JEFF. IT IS JEFF. SO WE'RE GOING TO ASK EVERYBODY TO RISE FOR THE INVOCATION, AND THEN WE'LL DO THE PLEDGES. THANK YOU. THANK YOU, COLE. LET US PRAY. GOD, WE COME BEFORE YOU. WE DO THIS ALL IN THE NAME OF LOVE. ON OUR KNEES, WE PRAY A PRAYER OF GRATITUDE AND GUIDANCE FOR OUR CITY LEADERSHIP TO BE WITH MAYOR COLE TODAY, AS HE TRULY HAS THE HEART OF A SERVANT AND HIS AMAZING TEAM THAT SURROUNDS HIM. MAY YOU GIVE THEM WISDOM, DIRECTION, ENCOURAGEMENT, PURPOSE, PLANS AND PROTECTION AND BIG DREAMS FOR AMARILLO. WE LIFT UP OUR FAMILY AND OUR FRIENDS WHO MAKE UP THIS GREAT COMMUNITY WE LIVE IN. BRING US YOUR UNITY AS WE SEEK YOUR SAFETY AND PROTECTION. BLESS OUR LAW ENFORCEMENT AND OUR FIRST RESPONDERS. WE PRAY FOR HOPE, HEALING AND RESTORATION AND PEACE AND RECONCILIATION THAT WE LEARN TO LOVE AND GROW FOR OURSELVES AND ONE ANOTHER. MAY WE ASK OURSELVES DAILY, HOW CAN I SERVE YOU WHETHER THIS IS OUR NEIGHBOR, OUR FAMILY MEMBER, OUR TEAMMATE, OUR FRIEND, OUR COWORKER, OUR LEADER, OUR CLASSMATE, OUR PATIENT, OUR STRANGER AS A CITY. WE SERVE YOU BY SERVING YOUR PEOPLE. WE ASK YOU TO HELP US WITH ECONOMIC PROSPERITY, ENVIRONMENTAL STEWARDSHIP, AND EDUCATION IN OUR CITY. MAY WE BRING HEALTH AND HEALING TO THE LEAST OF THESE. WE PRAY TO SHARE IN YOUR COMPASSION, YOUR SERVICE, AND YOUR KINDNESS TO ALL. MAY YOU BLESS OUR MEETING TODAY. MAY YOU BLESS AMARILLO. MAY YOU BLESS OUR COUNTRY DURING THIS ELECTION YEAR. MAY WE BE A CITY ON A HILL THAT SHINES YOUR LIGHT BRIGHT. MAY WE LOVE ONE ANOTHER. IN YOUR NAME WE PRAY. AMEN. AMEN. THANK YOU, JEFF. YOU'RE WELCOME. IF Y'ALL WILL JOIN ME WITH THE PLEDGE. THE TEXAS FLAG AS WELL. PLEASE BE SEATED. OKAY. MR. CITY MANAGER, DO YOU HAVE ANY ANNOUNCEMENTS TODAY? NO, MAYOR. OKAY. MISS CITY SECRETARY, DO YOU HAVE ANYTHING YOU NEED TO COVER? NO, MAYOR. OKAY. WE'RE GOING TO GO AHEAD AND ASK THE CITY SECRETARY TO READ US INTO PUBLIC COMMENT AND LET YOU GUYS SPEAK TO US ON ANY SUBJECT YOU FEEL IS NECESSARY TODAY. [6. Public Comment] THANK YOU MAYOR. WE HAVE THREE INDIVIDUALS SIGNED UP FOR PUBLIC COMMENT TODAY. THANK YOU FOR PARTICIPATING IN TODAY'S CITY COUNCIL MEETING. YOUR INPUT AND YOUR OPINIONS ARE IMPORTANT TO US, AND WE'RE GLAD THAT YOU'RE HERE TO SHARE THEM. TODAY, AT EACH POSTED MEETING, WE INVITE OUR FELLOW COMMUNITY MEMBERS TO ADDRESS CITY COUNCIL REGARDING POSTED AGENDA ITEMS OR TOPICS RELATED TO CITY POLICY. EVERY SPEAKER TODAY WILL HAVE THREE MINUTES. AT THE END OF 2.5 MINUTES, YOU'LL HEAR A WARNING BEEP. THAT'S JUST ALERTING YOU THAT YOU HAVE 30S LEFT TO WRAP UP YOUR THOUGHTS. WE DO HAVE PUBLIC HEARINGS TODAY, SO IF YOU'RE HERE TO SPEAK ON AN ITEM WITH A PUBLIC HEARING, WE WOULD KINDLY REQUEST THAT YOU SPEAK EITHER DURING PUBLIC COMMENT OR DURING THE PUBLIC HEARING, BUT NOT BOTH, IN ORDER TO HELP US KEEP ACCURATE MINUTES, AND IT'S YOUR CHOICE AT WHICH TIME YOU'D LIKE TO SPEAK. AS A REMINDER, IF YOU SPEAK ABOUT SOMETHING NOT ON TODAY'S AGENDA, TEXAS OPEN MEETINGS ACT LIMITS HOW COUNCIL CAN RESPOND TO YOU. THEY CAN RESPOND WITH A STATEMENT OF FACT OR POLICY. THEY CAN ASK THAT YOUR ITEM BE PUT ON A FUTURE AGENDA, OR THEY CAN REFER YOU TO STAFF. WITH THAT, WE'LL GET STARTED. WHEN YOU COME TO YOUR TO THE MICROPHONE TODAY, PLEASE STATE YOUR NAME AND WHETHER OR NOT YOU LIVE IN THE CITY LIMITS, THEN YOU MAY BEGIN ADDRESSING COUNCIL. FIRST, TODAY IS KEITH GRAYS. AFTER MR. GRAYS ON DECK WILL BE MICHAEL FORD. GOOD AFTERNOON TO MAYOR AND COUNCIL AND SECRETARIES AND POLICE PEOPLE AND EVERYBODY ELSE. [00:05:02] I'M KEITH GRAYS, G-R-A-Y-S, BECAUSE I THINK A LOT OF PEOPLE CONTINUE TO TRY TO MAKE ME BE A G-R-A-V-E-S. SO I WANT TO CORRECT MY LAST NAME FOR THE RECORD, IN CASE THE POLICE ARE LOOKING FOR ME. THEY'LL GET THE RIGHT PERSON. I'M HERE TODAY TO ASK YOU GUYS TO MAKE A DECISION TO DEMOLISH 1200 NORTH MONROE. KNOWN AS THE MONROE APARTMENTS. THERE HAS BEEN A FILIBUSTER, WHICH IS, IN OUR OPINION, IN THAT COMMUNITY, HAS BEEN A COMMON PRACTICE WITH PUTTING OFF LEAVING THESE DEBILITATED, DILAPIDATED BUILDINGS THAT ARE CRIME, CRIMINAL ACTIVITY, PEOPLE HIDING OUT. THE LAST OF ONE, WHICH WE CALLED ON FOR THREE YEARS, BURNED THREE TIMES. UNTIL THE LAST TIME IT BURNED, IT BURNED TO THE GROUND. SO WE'RE ASKING YOU ON 1200 NORTH MONROE THAT THEY DID NOT COMPLY WITH WHAT YOU PUT IN. THANK YOU FOR LEAVING IN IN THE CONTEXT WITH THIS, THAT IT WOULD BE DEMOLISHED IF THEY DIDN'T MEET IT. SO WE'RE ASKING YOU ALL TO HOLD YOURSELF ACCOUNTABLE TO WHAT YOU GAVE US AS A COMMUNITY. THAT WOULD BE THE RESULT OF THEM NOT BEING IN COMPLIANCE. THE OTHER THING IS, I THANK YOU, MR. PATH. I'M GLAD YOU'RE IN AMARILLO. I HOPE THAT WE CAN GET A BUS ONE DAY AND AT YOUR COST. JUST USE SOME TAX DOLLARS AND LOAD SOME OF YOU GUYS UP AND DRIVE YOU FROM NORTH HUGHES ST. TO NORTHWEST 24TH ST. SO YOU CAN SEE THE CONDITIONS OF WHAT WE LIVE WITH ON A DAILY BASIS AS TAXPAYERS. IT LOOKS LIKE A JUNGLE OUT OF THE MOST UNORTHODOX PLACE YOU COULD IMAGINE. WE HAVE TWO OF THE MOST BEAUTIFUL TAXPAYER ENTITIES IN ONE CITY BLOCK, ACTUALLY THREE HINES MEMORIAL PARK, WARFORD ACTIVITY CENTER, AND WHICH YOU GAVE $2 MILLION TO DO. WE THANK GOD FOR THAT, AND THEN THE OTHER ONE WAS HILLTOP EARLY LEARNING A NICE RESTAURANT ACROSS THE STREET. YOU GUYS HAVE GOT TO HELP US WITH SOME KIND OF ORDINANCE THAT WITH THESE TYPES OF AMOUNTS OF PROPERTY VALUE THAT TAXPAYERS HELP TO SUPPORT, THAT YOU WOULD DO SOMETHING WITH THESE DILAPIDATED BUILDINGS WITHIN, NOT CLOSE PROXIMITY ACROSS THE STREET. SIR, WHEN YOU GO SEE THIS, YOU PROBABLY WILL JOIN US IN A CRYING FEST. IT IS A NIGHTMARE WHAT THESE YOUNG KIDS AND THEIR PARENTS HAVE TO GO AND DRIVE PAST EVERY MORNING TO GO SEE AND GET A DECENT EDUCATION. IT'S NOT FAIR. I LIVE ONE BLOCK FROM CARVER ACADEMY ON NORTHWEST 12TH STREET, AND I THANK GOD FOR THE SCHOOL DISTRICT AND FOR THE CITY OFFICIALS THAT KEEP THAT PLACE A VIABLE, BEAUTIFUL STRUCTURE THAT THE TAXPAYERS ARE PROUD OF. NOT THE SAME THING AT NORTHWEST 18TH STREET. I KNOW I'M OUT OF TIME, BUT YOU GUYS DON'T BELIEVE IN EMINENT OR PUBLIC DOMAIN, AND YOU HAVE A CRY OF PEOPLE IN AN AREA THAT ALWAYS TALKS ABOUT GENTRIFICATION. I DON'T CARE WHAT KIND OF VOCATION YOU COME WITH, HELP US TEAR DOWN AND BUILD. THANK YOU, THANK YOU SIR. NEXT IS MR. FORD, AND AFTER MR. FORD ON DECK WILL BE JACOB MEYER. MIKE FORD, AMARILLO, TEXAS. GENTLEMAN MAKES A VERY GOOD ARGUMENT FOR SINGLE MEMBER DISTRICTS. THERE SHOULD BE SOME REPRESENTATION IN EVERY AREA OF TOWN. I'M HERE TO TALK. I THOUGHT I WAS GOING TO BE TALKING ABOUT ONE THING. I'M TALKING ABOUT TWO THINGS. THE BALLOT LANGUAGE THAT YOU'VE APPARENTLY ARE RESURRECTING. IT'S A VERY GOOD THING. YOU REALLY SHOULD BE, CONSIDERING THAT YOU LEFT OUT ONE OF THE BIGGEST THINGS IN THE BALLOT LANGUAGE, WHICH IS THE $10,000 FINE. HOW CAN YOU NOT ADVISE THE TAXPAYERS OR THE VOTERS THAT THEY'RE GOING TO BE FINED $10,000 IF THEY VIOLATE THAT, AND THEN THEY HAVE NO RECOURSE IF THEY'RE FOUND INNOCENT AND THEY CAN BE CHARGED OVER AND OVER AGAIN. VERY SIMPLE TO FIX THAT. YOUR BALLOT MEASURE COUNCIL MEMBER TIPPS. YOU'RE RIGHT. THEY DON'T SEE IT. THE BALLOT MEASURE WAS SUPPOSED TO DESCRIBE THE ENTIRE ORDINANCE IN ITS ENTIRETY. THE FINDINGS, THE DECLARATIONS, THE ADDITIONS TO THE ORDINANCE, THE ENTIRE THING. THE BALLOT LANGUAGE WAS THE ONLY THING, THE AMENDMENTS TO THE ORDINANCE, AND THAT WAS SECTION C OF THE ORDINANCE. SO THOSE TWO ARE VERY DIFFERENT. YOUR ATTORNEY CREATED ONE MISH MASH THAT THERE'S NO SEPARATION FROM, AND IT'S A COMPLETE MESS AND IT SHOULD BE FIXED. IN REGARD TO WHAT YOU WERE JUST UNDER EXECUTIVE SESSION FOR, I'VE COME TO YOU. YOU KNOW THIS. I'VE COME TO YOU. PREVIOUSLY ON THE KIDS INC. ISSUE WITH AEDC. [00:10:03] THIS CITY COUNCIL HAS MADE COMMENTS THAT THE THAT THE AEDC PROJECT IS GOING TO BENEFIT THE KIDS INC. PROJECT. THE ASSISTANT CITY MANAGER HAS MADE THESE STATEMENTS. THE TEARS THREE MEMBERS HAVE MADE THESE STATEMENTS THAT ALL BENEFITS, BUT WHEN IT COMES DOWN TO IT AND WE SAY, OH, THAT'S NOT LAWFUL. THAT'S