>> CITY OF AMARILLO, CITY COUNCIL PROCLAMATION.

WHEREAS LOCAL DEVELOPER AND BUSINESS M. T. JOHNSON JUNIOR OPENED SUNSET CENTER MARKET TOWN IN 1960.

WHEREAS THIS WAS THE FIRST MALL FOR AMARILLO AND WAS THE MOST POPULAR PLACE TO SHOP FOR MORE THAN TWO DECADES UNTIL WESTGATE MALL OPENED ITS DOORS IN 1982.

WHEREAS A DECADE LATER IN 1992, ANOTHER LOCAL DEVELOPER, C. W. CROUCH, DECIDED TO BUY THE PROPERTY OUT FOR FORECLOSURE IN HOPES OF EVENTUALLY REVITALIZING THE PROPERTY, AND WHEREAS IN 2001, WHEN MR. CROUCH PASSED AWAY HIS WIFE ANN TOOK OVER THE MANAGEMENT OF THE MALL, AND WHEREAS A SUCCESSFUL OPENING OF THE PANHANDLE ART CENTER AND RENTING OUT GALLERIES THROUGHOUT THE CENTER AND THEN OPENED THE AMARILLO ART INSTITUTE IN 2004.

WHEREAS TODAY ARTS IN SUNSET IS RUN BY THE CROUCH FOUNDATION, A 501 (C) 3 ORGANIZATION THAT WAS CREATED FOLLOWING THE DEATH OF ANN IN 2017 WITH THE SOLE PURPOSE OF REVIVING THE WELL-KNOWN ART CENTER.

AND WHEREAS THE INTERNATIONAL, ACCLAIMED MICHELANGELO'S SISTINE CHAPEL, THE EXHIBITION IS OPENED JUNE 9TH, 2023 AS AN INAUGURAL EXHIBIT FOR THE NEWLY RENOVATED SUNSET CENTER, NOW CALLED ARTS IN SUNSET.

WHEREAS PROCEEDS FROM THIS INAUGURATION EVENT BENEFIT LOCAL CHARITIES INCLUDING DOWNTOWN WOMEN'S CENTER,

CATHOLIC CHARITIES, AND THE TEXAS PANHANDLE, THE ART INSTITUTE, AND AMARILLO CULTURAL DISTRICT OF TEXAS ARTS COMMISSION.

NOW, THEREFORE, WE MAYOR, AND CITY COUNCIL OF THE CITY OF AMARILLO, DO HEREBY PROCLAIM THE 27TH DAY OF JUNE 2023 AS ARTS IN SUNSET DAY.

I KNOW I SPEAK ON BEHALF OF OUR CROUCH FOUNDATION.

I KNOW WE ARE REALLY EXCITED THAT OUR VERY FIRST EXHIBIT IS SUCH A HISTORIC AND ICONIC ONE AS MICHELANGELO'S SISTINE CHAPEL, AND MY STEERING COMMITTEE IS HERE FROM HELPING ME GET THAT EXHIBIT HERE.

WE HOPE THAT THIS IS SOMETHING THAT WILL CONTINUE TO BRING MORE VISITORS TO OUR AREA.

CAN I HAVE MS. FREDA POWELL COME UP? I GOT THE HONOR OF SERVING WITH COUNCILMEMBER SMITH FOR TWO YEARS.

I'D REALLY LOVE TO KEEP HIM, BUT WE CAN'T CREATE A COUNCIL PLACE 5 OR 6, OTHERWISE, I MIGHT.

HE'S BEEN PATIENT, KIND, INSTRUCTIVE, GOOD MENTOR ALONG THE WAY.

THAT MEANS MORE THAN YOU WOULD THINK WHEN YOU'RE SWIMMING OUT THERE, JUST TREADING WATER.

I WANT TO BEGIN TODAY BY THANKING MY WONDERFUL WIFE CAROL, [APPLAUSE] FOR HER UNBELIEVABLE SUPPORT OVER THE PAST SIX YEARS.

ONLY WAS SHE BEHIND ME 1000% WHEN I DECIDED TO RUN, BUT SHE HELPED ME IN ALL THREE CAMPAIGNS, 2017, 2019, 2021.

