BOND ISSUES AND STUFF LIKE THAT, THEY'RE VOTING FOR A STRAIGHT BALLOT FOR PRESIDENT OF THE UNITED STATES.

SO, YOU KNOW, WHEN WE GO OUT AND WANT TO VOTE FOR THIS, EVEN THOUGH I LIVE IN THE COUNTRY, I HAVE RENTAL PROPERTY IN THE CITY.

SO IT WILL AFFECT MY TAXES.

I BELIEVE $15 A MONTH IT'S NOT GOING TO BREAK ME OR MY BANK ACCOUNT OR A LOT OF PEOPLE'S BANK ACCOUNTS. IF YOU HAVE A MORTGAGE, MOST OF THAT GOES INTO YOUR MORTGAGE.

YOU KNOW, YOUR TAXES ARE INCREASED.

BUT YOU KNOW, THIS CIVIC CENTER, THIS NEW CIVIC CENTER.

IT WILL BRING SO MUCH BACK TO THE CITY OF AMARILLO.

AND, YOU KNOW, I REALIZE THAT SOME PEOPLE ARE CONCERNED WITH THE PARKING ISSUES.

I HAD KEVIN EXPLAIN THE PARKING TO ME, EVEN THOUGH THERE'S SIX THOUSAND THREE HUNDRED FIFTEEN SPOTS AS I WAS DRIVING INTO TOWN.

I'M THINKING OF ALL THESE PLACES, LIKE OUT HERE AT THE CITY, IN THE CITY PARKING LOT, THOSE COPS, THOSE SPOTS ARE NOT ACCOUNTED FOR.

SO I DON'T KNOW HOW MANY PEOPLE YOU CAN PARK OUT HERE AND DIFFERENT BUSINESSES THAT JUST OPENED UP THEIR PARKING.

IN HODGETOWN HOW WE ACCOMMODATED TRIED TO GO INTO PLAY OF HOW MUCH MORE PARKING SPACES WE NEEDED AND WE NEVER WERE IN A CRISIS MODE WITH THAT.

WE HAD ENOUGH FOR EVERYBODY.

EVERYBODY WAS WILLING TO COME, YOU KNOW.

AND IF THE CITY WILL CONSIDER, YOU KNOW, POSSIBLY BUSSING PEOPLE DOWNTOWN TO SOME OF THE EVENTS AT THAT NEW CIVIC CENTER, THIS ARENA AND THE NEW CIVIC CENTER IS A MUCH NEEDED THING. AND I HOPE THAT WE WILL PUT IT ON THE BALLOT IN MAY AND NOT WASTE OUR TIME AND GO BACK TO NOVEMBER. IT'S IT'S NEEDED NOW.

SECOND REASON IS THE LONGER WE WAIT, IF WE GET A FAVORABLE VOTE, THE LONGER WE WAIT, THE MORE IT COSTS FOR CONSTRUCTIONS.

SO IF THE VOTERS DECIDE TO GO AHEAD WITH IT, LET'S DO IT.

BUT EQUALLY IMPORTANT, SIMILAR CULTURES, UNIQUE LAW ENFORCEMENT ASPECTS OF WEST TEXAS AND ALL THE DISTANCES INVOLVED, INTER JURISDICTIONAL PARTNERS.

YOU WORKED OUT ALL THOSE ARRANGEMENTS IN PREVIOUS CITIES.

YOU'VE ALSO WORKED ON A LOT OF PROJECTS THAT WE'VE RECENTLY IMPLEMENTED HERE IN MIDLAND AS WE GO THROUGH THE NATIONWIDE SEARCH.

CHIEF ROBINSON'S TASK IS TO KEEP US MOVING FORWARD IN THE SAME DIRECTION THAT WE'VE BEEN GOING, WORKING AND FOCUSING ON THE SAME PROJECTS THAT WE'VE BEEN FOCUSING ON, BRINGING US OPPORTUNITIES TO DO THINGS BETTER OR TO DO A BETTER JOB OF SERVING OUR COMMUNITY, PROTECTING OUR COMMUNITY.

OH YEAH. TO SEE IS CONSIDER APPROVAL FINAL CONSTRUCTION CONTRACT WITH WESTERN BUILDERS FOR THE [INAUDIBLE]. SO THAT IS FINALIZING THE PROJECT AND TASKING ALL OF THE FUNDS TOWARD ALL THE SPECIFIC PROJECTS TO COMPLETE THE IMPACT PROJECT.

SO AS WE WERE GOING THROUGH THE CONSTRUCTION ESTIMATES FOR THE PROJECT, WE HAD TO VALUE ENGINEER CERTAIN SUPPLEMENTAL PARTS COMPONENTS OF THE PROJECT OUT SO THAT WE COULD MAKE SURE THAT WE WERE STAYING UNDER BUDGET AND THAT WE COULD COMPLETE THE PROJECT ON TIME AS WE GOT BETTER, BETTER RESOLUTION THROUGH THE BIDDING PROCESS IN THE CONSTRUCTION PROJECTS PROCESS AND KNEW THAT WE HAD.

WE WERE GOING TO FINISH THE PROJECT UNDER BUDGET.

WE DID NOT IMMEDIATELY TASK THOSE FUNDS BECAUSE WE WANTED TO GET THROUGH ONE YEAR OF OPERATION SO THAT WE COULD HAVE A BETTER IDEA OF WHERE WE NEEDED TO EXPEND THOSE FUNDS TO MAKE THE FACILITY OPERATE BETTER.

ONE OF THE THINGS THAT WE'RE GONNA BE DOING WITH THESE FUNDS IS BUILDING A THIRD FLAGPOLE THAT'LL HELP HOLD A PENNANT, WHICH WE DIDN'T ANTICIPATE HAVING RIGHT OFF THE BAT.

BUT AMONG IN ADDITION TO THAT, THERE'S OTHER SMALL FACILITY ORIENTED PROJECTS THAT WE'RE FINISHING UP AND WE'RE GOING TO FINISH THE PROJECT A LITTLE OVER FIVE HUNDRED DOLLARS UNDER BUDGET. SO THE MAIN TAKEAWAY OF THAT IS WE FINISHED IT ON TIME AND WE ALSO FINISHED IT UNDER BUDGET. SO IS THERE ANY QUESTIONS FOR JERRY? IT'S GOOD FOR US TO SPEND TIME TOGETHER.

THAT'S HOW RELATIONSHIPS ARE BUILT.

AND YOU LEARN THINGS JUST BEING AROUND OTHER CITIES THAT HAVE VERY SIMILAR CHALLENGES AND CITIZENS THEIR VALUES FROM THEIR CITIZENS, VERY SIMILAR TO OURS.