A TAXPAYER VOTE, YOU'RE REMOVING THE RIGHT OF THE TAXPAYERS TO VOTE AND APPROVE THAT. OH, NO, THAT HAS NOTHING TO DO WITH KIDS INC. EVERYONE SAYS THAT HAS NOTHING TO DO WITH KIDS, INC.. SO I DIG A LITTLE DEEPER IN AEDC AND EVERY SINGLE ONE OF THEIR AGENDA ITEMS, EVERY SINGLE ONE, FAILS THE PUBLIC NOTICE REQUIREMENT. LET ME ASK YOU THIS ONE. OF COURSE YOU REMEMBER PROJECT 20-08-05. EVERYONE REMEMBERS THAT ONE, RIGHT? THAT WAS DISCUSS CONSIDER TAKE APPROPRIATE ACTION ON PROJECT 20-08-05. YOU REMEMBER THAT ONE. THAT WAS THE PUBLIC NOTICE FOR THE AEDC TO CONSIDER AND VOTE ON AND APPROVE AMAZON'S CONTRIBUTION AND THAT WAS UNDER PROFESSIONAL AND TECHNICAL SERVICES. THAT'S THE SAME NAICS CODE THAT I WORK IN THAT I CONSULT IN THEIR GROCERY STORE. THEIR WHOLE FOODS, THEIR WHOLESALE STORE. OKAY. THAT JUST THIS ONE. THERE ARE DOZENS OF THEM THAT CAN BE REVERSED, AND NOW WE HAVE AND NOW WE HAVE THE GENTLEMAN IN PUBLICLY REVERSING OR SIGNING OVER THREE YEARS OF MEMBERSHIP TO THIS RANGE ORGANIZATION. YOU UNDERSTAND WHY THEY DID THREE YEARS, SO YOU GUYS WOULD NOT HAVE ANY WAY TO RECONSIDER THAT OR CHANGE THAT VOTE, THAT YOU WOULDN'T HAVE A BITE AT THAT APPLE. THEY WENT FOR THREE YEARS TO BYPASS YOU BECAUSE THEY PLAN ON REPLACING YOU, AND IF YOU ALLOW THIS TO HAPPEN, IF YOU ALLOW THIS TO HAPPEN, THEN WOE BE UNTO YOU. OUR NEXT COMMENTER IS JACOB MEYER. SORRY, I GOTTA ADJUST THE MIC A LITTLE BIT HERE. CAN YOU ALL HEAR ME GOOD? IF IT DOESN'T FALL OVER. ALL RIGHT, SO A LOT OF YOU ALL KNOW ME. MY NAME IS JACOB MEYER. I'M THE PRESIDENT OF THE YOUNG REPUBLICAN CHAPTER HERE IN THE AMARILLO AREA, AND I SIGNED UP ON 7E BECAUSE I DON'T KNOW WHAT YOU GUYS ARE GOING TO DO ON IT, BUT I DO WANT TO SAY, BEFORE I GET INTO THIS ON PROP A, I AM VERY GLAD THAT YOU GUYS ARE FIXING THE RECALL ELECTION THAT I MEAN, I STUDIED POLITICAL SCIENCE. I WAS ORIGINALLY PLANNING ON GOING TO LAW SCHOOL. I MAY GO ONE OF THESE DAYS, OR MAY GO TO GRAD SCHOOL, OR I MAY CHOOSE ANOTHER PATH, BUT WHEN I WAS GOING THROUGH THERE, I LOOKED AT THE RECALL MEASURE HERE IN AMARILLO AND OUR PREVIOUS MAYOR. IT IS MY PERSONAL OPINION THAT THE PREVIOUS MAYOR AND YOU SERVED UNDER HER WHEN YOU WERE IN PLACE FOUR RIGHT? SHE WAS A TYRANT, AND I DON'T USE THAT TERM FLIPPANTLY. I MEAN, WHO BANS CLAPPING AT CITY COUNCIL MEETINGS AND THEN HANDCUFFS A VETERAN AND HAS THEM THROWN OUT OVER IT? ONLY A TYRANT WOULD DO SOMETHING LIKE THAT. THAT WAS GINGER NELSON. SHE WAS THE ONLY MAYOR, TO MY KNOWLEDGE, IN THE STATE OF TEXAS THAT LOCKED THE CITY OF AMARILLO DOWN. NOT ONCE. I MEAN FULLY LIKE FULL LOCKDOWN. NOT ONCE, BUT TWICE, AND THEN HER THE CHERRY ON TOP OF HER ADMINISTRATION WAS THE ILLEGAL TAX INCREASE. THAT GOT HER PRETTY MUCH TO HER TO NOT RUN AGAIN AND GOT THE PREVIOUS CITY MANAGER. THE PREVIOUS CITY MANAGER UNANIMOUSLY FIRED. SO I DON'T MEAN THAT FLIPPANTLY WHEN I SAY SHE WAS A TYRANT. I DO BELIEVE THAT WE NEED A GOOD RECALL PROCESS, AND THAT JUST GOES FOR ANY CITY, REALLY. WE NEED TO BE ABLE TO RECALL OFFICIALS THAT HAVE VIOLATED THE RIGHTS OF THEIR CITIZENS, ESPECIALLY THEIR FIRST AMENDMENT RIGHTS AND OTHER RIGHTS AS WELL, AND NOW ON TO PROP A, YOU KNOW, I WASN'T OPPOSED TO HAVING LONG BALLOT LANGUAGE. YOU KNOW, I LIKE THE VOTERS HAVING MORE INFORMATION ON THIS AND HAVING IT AT THE BALLOT. THAT'S A GOOD PLACE TO HAVE IT BUT THEY'VE COME BACK AND THEY'RE SAYING WE NEED TO SHORTEN THAT FOR THAT, AND THE RECALL, YOU KNOW, PROP D, AND SO BUT MICHAEL FORD MADE A COMMENT HERE THAT I REALLY CAN'T IGNORE. THAT IS A VERY KEY COMPONENT OF THIS ORDINANCE. ONE OF THE THINGS THAT WE HAD TO CHANGE HERE WAS FROM CRIMINAL PROSECUTIONS, AND IT'S PART OF A BIGGER PROBLEM. WE HAD TO CHANGE THAT FROM CRIMINAL PROSECUTIONS TO WAS IT UNLAWFUL ACTIVITIES OR WE CHANGED IT TO UNLAWFUL RIGHT? YOU KNOW, A VERY, VERY SIMILAR BUT VERY ACCURATE CHANGE WOULD HAVE BEEN CIVIL LIABILITIES JUST REPLACING CRIMINAL PROSECUTIONS WITH CIVIL LIABILITIES. THAT PRIVATE RIGHT OF ACTION IS THE WAY THAT THE ORDINANCE IS ENFORCED. [00:15:03] IT IS THE ONLY WAY THAT IT IS ENFORCED. THE ORDINANCE IS VERY CLEAR. THE CITY, THE GOVERNMENT IS NOT ALLOWED TO ENFORCE THE ORDINANCE. THAT MEANS THAT APD, RCSO, PCSO CANNOT FINE INDIVIDUALS OR THROW PEOPLE IN JAIL OVER IT. I WANT TO THANK YOU FOR YOUR TIME TODAY. GOD BLESS THE CITY OF AMARILLO AND GOD BLESS WEST TEXAS. THANK YOU ALL. THANK YOU SIR. THANK YOU SIR. MAYOR, THAT CONCLUDES EVERYONE THAT SIGNED UP TODAY. REAL GOOD, DO I HAVE ANYONE ELSE HERE THAT WOULD LIKE TO OFFER PUBLIC COMMENT TODAY? MISS MILDRED, IF YOU'D COME FORWARD, PLEASE. GOOD AFTERNOON. MILDRED DORTON, NORTH HEIGHTS. I WHOLEHEARTEDLY AGREE WITH EVERYTHING MR. GRAYS SAID. WE NEED TO IMPROVE NORTH HEIGHTS IN MORE WAYS THAN ONE. OUR TAX DOLLARS ARE BEING SHIFTED ACROSS TOWN FEES. DRAINAGE FEE IN PARTICULAR. WE DON'T HAVE A DRAINAGE PROBLEM IN NORTH HEIGHTS, BUT IF YOU SO DESIRE, PUT ANOTHER FEE ON THAT WATER BILL TO TAKE CARE OF SOME OF THE THINGS THAT'S NEEDED IN NORTH HEIGHTS. I DON'T MIND PAYING TAXES. I KNOW WHAT TAX DOLLARS ARE SUPPOSED TO DO. EVERYTHING KEITH SAID WAS THE TRUTH, AND IT'S BEEN THE TRUTH FOR YEARS. I GREW UP IN NORTH HEIGHTS FROM 1959 TO 1979. THERE HAS BEEN NO NEEDLE CHANGE. THE NEEDLE DOES NOT CHANGE IN NORTH HEIGHTS, AND WHEN THE QUESTION WAS ASKED YEARS AGO, WHY ARE WE REPAIRING AND REPLACING INFRASTRUCTURE IN COMMUNITIES THAT'S LESS THAN FIVE YEARS OLD BUT WE'RE NOT DOING ANYTHING IN OUR OLDER NEIGHBORHOODS? ANSWER THAT QUESTION. DO SOMETHING ABOUT IT. THANK YOU. THANK YOU MA'AM. OKAY. DO I HAVE ANYONE ELSE HERE THAT WOULD LIKE TO GIVE PUBLIC COMMENT? ALL RIGHT. WE'RE GOING TO GO AHEAD AND CONTINUE FORWARD WITH OUR MEETING. I APPRECIATE EVERYONE FOR BEING HERE AND SPEAKING TODAY. WE WILL MOVE ON TO A REVIEW. [7.A. Review agenda items for regular meeting and attachments] COUNCIL, DO YOU HAVE ANYTHING YOU NEED FURTHER INFORMATION ON FOR ITEM SEVEN A? NO, SIR. OKAY. [7.B. Every Drop Counts Calendar contest winners] ITEM SEVEN B DO WE HAVE MICHAEL PRICE HERE TODAY FOR OUR EVERY DROP COUNTS CALENDAR CONTEST WINNERS. OH. YOU'RE UP. COME ON UP, SIR. MR. ORR. GOOD AFTERNOON, MAYOR AND COUNCIL. MY NAME IS BEN ORR; I'M THE CURRENT PRESIDENT OF THE EVERY DROP COUNTS CALENDAR CONTEST OR CALENDAR COMMITTEE. THIS MARKS OUR THIRD YEAR OF THE CALENDAR CONTEST AFTER WE REVAMPED IT IN 2021. THE GOAL OF THIS CONTEST IS TO SPREAD AWARENESS OF WATER CONSERVATION THROUGHOUT OUR COMMUNITY. WATER CONSERVATION IS A CRUCIAL ASPECT OF THE CITY'S WATER PLAN, AND WE ARE ALWAYS LOOKING FOR NEW AND EXCITING WAYS TO PROMOTE USING OUR WATER RESOURCES MORE EFFICIENTLY. GETTING THE YOUTH INVOLVED IN THIS CONTEST IS ONE OF THE MORE EXCITING THINGS OUR COMMITTEE LIKES TO PROMOTE. SO I WANT TO THANK THE STUDENTS, PARENTS AND TEACHERS WHO PARTICIPATED IN THIS YEAR'S EVENT, AND I ALSO WANT TO THANK OUR GENEROUS SPONSORS. OUR SPONSORS INCLUDED FROM ALL AROUND THE CITY [INAUDIBLE], WEST TEXAS A&M UNIVERSITY, WEST TEXAS A&M IS REALLY ON BOARD WITH GETTING STUDENTS MORE INVOLVED IN SCIENCE BASED CAREERS. SO THEY WERE MORE THAN HAPPY TO DONATE TO OUR CAUSE SYNERGY DISCOVERY CENTER, AMARILLO, SOD POODLES, WONDERLAND, AND OF COURSE, LOTS OF EVERY DROP COUNTS MERCHANDISE. THIS YEAR'S FORMAT WAS A LITTLE DIFFERENT. WE CHOSE 12 CALENDAR WINNERS AND THEN A GRAND PRIZE WINNER WHOSE ART WILL BE PRESENTED ON THE FRONT OF THE CALENDAR THIS YEAR. SO AS I ANNOUNCE THE WINNERS, PARENTS, PLEASE HAVE YOUR CHILDREN JOIN ME AT THE PODIUM. OUR JANUARY WINNER, ANNABELLA SANCHEZ. OUR FEBRUARY WINNER, LIDIA STOUGHTON. OUR MARCH WINNER, ELENI BURKHARDT, AND ELENI, DID I PRONOUNCE YOUR NAME RIGHT? BECAUSE YOUR MOM CORRECTED ME TWICE TODAY. APRIL WINNER. VIRIANA HEMORRHAGE. MAY WINNER. BRITT FINSTERWALD. JUNE WINNER. JASPER LEWIS. JULY WINNER. EMILY ROSTRUM. AUGUST WINNER. SNYDER CROUCH. [00:20:01] SEPTEMBER WINNER VIOLET HERNANDEZ. OCTOBER WINNER JACKIE LEWIS. NOVEMBER WINNER KINSLEY CATES. DECEMBER WINNER BEA CROUCH, AND OUR GRAND