SHE ALSO ATTENDED AT LEAST 98% OF ALL THE OPEN MEETINGS IN SIX YEARS.

THANK YOU, CAROL. [APPLAUSE] I'M GOING TO ADD SOMETHING TO MY NOTES.

WE ARE IN OUR 57TH YEAR, APRIL 15TH.

[APPLAUSE] I ALSO WANT TO THANK ALL MY SUPPORTERS, INCLUDING MY FRIENDS, FAMILY, PEOPLE IN MY CHURCH, MEMBERS OF THE REALTOR ASSOCIATION, A LOT OF THEM ARE HERE TODAY, WHO HELPED ME ON EVERY STEP OF THE WAY.

I ALSO WANT TO THANK STAFF MEMBERS WHO HAVE BEEN VERY PATIENT ANSWERING ALL OF MY QUESTIONS WHEN I ASKED, WHICH WAS OFTEN.

WHEN I WAS ELECTED IN 2017, IT WAS THE FIRST TIME IN 50 YEARS THAT THE WHOLE CITY COUNCIL CHANGE ALL AT ONCE.

THE CITY MANAGER WAS ALSO NEW TO AMARILLO, DESPITE BEING GREEN, THE COUNCIL ACCOMPLISHED QUITE A LOT FOR OUR CITY DURING MY TENURE.

IT WASN'T JUST ME, IT WAS A TEAM.

I WANT TO THANK MY FELLOW COUNCILMEMBERS, FORMER MAYOR GINGER NELSON, FREDA POWELL, ELAINE HAYS, DR. EDDY SAUER, MAYOR COLE STANLEY, FOR THEIR DEDICATION AND PASSION TO SERVE.

DURING EACH OF MY THREE TERMS ON THE COUNCIL, I ENCOURAGED ECONOMIC DEVELOPMENT IN THE CITY.

I FEEL VERY PROUD THAT THAT HAS BEEN ACCOMPLISHED IN A NUMBER OF WAYS.

WE FINISHED THE DOWNTOWN HOTEL, THAT HAS BEEN VERY SUCCESSFUL.

WE COMPLETED A BASEBALL STADIUM AND ATTRACTED A DOUBLE A TEAM, THE FIRST YEAR THAT THE TEAM PLAYED THEY WON THE TEXAS LEAGUE.

THE TEAM IS THE SMALLEST TOWN IN OUR LEAGUE, BUT YET THEY HAVE MORE ATTENDANCE THAN ALL THE OTHER TEAMS IN THE LEAGUE.

WE ATTRACTED THE SECOND VETERINARIAN SCHOOL IN THE STATE, THAT WAS A BIG EVENT.

AND WE ATTRACTED OTHER BUSINESSES THAT I'M NOT GOING TO LIST, BUT THEY'VE BEEN ANNOUNCED IN THE MEDIA.

THERE'S QUITE A FEW OF THEM, I NEED 30 MINUTES IF I WENT THROUGH ALL THAT.

BUT THERE'S IN EXCESS OF 4,000 EMPLOYEES COME IN WITH THESE BUSINESSES.

SOME OF THEM ARE ALREADY HERE, AND OTHERS ARE COMING IN THE NEXT TWO OR THREE YEARS.

I LOVE AMARILLO, THAT'S WHY I RAN TO SERVE ON THE COUNCIL.

IT'S BEEN AN HONOR TO SERVE, I APPRECIATE THE SUPPORT I HAVE RECEIVED.

I COMPLIMENT THE NEW COUNCIL ON THEIR ELECTION AND THEIR WILLINGNESS TO SERVE.

I WANT TO CONCLUDE WITH A COUPLE OF NUMBERS I'M GOING TO GIVE YOU, TWO OR THREE NUMBERS.

POPULATION OF AMARILLO IS AROUND 200,000.

IN THE MAY ELECTION, 20,000 PEOPLE VOTED, THAT'S 10%.

THAT'S A SHAME, BUT THAT'S THE FACT.

THE RUNOFF ELECTION AROUND 11,000 PEOPLE VOTED.

WHILE ONLY 10% CAST A BALLOT, IT IS IMPORTANT TO REMEMBER THIS IS A MESSAGE TO THE NEW COUNCIL, THAT YOU REPRESENT ALL OF AMARILLO.