MAYOR TURNER FROM ODESSA, OF COURSE, GAVE A REPORT ON THEIR ACTIVE SHOOTER SITUATION AND JUST HOW DEVASTATING IT WAS AND UNEXPECTED TO HAVE THAT LARGE OF A CRIME SCENE INVOLVING THAT MANY PEOPLE. SO THERE WERE MANY TAKEAWAYS INSIDE THAT THAT MADE ME, AS A LEADER IN OUR CITY, WANT TO KNOW HOW PREPARED ARE WE TO RESPOND TO THAT KIND OF SITUATION IN THE CITY? MANAGER WAS VERY GENEROUS AND GIVING ME A LOT OF TIME TO TALK THROUGH THAT AND ADDRESS SOME OF THOSE QUESTIONS.

AND A LOT OF THE QUESTIONS FROM THE MAYOR'S POINT OF VIEW ARE RELATED TO HOW DO WE CORRESPOND WITH THE MEDIA.

YOU KNOW, THEY WERE ON NATIONAL NEWS INSTANTLY.

SO DO WE HAVE A PLAN IN PLACE SO THAT WE HAVE ACCURATE INFORMATION SO THAT WE'RE NOT GIVING TOO MUCH INFORMATION, THAT THE FIVE OF US KNOW WHAT THE PLAN IS FOR COMMUNICATING WITH NATIONAL MEDIA? HE WAS GETTING PHONE CALLS FROM PEOPLE LIKE BETO O'ROURKE.

AND, YOU KNOW, HE'S LIKE, I HAVE NO IDEA HOW THEY GOT MY CELL PHONE NUMBER, BUT THEY HAD IT. AND YET HE WAS ON THE SPOT AND FELT UNPREPARED.

MAYOR WILLIAMS FROM ABILENE TALKED ABOUT THEIR STREET MAINTENANCE FUND A FEW YEARS AGO.

THEY PASSED A $6 .50 CENT PER SPIGOT FUND.

SO THEY ANNUALLY PUT THAT THEY CHARGE EACH HOUSEHOLD AND THEY PUT IT TOWARDS STREET MAINTENANCE AND THEY DECIDED TO DO THAT INSTEAD OF PASSING A BOND, HAS A FOUR YEAR SUNSET ON IT. AND HE JUST TALKED ABOUT HOW POLITICALLY DIFFICULT IT WAS TO GET THAT PASSED.

BUT ONCE IT PASSED, HE FEELS LIKE IT'S GOING TO MAKE A BIG EFFECT IN THEIR INFRASTRUCTURE, IN THEIR CITY.

SO IT WAS REALLY INTERESTING TO HEAR HIM TALK THROUGH ALL THE DYNAMICS OF THAT.

AND SO WE ASKED WE'RE ASKED TO PUT TOGETHER A KIND OF A RECAP OR A SNAPSHOT OF WHAT WE'VE DONE THROUGH PROJECT SAFE NEIGHBORHOOD.

I WANTED TO START OUT AND JUST KIND OF RECAP THIS FOR THOSE IF THEY'RE NOT FAMILIAR WITH THE PROGRAM IN JANUARY OF 2019, THE AMARILLO POLICE DEPARTMENT BEGAN PROJECT SAFE NEIGHBORHOOD INITIATIVE TO COLLABORATIVE.

CAN WE MOVE THAT SLIDE ? A COLLABORATIVE PROGRAM BETWEEN AMARILLO POLICE DEPARTMENT, OTHER LOCAL, STATE AND FEDERAL LAW ENFORCEMENT AND PROSECUTORS.

AND I SPOKE WITH MICHELLE.

SHE DIDN'T WANT THE ALPHABET SOUP, SO I'M NOT GONNA GO THROUGH THAT LONG LAUNDRY LIST OF ALL OUR PARTNERS, BUT IT'S BEEN A REALLY GOOD PROGRAM.

THE MAIN FOCUS OF THE PSN IS TO REDUCE VIOLENT CRIMES IN OUR COMMUNITIES.

MOST AFFECTED BY VIOLENCE AFTER CONDUCTING STRICT DATA RESEARCH TO PSN ZONE WAS ESTABLISHED PRIMARILY IN THE SAN [INAUDIBLE] AND NORTH HEIGHTS NEIGHBORHOOD.

IN ADDITION TO A CORRIDOR ALONG AMARILLO BOULEVARD, THE MAIN TENETS OF PSN INCLUDE FILING FEDERALLY INSTEAD OF IN STATE COURTS, WHICH HAS SEVERAL DISTINCT ADVANTAGES IN FEDERAL COURT BONDS TYPICALLY IS DENIED AS OPPOSED TO IN OUR STATE COURTS.

THEY ALSO HAVE A SPEEDY TRIAL REQUIREMENT OF 90 DAYS TO WERE IN STATE PROSECUTIONS.

OFTEN IT'S TAKEN TWO AND THREE YEARS SOMETIMES TO GET A CASE ADJUDICATED.

DURING THAT TIME, A GOOD MANY OF OUR VIOLENT AND REPEAT OFFENDERS ARE OUT ON OUR STREETS, OUT ON BOND, SOMETIMES ON SERVE OF FELONY BONDS WHILE THEY'RE STILL OUT CREATING MAYHEM AND CRIMES IN AMARILLO.

SO IN THIS CIRCUMSTANCE, IF THEY GET FILED ON FEDERALLY WOULD TAKE HIM TO THE RANDALL COUNTY, WHICH HAS THE CONTRACT FOR THE FEDERAL PRISONERS.

AND TYPICALLY THEIR FEET DON'T HIT THE GROUND, AS CHIEF LIKE TO SAY, UNTIL THAT'S DONE.

OBVIOUSLY, IF THERE IS A CONVICTION OR A PLEA DEAL, THEN THEY GO OFF TO A FEDERAL PRISON.

AND THAT WAY, OUR COMMUNITY IS SO PROTECTED FROM THEM THAT THEY'RE NOT OUT CREATING MORE CRIMES. TODAY WE FILED ON APPROXIMATELY 91.

AND THAT HAS GONE OVER VERY WELL WITH OUR PARTNERS ACROSS THE COUNTRY.

THEY RECOGNIZE THAT AMARILLO HAS BEEN VERY SUCCESSFUL IN THAT.

WE STARTED OUT WE WANT TO TALK ABOUT PSN AS A WHOLE.

YOU WILL SEE THAT THERE IS A SLIGHT PART OF SAN JACINTO, NORTH OF THAT PURPLE LINE THAT IS ACTUALLY NOT IN THE PSN ZONE.

AND THAT'S JUST SIMPLY BECAUSE THE DATA AT THE TIME DID NOT SUPPORT THAT.

SO WE DO HAVE SOME INSTANCES OF THAT.

OK. SO FOR AMARILLO, VIOLENT CRIMES FOR THE YEAR, IF YOU'LL LOOK AT FOCUS ON 2019, I KNOW YOU'LL HAVE THE OTHER YEARS IN FRONT OF YOU.