PRIZE COVER WINNER EMMA BORON. ONCE THE NEW CALENDARS ARE FINISHED PRINTING, I'M GOING TO POST A LINK ON THE CITY WEBSITE WHERE ANYONE WHO WANTS A CALENDAR CAN COME PICK ONE UP. USUALLY IT'S DOWN AT BILLING, BUT WE'RE GOING TO HAVE SOME MORE LOCATIONS AS WELL THAT YOU CAN PICK THOSE UP AFTER WE TAKE SOME PHOTOS. I ASK THAT PARENTS AND STUDENTS MEET ME IN THE HALLWAY, AND I'M GOING TO HAND OUT SOME PRIZES FOR THE KIDDOS, AND SO LET'S GIVE A FINAL CONGRATULATION TO OUR WINNERS, AS WELL AS A ROUND OF APPLAUSE FOR SUBMITTING ARTWORK. NOW, MAYOR STANLEY, I DIDN'T ASK YOU DIRECTLY, BUT IF YOU COULD COME DOWN AND TAKE SOME PHOTOS WITH US BECAUSE SHILOH SAID IT'D BE OKAY. WE'LL COME DOWN. GREAT JOB BEN. IF ANYONE HAS A VICTORY ACCEPTANCE SPEECH YOU'D LIKE TO GIVE WHILE WE GET DOWN THERE. YEAH, ANYBODY? NO. ALL RIGHT. GREAT JOB GUYS. THANK YOU BEN, AND TO THE FAMILIES THAT WERE HERE. IT'S BEEN A LONG TIME SINCE COUNCILMAN SIMPSON FELT THAT MUCH LOVE IN THE CHAMBERS. SO WE APPRECIATE THE KIDS ONCE AGAIN. MOVING US ALONG TO ITEM SEVEN C OUR 911 NURSE NAVIGATION PROGRAM. [7.C. 911 Nurse Navigation Program] THERE'S THE GOOD DOCTOR RIGHT THERE, SIR, IF YOU DON'T MIND TAKING US INTO THIS ONE. ABSOLUTELY. THANK YOU MAYOR, COUNCILMEMBERS, MY NAME IS DOCTOR JARED TROUTMAN. I STAND BEFORE YOU TODAY AS THE EMS MEDICAL DIRECTOR FOR THE CITY OF AMARILLO AND WANT TO GIVE YOU A LITTLE INFORMATION ABOUT A 911 NURSE NAVIGATION PROGRAM JUST TO LEVEL SET. YOU'LL SEE GLOBAL MEDICAL RESPONSE UP THERE. THAT'S THE PARENT COMPANY OF AMARILLO MEDICAL SERVICES, WHICH IS THE CONTRACTED PARTNER TO PROVIDE EMS SERVICES IN THE CITY. THEY ARE THE LARGEST PROVIDER OF EMS SYSTEMS ACROSS THE ENTIRE U.S.. SO WHAT IS 911 NURSE NAVIGATION. SO WHAT WE'VE LEARNED THROUGH THE YEARS IS PATIENTS CALL 911 FOR ALL SORTS OF PROBLEMS, AND THEY JUST LOOK FOR SOLUTIONS TO THOSE PROBLEMS AND SOMETIMES LOW ACUITY, AND WE'VE LEARNED THAT THROUGH STUDYING WHY PATIENTS CALL THAT, AND TODAY THE ONLY RESOURCE WE HAVE IS TO SEND POTENTIALLY A FIRE ENGINE, POTENTIALLY AN AMBULANCE, AND THEN TAKE THEM TO AN EMERGENCY DEPARTMENT WHEN SOMETIMES THEY MAY BE CALLING THEY DON'T KNOW WHAT TO DO. THEY MAY BE OUT OF MEDICATIONS. THEY MAY FALL AND HURT THEIR FOOT AND HAVE A VERY MINOR AILMENT, BUT COULD WE DO SOMETHING A LITTLE BIT DIFFERENT THAN TO TAKE THEM TO THOSE PLACES? BECAUSE WHEN WE THINK ABOUT THIS, THAT POTENTIALLY BURDENS THEM WITH EXCESSIVE MEDICAL BILLS, IT'S EXPENSIVE TO GO FOR AN AMBULANCE RIDE OR TO GO TO AN EMERGENCY DEPARTMENT, AND THAT'S APPROPRIATE WHEN IT'S NEEDED, BUT IS IT THE RIGHT THING TO DO WHEN IT'S POTENTIALLY NOT NEEDED? ADDITIONALLY, OUR EMS AND FIRE SOURCES ARE A PRECIOUS RESOURCE. WE WANT THOSE AVAILABLE FOR THE NEXT BAD CAR WRECK, THE NEXT HEART ATTACK, THE NEXT NEXT CARDIAC ARREST. IT'S IMPORTANT TO HAVE THOSE PROVIDERS READY TO GET TO THAT NEXT PATIENT, AND LASTLY, OUR HOSPITAL PARTNERS NOT ONLY CARE FOR OUR PATIENTS HERE IN THE CITY, BUT THE ENTIRE REGION, AND SOMETIMES THEY COULD USE SOME HELP NOT HAVING THOSE LOW ACUITY PATIENTS COME AND SEE THEM. [00:25:03] SO ESSENTIALLY THE SOLUTION TO THIS PROBLEM IS TO PERFORM AN ENHANCED SCREENING PROCESS THROUGH THE 911 CALLER AND THEN OFFER ALTERNATIVE DESTINATIONS AND ALTERNATIVE CARE MODULES IN A CLINICAL, SAFE WAY TO THE PATIENT. ALSO, I WANT TO MENTION THAT THIS HAS BEEN TALKED EXTENSIVELY WITH OUR PARTNERS WITH THE AMARILLO FIRE DEPARTMENT, AMARILLO MEDICAL SERVICES, MYSELF AS THE MEDICAL DIRECTOR, AND ALSO OUR LOCAL HEALTHCARE SYSTEMS AND EVERYONE HAS SHOWN SUPPORT FOR THIS AND BELIEVE IT'S GOOD FOR OUR CITIZENS AND OUR COMMUNITY. A COUPLE SLIDES ON HOW THE SYSTEM WORKS. THAT TOP LINE IS WHAT HAPPENS TODAY. IF SOMEBODY CALLS 911 AND THE AECC TALKS TO THEM, THERE IS AN INTERNATIONAL TRIAGE PROCESS THAT THEY GO THROUGH. THEY ASK QUESTIONS, AND THE IDEA IS TO FIGURE OUT, IS THIS A VERY HIGH ACUITY CALL? IS THERE A LIFE THREAT? ARE THEY BREATHING? ARE THEY POTENTIALLY IN CARDIAC ARREST? IS THIS A MAJOR TRAUMA? AND AS SOON AS WE FIGURE THAT OUT, WE SEND ALL THE AVAILABLE RESOURCES. WE MAY SEND CAPTAIN TRUCKS AND PARAMEDICS ON ENGINES. WE SEND AMBULANCES, SUPERVISOR. WE SEND ALL THE RESOURCES THAT PATIENT AND CITIZEN DESERVES. HOWEVER, AS WE ASK MORE QUESTIONS AND DECIDE IT'S LOW ACUITY, WHAT WE STILL DO TODAY IS WE MAY JUST SEND AN AMBULANCE AND AGAIN, ALL THEY CAN DO IS PUT THE PATIENT IN THE BACK AND TAKE THEM TO THE EMERGENCY DEPARTMENT. SO THE ONLY THING THAT CHANGES IS NOW THOSE LOW ACUITY PATIENTS WOULD BE TRANSFERRED TO A NURSE, AND NOW THE NURSE SPENDS A LITTLE MORE TIME. THAT OTHER PROCESS IS A 30 SECOND TO TWO MINUTE PROCESS. THE NURSE WILL SPEND 8 TO 10 MINUTES HAVING A DEEPER CONVERSATION THROUGH PROTOCOL TO TEASE OUT AND ASSURE THAT THIS IS A VERY LOW ACUITY CALL, AND THEN ONCE WE CONFIRM THAT, WE ALSO ASK ABOUT THE PAYOR SITUATION. DO YOU HAVE INSURANCE? DO YOU NOT? WHAT KIND OF INSURANCE DO YOU HAVE? BECAUSE IF IT IS LOW ACUITY, IT'S ALSO IMPORTANT TO MATCH THAT PATIENT TO THE RIGHT IN-NETWORK TYPE RESOURCE SO THAT THEY WON'T BE BURDENED WITH ADDITIONAL MEDICAL DEBT. SO VARIOUS RESOURCES ARE AVAILABLE RIGHT HERE IN OUR COMMUNITY. WE HAVE A NUMBER OF URGENT CARES THAT YOU'RE AWARE OF THAT CAN TAKE WALK INS DURING THE DAY AND SOME EVEN 24 HOURS. WE CAN UTILIZE TELEHEALTH AND ACTUALLY POTENTIALLY CONNECT THE PATIENT TO A DOCTOR, NP OR PA RIGHT THERE IN THE HOME. SOMETIMES JUST NURSE ADVICE, AND SOMETIMES THE PATIENT MAY STILL NEED TO GO TO AN EMERGENCY DEPARTMENT AND UTILIZE AN AMBULANCE. THE OTHER THING, AS WE LEARNED, IS SOMETIMES PATIENTS CALL BECAUSE THEY ACTUALLY JUST NEED TRANSPORTATION. SO THE SERVICE ALSO PROVIDES RIDESHARE TO MOVE THE PATIENT FROM POINT A TO POINT B, AND CAN ALSO BRING THEM BACK AND DO A PHARMACY STOP IF NEEDED. BECAUSE SOMETIMES WE SEE THE DOCTOR, WE NEED TO STOP AND GET ANTIBIOTICS OR SOMETHING. SO IT'S A FULL END TO END SOLUTION, AND I ALSO WANT TO MENTION THE NAVIGATION PIECE. THERE'S NO CHARGE OR COST TO THE PATIENT OR TO THE CITY. THIS IS AN INTERNAL THING THAT GMR WOULD PROVIDE. I JUST WANT TO SHOW THIS, TO SHOW THAT THIS ISN'T SOME NEW PROGRAM THAT WE'RE TRYING TO START HERE ANEW. THIS IS SOMETHING NEW TO AMARILLO, BUT THIS IS THE LARGEST SCALED 911 NURSE NAVIGATION PROGRAM, ALMOST 30 SITES. YOU CAN SEE COAST TO COAST ALMOST 200,000 PATIENTS THROUGH THAT PROGRAM OVER THE COURSE OF ABOUT FIVE YEARS OR SO. SO I WILL STOP THERE AND SEE IF THERE'S ANY PARTICULAR QUESTIONS. I'VE GOT MORE SLIDES AND OBVIOUSLY COULD TALK AT THIS AT LENGTH, BUT I WANT TO SEE IF THERE'S ANY PARTICULAR QUESTIONS. COUNCILMAN CRAFT YOU WANT TO TAKE THIS ONE? NO, I DON'T HAVE ANY QUESTIONS AT ALL. ANY QUESTIONS? COUNCILMAN. NO, SIR. I WOULD JUST SAY THIS WAS SOMETHING THAT I WAS MADE AWARE OF, AND, AND I THINK IT'S IMPORTANT IN UTILIZING THE RESOURCES THAT WE NEED, AND SO SOME OF THE SPECIFICS OF THE INSTANCES OF THE 911 CALL YOU KNOW, WHERE YOU WEREN'T IN ANY KIND OF AN EMERGENCY SITUATION. SO IT WASN'T THE ISSUE OF, WE DON'T REALLY KNOW, YOU COULD BE HAVING SOMETHING, BUT WE'RE GOING TO GO AHEAD AND THROW YOU OVER HERE TO THIS NURSE. IT WAS SOMETHING THAT WAS VERY, VERY OBVIOUS THAT THE, THE RELEVANCE OF THAT PARTICULAR CALL OR THAT NEED SHOULDN'T WARRANT A FIRE TRUCK, AND THEN WE'RE TAKING OUR RESOURCES OUT OF SERVICE, MORE OR LESS. WHILE WE'RE DOING THAT. SO I DON'T KNOW IF COUNCIL NEEDS ANYTHING FURTHER ON IT. I APPRECIATE THE UPDATE. COUNCIL, IS THERE ANYTHING ELSE YOU HAVE FOR THE GOOD DOCTOR HERE TODAY? NO. OKAY. WE APPRECIATE YOU BEING HERE, SIR. ABSOLUTELY. THANK YOU. THANK YOU FOR THE PRESENTATION. I WOULD ASK MAYBE MR. PATH, ARE WE EXPECTED TO DO ANYTHING ON THIS IN A FUTURE COUNCIL MEETING? IS THERE AN ACTION ITEM? CORRECT, YES. TO MY KNOWLEDGE THAT WE'LL HAVE TO AMEND THE PERMIT, I THINK, FOR AMS. YES. WE'LL BRING AN ITEM BACK TO THE COUNCIL AT A FUTURE DATE. OKAY. REAL GOOD. I'M GOING TO GO AHEAD AND TAKE ITEM SEVEN E OUT OF ORDER, MISS CITY