HE'S BORN AND RAISED IN BORGER, TEXAS, SO HE IS A PANHANDLE GUY.

EARNED A BACHELOR OF SCIENCE DEGREE IN CIVIL ENGINEERING FROM OKLAHOMA STATE IN 2008.

FOLLOWING GRADUATION, HE RECEIVED HIS COMMISSION AS A NAVAL OFFICER THROUGH THE NAVY'S OFFICER CANDIDATE SCHOOL IN NEWPORT, RHODE ISLAND.

FUN FACT, HOWARD SMITH ALSO DID HIS OFFICER CANDIDATE SCHOOL AT NEWPORT, RHODE ISLAND.

DURING HIS TIME IN THE NAVY, ALAN SERVED AS THE FACILITY SERVICE CONTRACT MANAGER AT THE NAVAL RESEARCH LABORATORY IN WASHINGTON, DC AS THE DELTA COMPANY COMMANDER OF NAVAL MOBILE CONSTRUCTION BATTALION 11 IN GULF PORT, MISSISSIPPI.

I'VE MOBILIZED THROUGH GULF PORT, MISSISSIPPI WITH A BUNCH OF CVS, AND I CAN TELL YOU THOSE GUYS ARE GREAT, THOSE PEOPLE ARE GREAT.

ALAN GOT A CHANCE TO SERVE IN A LEADERSHIP ROLE IN GULF PORT, MISSISSIPPI, WHICH IS A BIG DEAL.

HE WAS FINALLY THE OFFICER IN CHARGE OF CONSTRUCTION CIVIC ACTION DETAIL, MARSHALL ISLANDS ON THE KWAJALEIN ATOLL, RMI. WHAT IS THAT?

HE'S BEEN MARRIED TO HIS WIFE MEGAN SINCE 2012, AND TOGETHER THEY HAVE THREE SONS, JAMES, ALI, AND THEO.

IT WAS JUST UNBELIEVABLE ALL THE ACCOLADES THAT MR. BELTRAN GAVE HER.

I'M VERY INTERESTED IN WHAT THIS ORGANIZATION IS TRYING TO ACCOMPLISH.

AS MANY OF YOU ARE PROBABLY FAMILIAR, AMARILLO WAS FOUNDED BACK IN THE LATE 1800S AND IT WAS PRIMARILY BECAUSE OF THE RAILROADS.

RAILROADS, THERE WERE ACTUALLY THREE DEPOTS THAT WERE FORMED HERE IN AMARILLO.

THE SANTA FE DEPOT IS THE ONLY ONE STILL STANDING.

OUR ORGANIZATION HAS PRESENTED A PACKET TO THE COUNCIL THAT INCLUDES A LEASE THAT OUR FOUNDATION IS VERY INTERESTED IN LEASING THE DEPOT AND THE REA BUILDING.

PATRICK SPEARHEADED THE LEGAL EFFORT TO KEEP THE BARFIELD BUILDING FROM BEING DEMOLISHED YEARS AGO.

IN 2016, WE HELPED RENOVATE THE WOOLWORTH BUILDING WHERE WE OWNED ESQUIRE JAZZ CLUB THERE UNTIL WE SOLD IT DURING COVID.

MY CPA OFFICE ON THE 21ST FLOOR LOOKS OUT THE EAST TO THE DEPOT BUILDING AND THE REA BUILDING.

THE REA BUILDING IS WHERE THE CITY STAFF ORIGINALLY SAID THEY WANT TO INSTALL TOILETS FOR THE NEW MIDDLE PAVILION.

NOW, LET ME SHOW YOU THE NATIONAL HISTORIC REGISTER FROM 1986 WHEN THE DEPOT BUILDING AND THE REA BUILDING AND THE LAND AROUND IT WERE RECORDED AND THE PARTS THAT TALK ABOUT THE REA BUILDING BECAUSE I DON'T THINK YOU ALREADY THAT FAMILIAR WITH IT, IS THEY'RE HIGHLIGHTED IN YELLOW.

THEN THERE'S ANOTHER PLACE THAT SHOWS YOU THE LAND PLOT, AND THE REA BUILDING IS THIS ONE DOWN HERE.