JUST WANT TO SHOW THAT AMARILLO AS A WHOLE, WE HAD JUST A LITTLE BIT LESS OF 1 PERCENT DECREASE IN THE AGGRAVATED ASSAULTS, 25 PERCENT ACTUAL INCREASE IN HOMICIDES FROM 18 TO 19. WE HAD APPROXIMATELY A 17 PERCENT DECREASE IN ROBBERIES 20 PERCENT .65 IN SEXUAL ASSAULTS WITH A BOTTOM LINE TOTAL OF A REDUCTION OF SEVEN POINT THIRTY NINE IN THOSE VIOLENT CRIMES GOING OVER TO THE SAN JACINTO AREA IN 2019, WE SAW A DECREASE OF SIXTEEN POINT FOUR PERCENT HOMICIDES, 50 PERCENT.

WE WENT FROM TWO TO ONE.

SO THOSE SMALLER NUMBERS MOVES THE NEEDLE, THE LAW.

THAT'S WHY THAT'S REFLECTED THAT WAY.

AND ROBBERIES THEY WERE REDUCED BY 29.7 PERCENT. SEXUAL ASSAULTS REDUCED BY FORTY FIVE POINT FIVE PERCENT IN A GRAND TOTAL FOR THE VIOLENT CRIMES AT SAN JACINTO AREA WAS A REDUCTION OF TWENTY THREE POINT FOUR PERCENT MOVING OVER THE NORTH HEIGHTS AGAIN FOR 2019.

WE HAD A TWENTY SEVEN POINT THREE PERCENT REDUCTION IN AGGRAVATED ASSAULTS, 50 PERCENT IN MURDERS 20 PERCENT AND ROBBERY AND SEVENTY FIVE PERCENT REDUCTION IN SEXUAL ASSAULTS WITH THE GRAND TOTAL OF THIRTY THREE POINT THREE PERCENT FOR TOTAL VIOLENT CRIMES IN THOSE AREAS. AND GO ON TO THE NEXT.

EVEN THOUGH THERE IS A FOCUS ON THE VIOLENT CRIME AND PSN, I THINK WE JUST WANTED TO KIND OF HIGHLIGHT SOME OF THE OTHER AREAS AS WELL WHERE WE'VE SEEN SUCCESS.

SO FOR AMARILLO AS A WHOLE, THE AREAS YOU SEE HIGHLIGHTED IN PINK OR SALMON, WHATEVER COLOR THAT MIGHT BE.

DWI S WE'RE DOWN TWENTY SIX POINT FOUR PERCENT.

THEFT TWENTY POINT SIX AND UNLAWFUL POSSESSION OF A FIREARM BY 24 PERCENT.

AND THEN THAT'S NOT LISTED AS A VIOLENT CRIME PER SAY.

BUT THAT'S JUST THE MERE FACT OF A FELON HAVING A FIREARM ON THEM, WHICH AGAIN, IS JUST WAITING FOR A VIOLENT CRIME TO HAPPEN.

BUT IT'S NOT CATEGORIZED AS A VIOLENT CRIME, PARTICULARLY MOVING OVER TO THE NORTH HEIGHTS. AGAIN, THE NONVIOLENT CRIME FOR BURGLARIES, WE WERE DOWN THIRTY FIVE POINT FIVE PERCENT, DISCHARGING OF A FIREARM REDUCED BY TWENTY THREE POINT ONE.

DISORDERLY CONDUCT REDUCED BY THIRTY POINT EIGHT.

DWI IS REDUCED BY TWENTY EIGHT POINT SIX IN THEFT BY TWENTY SIX POINT FOUR PERCENT.

MOVING OVER TO SAN JACINTO, WE HAD A REDUCTION OF NARCOTICS OFFENSES OF 16 PERCENT DWI, 16 PERCENT HARASSMENT, 30 PERCENT REDUCTION IN UNLAWFUL POSSESSION BY FIREARM, A REDUCTION OF 20 PERCENT.

SO ALL THESE OTHER ITEMS, THEY MAY NOT BE VIOLENT CRIMES.

A DUI IS JUST WAITING FOR SOMEBODY TO BE HURT OR KILLED.

THESE OTHER THINGS ARE ALL THINGS THAT IMPACT PEOPLE'S LIVES.

AND SO BESIDES THE VIOLENT CRIMES, WE JUST THINK IT SHOWS REALLY GOOD PICTURE HOW WE THINK THAT THIS IS HAVING A GOOD CAUSE AND EFFECT AND TOTAL QUALITY OF LIFE FOR OUR CITIZENS, PARTICULARLY THOSE AFFECTED IN THE NORTH HEIGHTS AND SAN JANCINTO AND THE PS N AS A WHOLE. CHIEF, THESE REDUCTIONS IN MOST CASES ARE DRAMATIC.

IN YOUR OPINION AND POSSIBLY IN ANYBODY'S OPINION, IS THIS A FUNCTION OF VIOLENT OFFENDERS BEING REMOVED FROM THE COMMUNITY THROUGH A MORE EFFECTIVE PROSECUTION PROCESS ASSOCIATED WITH THE PEN AND FEDERAL OPPORTUNITIES? THANK YOU. [INAUDIBLE] YES, SIR.

THEIR I.D. BADGES OPERATE THE GATE SO IT STAYS SECURE FOR FULL OPERATIONS.

THE SECOND ONE IS THE PARKING AREA DIRECTLY NORTH OF PD IN BETWEEN THE TWO PROPERTIES.

AS YOU CAN SEE, THE SECURITY FOR THAT AREA WAS ONLY IN THE LOWER RIGHT HAND CORNER.

IT DID PROVIDE SECURITY FOR NEARLY ENOUGH OF OUR PATROL VEHICLES OR OFFICERS TO OPERATE SAFELY. THE ENHANCEMENT BASICALLY ENCOMPASSES TWO THIRDS OF THAT CITY BLOCK.

ONE THING THAT WE DID ON THIS THAT'S CRITICAL TO POINT OUT AS WELL AS THE DOWNTOWN STANDARDS ARE MET ON THESE CONSTRUCTION PROJECTS.

SO ADDITIONAL STREETSCAPE, LIGHTING AND TREES AND GREEN SPACE WAS DEVELOPED AS WELL.

WE WE FEEL LIKE THIS AREA IS GOING TO GREATLY ENHANCE THEIR OPERATIONS WITHIN PD.

ALL OF THESE DESIGNS WERE DONE IN CONJUNCTION WITH THE POLICE DEPARTMENT.

COLONEL FUNTEK AND CHIEF DRAIN WERE MAJOR CONTRIBUTORS TO THE CONCEPT AND WHAT THEIR NEEDS WERE. AS YOU CAN SEE, THE PROPOSED BOND FUNDED FIVE MILLION SIX HUNDRED TWENTY NINE THOUSAND, WE CURRENTLY HAVE FIVE MILLION ONE HUNDRED FOURTEEN THOUSAND UNDER CONSTRUCTION CONTRACTS ON THE JOB.