SECRETARY, IF YOU'RE READY, AND THEN WE'LL COME BACK FOR SEVEN D AFTER WE'RE DONE. [7.E. Reduced ballot language for Proposition A (Citizen initiated petition election called for November 2024 regarding Sanctuary City for the Unborn) and Proposition D (Mayor and city council recall process)] SO THIS IS OUR BALLOT LANGUAGE PROP A PRESENTATION ON THE LENGTH OF THIS GUY, AND SO WHEN MISS CITY SECRETARY GETS OUT HERE, SHE CAN TELL [00:30:01] US WHAT WE'RE UP AGAINST AND WHAT THE LIMITATIONS ARE. MAYOR AND COUNCIL. THANK YOU. LET ME PULL THIS DOWN A LITTLE BIT. SO LAST WEEK, OUR ELECTION ADMINISTRATORS FOR BOTH POTTER AND RANDALL COUNTIES REACHED OUT TO US WITH SOME CONCERNS THEY HAD ON THE LENGTH OF BALLOT LANGUAGE FOR PROPOSITION A, WHICH IS THE SANCTUARY CITY FOR THE UNBORN. BALLOT ITEM, AND FOR PROPOSITION D, WHICH IS THE RECALL MEASURE ON YOUR CHARTER AMENDMENT. ELECTION ORDINANCE. THOSE IN THEIR CURRENT STATE WITH THE LENGTH THAT THEY ARE, THERE'S SOME CONCERNS BECAUSE THEY CANNOT FIT THEM INTO THE TRADITIONAL 2 OR 3 COLUMN BALLOT, AND SO THEY'VE SHARED SOME OF THEIR CONCERNS WITH WITH US AND WE'VE TALKED THROUGH THOSE, AND I WANT TO SHARE THOSE WITH YOU TODAY. SO YOU KIND OF KNOW WHERE WE'RE SITTING AT HERE. THIS IS NOT SOMETHING WE'VE EXPERIENCED BEFORE BECAUSE I DON'T THINK THEY TO THEIR KNOWLEDGE IN THE TIME THEY'VE BEEN DOING THIS AND THE TIME WE'VE BEEN DOING THIS. WE'VE NEVER HAD LANGUAGE THIS LONG. SO, AS CURRENTLY APPROVED, THE EXTREMELY LONG TEXT OF BOTH OF THESE PROPOSITIONS WILL NOT FIT ON A TRADITIONAL 2 OR 3 COLUMN PAPER BALLOT. THE CURRENT SYSTEM IS NOT MADE TO LET SOMETHING WRAP FROM ONE COLUMN TO THE NEXT, OR ONE PAGE TO THE NEXT, AND SO IN ORDER TO MAKE IT FIT IN ONE COLUMN, YOU'D HAVE TO TAKE IT DOWN TO A FOUR POINT FONT, WHICH THEY SENT US A SAMPLE TO LOOK AT, AND IT'S NOT LEGIBLE. I MEAN, ANYBODY THAT CAN READ THAT HAS FAR BEYOND 2020 VISION. SO AN ALTERNATIVE WE DISCUSSED WAS MOVING IT FROM 2 OR 3 COLUMNS DOWN TO ONE COLUMN. THAT'S VERY INCONSISTENT WITH WHAT THE COUNTIES TYPICALLY DO ON THAT 2 OR 3 COLUMN BALLOT, AND IN DOING THAT, IT WOULD CAUSE THE SIZE OF THE PAPER BALLOT SPECIFICALLY TO GO UP. IT WOULD BE ANYWHERE FROM 6 TO 7 PAGES BEFORE THEY EVEN GET CANDIDATE NAMES ON THEIR RACES, AND SO ONE THING THAT THEY SAID IN THEIR EXPERIENCE IS EXPERIENCES. THE LONGER THE BALLOT, THEY DON'T GET ALL THE PAGES BACK. SO MANY TIMES IN THEIR EXPERIENCE, VOTERS MAY RETURN THE FIRST PAGE OR THE LAST PAGE, AND THEY WOULDN'T GET FULL PAGES BACK. THERE WOULD ALSO BE AN INCREASED COST IN PRINTING AND POSTAGE FOR THOSE BALLOTS, AND ON THE FLIP SIDE, THEY HAD CONCERNS THAT WHEN VOTERS MAILED THE BALLOT BACK, IF IT TAKES EXTRA POSTAGE, IT MIGHT BE RETURNED TO SENDER AND IT MIGHT NOT GET BACK TO THEM IN TIME TO BE COUNTED. SO IN-PERSON VOTERS WILL HAVE TO SCROLL DOWN ON THE SCREEN MORE THAN ONCE TO SEE THE ENTIRE PROPOSITION LANGUAGE. THEY'RE CONCERNED. IF SOMEONE'S DOING THAT, THEY MAY NOT WANT TO READ IT. THEY MAY JUST HIT THE SKIP BUTTON AND THEN LATER COME BACK AND REALIZE, WAIT, I DIDN'T ACTUALLY GET TO VOTE ON THAT. SO THAT IS ANOTHER THING THAT OUR ELECTION ADMINISTRATORS HAD SHARED WITH US IN THEIR EXPERIENCE. THEY ALSO SAID THE LONGER THE BALLOT LANGUAGE, THE LONGER THE WAIT LINES, THE LONGER IT TAKES PEOPLE TO USE THE MACHINES, AND THAT CAN ADD STRESS TO WHAT'S ALREADY A STRESSFUL SITUATION FOR YOUR POLL WORKERS AND VOTERS ON AN ELECTION DAY. SO TO REMEDY THESE CONCERNS, WE'RE HERE WITH YOU TODAY TO TALK ABOUT SOME REVISED BALLOT LANGUAGE THAT CONDENSES DOWN WHAT YOU HAVE. ONE THING THAT I WANT TO SHARE ON THIS, AND I'M GOING TO DEFER TO BRYAN TO CORRECT ME IF I SAY THIS WRONG, BUT WE SEE CONSTITUTIONAL AMENDMENTS ON THE BALLOTS ALL THE TIME FOR THE STATE AND SOMETIMES THOSE THINGS MAY BE 2 TO 3 PAGES LONG, BUT THEY CONDENSE THEM DOWN INTO A FEW SENTENCES, AND WHAT THEY DO WHEN THEY DO THAT IS EACH OF THE COUNTIES PUTS THE FULL TEXT ON THEIR WEBSITE, AND THEY ALSO HAVE THAT FULL TEXT AVAILABLE AT EVERY POLLING LOCATION, AND SO IF WE CONDENSE OUR LANGUAGE TODAY, WHAT WE WOULD LOOK AT DOING IS SOMETHING VERY SIMILAR TO WHERE THE COUNTIES WOULD POST THE FULL ORDINANCE AND THE FULL MEASURE ON THEIR WEBSITES FOR US, WE WOULD HAVE COPIES PRINTED TO PUT OUT AT EACH POLLING LOCATION SO THAT PEOPLE CAN SEE THOSE WHEN THEY COME IN, AND THEN WE WOULD OF COURSE HAVE THAT ON OUR WEBSITE AS WELL, SO THAT PEOPLE CAN SEE THE FULL ORDINANCE, THE FULL INFORMATION, THE FULL MEASURE ON THE PROPOSITION D FOR RECALL AND HAVE A LITTLE MORE INFORMATION THAT WAY. SO WITH THAT BASED ON OUR CONVERSATIONS WITH THE ELECTION ADMINISTRATORS, FOR OPERATIONAL REASONS, WE ARE ASKING COUNCIL TO REDUCE YOUR BALLOT LANGUAGE DOWN ON THESE TWO PROPOSITIONS. FOR PROPOSITION A, THIS IS WHAT WAS ORIGINALLY APPROVED, AND THIS IS WHAT IS PROPOSED, AND I WOULD LET BRYAN HIT ON THIS A LITTLE BIT, BUT THIS WAS MADE AND REDUCED DOWN FROM THAT ORIGINAL ONE. I KNOW IT'S VERY HARD TO READ ON THIS. WE CAN FIT THIS ON ONE COLUMN OF A BALLOT AT AN EIGHT POINT FONT, AND SO WE HAVE CONFIRMED WITH OUR ELECTION ADMINISTRATORS THAT IS DOABLE. WE'VE VETTED THAT AND THEY'RE COMFORTABLE WITH THAT. EVERYTHING ELSE ON THE BALLOT WOULD BE IN A TEN POINT FONT, BUT THIS PARTICULAR PROPOSITION WOULD BE JUST A LITTLE BIT SMALLER, AND SO THIS ONE WE FELT WAS A GOOD OPTION TO BRING TO COUNCIL TO HOPEFULLY STILL CONVEY EVERYTHING IN THAT ORDINANCE THAT YOU WANT TO CONVEY WITH TAKING A FEW THINGS OUT, AND I WOULD LEAN OVER TO BRYAN AT [00:35:07] THIS TIME TO SAY ANYTHING I SHOULD SHARE ON THAT PARTICULAR ONE. NO, I THINK YOU'RE YOU'RE RIGHT ON. I NEED TO ANSWER ANY QUESTIONS, THOUGH. I CAN DO THAT. IS IT A WORD COUNT ISSUE? I GUESS SO IT'S. I MEAN, COULD YOU. IT IS, BUT IT'S NOT. WE CAN'T GO WITH JUST A CHARACTER COUNT, AND WE DID ASK BOTH OF OUR ELECTION ADMINISTRATORS THIS, AND ONE OF THEM ACTUALLY TOOK THE EXTRA STEP TO REACH OUT TO THEIR VENDOR TO SAY, WHAT IS A CHARACTER COUNT? WHAT IS THE WORD COUNT? BUT IT DEPENDS ON THE WORDS AND WHERE THEY WRAP, AND SO THEY COULDN'T GIVE US A, HEY, YOU HAVE THIS MANY CHARACTERS TO WORK WITH BECAUSE FOR EXAMPLE, IF YOU HAVE A LINE WITH FIVE SHORT WORDS. IT'S ONE LINE. IF YOU HAVE FIVE VERY LONG WORDS, IT MIGHT BE THREE LINES, AND SO. SO WHAT THEY HAVE TO DO IS REALLY TAKE OUR BALLOT LANGUAGE AND PLACE IT IN THERE AND, AND ALMOST KIND OF PLAY AROUND WITH IT AND TEST IT TO SEE WHAT FONT THEY CAN MAKE FIT WITHIN THAT SPACE. WORKED THIS ONE UP, BRYAN? WHAT'S THAT? DID YOU WORK ON THIS ONE? I DID. THIS IS ORIGINALLY MR. HYDE. REMEMBER, PROPOSITION LANGUAGE DOES NOT HAVE TO HAVE THE ENTIRE MEASURE IN IT. IT JUST HAS TO IDENTIFY THE MEASURE, AND THAT'S WHAT THE STATE NORMALLY DOES ON ANY AMENDMENT, AND SO WHAT YOU'VE DONE IS JUST REDUCE THE LANGUAGE TO STILL CAPTURE THE ESSENCE OF WHAT THE MEASURE IS, WHICH IS WHAT THE SUPREME COURT OF THE STATE OF TEXAS HAS SAID YOU MUST DO. SO IT MUST SUBSTANTIALLY SUBMIT THE MEASURE TO THE VOTERS, AND THIS THIS PARTICULAR VERSION STILL HAS ALL OF THE OPERATIVE POINTS IN IT THAT THIS COUNCIL, IN PAST DISCUSSIONS HAD NOTED WERE VERY IMPORTANT TO THEM. SO AND THE MEASURE AND THE FULL LANGUAGE WOULD BE READILY AVAILABLE ON THE WEBSITE AT THE POLLING PLACES. IT WOULD BE, YES, AND WE WOULD TAKE THAT MEASURE DIRECTLY OUT OF ORDINANCE OR EXCUSE ME ON FOR SANCTUARY CITY FOR PROPOSITION A WOULD TAKE IT DIRECTLY OUT OF THE RESOLUTION THAT WE PASSED AT THE LAST MEETING, AND WE WOULD PUT THAT ON THE FRONT PAGE AND PUT THE FULL 18 PAGE ORDINANCE RIGHT BEHIND IT, AND RECALL WITH A WITH AN INITIATIVE PETITION. IT JUST IS WHAT IT IS, AND SO THAT'S WHAT YOU'RE TRYING TO CAPTURE HERE IS, IS JUST WHAT THE PETITION IS IN ITS ESSENCE. THAT'S ALL YOU'RE TRYING TO DO. DID YOU LOOK AT ANY OF THE OTHER CITIES THAT HAVE DONE THIS OR HAVE PROPOSED IT, OR WE LOOKED AT LUBBOCK AND SO SIMILAR ON LUBBOCK, THEY HAD A VERY SHORTENED ONE, AND WE BROUGHT UP AN EXAMPLE LIKE THAT WE COULD SHOW COUNCIL, BUT WE