THE DEPOT BUILDING IS THE BIGGER ONE UP HERE, AND THIS LINE SHOWS ALL THE LAND THAT WAS CLASSIFIED AS HISTORICAL.

BUT THE CITY OF AMARILLO HAS NEVER FORMALLY ACKNOWLEDGED THE HISTORIC ASPECT OF THE DEPOT AREA, FEARING IT WOULD KEEP THEM FROM TEARING DOWN OR RENOVATING HOWEVER THEY WANTED.

IN FACT, THEY INSTALLED THAT MIDDLE PAVILION ON LAND THAT IS HISTORIC.

THE DEPOT BUILDING AND THE REA BUILDING ARE TWO OF THE LAST REMAINING TREASURES OF DOWNTOWN.

THEY NEED TO BE TREATED WITH RESPECT AND PRESERVATION.

I HOPE THE NEW COUNCIL WILL TAKE THE TIME TO HEAR ABOUT ALL POSSIBLE PLANS FOR THE AMARILLO DEPOT DISTRICT, WHICH WOULD BE A TOURIST AREA SIMILAR TO THE SILOED DISTRICT IN DOWNTOWN WACO.

I WOULD LIKE TO HAVE THIS FOR THE FUTURE OF AMARILLO, BUT IT KEYS ON THE REST OF THE AREA AROUND THE DEPOT STAYING INTACT.

YOU PROBABLY HAVE ALREADY DONE THIS, PLEASE DISCONTINUE ANY ACTION TO USE THE REA BUILDING, A 100 YEAR OLD HISTORIC BUILDING FOR TOILETS, AS A QUICK FIX FOR NOT HAVING INCLUDED BATHROOM FACILITIES IN THE MIDDLE PAVILION.

THEN ANOTHER IMPORTANT PIECE THAT CHANGED DURING THE LAST YEAR IS WHEN WE SWITCHED OPERATORS WITH THE EMBASSY SUITES HOTEL.

PART OF THE REASON WE HAD TO HAVE PAID PARKING SPECIFICALLY AROUND AT LEAST THE CATALYST PROJECTS.

WAS THAT WE HAVE A LEASE AGREEMENT WITH THEM FOR THE VALET PARKING WITHIN THE GARAGE, THAT THEY PAY A LITTLE OVER 120,000 A YEAR FOR THOSE SPACES, IN ORDER TO INCREASE THEIR RENT VIA CPI, WE HAD TO HAVE PAID PARKING.

SO MOST RECENTLY AS PART OF THAT CHANGE WE NEGOTIATED TO GET THAT LANGUAGE REVISED.

SO NOW IT ONLY REQUIRES MANAGING ON-STREET PARKING WITH EITHER PAID PARKING METERS OR FREE SHORT-TERM TIME LIMIT PARKING ON STREET PARKING WITHIN THAT AREA.

SO THIS WOULD GIVE COUNCIL THE OPPORTUNITY TO GO BACK AND MAKE CHANGES OR GO A DIFFERENT DIRECTION THAT WOULDN'T IMPACT AT LEAST THAT FINANCIAL COMPONENT OF THE PARKING GARAGE.

THEN JUST WANTED TO TOUCH ON SOME OF THE CONCERNS THAT YOU HEARD DURING PUBLIC COMMENT.

WE DO CONTINUE TO SEE CONCERNS ABOUT THE PHONE APP-BASED SYSTEM AS BEING THE ONLY WAY TO PAY.

THAT WAS A STRATEGIC DECISION BY COUNCIL AT THE TIME AS FAR AS THE LOWEST COST TO START A PROGRAM VERSUS VERY EXPENSIVE KIOSK OR METERS IN EACH PHYSICAL SPOT, KNOWING THAT THIS WAS A FIRST TIME FOR DOWNTOWN TO GO BACK TO PAID PARKING IT WOULD ALLOW MORE FLEXIBILITY.

NOW WE REALLY JUST HAVE THE SIGNAGE COSTS AND THOSE POLES WOULD STILL BE USED IF WE SWITCH BACK TO TIME PERIOD, WE JUST CHANGE THE SIGN FROM PAID PARKING APP TO ONE-HOUR, TWO-HOUR PARKING.