THE REMAINING AMOUNT IS TO BE USED BY THE POLICE DEPARTMENT AT THEIR DISCRETION.

THAT PROJECT SHOULD BE COMPLETE IN ANOTHER THREE HUNDRED AND TWENTY FIVE DAYS.

OF COURSE, WE HAD SOME CONCERNS DURING THE CONSTRUCTION OF THIS.

WHEN WE LOOK AT THE FIRE DEPARTMENT AND THE CONSTRUCTION COSTS, YOU CAN SEE THAT THE FIRE DEPARTMENT BOND NUMBERS WERE A LITTLE OVER 12 MILLION DOLLARS.

WE SPENT NINE MILLION SIX TWENTY FIVE ON THE PROJECT.

YOU SEE THAT THEIR FIRE DEPARTMENT EQUIPMENT NEEDS ARE A LITTLE BIT BIGGER.

SOME OF THOSE NEEDS REPRESENTED OR SOME OF THE EQUIPMENT THAT THEY NEED TO OPERATE, AS WELL AS A FIRE TRUCK. THAT WAS RIGHT AT NINE HUNDRED THOUSAND DOLLARS.

I'D LIKE TO ALSO POINT OUT THAT WITH JERRY'S INPUT AND WITH COUNCIL SUPPORT, MOST OF, CITIES IN GENERAL ARE NOT CONSIDERED TO BE TERRIBLY NIMBLE.

BUT WHEN JERRY WAS DOING THE ANALYSIS ON HOW JUST HOW FAST CONSTRUCTION PRICES WERE ESCALATING, WE BROUGHT A RECOMMENDATION TO COUNCIL TO ACCELERATE THE FACILITY PROJECTS TO CONSTRUCTION PROJECTS THAT WE HAD IN PROP 2 FROM THE 2016 BOND.

COUNCIL AUTHORIZED THAT IMMEDIATELY AND THAT ENABLED US TO PUT STATION NINE UNDER CONSTRUCTION, ALMOST SIMULTANEOUS WITH STATION THREE.

IN FACT, IT WAS SIMULTANEOUS WITH STATION THREE FOR MANY, MANY MONTHS OF THE CONSTRUCTION PROCESS. IT ALSO ENABLED US TO MOVE STATION FIVE MORE THAN TWO YEARS UP IN THE CONSTRUCTION SCHEDULE BECAUSE IT WAS PREVIOUSLY SCHEDULED TO BE ONE OF THE LAST THINGS WE BUILT. AND WE KNEW THAT IF WE DIDN'T DO THAT, WE WOULD NOT BE ABLE TO BUILD STATION 5 AND Y'ALL SAW THE CONDITION OF STATION 5.

THAT WOULD HAVE LEFT OUR FIREFIGHTERS WORKING IN A VERY OLD UNDERSIZED, DILAPIDATED, QUITE FRANKLY, ALMOST UNSAFE BUILDING FOR THE FORESEEABLE FUTURE BECAUSE WE WOULDN'T HAVE HAD THE MONEY TO BUILD STATION FIVE.

SO I THINK THAT REALLY MORE THAN ANYTHING ELSE, I JUST WANT TO POINT OUT HOW YOU ALL HAVE TAKEN A VERY PROACTIVE APPROACH TO THAT AND BEHAVED IN A IN A IN A WITH A LEVEL OF NIMBLENESS THAT THAT IS RARELY SEEN IN CITIES.

SO THANK YOU. AND IT WENT UP WOULD PROBABLY BE AT LEAST 10 PERCENT SAVINGS IN COST.

SO ABSOLUTELY, WE WOULD HAVE BEEN LOOKING AT A MINIMUM OF TWELVE.

BUT THAT'S NOT FORESEEABLE WHEN WE PUT THESE BUDGETS TOGETHER.

WE COULD HAVE A YEAR WHERE WE GET A 15 PERCENT INCREASE AND THEN ALL OF A SUDDEN WE'RE LOOKING AT TWENTY TWO PERCENT ON THE ON A PROJECT OF THAT SIZE.

AND IN THE CITY MANAGER IS ABSOLUTELY CORRECT.

AND YOU HAD ENOUGH FORESIGHT TO SEE THAT, THAT IF WE DIDN'T MOVE QUICK ENOUGH, WE COULD POTENTIALLY NOT BEEN ABLE TO BUILD OUR STATION 5.

WELL A HUGE PART OF THAT IS OUR ABILITY TO TRUST YOUR YOUR VISION, YOUR COMPETENCE IN THE PROJECTS AND JUST THE EXPERIENCE YOU'VE ALREADY SHOWN WITH THE CITY.

I'D LIKE TO GO BACK THROUGH THE PROJECT AND THEN THROUGH THE STAFF RECOMMENDATION FOR YOUR RESOLUTION.

THE PROJECT AS PROPOSED IS A THREE HUNDRED AND NINETEEN MILLION DOLLAR PROJECT, AND I KNOW WE'VE TALKED ABOUT THIS EXTENSIVELY.

SO THE SCOPE OF THE PROJECT REMAINS THE SAME.

THE ESTIMATED DOLLAR AMOUNT THREE HUNDRED NINETEEN MILLION DOLLARS.

BUT I'D LIKE TO REVIEW WITH YOU IS THE SOURCES OF FUNDS.

SO WE'VE TALKED ABOUT BOND ISSUES THAT WOULD BE SUPPORTED BY A PROPERTY TAX INCREASE IN THE TOTAL BOND ISSUES ARE TWO HUNDRED AND NINETY SIX MILLION DOLLARS.

AND WHAT WE'VE TALKED ABOUT INSIDE THOSE BOND ISSUES IS A GENERAL OBLIGATION BOND ORIGINALLY TALKED ABOUT IT.

TWO HUNDRED AND SEVENTY NINE MILLION AND A CERTIFICATE OF OBLIGATION BOND OF $17 MILLION.

NOW, WHAT HAPPENED A FEW WEEKS AGO IS THE CITY WAS ABLE TO SECURE A PIECE OF LAND FOR JUST UNDER FOUR MILLION DOLLARS AND THAT LAND WOULD BE NEEDED FOR YOUR FUTURE EXPANSION OF THE CIVIC CENTER.

LAST WEEK, YOU ALL PASSED A REIMBURSEMENT RESOLUTION.

SO OUR RECOMMENDATION TO YOU TODAY IS STILL TWO HUNDRED NINETY SIX MILLION DOLLARS IN BOND AND WE'RE RECOMMENDING FOR THE GENERAL OBLIGATION BOND ELECTION.

SO ON YOUR RESOLUTION.

TWO HUNDRED AND SEVENTY FIVE MILLION, WE'VE REDUCED IT BY THE FOUR MILLION DOLLARS BECAUSE THE CITY HAS ALREADY SECURED THAT LAND AND WE'VE MOVED THAT OVER TO THE CERTIFICATE OF OBLIGATION FOR TWENTY ONE MILLION DOLLARS.