FELT THAT Y'ALL MIGHT WANT MORE DETAIL TO WHERE WE COULD KEEP IT AS INFORMATIONAL AS POSSIBLE. IF YOU'D LIKE TO SEE THAT ONE COUNCILMEMBER TIPPS, WE CAN PULL IT UP ON THE SCREEN AND SHOW YOU. YEAH, I DON'T I DON'T THINK IT'D BE APPLES TO APPLES BECAUSE THE LUBBOCK ORDINANCE WAS FAR DIFFERENT THAN THIS ONE. SO THIS ONE'S, I THINK, A LOT MORE ROBUST THAN WHAT LUBBOCK WAS IT THE LUBBOCK COUNTY OR LUBBOCK [INAUDIBLE]. THIS WAS THE CITY OF LUBBOCK. CITY OF LUBBOCK. THAT WAS EVEN BEFORE ROE V WADE, RIGHT? SO I THOUGHT WE HAD A DEADLINE. WASN'T THERE A DEADLINE? SO YOU HAD A DEADLINE TO CALL THE ELECTION OF AUGUST 19TH. ONCE IT'S CALLED, YOU CAN MAKE A CHANGE TO YOUR BALLOT LANGUAGE. WE JUST HAD TO HAVE IT CALLED. WHAT'S THE LATEST DATE? YOU CAN AMEND THE BALLOT LANGUAGE. WE'VE GOT TO HAVE IT DONE. IN TALKING WITH OUR ELECTION ADMINISTRATORS, WE CAN'T GO ANY LATER THAN SEPTEMBER 10TH. SO THEY'VE BEEN VERY GRACIOUS TO WORK WITH US AND KIND OF PUSH THEIR DEADLINES A LITTLE BIT, BUT IF WE APPROVE SOMETHING BY SEPTEMBER 10TH, THEN THAT GIVES THEM 11 DAYS TO GET BALLOTS APPROVED, GET BALLOTS MAILED OUT AND SENT TO ALL BY MAIL VOTERS. RON, THIS CAME FROM HYDE. IS THAT WHAT YOU SAID? THIS WAS ONE OF THE ORIGINAL DRAFTS THAT I'D JUST CONDENSED DOWN. SO THAT. SO THE COUNCIL WOULD HAVE AN OPTION. OKAY. THANK YOU. SO WE CAN'T GET A CHARACTER COUNT. CAN WE GET A LINE COUNT? CAN YOU FLIP BACK TO THE OTHER ONE? CAN YOU JUST PULL THE COUNT OFF OF THAT AND SEND IT OVER? SO THIS IS YOU WANT THE ORIGINAL? YEAH. SO THAT'S THE ORIGINAL AND THEN SO GIVE ME A SECOND. WELL, AND A LINE COUNT DOESN'T WORK BECAUSE YOU DON'T KNOW WHERE YOUR LINES ARE GOING TO BREAK. YOU DON'T KNOW WHERE IT'S GOING TO MOVE FROM ONE WORD TO THE NEXT. LET ME LOOK AT THE NEXT ONE, PLEASE. SO THE FONT FONT IS BIGGER ON THIS ONE? YEAH, AND I APPRECIATE THAT LARGER FONT. AS I GET LATER INTO MY 40S. NO READERS. SO THAT'S 21 LINES. THE OTHER ONE IS 26 LINES. SO WE CAN'T GET A SQUARE INCH. [00:40:04] NO. NO LIMITATION. I MEAN, IT'S A COMPUTER PROGRAM, SO IT DEALS IN ZEROS AND ONES, BUT I, FOR WHATEVER REASON, CANNOT GET SOME SORT OF LIMITATION CRITERIA CORRECT. WE CANNOT GET THAT, AND AGAIN, ONE OF THOSE ELECTION ADMINISTRATORS REACHED OUT TO THE COUNTY TO ASK THEM AS WELL. IT'S A MATTER OF HOW SMALL YOU'D GO ON THAT FONT TO MAKE IT FIT WITHIN THE BOX, TO HELP US AND THE CITIZENS UNDERSTAND. WHAT DOES THE WRAP TO THE COLUMN MEAN, LIKE ILLUSTRATE HOW THIS IS GOING TO LOOK AT THE POLLING PLACE. SO AT THE POLLING PLACE AND ANYONE THAT'S SEEN A BALLOT BY MAIL OR A SAMPLE BALLOT ONLINE. IT'S A LEGAL SIZE SHEET OF PAPER AND THERE'S THREE COLUMNS ON IT. THERE MAY BE EITHER 2 OR 3. TYPICALLY, OUR COUNTIES HISTORICALLY HAVE ALWAYS USED A THREE COLUMN BALLOT, AND SO EACH COLUMN IS IS ONE BOX, AND YOU HAVE TO FIT ONE PROPOSITION WITHIN THAT ONE COLUMN OR BOX BECAUSE IT WILL NOT IF IT NEEDS TO GO LONGER, GO TO THE NEXT COLUMN OR IT WON'T GO TO THE NEXT PAGE. NOW, WE DID CHAT WITH THE COUNTIES ABOUT THIS, AND THERE IS A SOFTWARE UPGRADE FOR THEIR SYSTEMS THAT THEY CAN DO. THAT WOULD CHANGE THAT, AND SO THAT ONCE THEY GO THROUGH THAT UPGRADE WOULD NOT BE AN ISSUE, BUT DUE TO THE TIMING RIGHT NOW OF BEING SO CLOSE TO THE ELECTION, NUMBER ONE, IT WAS GOING TO BE A PRETTY SIZABLE AMOUNT FOR BOTH COUNTIES TO HAVE TO DO THAT, AND THEY WOULD BE MAKING CHANGES TO THESE MACHINES WITHIN ABOUT A WEEK OR TWO OF USING THEM FOR THE ELECTION, AND SO IN TALKING WITH OUR ELECTION ADMINISTRATORS, THEY WERE NOT COMFORTABLE WITH TRYING TO GO THROUGH WITH AN UPGRADE RIGHT BEFORE THE ELECTION LIKE THAT. COUNCILMAN CRAFT WAS IT YOU THAT WANTED TO REMOVE THE DECLARATIONS IN ORDER TO SPEAK TO WHAT THE CHANGE IN THE LAW OR THE ORDINANCE WOULD BE? IT'S MORE OBJECTIVE AND MORE STUFF ON THERE. SO I GREATLY APPRECIATE WHAT WHAT BRYAN'S DONE FOR US, BUT WE DON'T HAVE AN ACTION ITEM ON THIS ONE TODAY, EVEN THOUGH THIS DISCUSSION FOLLOWS UP WITH THE RECALL MEASURE D, I THINK, OR PROP D, AND WE DO NEED TO TAKE ACTION ON THAT ONE. THAT ONE IS A LITTLE LESS CONTROVERSIAL THAN THIS ONE. CORRECT. SO DOES COUNCIL WANT TO LOOK AT WHAT IT WOULD LOOK LIKE BEFORE WE TAKE ACTION ON THIS IN TWO WEEKS, WHAT IT WOULD LOOK LIKE IF YOU JUST REMOVED THE DECLARATION STATEMENTS YOU LEFT, YOU KNOW, THE STATEMENT AT THE BEGINNING AND THEN YOU TAILORED IT MORE TO LIKE WHAT COUNCIL MEMBER CRAFT WAS WAS GOING AFTER LAST MEETING. I MEAN, IT'S JUST A RESOLUTION. WELL, I DON'T KNOW, I THINK THE MORE THAT IT SAYS AND I DON'T KNOW PRO AGAINST WHATEVER IF IT'S MORE WHAT THE MEASURE OR WHAT THE ORDINANCE SAYS MAYBE BETTER. I MEAN, BECAUSE AGAIN, I THINK PEOPLE HAVE ISSUES WITH THAT, YOU KNOW, DECLARING THE CITY. WELL, IF THAT'S THEN THEY'LL VOTE FOR OR AGAINST THAT. SO IF WE TAKE IT OUT, I MEAN, I DON'T KNOW. I MEAN, THIS WAS DRAWN UP BY OUR OUTSIDE COUNSEL. YEAH, I MEAN, WELL, NOT THIS PARTICULAR ONE. THIS WAS AMENDED BY BRYAN. WELL, IT WAS JUST CLEANED UP. THIS VERSION WAS CONDENSED DOWN FROM JUST CONDENSED DOWN. THAT GEORGE HYDE PROVIDED. NO VERBIAGE CHANGE. JUST CONDENSED DOWN. IS THAT CORRECT? CORRECT. YEAH. NO VERBIAGE CHANGE. JUST TOOK OUT SEVERAL OF THE DECLARATIONS THAT WERE NOT PART OF THE OPERATIVE PORTIONS OF IT. SO YOU DID TAKE OUT A FEW OF THE DECLARATIONS THAT YOU DIDN'T FEEL WERE PERTINENT TO THE OUTCOME OF PASS OR FAIL OF THIS THE MEASURE, THE MEASURE. THIS STILL CAPTURES THE ESSENCE OF WHAT WHAT THE MEASURE IS BECAUSE THE MEASURE IS NOT CHANGING. THE MEASURE IS THE SAME AS YOU'VE ALREADY APPROVED. OKAY. I WOULD SAY IF WE COULD HAVE A FEW SAMPLES TO LOOK AT BEFORE NEXT MEETING, THEN WE COULD UPDATE IT. OKAY. SO I THINK THAT'S PROBABLY DUE DILIGENCE UNFORTUNATELY, ON THIS GUY. SO YEAH, I WOULD ASK STAFF TO SHOW WHAT THIS LOOKS LIKE. IF YOU REMOVE THE DECLARATORY STATEMENTS AND LEAVE ALL OTHER LANGUAGE AS WRITTEN, AND THEN KEEP THIS ONE, THIS ONE MAY BE, YOU KNOW, OUR FIRST SHOT AT IT, BUT MAYBE OUR BEST. I DON'T KNOW, AND THEN WHAT IF WE DO NOTHING? IF WE DO NOTHING THERE WOULD BE INCONSISTENCY, POSSIBLY IN THE BALLOTS BETWEEN THE COUNTIES, AND WE COULD HAVE. I KNOW ONE OF THE ELECTION ADMINISTRATORS IS WILLING TO COME NEXT TIME THEY'LL BOTH BE HERE, BUT ONE IS WILLING TO TALK ABOUT HER CONCERNS AND WITH 18 YEARS OF EXPERIENCE IN HER ROLE, SHE CAN TALK TO INCONSISTENCIES ARE NOT GOOD IMPACTS, INCONSISTENCIES, MEANING IT WON'T WRAP OR IT GOES AHEAD AND WRAPS TO THE OTHER. IT MIGHT LOOK DIFFERENT FOR A POTTER COUNTY VOTER THAN IT DOES FOR A RANDOM COUNTY VOTER, REGARDLESS OF THE OUTCOME. SO. OKAY. [00:45:03] SO DO YOU KNOW IF OR ARE THE IS IT UP TO THE COUNTY TO DETERMINE WHAT VOTING MACHINES DO THEY USE, OR DOES ALL THE STATE USE THE SAME VOTING MACHINES? IT'S UP TO THE COUNTY NOW. THERE'S VERY LIMITED VENDORS BECAUSE THE STATE HAS PASSED SOME LAWS THAT YOU HAVE TO USE SPECIFIC VENDORS, AND SO THERE ARE REALLY ONLY 2 OR 3 THAT I'M AWARE OF, COUNCILMEMBER SIMPSON. BOTH OF OUR COUNTIES USE THE SAME ONE. THEY USE HEART VOTING MACHINES. YEAH. I'M JUST TRYING TO FIGURE OUT WHY A DIFFERENCE BETWEEN HOW THEY LOOK WOULD MAKE A DIFFERENCE. I GUESS YOU HAVE DIFFERENT VOTING MACHINES THAT COULD HAVE DIFFERENT LOOKS ON THEM. YOU DO, AND YOU'LL HAVE DIFFERENT LINKS TO YOUR BALLOTS AND THINGS, AND SO THEY MAY LOOK A LITTLE DIFFERENT THERE. SO AT ONE POINT IN TIME WE WERE TALKING ABOUT POSSIBLY LOOKING AT THE UPDATE, BUT I KNOW IN SPEAKING WITH BOTH COUNTIES, WE DECIDED THAT WE WOULD PRESENT THIS TO COUNCIL AS A BETTER OPTION, SINCE NEITHER OF THEM WERE COMFORTABLE WITH MOVING FORWARD WITH AN UPDATE THAT CLOSE TO AN ELECTION. FURTHER QUESTIONS COUNCIL? NO. OKAY. THANK YOU FOR THE DISCUSSION, AND WE'LL LOOK FOR THAT ADDITIONAL INFORMATION PRIOR TO SEPTEMBER 10TH. OKAY. DO YOU WANT TO COVER PROPOSITION D? I THINK SO. NO, I THINK IF YOU'LL COVER IT NOW, THEN THAT WAY WE CAN TAKE IT UP FOR AN ACTION ITEM. SO THIS ONE AND WE DO HAVE ON YOUR NON CONSENT AGENDA TODAY. SINCE IT WAS DONE BY ORDINANCE, WE HAVE TO APPROVE AN ORDINANCE