SO GIVES COUNCIL A LITTLE BIT MORE FLEXIBILITY IF YOU WANT TO SWAP THOSE OUT.

THEN AS WAS HEARD IN THE PUBLIC COMMENT, THERE ARE CONCERNS ABOUT COUNTY BUSINESS, JURY DUTY, PARKING.

WE DID RUN SOME NUMBERS, JUST SO COUNCIL IS AWARE, THERE'S APPROXIMATELY 76 ON STREETS SPACES THAT BORDER THE COURTHOUSE AREAS THAT WOULD HAVE TO SERVE A POTENTIAL ON ANY GIVEN DAY, 150 - 108 JURORS.

THE WAY WE'VE DONE IT AS STAFF THROUGH MUNICIPAL COURT, WE REALLY ENCOURAGE PEOPLE TO SEEK OFF STREET PARKING, WHETHER IT'S A CITY LOTS THAT ARE ADJACENT ONE-BLOCK OVER.

COUNTIES GOT THEIR SURFACE A LOT.

SOME OF THOSE OTHER ONES THAT ARE MEANT MORE FOR LONG-TERM PARKING AS A POSSIBILITY.

OF COURSE, WE IN AMARILLO, WE DO LIKE PARK RIGHT IN FRONT OF THE BUSINESS THAT WE'RE GOING INTO, SO THAT IS A CONCERN WE HEAR ABOUT.

I WOULD SAY IF YOU DID MOVE BACK TO TIME PARKING, I THINK YOU'D STILL HAVE THE CHALLENGE OF PEOPLE.

SO EACH COUNTY DISTRICT COURT IS A LITTLE BIT DIFFERENT JUST BASED ON THEIR PARKING DEMANDS IN THEIR DOWNTOWN ENVIRONMENT.

SO THAT IS REALLY ALL I HAD PREPARED TO PRESENT THE TOPIC.

I SEE THAT AS A PROBLEM BECAUSE EVERY CITIZEN, EVERY BUSINESS, SHOULD BE TREATED THE SAME WITHIN THE CITY OF AMARILLO.

I THINK WHEN WE PICK AND CHOOSE WELL, DOWN ON POLK STREET, WE GET TWO HOURS OF FREE PARKING IN FRONT OF THE RESTAURANTS.

BUT I GO A BLOCK OVER, I GOT TO PAY TO GO TO COURT. THAT'S NOT RIGHT.

WE'RE IGNORING THE FREE AMARILLO WE SHOULD HAVE.

THE LEASE AGREEMENT INSURES TO MY UNDERSTANDING THE CONCERN IS THAT, WE ARE INVOLVING OR A RELIGIOUS ORGANIZATION WOULD BE INVOLVED IN TRANSFORMATION PARK OPERATIONS.

THE LEASE AGREEMENT ENSURES SOME THINGS.

IT ENSURES THAT THE CITY OF AMARILLO, WILL UPKEEP THE PREMISES AND PROVIDE THE PREMISES.

THE ARPA FUNDING, THE AMERICAN RESCUE PLAN FUNDING IS GOING TO BE USED FOR THE FACILITIES ONLY, TO CONSTRUCT THE FACILITIES.

THAT'S SEPARATE FROM THE OPERATIONS.

THIS LEASE AGREEMENT PROVIDES AN AGREEMENT, BETWEEN THE CITY OF AMARILLO AND TRANSFORMATION PARK AND THE LEASE AGREEMENT ALLOWS THEM TO USE THE PROPERTY FOR THE PURPOSES OUTLINED IN A MEMORANDUM OF UNDERSTANDING, WITH TRANSFORMATION PARK OF SERVING THE HOMELESS COMMUNITY.

IT WILL PROVIDE A LOW BARRIER SHELTER, AND WITHIN THE LEASE AND THE MOU WITH TRANSFORMATION PARK, WE HAVE BEEN SURE TO INCLUDE NON-DISCRIMINATION CLAUSES, AND TO ENSURE THAT IT'S LOW BARRIER, ACCESSIBLE TO ANYBODY IN THE COMMUNITY EXPERIENCING HOMELESSNESS.

THE LANGUAGE INSURES SEVERAL THINGS BUT IT DOES ENSURE THAT, AND THIS IS IN ACCORDANCE WITH 24 CFR PART 1.