SO SAME AMOUNT.

TWO HUNDRED NINETY SIX MILLION.

AND JUST AS A REMINDER, THE TOTAL PROPERTY TAX IMPACT THAT WE'VE TALKED ABOUT FOR BOTH OF THOSE BONDS IS JUST OVER 15 CENTS ON THE PROPERTY TAX RATE.

SO THAT HAS NOT CHANGED.

WE'VE JUST CHANGED A LITTLE BIT ON WHAT WE'RE RECOMMENDING FOR THE BOND ELECTION.

THE OTHER SOURCE IS TWENTY THREE MILLION DOLLARS AND THAT'S EIGHT MILLION DOLLARS IN INFRASTRUCTURE FUNDING AND 15 MILLION DOLLARS IN VALUE ENGINEERING, WHICH MAKES UP YOUR TOTAL SOURCES OF THREE HUNDRED NINETEEN MILLION DOLLARS.

ANY QUESTIONS ON THE SOURCES OF FUNDS? MICHELLE, WOULD YOU EXPLAIN JUST THE DIFFERENCE BETWEEN THE GO AND THE CO AND WHY THE CITY WOULD USE DIFFERENT TYPES OF FINANCING FOR THOSE TWO DIFFERENT? OK, SO THAT BOTH OF THOSE BONDS WERE ANTICIPATING TO BE SUPPORTED BY PROPERTY TAXES.

THE GENERAL OBLIGATION BOND WILL GO TO THE VOTERS IF APPROVED TODAY BY YOU ALL WOULD GO TO THE VOTERS AND THERE WOULD BE ONE PROPOSITION, AND THAT WOULD BE FOR THE CIVIC CENTER EXPANSION AND RENOVATION PROJECT.

THE CERTIFICATE OF OBLIGATION.

IT'S STILL PROPERTY TAX SUPPORTED, BUT COUNCIL HAS THE AUTHORITY TO ISSUE THOSE BONDS.

SO THAT WOULD BE A PROCESS THAT YOU ALL HAVE STRUCTURED FOR US IS GIVEN.

IF THE ELECTION IS SUCCESSFUL, WE'VE TALKED ABOUT THE NEED TO MOVE CITY HALL SO THAT MONEY WOULD BE USED TO HELP SECURE AND RENOVATE A SPOT FOR CITY HALL.

SO THAT'S WHERE THOSE DOLLARS WOULD BE USED.

BUT AGAIN, DURING THE COMMUNICATION PROCESS AND I KNOW WE'RE GOING TO GO FOR COMMUNITY ENGAGEMENT, THERE'S BEEN MANY, MANY MEETINGS THAT STAFF HAS DONE TO EDUCATE OUR CITIZENS.

THE TOTAL PROPERTY TAX IMPACT OF 15 CENTS WAS FOR BOTH OF THOSE BONDS, TOTAL OF TWO HUNDRED NINETY SIX MILLION DOLLARS IN BONDS.

MICHELLE, JUST A LITTLE FURTHER EXPLANATION.

CORRECT ME IF I MISSTATE THIS.

LEGALLY, WE CANNOT ROLL A NEW CITY HALL PROJECT IN TO THE CIVIC CENTER BOND.

AND THERE ARE LEGALITIES ABOUT HOW YOU CAN LIST BOND ELECTIONS ON A BALLOT AND YOU CANNOT COMBINE TWO PROJECTS LIKE THAT.

COULD NOT COMBINE A CITY SO PROJECT WITH THE CIVIC CENTER PROJECT ON THE SAME PROPOSITION. AND WE WERE PRESENT WE WERE PREVENTED LEGALLY FROM BEING ABLE TO PRESENT IT AS ONE BIG ISSUE.

THAT'S CORRECT. AND SO ONCE WE HIT THAT POINT, THEN WE KNEW A NEW CITY HALL PROJECT HAD TO BE A SEPARATE BOND.

WELL, THEN YOU GET IN A SITUATION WHERE IF YOU PUT BOTH OF THOSE ON THE BALLOT, ONE COULD PASS AND THE OTHER ONE NOT.

THAT'S CORRECT. BUT YET THEY'RE TIED TOGETHER AS A PROJECT.

SO THAT'S WHY WE ENDED UP IN THE STRUCTURE OF NEEDING CO BONDS TO COVER NEW CITY HALL GO BONDS FOR THE LARGEST PART OF THE PROJECT.

WE TRIED TO ASK THE VOTERS, YOU KNOW, YES OR NO ON THE LARGEST PART OF THE PROJECT.

THAT'S WHAT WAS BEFORE THE CITY COUNCIL TODAY, IS THAT CORRECT? THAT'S CORRECT. AND GOING BACK TO THE VERY BEGINNING, BECAUSE IN MEETING WITH YOU, YOU WERE VERY ADAMANT THAT WHEN WE PRESENT THIS, WE WANT TO MAKE SURE OUR CITIZENS KNOW THE TOTAL PROPERTY TAX IMPACT, HENCE THE 15 .1 CENTS FOR BOTH PIECE BECAUSE UPON VOTER APPROVAL, WHEN YOU HAVE A CIVIC CENTER AND EXPANSION THAT IS BASICALLY RIGHT NEXT TO ON TOP OF CITY HALL, THERE WAS GOING TO BE A

SO THAT'S WHY ALL OF OUR COMMUNICATION MATERIAL ALWAYS MENTIONED TWO BONDS AND WHAT THE PROPERTY TAX IMPACT FOR BOTH OF THOSE BONDS WOULD BE.

AND IT MENTIONS THAT OUR DEBT PROPERTY TAX RATE WILL MOVE TO .01833.

SO 18.33 CENTS. WHAT THAT IS, IS WE ALREADY HAVE A DEBT RATE IN OUR PROPERTY TAX AND IT IS .04401.

SO .044, WE ALREADY HAVE THAT PROPERTY TAX RATE FOR DEBT SERVICE AND OUR PROPERTY TAX.

WHEN YOU LOOK AT JUST THE GENERAL OBLIGATION BONDS.

SO THE. AND I HAVE IT RIGHT THERE, THE $275 MILLION, IT'S ANTICIPATED THE PROPERTY TAX RATE INCREASE FOR DEBT WOULD BE 13, JUST UNDER JUST OVER 13.9 PENNIES, AND WHAT THAT GIVES US IS A TOTAL NEW RATE OF OR 18.33 CENTS. SO IT'S THE EXISTING PROPERTY TAX RATE FROM 20 19 PLUS THE ANTICIPATED PROPERTY TAX INCREASE ASSOCIATED WITH THESE GO BONDS IS JUST OVER 18 CENTS.

MICHELLE, I THINK THIS WOULD BE A A GREAT SPOT TO EXPLAIN THE DIFFERENCE BETWEEN THE INTEREST AND SINKING IN THE OPERATING AND MAINTENANCE.