TO AMEND IT. SO TODAY WOULD BE YOUR FIRST READING, AND THEN WE WOULD BRING BACK THAT SECOND READING WITH ANY CHANGES YOU MAY WANT ON SEPTEMBER 10TH. THIS IS YOUR CURRENT BALLOT LANGUAGE, AND AGAIN, THIS WAS INFORMATION THAT WAS DRAFTED BY MR. HYDE AND OUR CONSULTANTS, BAKER TILLY, AS PART OF THAT PROCESS, AND THEN BRYAN HAS TAKEN THAT AND CONDENSED IT DOWN TO THIS VERSION RIGHT HERE. I'VE GOT A IN THIS LANGUAGE, AT LEAST 30% OF THE REGISTERED VOTERS WITHIN THE CITY, WITH AT LEAST ONE FIFTH OF THE SAME CERTIFYING THAT EACH [INAUDIBLE] VOTER FOR THE OFFICER IN THE LAST ELECTION, I THOUGHT THAT WAS THE PART THAT WE WERE TAKING OUT. WE DID. WE SHOULD HAVE. YEAH JUST KEEP READING. WHAT IT'S DOING IS IT'S TELLING THE VOTER, WE'RE CHANGING THIS. WHAT YOU HAVE TO THIS. THAT'S NOT CONFUSING AT ALL, AND THAT'S REQUIRED TO BE IN THERE. THAT'S SUPER CONFUSING. IT THAT WAS THE LANGUAGE THAT WAS THAT WAS APPROVED. BY WHOM? MR. HYDE? OH, THAT'S SUPER CONFUSING. LOTS OF MATH GOING ON THERE. WHAT YOU'RE TRYING TO DO IS INFORM THE VOTER OF THE MEASURE. YOU'RE TRYING TO IDENTIFY WHAT THE MEASURE IS. THE MEASURE IS MUCH LONGER. SO WHAT YOU'RE TRYING TO DO IS IDENTIFY THE CHANGE THAT YOU'RE MAKING SO THAT IT GIVES THEM SOME CONTEXT, AND THEN YOU'RE TRYING TO OBVIOUSLY, THE GOAL IS, IS TO SUBSTANTIALLY SUBMIT THE MEASURE SO THAT THE VOTERS CAN VOTE ON IT. YOU'RE CAPTURING THE ESSENCE OF WHAT THE MEASURE IS. SO THAT'S WHY IT'S DRAFTED THAT WAY. IT MIGHT BE HARD TO HAVE CONTEXT FOR A RECALL WITHOUT IT. CAN YOU GO BACK TO THAT NEXT ONE OR THAT PREVIOUS ONE? STEPHANIE. ANY FURTHER QUESTIONS, COUNCIL? SO YOU YOU CUT THE VACATE PART OUT BUT THAT ALL STAYS IN THE MEASURE. SO ALL THAT LANGUAGE THAT WE NEEDED. STILL THERE. JUST NOT IN THE PROP. SO WE'RE STILL GETTING ALL THE OUTCOMES THAT WE NEEDED. ABSOLUTELY. OKAY. ABSOLUTELY. OKAY. REALLY GOOD. ANY OTHER QUESTIONS FOR MISS CITY SECRETARY? OKAY. THANK YOU, MRS. COGGINS. WE'RE GOING TO GO BACK TO ITEM SEVEN D SO WE DON'T SKIP THAT ONE ALTOGETHER. [7.D. Request future agenda items and reports from City Manager.] ANY FUTURE AGENDA ITEM REQUESTS FROM COUNCIL. OKAY. WE'RE GOING TO GO AHEAD AND MOVE ON TO OUR CONSENT AGENDA. [8. Consent Items] [00:50:01] NO PROBLEM AND DO I HAVE ANYTHING THAT COUNCIL WOULD NEED TO PULL OFF OF THE CONSENT AGENDA FOR FURTHER DISCUSSION? MAYOR, I'LL PULL ITEM EIGHT L. SO ITEM EIGHT L WE'RE GOING TO PULL TO DISCUSS. DO WE HAVE ANYTHING ELSE? KNOWING WHAT ITEM EIGHT L IS, I'M GOING TO RECOMMEND THAT WE VOTE ON THAT ONE INDEPENDENTLY, AND SO WE COULD GO AHEAD AND MOVE FORWARD WITH THE REST OF THE CONSENT AGENDA AS PRESENTED, EXCLUDING ITEM EIGHT L UNLESS COUNCIL HAS ANYTHING ELSE THEY NEED TO PULL OUT. WELL, I WOULD ASK FOR A MOTION THEN. I MOVE TO APPROVE THE CONSENT AGENDA EXCLUDING EIGHT L AS PRESENTED. SECOND. I HAVE A MOTION AND A SECOND. ALL IN FAVOR, PLEASE SAY AYE. AYE. ANY OPPOSED? CONSENT AGENDA PASSES, AS AMENDED. WE'LL GO AHEAD AND PULL UP ITEM EIGHT L HERE. [8.L. CONSIDER AWARD - AIRPORT MARKETING & ADVERTISING SERVICES] SO WHAT WE'RE LOOKING AT HERE, I'LL JUST READ IT SO WE DON'T HAVE TO GET ANYBODY BACK OUT THERE. IT'S OUR AIRPORT MARKETING AND ADVERTISING SERVICE. WE HAVE A THREE YEAR ADVERTISING SERVICES CONTRACT, AND IT'S BEING AWARDED TO NOBOX CREATIVE. IT'S ROUGHLY $1 MILLION CONTRACT, BUT IT'S $360,000 ANNUALLY, AND IT'S PAID FOR OUT OF OUR AIRPORT OPERATING FUND AND RESERVES, AND SO REVENUES, I SHOULDN'T SAY RESERVES. COUNCIL MEMBER. CRAFT WHAT ISSUES DO YOU HAVE WITH THIS? I'LL JUST BE ABSTAINING FROM THAT VOTE. OKAY. SO YOU HAVE A YOU WILL ABSTAIN FROM THAT VOTE. DIRECT CONFLICT. YOU HAVE A CONFLICT. OKAY. YES. COUNCILMAN SIMPSON. YOU'LL ABSTAIN FROM THAT AS WELL. OKAY. DO I HAVE ANYTHING THAT WE NEED TO ASK ON THIS, OR ARE WE GOOD JUST WITH WITH THOSE ABSENCES? WELL, I'D LIKE TO I'M JUST CURIOUS WHAT THIS ENTAILS. I MEAN, A $360,000 ADVERTISING CONTRACT FOR THE AIRPORT. I'M CURIOUS. I GET THAT IT SAYS MEDIA PURCHASES, DIGITAL CAMPAIGNS, WEBSITES, SOCIAL MEDIA. WE HAD ONE PRIOR, I THINK THAT WE HAD A SOD POODLES AND AGREEMENT WITH SOD POODLES I GUESS THAT WAS PART OF THE ADVERTISING THAT WE HAD REDIRECTED. SO I'M JUST KIND OF CURIOUS WHAT WHAT GOES INTO THIS? MR. CONNOR, IF YOU WANT TO TELL US WHAT WHAT YOU'RE USED TO, MAYBE KIND OF HOW IT'S BEEN DONE IN THE PAST. IS THIS A RENEWAL? WHAT PROCESS HAVE YOU GONE THROUGH? SURE. SO THIS WENT THROUGH AN RFP PROCESS. WE HAD FIVE COMPANIES THAT PROPOSED DIFFERENT AMOUNTS AND DIFFERENT THINGS TO US, AND NOBOX WAS THE CHOSEN ONE OUT OF ALL FIVE. SO PREVIOUSLY WE HAD A CONTRACT THAT WAS WITH A DIFFERENT COMPANY, AND THEY PROVIDED THE SAME TYPE OF SERVICES AS THIS CONTRACT. THE ONLY REAL DIFFERENCE HERE IS THAT YOU HAVE INSTEAD OF THE AIRPORT OR INSTEAD OF THE CONTRACTOR ONLY PROVIDING THE SERVICES OF THE CREATIVE WRITING, THE, YOU KNOW, SETTING UP THE GRAPHICS COORDINATING WITH THE TELEVISION STATIONS, RADIO STATIONS AND OTHER MEDIA, DOING SOCIAL MEDIA AND ALL THAT. THIS CONTRACT ALSO INCLUDES THE ACTUAL CONTRACTING WITH THE WITH THOSE MEDIA OUTLETS. SO RATHER THAN HAVING TO GO BACK TO THE AIRPORT FOR ADDITIONAL APPROVALS ON ALL THAT STUFF, THEY WOULD JUST CONTRACT WITH THEM. SO ESSENTIALLY THE CONTRACTOR WOULD PROPOSE THE LIKE THE TELEVISION STATION. THEY WOULD PROPOSE A CERTAIN AMOUNT OF ADVERTISING FOR A CERTAIN CAMPAIGN THAT WOULD THEN GO THROUGH NO BOX. NO BOX WOULD GIVE THAT INFORMATION TO ME AND SAY, ARE YOU GOOD WITH IT? DO YOU APPROVE THAT SET? WE WOULD GO BACK TO THEM AND SAY YES OR NO. ASSUMING THAT WAS YES, THEN THEY WOULD JUST CONTRACT WITH THAT STATION RATHER THAN HAVING TO GO PAST ME, GO TO FLOYD OR OTHERS FOR APPROVAL ADDITIONALLY, AND THEN HAVE IT GO THROUGH OUR PURCHASING PROCESS IN ADDITION TO HAVING TO GO THROUGH NOBOX. SO THAT'S REALLY WHY THERE'S THE ADDITIONAL COST, BECAUSE IT'S NOT JUST THE COST OF NO BOX SERVICES, WHICH IS, BY THE WAY, $30,000 LESS THAN THE PREVIOUS CONTRACTOR. SO IT ALLOWS US TO ACTUALLY DO MORE ADVERTISING FOR ABOUT THE SAME AMOUNT OF MONEY. SO IS THIS NORMAL IN THE BUDGET? I MEAN, WE USUALLY SPEND ROUGHLY 360,000 TO ADVERTISE. YES, THAT'S WHAT WE SPENT IN THE PAST. NOW, LAST YEAR WE SPENT ALMOST NOTHING BECAUSE WE HAD TO ALLOW FOR BOND ISSUE PAYMENTS AND THAT TYPE OF THING. SO WE REDUCED THAT TO NEAR NOTHING, BUT WE STILL HAD SOME MINOR JUST TO ACCOMMODATE THE CONTRACT THAT WE ALREADY HAD. DID YOU SEE ANY REDUCTION IN TRAVEL OR USAGE OF THE AIRPORT WHEN YOU SPENT NOTHING IN ADVERTISING? WELL, THAT HAS YET TO BE SEEN BECAUSE PEOPLE BOOK FAR IN ADVANCE. SO IT'S REALLY HARD TO TELL WHETHER IT WAS REDUCED OR NOT. THAT WON'T BE NECESSARILY SEEN UNTIL THIS COMING FALL, ACTUALLY. SO WE CAN'T COMPARE YEAR OVER YEAR TO DATE? NOT YET. WHAT I CAN COMPARE IS, YOU KNOW, 2016, 2019 TO THIS PAST YEAR WHERE WE WENT FROM ABOUT [00:55:09] $344,000. SORRY, 344,000 ENPLANEMENTS IN 2016 TO OVER 406,000 IN LAST YEAR. I GUESS I'M JUST CURIOUS. I MEAN, IN BUSINESS, YOU KNOW, THE REASON FOR ADVERTISING OR MARKETING. WHEN YOU HAVE A MONOPOLY, YOU DON'T REALLY HAVE TO DO A LOT, YOU KNOW? I MEAN, IT'S LIKE YOU DON'T I DON'T MEAN THAT IN ANY WAY, BUT IF SOMEBODY WANTS TO TRAVEL OUT OF AMARILLO, THEN THEY WANT TO FLY. YEAH, THERE ARE A LOT OF REASONS FOR ADVERTISING IN AN AIRPORT. I HAVE A PAPER HERE. I DON'T KNOW IF YOU RECEIVED COPIES OF IT. HAVE YOU RECEIVED COPIES OF IT? IF NOT, I'LL GIVE THEM TO YOU NOW. YOU CAN LOOK AT IT. THERE'S ON THIS PAGE. THERE'S ABOUT 16 OTHER AIRPORTS LISTED, AND THE AMOUNT OF MONEY THAT THEY SPEND ON ADVERTISING, THEY'RE ALL SORT OF SIMILAR. IN PASSENGER ENPLANEMENTS THAT WE HAVE AT THE AIRPORT HERE. SO YOU CAN KIND OF SEE IT'S SORT OF ALL OVER THE PLACE BUT, YOU KNOW, REASONS FOR AIRPORT ADVERTISING INCLUDE KEEPING THE PUBLIC AWARE OF AVAILABLE DESTINATIONS, GETTING THE WORD OUT ABOUT NEW SERVICE AND NEW DESTINATIONS, AND INFLUENCING PEOPLE TO FLY INSTEAD OF DRIVE, WHICH IS REALLY OUR BIGGEST ISSUE BECAUSE, YOU KNOW, PEOPLE IN