IT ENSURES THAT NO PERSON ON THE GROUNDS OF RACE, CREED, COLOR, NATIONAL ORIGIN, CONDITION OF DISABILITY, OR SEX, BE EXCLUDED FROM PARTICIPATING IN ANY EMPLOYMENT ACTIVITIES, AND THEY SHOULDN'T BE EXCLUDED FROM PARTICIPATING IN RECEIVING SERVICES, OR BENEFITS FROM ANY PROGRAM OR ACTIVITY COVERED BY THE SUBPART, OR OFFERED BY TRANSFORMATION PARKS.

THOSE ARE OUTLINED IN BOTH THE LEASE AGREEMENT, AND THE MOU WITH TRANSFORMATION PARK.

CITY COUNCIL ESTABLISHED THE RECOGNIZED NEIGHBORHOOD ASSOCIATION PROGRAM IN AUGUST OF 2022 TO FORMALLY RECOGNIZE THE PARTNERSHIP BETWEEN THE CITY AND THE NEIGHBORHOOD ASSOCIATIONS FOR COORDINATION ON NEIGHBORHOOD PLAN PROJECTS.

THE PLANS RELY HEAVILY ON VOLUNTEER EFFORTS AND THIS IS A WAY FOR US TO ENSURE A MUTUAL COMMITMENT ON BEHALF OF BOTH THE CITY AND OUR NEIGHBORHOOD PARTNERS TO ACHIEVING THE PLANNED GOALS.

WE CURRENTLY HAVE FOUR ADOPTED PLANS AND IF A NEIGHBORHOOD GROUP WANTS TO REPRESENT THEIR PURPOSE AS IMPLEMENTATION OF THOSE THEN THEY'RE REQUIRED TO BECOME RECOGNIZED WITH THIS ORDINANCE.

THERE'S A SET OF ELIGIBILITY CRITERIA THAT REQUIRES THEM TO RUN TRANSPARENT, ORGANIZED ASSOCIATIONS THAT ARE OPEN TO ALL RESIDENTS, BUSINESS OWNERS, AND PROPERTY OWNERS, AND THEIR BOUNDARIES.

IN TOTAL, THERE ARE 11 ORGANIZATIONAL REQUIREMENTS THAT THEY HAVE TO MEET TO APPLY.

THEY APPLY THROUGH THE PLANNING DEPARTMENT, WE REVIEW IT AND MAKE SURE THAT THEY DO MEET THOSE REQUIREMENTS, AND THEN WE PRESENT THAT TO THE NEIGHBORHOOD OVERSIGHT COMMITTEE FOR RECOMMENDATION TO CITY COUNCIL.

AND SO THE OVERSIGHT COMMITTEE REVIEWED THIS AT THEIR JUNE 8TH MEETING AND RECOMMENDED THAT THIS RESOLUTION MOVE ON TO CITY COUNCIL.

THIS HAS A LITTLE BIT OF BACKGROUND, THE NORTH HEIGHTS PLAN WAS THE FIRST ONE ADOPTED IN 2017 AND WE'VE BEEN WORKING WITH THE NORTH HEIGHTS ADVISORY ASSOCIATION SINCE THAT TIME.

THE PARTNERSHIPS DEVELOPED THROUGH THE PLAN HAVE RESULTED IN MAJOR REDEVELOPMENT PROJECTS LIKE THE NORTH HEIGHTS LINEN SERVICE, THE COMMONS AT ST. ANTHONY'S, AND RECONSTRUCTION OF THE YMCA INTO THE WARFORD COMMUNITY CENTER.

RECENTLY, THE NORTH HEIGHTS ADVISORY ASSOCIATION HAS CREATED AN EMERGENCY REPAIR GRANT FOR RESIDENTS, INSTALLED SIGN TOPPERS, AND CONTINUED TO ENGAGE THE COMMUNITY THROUGH A COMMUNITY CHARRETTE THAT WAS DONE IN PARTNERSHIP WITH PARK HILL ON FEBRUARY.

WE'RE ALSO GETTING READY TO INSTALL CREATIVE CROSSWALKS NEAR SCHOOLS, INSTALL NEW RESIDENTIAL SIDEWALKS WITH CDBG FUNDING, AND BUS SHELTERS.