SO THE CITY OF AMARILLO AND ALL CITIES, ALL TAXING ENTITIES IN THE STATE, THEIR PROPERTY TAX RATE IS MADE UP OF TWO PIECES.

ONE IS MAINTENANCE AND OPERATING AND ONE IS DEBT SERVICE.

THE DEBT SERVICE SUPPORTS OUR DEBT THAT IS PAID FOR BY BONDS.

SO IN THE CITY'S CASE, MOST OF THOSE BONDS ARE PROPOSITIONS 1 AND 2 THAT WERE VOTER APPROVED IN NOVEMBER OF 2016.

SO WHAT THIS BOND RESOLUTION WOULD DO WAS PROVIDE FOR THE CITY TO HOLD A BOND ELECTION OF TWO HUNDRED SEVENTY FIVE MILLION DOLLARS IN MAY OR MAY 2ND.

AND WHAT THE NEW PROPERTY TAX RATE WOULD BE IF THAT ELECTION IS SUCCESSFUL IS 18.33 CENTS. NOW, JUST AS A REMINDER, THE CITY INTENDS TO GO FORWARD WITH A CERTIFICATE OF OBLIGATION BOND OF TWENTY ONE MILLION DOLLARS.

SO THESE RATE INCREASES COULD BE STAGGERED OVER THREE YEARS, MUCH LIKE WHAT WE'VE DONE WITH PROPOSITIONS 1 AND 2 THAT WERE VOTER APPROVED IN 2016.

BUT AS YOU CAN SEE, THEIR TAX RATE IS MUCH HIGHER THAN THE CITY OF AMARILLO.

SO IF YOU COMPARE ALL OF THAT, AS WE'RE SEEING ENTITIES THAT HAVE A LOWER TAXABLE VALUE PER CAPITA, WE'RE SEEING A HIGHER TAX RATE.

SO BASED ON THE REVIEW WE DID, EVEN WITH THIS 15 .1 CENT INCREASE, OUR TAX RATE IS VERY COMPARABLE TO OUR PEERS CITIES.

I DO CURL WHEN SOMETHING IS SAID LIKE THAT, BECAUSE I WANT THE VOTERS TO TO KNOW THAT EVERYTHING IS SAFE AND THAT EVERYTHING IS SECURE AND THAT YOU'VE GOT ELECTION PEOPLE THAT THROW THEIR HEARTS AND DEFINITELY THEIR INTEGRITY THAT WE PUT IT ON THE LINE EVERY SINGLE DAY. YOU KNOW, ONCE YOU START GETTING THOSE CRACKS AND DOING THINGS LIKE THAT, YOU DON'T WANT TO. THIS ISN'T JUST THE BEST PRODUCT.

THE TOTAL COST OF THE PROJECTS, EIGHT HUNDRED NINETY SEVEN THOUSAND FOUR HUNDRED SEVENTY ONE DOLLARS. AND YOU CAN SEE AS WELL AS THE PROJECT'S SCOPE'S INCREASE, THAT PRICE PER SQUARE YARDS ACTUALLY CREPT DOWN FROM LAST YEAR.

THIS YEAR, WE'RE LOOKING AT ABOUT THREE DOLLARS AND 19 CENTS WAS LAST YEAR WE WERE PAYING THREE DOLLARS AND 28 CENTS.

SO AS WE'VE GOTTEN A LITTLE BIGGER PROJECT, WE'VE GOTTEN A LITTLE BETTER PRICE PER UNIT PRICE FOR THE PROJECT. SO AS ALWAYS.

THIS IS A PAVEMENT MAINTENANCE PROJECT.

SO WE WILL PLAN ON STARTING EARLY PART OF THE SUMMER.

LET THAT ASPHALT GET WARMED UP.

WE PUT THAT PRODUCT DOWN ON IT.

LAST THING I WANT TO SHOW YOU.

SO I SHOWED YOU THE PICTURE OF US ACTUALLY APPLYING THE PRODUCT LAST YEAR.

THIS IS OUT IN THE WOODLANDS.

THIS IS ACTUALLY ONE OF THE STREETS THAT IS AFTER IT'S BEEN DOWN AND SET UP.

YOU CAN SEE IT HAS IT HAS A NICE DARK LOOK WHERE THAT WHERE THAT ASPHALT PRODUCT HAS ACTUALLY SOAKED INTO THE TOP SURFACE OF THAT ASPHALT AND REJUVENATED THE ASPHALT IS A GOOD WAY TO PUT IT. IT ACTUALLY TURNS OUT A REALLY NICE, NICE LOOKING STREET WHEN IT'S

ALL SAID AND DONE. ONE OF THE THINGS IS THIS IS THE PRODUCT THAT THE ROADS ARE SHUT DOWN FOR 24 HOURS.

BUT THE CONTRACTOR THAT WE'RE AWARDING THIS TO, THE SAME CONTRACTOR WE USED LAST YEAR, THEY DO VERY WELL ON STAGING THIS FOR THESE PROJECTS AND THIS PRODUCT SO THAT THEY DON'T SHUT DOWN ENTIRE STREETS AT A TIME MAKING SURE THAT THE NEIGHBORHOOD HAS ACCESS AT ALL TIMES IN SOME WAY OR FASHION.

GENERALLY, THEY BRING A GOLF CART OUT AND CART PEOPLE AROUND.

THEY HAVE A WEB SITE SET UP TO WHERE YOU CAN GO CHECK ON THE STATUS OF THE PROJECT DAILY AND THEY DO UPDATE THAT DAILY.

SO WE'VE HAD VERY GOOD SUCCESS WITH THIS CONTRACTOR AS FAR AS THE APPLICATION OF THE PRODUCT. QUESTIONS.

SO BEFORE YOU TODAY, YOU HAVE AN ORDINANCE AND THIS WOULD BE A FIRST READING OF AN ORDINANCE TO AMEND A HANDFUL OF THE LEGALLY ADOPTED BUDGETS FOR FISCAL YEAR 2018, 2019, AND THAT ENDED IN SEPTEMBER 30TH OF 2019.

WE'VE KIND OF PUT THIS CLOSER TO WHEN WE BRING THOSE AUDITED FINANCIAL STATEMENTS TO COUNCIL. AND I REALIZE THERE'S QUITE A BIT OF LAG THERE BECAUSE WE DO GO THROUGH A FAIRLY EXTENSIVE YEAR IN AUDIT PROCEDURE WITH EXTERNAL AUDITORS AND WE WANT TO MAKE SURE ALL ADJUSTMENTS ARE IN BEFORE WE BRING A BUDGET AMENDMENT AND POTENTIALLY HAVE TO BRING ANOTHER ONE BACK. SO BUT WE COULD CERTAINLY LOOK AT TRYING TO BRING THAT SOONER IF THAT'S SOMETHING THAT COUNCIL WOULD LIKE TO SEE.