TEXAS LOVE TO DRIVE. SO WE'RE TRYING TO CONVERT ALL THE PEOPLE WHO DRIVE TO FLY, RIGHT? AND THEN SIMPLY KEEPING THE THOUGHT OF FLYING FROM A PARTICULAR AIRPORT IN THE PUBLIC MIND BY PAINTING A POSITIVE PICTURE OF THE AIRPORT AND THE AIRLINES THAT FLY THERE. SO THERE'S A LOT TO IT. IT'S VERY COMPLICATED, YOU KNOW, IT'S A COMPLICATED THING. IT'S NOT ALWAYS EASY TO FIND WHAT THE EXACT EFFECT IS, BUT I THINK YOU CAN ALSO SEE THAT A LOT OF AIRPORTS ARE SPENDING A LOT OF MONEY ON ADVERTISING, AND WE THINK THAT IT HAS A REALLY POSITIVE EFFECT, BECAUSE WHEN I FIRST GOT HERE, THE NUMBERS WERE PRETTY FLATLINED, AND SINCE 2017 WE'VE BEEN GROWING AT A PRETTY GOOD RATE, SO MINUS SOME COVID YEARS, BUT YEAH, SO THERE'S NO NATIONAL ASSOCIATION THAT PROMOTES FLYING VERSUS DRIVING. NO. I MEAN, THERE'S NO IT'S UP TO THE INDIVIDUAL AIRPORTS TO GET THAT MESSAGE ACROSS IS WHAT YOU'RE SAYING. CORRECT, AND THE AIRLINES USED TO DO A LOT OF THAT MARKETING THEMSELVES, BUT THEY DON'T ANYMORE. SO IT'S VERY RARE THAT YOU'LL SEE AN ADVERTISING SET ON TELEVISION OR RADIO THAT IS ACTUALLY PROMOTED STRICTLY FROM THE AIRLINE ITSELF. THE AIRLINES HAVE ACTUALLY TAKEN THAT AND SAID, WE WANT THE AIRPORTS TO DO IT INSTEAD. SO AND THERE'S A LOT OF FAA RULES BEHIND ALL THAT REASONING, BUT WHERE DO YOU ADVERTISE? I MEAN, AND PLEASE HEAR ME SAY, I'M JUST COMING FROM A BUSINESS. I'VE NEVER SEEN AN ADVERTISEMENT FOR AMARILLO INTERNATIONAL AIRPORT. OKAY. I MEAN, I KNOW WE'VE HAD A BAD FIRM, YOU KNOW, MAYBE WE NEED A NEW ONE, BUT I GUESS I JUST HAVEN'T SEEN IT, AND WHEN I GO TO TRAVEL, PULL THIS OUT. GO TO THE AIRLINE. I'M DOING SEARCH MY DESTINATION. YOU KNOW WHERE I'M COMING FROM. MY DESTINATION HAS NO BEARING ON AN AIRPORT. I MEAN, I MAY BE RARE, BUT, I MEAN, IT'S JUST GOING TO BE SURE. WE'VE ACTUALLY DONE SOME STUDIES. WE HAVE A KIOSK. I DON'T KNOW IF YOU'VE EVER SEEN IT IN THE TERMINAL, BUT THERE'S A KIOSK, AND FROM THAT, WE ACTUALLY HAVE PULLED SOME DATA THAT SAYS APPROXIMATELY 15% OF THE PEOPLE THAT TRAVEL HAVE TRAVELED WITH US BECAUSE OF SEEING ADVERTISING. REALLY? IT'S QUITE A DEAL. YEAH. I'M NOT JOKING. I GUESS I JUST, I MEAN, FLOORS ME THAT YOU WOULD I'M CHOOSING TO GO TO THE AMARILLO AIRPORT BECAUSE THAT'S WHERE I NEED TO GO TO FLY. WE'VE DONE, YOU KNOW, PRIMARILY FOUR, SEVEN, 10. WE'VE ADVERTISED ALL THOSE TV STATIONS AND SOME RADIO IN THE PAST, AND WE'VE DONE WE DO A SOCIAL MARKETING SOCIAL MEDIA CAMPAIGN AND WE'VE ALSO DONE RADIO AND SOME PRINT MEDIA IN THE PAST, SPECIFIC CAMPAIGNS, YOU KNOW, IT DEPENDS ON WHAT YOU GOT GOING THAT YEAR. SO THE MAIN MESSAGE IS DON'T DRIVE, FLY. IT'S EASIER. THAT'S THE MAIN MESSAGE WE PUSH. NOT THAT WE OFFER A DIFFERENT EXPERIENCE AT AMARILLO INTERNATIONAL AIRPORT. THERE'S NOTHING ABOUT THAT. IT'S JUST FLY, DON'T DRIVE. WE TRY TO KEEP IT PRETTY SIMPLE, YOU KNOW, AND THERE'S DIFFERENT, YOU KNOW, THEMES TO EACH CAMPAIGN AS IN ANY ADVERTISING CAMPAIGN, BUT WE TRY TO KEEP IT FRESH. SO YEAH, I THINK WHAT COUNCILMAN TIPPS IS SAYING, YOU KNOW, LIKE A GOOD NEIGHBOR OR AMARILLO AIRPORT IS THERE FOR YOU, IS THAT KIND OF GET TO THE POINT THERE? WELL, LET ME LET ME JUST GIVE YOU A REAL QUICK EXAMPLE. SO WHEN I FIRST GOT HERE BACK IN 2017, I WAS HERE FOR A LITTLE WHILE WITHOUT MY WIFE, AND SO I WAS ABLE TO GO OUT TO RESTAURANTS AND BARS AND THINGS AND ASK PEOPLE STRAIGHT ON IN THEIR FACE, WHAT DO YOU KNOW ABOUT THE AIRPORT? I GOT ALL KINDS OF ANSWERS FROM IT'S THE GREATEST THING, FROM SLICED BREAD TO YOU HAVE AN AIRPORT OR IT'S STILL OPEN. I MEAN, LITERALLY, AND A LOT OF THEM WERE AGRICULTURAL PEOPLE, BUT AGRICULTURAL PEOPLE ARE THE BIGGEST DRIVERS. THEY WILL DRIVE FROM HERE TO HOUSTON, YOU KNOW, JUST LIKE THAT [01:00:02] AND WE WANT THEM TO FLY INSTEAD. SO THOSE ARE THE REALLY THE PEOPLE THAT WE'RE TRYING TO HIT. YEAH. WELL, WE'LL COMMEND YOU. OUR AIRPORT IS AMAZING. I MEAN, FOR OUR ESPECIALLY FOR THE SIZE. GOSH, I MEAN, IT IS AMAZING. GO LUBBOCK. SURE. GOLLY. YEAH, IT'S A GREAT AIRPORT. WE APPRECIATE THAT. DO YOU THINK THE AIRLINES MIGHT PARTICIPATE IN THIS BUDGET? NO, THEY WILL. NOT AT ALL. THEY WOULD RATHER HAVE IT THE OTHER WAY. ASK US TO PARTICIPATE. GIVING THEM MILLIONS OF DOLLARS TO COME IN HERE. RIGHT. I MEAN, YOU KNOW, THEY FIGURE THAT THEY'RE PAYING FOR IT IN THE FEES THAT THEY PAY. OKAY. WHICH ARE MILLIONS OF DOLLARS. ANY FURTHER QUESTIONS FOR MR. CONNOR? NO, AND I GUESS, YES, THIS IS, LIKE YOU SAID, MODEST LAST YEAR. THIS IS PRETTY NORMAL. YOUR YOUR MARKETING BUDGET HAS BEEN PRETTY FLAT. OUR BUDGET WAS 360. SO. YEAH, AND YOU SEE A RETURN ON INVESTMENT ON THAT? YES, SIR. DO WE ADVERTISE IN SMALL TOWNS? IS THAT. I MEAN, WHERE DO WE GO? I MEAN, LIKE YOU SAID, MAYBE RURAL? I MEAN, [INAUDIBLE] STATIONS AND RADIO STATIONS GENERALLY HIT PRETTY FAR. SO IT JUST SEEMS LIKE A LOT FOR NOT A LOT OF BANG FOR MY BUCK, YOU KNOW? BUT ANYWAY. OKAY. I'M DONE. THANK YOU. OKAY. GOOD QUESTIONS. ALWAYS GOOD DISCUSSION UP HERE. ITEM EIGHT L IS READY FOR A MOTION. PREFERABLY WITH ONE OF US THREE THAT IS STILL VOTING. I'LL MAKE A MOTION WE ACCEPT EIGHT L STATED. I HAVE A MOTION AND A SECOND. I DON'T HAVE A SECOND. I HAVE A MOTION. DO I HEAR A SECOND? I'LL SECOND. I HAVE A MOTION AND A SECOND. ALL IN FAVOR, PLEASE SAY AYE. AYE. ANY OPPOSED? ITEM EIGHT L PASSES. SO WE WILL NOW MOVE ALONG TO OUR NON CONSENT AGENDA. WE'RE MAKING PRETTY GOOD TIMING. I'M JUST GOING TO KEEP US MOVING HERE IN THE HOPES THAT WE WOULD ACTUALLY GET THROUGH ONE OF OUR BUSINESS MEETINGS HERE TODAY WITHOUT A RESTROOM BREAK. WE'LL SEE. ITEM NINE A, IS THAT MR. [9.A. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 8147] KENDRICK? ARE YOU COMING UP HERE, BRADY? WALK US THROUGH THIS ONE, PLEASE, SIR. GOOD AFTERNOON, MAYOR AND COUNCIL. NINE A IS A PUBLIC HEARING AND A CONSIDERATION OF AN ORDINANCE THAT IS REZONING 12.48 ACRES OF LAND THAT IS UNPLATTED IN RANDALL COUNTY, TEXAS, IN THE VICINITY OF TOWNE SQUARE BOULEVARD AND SONCY ROAD, TO REZONE FROM AGRICULTURAL DISTRICT TO GENERAL RETAIL DISTRICT, AND THE APPLICANT IS A FIRM AND LAND SURVEYORS, INC. FOR THE EMELINE BUSH O'BRIEN MARSH TRUST, AND LIKE I SAID, THEY'RE REZONING THE GENERAL RETAIL TO DEVELOP THIS TRACT WITH A HANDFUL OF RETAIL USES. I KNOW THEY HAVE A COUPLE THAT ARE UNDER ACTIVE DEVELOPMENT AT THIS TIME. SO THIS IS THE FIRST STEP BEFORE THEY CAN MOVE ALONG THE PLANNING AND ULTIMATELY SITE PLAN DESIGN. THE REQUEST WAS FOUND TO CONFORM WITH THE CITY PLANS, PLACE TYPES AND THE COMPLETE NEIGHBORHOOD SCENARIO FOR THIS AREA, AND PLANNING AND ZONING ALSO FOUND THAT GIVEN THE EXISTING ZONING AND DEVELOPMENT PATTERNS IN THIS AREA ALONG THE PERIPHERY OF THE TOWN SQUARE SUBDIVISION, THEY FELT IT WAS A LOGICAL ZONING DISTRICT TO ESTABLISH IN THIS AREA. WE SENT NOTICES AS REQUIRED BY STATE LAW AND HAVE NOT RECEIVED ANY COMMENTS AS OF THIS MEETING TODAY, AND PLANNING AND ZONING COMMISSION RECOMMENDED APPROVAL WITH A 7-0 VOTE TO APPROVE THIS ITEM. ANY QUESTIONS FOR MISTER KENDRICK? YES, SIR. LET ME DOUBLE CHECK MYSELF. THIS IS NOT A PUBLIC HEARING. THIS IS A PUBLIC HEARING. OKAY, I WOULD NOW GO AHEAD AND OPEN A PUBLIC HEARING. DO I HAVE ANYONE HERE THAT WOULD LIKE TO SPEAK FOR OR AGAINST THIS ITEM? SEEING NO ONE WILL CLOSE THE PUBLIC HEARING. DO I HEAR A MOTION ON ITEM NINE A? I MOVE WE ACCEPT ORDINANCE 8147. SECOND. A MOTION AND A SECOND. ANY FURTHER DISCUSSION? ALL IN FAVOR, PLEASE SAY AYE. AYE. ANY OPPOSED? ITEM PASSES. WE'LL MOVE ON TO ITEM NINE B. [9.B. PUBLIC HEARING AND CONSIDERATION OF ORDINANCE NO. 8148] MR. KENDRICK, YOU'RE BACK UP. NINE B IS A PUBLIC HEARING AND CONSIDERATION OF ORDINANCE 8148. THIS IS TO CONSIDER THE VACATION OF A 0.388 ACRE PORTION OF PUBLIC RIGHT OF WAY, BEING THE REMAINING PORTION OF NORTH WILSON STREET THAT IS LOCATED BETWEEN BLOCKS ONE AND TWO OF EBERSTADT'S SUBDIVISION OF BLOCKS 270 AND 277 OF HOLLAND'S ADDITION. THIS IS IN THE VICINITY OF NORTHEAST FIFTH AVENUE AND NORTH WILLIAMS STREET, AND THE APPLICANTS ARE FABIAN ALVAREZ AND JOSE SILVESTRE, AND THEY ARE