WE'VE ALSO WORKED ON SIGNIFICANT INFRASTRUCTURE GRANTS FOR STREET RECONSTRUCTION AND STREET SCAPING AND ARE LITERALLY AWAITING WORD ON THAT GRANT RIGHT NOW.

I THINK MELODIE GRAVES IS HERE, THE PRESIDENT, AND THERE ARE OTHER MEMBERS I SEE.

THE CHANGE FROM AGRICULTURAL DISTRICT TO GENERAL RETAIL DISTRICT IN THE VICINITY OF SONCY ROAD AND HILLSIDE ROAD.

AND THE APPLICANT IS FIRM AND LAND SURVEYORS INK FOR ADDED BARRY ELEVATORS, LLC, HAPPY HORIZONS PROPERTIES, LP, AND ROCKROSE DEVELOPMENT, LLC.

AND THE APPLICANT IS REQUESTING THE CHANGE IN ZONING TO DEVELOP THE TRACTOR FOR VARIETY OF OFFICE AND RETAIL LAND USES.

THEY DIDN'T NOTE THAT A SMALL PORTION AT THE SOUTHEAST CORNER IS WITHIN THE SUBURBAN RESIDENTIAL CATEGORY, WHICH THEY DO NOTE.

THE REQUEST DOES NOT TECHNICALLY CONFORM WITH.

REGARDING THE NEIGHBORHOOD UNIT CONCEPT, THE PLANNING AND ZONING COMMISSION FOUND THAT AS A WHOLE, THIS WOULD ALLOW GR ZONING AND USES BEYOND THE TYPICAL LOCATION AT THE SECTION LINE INTERSECTION.

AND THIS TECHNICALLY, WE'RE NOT STRICTLY CONFORM WITH THE NEIGHBORHOOD UNIT CONCEPT WITH THAT NORTHWARD EXTENT.

THE PLANNING AND ZONING COMMISSION NOTED THAT WHEN LOOKING AT THE SONCY ROAD CORRIDOR, THEY HAVE ACKNOWLEDGED THAT THIS HAS TRANSFORMED INTO A RETAIL CORRIDOR OVER THE LAST FEW DECADES AND THERE ARE INSTANCES WHERE SINGLE-FAMILY IS BACKED UPON BY RETAIL ZONING ALONG THAT CORRIDOR.

AND ON THE SCREEN NOW ON THE LEFT IS THE FUTURE LAND USE MAP.

AND ON THE RIGHT ARE ZONING PATTERNS WITHIN THE AREA, KIND OF ILLUSTRATING THIS POINT.

SIMILAR ZONING PATTERNS CAN BE SEEN IN OTHER AREAS AROUND AMARILLO, INCLUDING AREAS ADJACENT TO THE GREENWAY CITY PARK AND WESTOVER PARK AS A FEW EXAMPLES, TYPICALLY A MORE DESIRED PATTERN OF DEVELOPMENT WOULD BE TO INCORPORATE A TRANSITION AND ZONING BETWEEN THE SINGLE-FAMILY AND RETAIL.

HOWEVER, GIVEN THE ZONING AND DEVELOPMENT PATTERNS IN THE AREA AND GIVEN THAT SONCY IS A HEAVILY TRAVELED TEXTS THAT RIGHT AWAY.

THE PLANNING AND ZONING COMMISSION WAS OF THE OPINION THAT THE TRACT IS MORE SUITED FOR NON-RESIDENTIAL DEVELOPMENT OF THE DEVELOPER HAS INDICATED TO THE CITY THAT AS PROPERTIES ARE DEVELOPED AND SOLD, DEED RESTRICTIONS ARE BEING PUT IN PLACE, INCLUDING SOME USE RESTRICTIONS.

AND SOME OF THOSE RESTRICTIONS I WOULD LIKE TO NOTE FOR YOUR REFERENCE, THEY ARE GOING TO LIMIT OR NOT ALLOW FAST FOOD OR QUICK-SERVE RESTAURANTS.