SO EVERYBODY UNDERSTANDS. AND IT'S NOT LIKE IT'S A KNEE JERK SECOND REACTION, BUT IT'S A FULLY PLANNED.

ABSOLUTELY. AND WITH THE SIZE OF AUDIT THAT THE CITY OF AMARILLO GOES THROUGH, AS I MENTIONED, IT'S A VERY LONG PROCESS.

AND THAT'S WHY WE'LL BE BRINGING THOSE AUDITED FINANCIAL STATEMENTS TO COUNCIL HERE IN A COUPLE OF WEEKS. THEY'LL BE GOING TO THE AUDIT COMMITTEE NEXT WEEK AND THEN IN A COUPLE OF WEEKS BE COMING TO COUNCIL FOR APPROVAL.

AND I REALIZE WE'RE ALMOST HALFWAY INTO YOUR NEW FISCAL YEAR, BUT IT IS ALL A LENGTHY PROCESS TO GET THAT THOROUGHLY REVIEWED AND AUDITED BY OUR EXTERNAL AUDITORS.

SO BEFORE YOU TODAY AND THE FIRST TWO ITEMS ON HERE WE HAVE THE LAW ENFORCEMENT OFFICERS STANDARD EDUCATION TRAINING FUND.

WE ARE LOOKING AT NEEDING TO DO A TWENTY TWO THOUSAND DOLLAR BUDGET AMENDMENT FOR THAT

FUND. THEY RECEIVE FUNDING EACH YEAR, BUT THEY DON'T ALWAYS SPEND THAT FUNDING IN THE YEAR THEY RECEIVE THE FUNDING.

SO IT'S REMAINS INSIDE THE FUND.

AND SO WHAT THEY DID IN THIS PRIOR YEAR IS THEY SPENT SOME PREVIOUS YEAR'S FUNDING AND WE HAD NOT ANTICIPATED THAT IN THE BUDGET.

SO THIS BUDGET AMENDMENT WOULD ACCOUNT FOR THAT ADDITIONAL AMOUNT THEY SPENT FROM PRIOR YEARS. THE COURT SECURITY FUND, WE'RE LOOKING AT INCREASING THE BUDGET BY FIVE THOUSAND DOLLARS. THAT IS WHERE THE MUNICIPAL COURT BAILIFFS SALARIES AND BENEFITS RESIDE.

AND SO WE'D NEED A SMALL INCREASE RELATED TO THOSE COSTS IN THE COURT SECURITY FUND.

THEN THE NEXT FIVE BUDGET AMENDMENTS ARE RELATED TO SEVERAL OF THE CITY'S PUBLIC IMPROVEMENT DISTRICTS.

AS YOU LOOK DOWN THAT LIST, YOU WILL SEE THAT THEY ARE VERY SMALL, MINOR BUDGET AMENDMENTS EXCEPT FOR THE POINT WEST PUBLIC IMPROVEMENT DISTRICT, THAT ONE WE'RE LOOKING AT A TWENTY FIVE THOUSAND DOLLAR BUDGET AMENDMENT.

THERE WAS SOME GRASS, SOME SOD THAT HAD TO BE REPLACED DURING THE YEAR.

IT WAS NOT ANTICIPATED DURING THE BUDGET PROCESS.

AND SO THAT KIND OF PUSHED THAT ONE OVER BUDGET.

WHAT WE HAVE DONE IS WE HAVE COMMUNICATED ALL OF THIS INFORMATION TO THOSE PUBLIC IMPROVEMENT DISTRICT BOARDS AND LET THEM KNOW THAT WE WOULD BE BRINGING THESE BUDGET AMENDMENTS TO COUNCIL TO KEEP THEIR THEIR LEGALLY ADOPTED BUDGETS OR THE AMOUNT SPENT WITHIN THEIR LEGALLY ADOPTED BUDGETS.

SO THE REST OF THOSE ARE VERY SMALL ADJUSTMENTS, SOME ARE RELATED TO WATER AND SEWER CHARGES AND JUST SMALL THINGS THAT WENT OVER DURING THE YEAR.

AND THEN WE WERE AT THE PLANNING AND ZONING COMMISSION YESTERDAY AFTERNOON AS WELL.

IT HAD PREVIOUSLY BEEN PRESENTED TO THEM AS A WORK SESSION ITEM AS WELL.

SO THIS WAS A PUBLIC HEARING AND ACTION AND THEY ALSO RECOMMENDED IT FOR ADOPTION UNANIMOUSLY. AND FINALLY, PROBABLY MOST IMPORTANTLY, THE NEIGHBORHOOD IS REALLY PROUD OF THIS EFFORT. WE'VE HAD 17 DEDICATED MEMBERS OF THE ADVISORY COMMITTEE THAT HAVE WORKED HARD FOR ALMOST A FULL YEAR NOW ON THIS NEW VISION.

AND THEY'RE ALSO READY TO TRANSITION TO IMPLEMENTATION.

THE PROJECT'S IN MOTION, AS WE'RE CALLING IT, FOR THESE NEIGHBORHOOD PLANS AND ALSO TALKED ABOUT THE FORMATION OF A NEW NEIGHBORHOOD ASSOCIATION THAT WOULD BE RESPONSIBLE FOR IMPLEMENTATION OF THE PLAN.

WE HAVE TO NEIGHBORHOOD PLAN ADVISORY COMMITTEE MEMBERS HERE TODAY TO SHOW THEIR SUPPORT.

ADJACENT LAND USES CONSIST OF SINGLE FAMILY DETACHED HOMES TO THE NORTH AND A RESTAURANT

THE APPLICANT IS REQUESTING PLAN DEVELOPMENT ZONING IN ORDER TO BE ABLE TO CONTINUE ATV SALES ON THE SITE.

A LETTER WAS SENT TO THE APPLICANT INFORMING THEM THAT THE NEWLY OPENED OPERATION WAS IN VIOLATION OF OCCUPYING THE BUILDING WITHOUT A CERTIFICATE OF OCCUPANCY, AS WELL AS IN VIOLATION OF LAND USES FOR GENERAL RETAIL DISTRICT, WHICH IS THE CURRENT ZONING OF THE PROPERTY. SINCE RECEIVING THIS INFORMATION, THE APPLICANT HAS VISITED WITH STAFF ON SEVERAL OCCASIONS, WHICH INCLUDED TWO PRELIMINARY APPLICATION CONFERENCES.

DURING THESE MEETINGS, THE APPLICANT INQUIRED AS TO THE BEST WAY TO ADDRESS THE SITUATION. WE COMMENTED THAT THERE ARE BASICALLY TWO ALTERNATIVES TO ALLEVIATING THE SITUATION, AND THAT WAS TO SHIFT THE BUSINESS FOCUS OF OUTDOOR DISPLAY TO INDOOR DISPLAY AND SALES. INDOOR DISPLAY OF ATV OR SALES OF ATV IS ALLOWED IN GENERAL RETAIL BUT OUTDOOR IS NOT. REZONE THE SITE TO A ZONING DISTRICT WHICH WOULD ALLOW FOR THE USE OUTRIGHT.