WANTING TO DEVELOP COMMERCIAL SITES ON BOTH SIDES OF THIS STREET THAT WAS NEVER CONSTRUCTED AND IS THE REASON FOR THE REQUEST FROM THE CITY AND UTILITY COMPANIES BOTH REVIEWED THIS [01:05:02] SEGMENT OF STREET AND THERE ARE NO UTILITIES LOCATED IN THIS STREET SEGMENT, SO THERE IS NOT THE NEED TO RETAIN PUBLIC UTILITY EASEMENTS FOR THIS ITEM. ADDITIONALLY, THE TRAFFIC ENGINEER AND OTHERS LOOKED AT THIS AS WELL, AND THEY SAID IT'S HIGHLY UNLIKELY THAT WE WOULD EVER WANT TO DEVELOP THIS STREET SEGMENT, GIVEN HOW THE ROSS STREET DEVELOPED ON THE SOUTH END OF THIS. THIS WOULD CREATE AN UNSAFE INTERSECTION, AND IT'S SOMETHING THAT THEY FELT COMFORTABLE WITH ABANDONING. ON THIS ITEM IN PARTICULAR. SINCE THERE WAS NO EASEMENT RETENTION, THE APPLICANT DID PAY $5,800 TO THE CITY, WHICH WAS THE FAIR MARKET VALUE AS ESTABLISHED BY AN APPRAISAL ON THE PROPERTY. SO THE CITY HAS RECEIVED THAT PAYMENT FOR THIS ITEM. WE DID SEND PUBLIC NOTICES AND NO COMMENTS WERE RECEIVED ON THIS AND PLANNING AND ZONING RECOMMENDED APPROVAL OF THIS ITEM WITH A 7-0 VOTE AS WELL. QUESTIONS FOR MR. KENDRICK? NO, SIR. OKAY. I WILL OPEN A PUBLIC HEARING ON ITEM NINE B. ANYONE CARE TO SPEAK FOR OR AGAINST THIS ITEM? SEEING NO ONE HERE TO SPEAK, WE'LL CLOSE THE PUBLIC HEARING AND I WOULD ASK FOR A MOTION. I MOVE TO ADOPT ORDINANCE NUMBER 8148. SECOND. I HAVE A MOTION AND A SECOND FROM THE RIGHT SIDE. ALL IN FAVOR, PLEASE SAY AYE. AYE. ANY OPPOSED? MOTION PASSES. [9.C. CONSIDERATION OF RESOLUTION NO. 08-27-24-3] ITEM NINE C. BRADY ONE MORE TIME. SO NINE C IS THE CONSIDERATION OF A RESOLUTION 08-27-24-3. THIS IS A RESOLUTION TO SET THE DATE, TIME AND PLACE FOR A PUBLIC HEARING ON A PROPOSED ANNEXATION OF 203.80 ACRES OF LAND BEING UNPLATTED LAND IN THE WEST 50FT OF TARTAR AVENUE, AS DEDICATED IN SONCY PARK, UNIT NUMBER TEN. THIS IS ALL LOCATED IN SECTION 62, BLOCK NINE OF RANDALL COUNTY, TEXAS AND THE VICINITY OF SOUTHWEST 45TH AVENUE AND SONCY ROAD, AND THE APPLICANT IS ATTEBURY A G TESTAMENTARY TRUST, AND THIS RESOLUTION WOULD ALSO AUTHORIZE THE CITY MANAGER TO SIGN AND EXECUTE THE AGREED SERVICE PLAN. LIKE ON OTHER ANNEXATIONS RECENTLY, THIS IS JUST A FORMAL STEP TO SET THE DATE AND TIME AND PLACE OF THE PUBLIC HEARING, WHICH WE ARE PROPOSING TO BE SEPTEMBER 10TH AT 3 P.M., WHICH IS YOUR NEXT REGULARLY SCHEDULED MEETING TO CONSIDER THIS ANNEXATION. AND AS A REMINDER, THE SERVICE PLAN ONLY BECOMES BINDING, AND IN EFFECT, IF YOU ALL CHOOSE TO APPROVE THAT ANNEXATION AND ALSO GO THROUGH WITH THE SECOND HEARING ON THAT ANNEXATION. STATE LAW REQUIRES THAT SERVICE PLAN BE EXECUTED BY BOTH PARTIES BEFORE YOU ALL CONSIDER IT AND AT THIS STAGE, THAT SERVICE PLAN HAS BEEN NEGOTIATED BETWEEN CITY STAFF AND THE PROPERTY OWNER. LEGAL DEPARTMENT ALSO REVIEWED IT AND FOUND IT TO BE IN GOOD ORDER. SO STAFF FEELS THAT THIS ITEM IS AT A PLACE WHERE IT IS READY TO SET THAT PUBLIC HEARING FOR THIS PROPOSED ANNEXATION, AND THEN JUST TO THE DEVELOPER, IF ANNEXED, INTENDS TO DEVELOP THIS AREA WITH A MULTI-PHASE MULTIFAMILY DEVELOPMENT WITH ALSO SOME GREEN SPACE THAT WOULD SERVE FUTURE RESIDENTS IF ANNEXED. SO THAT IS ALL I HAVE. UNLESS YOU HAVE QUESTIONS FOR ME. QUESTIONS FOR OUR SENIOR PLANNER. AT THIS TIME. OKAY. THANK YOU, BRADY. NO PROBLEM. I WOULD ASK FOR A MOTION ON ITEM NINE C, THEN. I MOVE TO ADOPT RESOLUTION NUMBER 08-27-24-3 AS PRESENTED. SECOND, SECOND. OKAY, I HAVE A MOTION FROM PLACE FOUR A SECOND FROM PLACE TWO. ANY FURTHER DISCUSSION ON ANNEXING THIS PROPERTY? ALL IN FAVOR, PLEASE SAY AYE. AYE. ANY OPPOSED? THAT ITEM PASSES. MRS. COGGINS, I DON'T THINK YOU HAVE TO GET BACK UP ON THIS ONE. [9.D. CONSIDERATION OF ORDINANCE NO. 8149] ON ITEM NINE, D SINCE YOU'VE ALREADY WALKED US THROUGH THAT ONE I WOULD SAY DO WE HAVE ANY QUESTIONS ON ITEM NINE D FOR THAT RECALL LANGUAGE. DOES ANYBODY NEED ANY ADDITIONAL REVIEW OR DOES COUNCIL HAVE ANY NEED TO CHANGE ANY OF THAT LANGUAGE AS CHANGED. WHAT'S EVERYBODY'S THOUGHTS ON THIS? I MEAN AGAIN I'M NOT I'M NOT CLEAR ON WHETHER WE HAVE TO PUT IN WHAT THE CURRENT LAW IS OR NOT, BUT I DON'T KNOW IF ANYBODY HAS ANY THOUGHTS ABOUT LEAVING THE ONE FIFTH IN. DOES IT HAVE TO BE THERE? I MEAN, IF IT'S REQUIRED, IT HAS TO BE THERE, THEN I GUESS WE NEED IT TO STAY, BUT I'VE GOT VOTER FATIGUE AND WE HAVEN'T EVEN VOTED YET [INAUDIBLE]. SO I APPRECIATE THE FACT THAT WE TOOK SOME OF THE HOUSEKEEPING ITEMS THAT ARE OLD IN THE CHARTER AND CHANGES AT THE STATE LEVEL THAT WE NEED TO GET DONE. THEY'RE STILL ON THE MEASURE, BUT THEY'RE NOT AS LENGTHY ON THE PROP. SO I THINK WE DIDN'T LOSE ANYTHING. WE WOULD BE GOING BACK AND REVISITING A CONVERSATION WE HAD TWO WEEKS AGO. IT REALLY DOESN'T SAY ANYTHING DIFFERENT THAN IT SAID BEFORE. SO WE'RE GIVING IT A SECOND LOOK. I UNDERSTAND IT AS MUCH AS ANYBODY, AND I AGREE WITH YOU. [01:10:06] IT'S NOT THE EASIEST THING TO UNDERSTAND OR SIFT THROUGH, BUT IT'S ALL STATE LANGUAGE. BRYAN, YOU'RE SAYING THAT THIS IS STANDARD. IT STATES WHAT IT WAS AND THEN WHAT? THIS WOULD BE CHANGING. IS THAT CORRECT? YOU'RE SAYING THAT'S STANDARD BALLOT LANGUAGE. ONCE AGAIN, WHEN YOU SAY STANDARD IT DEPENDS ON WHAT IT IS. RIGHT, BUT BUT WHAT I'M, YOU KNOW, YOU'RE ALWAYS GOING TO GET A DEPEND FROM THE LAWYER, BUT WHAT I'M SAYING TO YOU IS YOUR TASK, AS THE LEGISLATIVE BODY, IS TO CRAFT A PROPOSITION THAT SUBMITS THE MEASURE TO THE VOTERS AND SO IF YOU'VE GOT ALL OF THE, THE CHIEF CHARACTERISTICS OF IT IN THERE, THEN YOU HAVE DONE WHAT YOU NEED TO DO PURSUANT TO STATE LAW. SO YOUR MEASURE TALKS ABOUT AMENDING A PORTION OF SECTION 24 RELATED TO RECALL FROM A CERTAIN PERCENTAGE PLUS ANOTHER FRACTION OF VOTERS RELATED TO WHO THEY VOTED FOR IN THE LAST ELECTION, TO JUST 30% OF WHOEVER VOTED LAST TIME. RIGHT. SO THE VOTER, WHAT YOU'RE TRYING TO DO IS CONVEY THE CHANGE THAT YOU'RE MAKING. YOU'RE CHANGING A COUPLE OF PIECES THERE THAT IS SIGNIFICANT, AND SO, YOU KNOW, WHETHER YOU WOULD NEED IT OR NOT. IT WOULD BE A SITUATION IN WHICH IF YOU'RE GOING TO CONVEY THE ESSENCE OF WHAT IT IS, DO THEY UNDERSTAND THE CONTEXT? RIGHT. I UNDERSTAND. COUNCILMAN. SIMPSON IS THAT ANY CLEARER OR STILL THE SAME? I DON'T KNOW, I'LL GO. I MEAN, AT THIS POINT, I MEAN, I DON'T UNDERSTAND WHY YOU CAN'T SAY, YOU KNOW, TO CHANGE THE RECALL PROCEDURES. I'M TRYING TO PICK IT UP HERE THAT, YOU KNOW, THAT YOU HAVE TO GET 30% OF THE NUMBER OF VOTES CAST IN THE LAST ELECTION. I'M JUST, YOU KNOW, I MEAN, IF WE NEED TO INCLUDE WHAT THE CURRENT LAW IS AND THAT'S A REQUIREMENT, BUT I JUST CAN'T. I'M NOT HEARING ANYTHING THAT SAYS IT'S A REQUIREMENT. SO I GUESS IT JUST IS COUNCIL'S PREROGATIVE AS TO WHETHER WE WOULD WANT TO LEAVE IT IN THERE OR NOT. I THINK YOU'RE RIGHT. YEAH. WELL, IT'S REALLY CONFUSING, I'LL SAY THAT. I KNOW IT'S PROPOSITION LANGUAGE. IT'S NOT ALWAYS THE EASIEST THING TO CAPTURE. SO HISTORICALLY, THAT IS TRUE AS WELL. DO WE HAVE THE SAME SEPTEMBER 10TH DEADLINE ON THIS OR. THIS ONE IS AN ORDINANCE, NOT A RESOLUTION. SO IT WILL REQUIRE FIRST AND SECOND READING. SO WE HAVE TO TAKE ACTION ON THIS TODAY AND ON THE 10TH. HOWEVER IF YOU NEEDED TO AMEND SOMETHING, YOU COULD DO IT UP UNTIL THE 10TH, AS LONG AS WE TAKE ACTION ON IT HERE TODAY. DID I SAY THAT CORRECTLY? OKAY. CORRECT, MAYOR. ANY FURTHER DISCUSSION ON NINE D. OKAY. I'M GOING TO ASK FOR A MOTION ON ITEM NINE D AND WE'LL COMPLETE THIS ONE. I MOVE TO ADOPT ORDINANCE NUMBER 8144. 49. 49? YES. 8149? 8149? WHICH ONE IS FOUR FOUR? I IF I CAN 8144 WAS YOUR ORIGINAL ORDINANCE. 8149 AMENDS 8144 JUST TO CHANGE THAT BALLOT LANGUAGE. OKAY. SO CORRECTION I MOVE TO ADOPT ORDINANCE NUMBER 8149. I HAVE A MOTION. DO I HAVE A SECOND? SECOND. I HAVE A MOTION, AND A SECOND. ALL IN FAVOR, PLEASE SAY AYE. AYE. ANY OPPOSED? ITEM NINE D PASSES. WE ARE READY TO ADJOURN THIS MEETING, AND THEN WE'RE GOING TO STEP BACK INTO EXEC. SO COUNCIL, YOU'RE ADJOURNED FOR TODAY. THANK YOU GUYS FOR ALL BEING HERE. WE'LL SEE YOU IN EXEC. * This transcript was compiled from uncorrected Closed Captioning.