THE APPLICANT STATED THAT SHIFTING THE FOCUS OF THE SALES TO INDOOR WOULD NEGATIVELY IMPACT THE BUSINESS MODEL, AND ASKED ABOUT REZONING THE PROPERTY TO LIGHT COMMERCIAL ZONING. STAFF COMMENTED THAT ALTHOUGH LIGHT COMMERCIAL ZONING IS FOUND IN THE IMMEDIATE AREA AND THOSE ARE THE RED AREAS ON THAT ZONING MAP RIGHT THERE TO THE SOUTH AND TO THE SOUTHWEST OF THAT OF THE APPLICANT'S PROPERTY LIGHT COMMERCIAL WOULD NOT BE RECOMMENDED BY STAFF STAFF'S OPINION CENTERS ON BEING ABLE TO PROTECT THE RESIDENTIAL NEIGHBORHOOD TO THE NORTH FROM IMPACTS ASSOCIATED WITH VARIOUS OTHER LAND USE IS ALLOWED OUTRIGHT IN LIGHT COMMERCIAL AND THAT MANY OF THESE GO AGAINST THE RETAIL CHARACTER OF THAT PARTICULAR AREA. THE APPLICANT THEN INQUIRED AS TO WHETHER OR NOT PLAN DEVELOPMENT ZONING WOULD BE AN OPTION. STAFF RELAYED THAT PER THE ORDINANCE.

IT WOULD BE ELIGIBLE FOR CONSIDERATION, BUT THAT ANY OTHER USE ON THE SITE SHOULD BE RETAIL IN NATURE AS MUCH AS POSSIBLE.

AS A RESULT, THE APPLICANT SUBMITTED A PLANNED DEVELOPMENT SITE PLAN THAT PROPOSES THE FOLLOWING ATV SALES WITH LIMITED OUTDOOR STORAGE AND DISPLAY.

OUTDOOR DISPLAY WILL BE LIMITED TO THE SIDE AND REAR OF THE MAIN BUILDING.

ALL OTHER LAND USES SHALL CONFORM TO GENERAL RETAIL LAND USES SCREENING IN THE FORM OF AN EIGHT FOOT FENCE ALONG THE NORTH AND WEST BOUNDARY OF THE OUTDOOR STORAGE LOT.

NO DEMONSTRATION OR TEST DRIVING OF ATVS WILL BE ALLOWED ON THE SITE.

STORAGE OF ANY ITEMS IN THE OUTDOOR STORAGE AREA MAY NOT EXCEED THE SCREENING FENCE HEIGHT. ALL OTHER DEVELOPMENT STANDARDS SHALL CONFORM TO GENERAL RETAIL.

IN REFERENCING THE FUTURE LAND USE AND CHARACTER MAP, GENERAL COMMERCIAL IS THE RECOMMENDED DEVELOPMENT TYPE FOR THIS SITE.

GENERAL COMMERCIAL CALLS FOR A WIDE RANGE OF RETAIL AND SERVICE RELATED LAND USES.

THESE TYPES OF LAND USES CAN BE FOUND WITH THE MAJORITY OF THE NONRESIDENTIAL ZONING IN THE AREA AND THIS AERIAL AERIAL KIND OF SHOWS SOME OF THE NONRESIDENTIAL ZONING AT THAT PARTICULAR INTERSECTION.

WITH RESPECTS TO THE NEIGHBORHOOD UNIT CONCEPT OF DEVELOPMENT, CONSIDERING THE APPLICANT SITE IS LOCATED NEAR A SECTION LINE, ARTERIAL INTERSECTION IS SOMEWHAT CONFORMS TO THIS CONCEPT. HOWEVER, WHAT IS MISSING FROM FULLY CONFORMING IS AN ACCEPTABLE ZONING OR DEVELOPMENT BUFFER BETWEEN THE SINGLE FAMILY DETACHED HOMES TO THE NORTH.

REGARDING AREA AND ZONING AREAS, ZONING AND DEVELOPMENT PATTERNS , A MAJORITY OF THE NONRESIDENTIAL ZONING IS ACTUALLY LOT COMMERCIAL.

IN THIS PARTICULAR AREA AND AGAIN, IF YOU GO BACK TO THIS PARTICULAR SLIDE, YOU CAN SEE IN THE SOUTHWEST QUADRANT OF THAT INTERSECTION, THAT'S WHERE THE LIGHT COMMERCIAL ZONING IS FOUND. AT FIRST GLANCE, THIS MAY APPEAR THAT AND SIGNAL THAT EXPANDING THE LIGHT COMMERCIAL ZONING IN THE AREA IS APPROPRIATE.

THAT SAID, STAFF BELIEVES THAT THIS AREA IS UNIQUE IN THAT THE BULK OF COMMERCIAL ZONING IS DEVELOPED WITH RETAIL ACTIVITIES AND MOST OF THE COMMERCIAL ZONING IS BOUNDED BY JOHN STIFF PARK WHEREBY THE NEED TO LESSEN ANY EXTERNAL IMPACTS TYPICALLY ASSOCIATED WITH LIGHT COMMERCIAL ZONING IS LESSENED SOMEWHAT THAN IT WOULD BE IF IT WERE IMMEDIATELY ADJACENT TO A RESIDENTIAL AREA.

CONSIDERING THE JUST MENTIONED, THE PLANNING AND ZONING COMMISSION WAS ALSO OF THE OPINION THAT THIS AREA HAS TRANSITIONED INTO A RETAIL AREA AND SHOULD BE MAINTAINED AS MUCH AS POSSIBLE WHILE STILL PROTECTING THE RESIDENTIAL AREAS TO THE NORTH.

CONSIDERING THE PROPOSED DEVELOPMENT STANDARDS SUBMITTED BY THE APPLICANT, THE PLANNING COMMISSIONERS BELIEVE THAT THE APPLICANT ATTEMPTS TO BOTH MITIGATE ANY NEGATIVE IMPACTS ON ADJACENT RESIDENTIAL AREAS, AS WELL AS MAINTAIN THE RETAIL CHARACTER OF THE AREA AS

MUCH AS POSSIBLE BY LIMITING OUTDOOR DISPLAY VISIBILITY AND LOCATION INCREASED SCREENING HEIGHT ADJACENT TO THE RESIDENTIAL AREAS AND PROHIBITING OUTDOOR DEMONSTRATIONS OF ANY VEHICLES. AS SUCH, THE PLANNING AND ZONING COMMISSION RECOMMENDS APPROVAL AS PRESENTED.

IT IS WORTH NOTING THAT WE DID SEND NOTICES OUT TO EVERYONE WITHIN 200 FEET.