DISCOUNT RETAIL STORES SUCH AS FAMILY DOLLAR, OR THE TAYLOR'S AUTO REPAIR, SUCH AS QUICK LUBE, THINGS OF THAT NATURE, PAWNSHOPS AND TATTOO PARLORS WOULD NOT BE ALLOWED WITHIN THESE PROPERTIES FOR THE DEED RESTRICTIONS AS AN EFFORT TO MINIMIZE IMPACTS TO THE NEIGHBORHOOD TO THE EAST.

ADDITIONALLY, REGARDING SOME OF THE TRACKS; THE TRACKS IMMEDIATELY ADJACENT TO THE COLONIES SO FAR THAT HAVE BEEN SOLD.

I'VE ACTUALLY BEEN SOLD THE OFFICE AND USERS, WHICH WOULD BE OF THAT LOWER IMPACT LAND USE YOU WOULD LIKE TO SEE NEXT TO A SINGLE-FAMILY NEIGHBORHOOD.

ADDITIONALLY, BECAUSE THIS IS A LONG SONCY ROAD, THERE IS GOING TO BE A PRETTY SUBSTANTIAL DETENTION REQUIREMENT OF STORM WATER.

SO THEY ARE GOING TO INCORPORATE DRAINAGE PONDS ALONG IN THE AREAS IN GREEN ALONG WITH SOME GREEN SPACE, THEY ARE IMMEDIATELY ADJACENT TO THE NEIGHBORHOOD.

TO ADD AN ADDITIONAL BUFFER THERE.

I WILL MENTION THAT SINCE THIS IS JUST A GENERAL REZONING THE GR, THIS IS SOMETHING THE CITY CAN'T HOLD THAT DEVELOPER TOO, BUT WE WOULD LIKE TO MENTION THAT HE WANTED THAT PASSED ALONG AS SOME EFFORTS THEY ARE MAKING TO MITIGATE IMPACTS ON THE SINGLE-FAMILY TO THE EAST.

REGARDING PUBLIC NOTICES WE DID FOR C1 CALL AN OPPOSITION AFTER THE PLANNING AND ZONING COMMISSION PUBLIC HEARING AND THE COLOR EXPRESS, THAT THEY WERE CONCERNED ABOUT THE FULL RANGE OF GENERAL RETAIL USES THAT COULD POTENTIALLY BE ALLOWED NEXT TO THE COLONIES.

AND WE DID INFORM THEM OF THE DEVELOPERS AND TINT WITH SOME OF THE DEED RESTRICTIONS, AND THEY STILL MAINTAINED A CONCERN THOUGH AFTER THAT PHONE CALL.

WITH THAT BEING SAID, I'M IN CONSIDERING ALL JUST MENTIONED, THE PLANNING AND ZONING COMMISSION DID RECOMMEND APPROVAL WITH A UNANIMOUS 5-0 VOTE FOR THIS ITEM.

HOWEVER, GIVEN THE PLANS OF THE DEVELOPER AND THE TYPICAL DEVELOPMENT STANDARDS THAT THEY WILL HAVE TO FOLLOW, SUCH AS INCREASED SETBACKS, LANDSCAPING, SCREENING FENCES, THE PLANNING AND ZONING COMMISSION FILLED AT THE PROPER PROTECTIONS WERE THERE FOR THE NEIGHBORHOOD TO THE EAST.

THEY ARE NOT SURE OF THE DEVELOPMENT PLANS AT THIS TIME WHETHER OR NOT THERE'LL BE UTILIZING THE CURRENT BUILDING OR TEARING IT DOWN, BUT THEY WANTED TO ZONING AND IN A MANNER THAT MADE IT OPEN TO A WIDER RANGE OF POTENTIAL USES.

THE PLANNING AND ZONING COMMISSION FOUND THAT THE REQUEST DOES CONFORM WITH THE LAND USES IN THE AREA AND ALONG SONCY.

THE APPLICANT IS GOING TO BE KEEPING THE SAME SIGN STANDARDS THAT ARE IN THE CURRENT PLAN DEVELOPMENT, WHICH IS A MAXIMUM OF 60 SQUARE FEET FOR A FREESTANDING SIGN AT A MAXIMUM OF 15 FEET TALL AND 162 SQUARE FEET OF WALL SIGNAGE WILL BE ALLOWED.

ADDITIONALLY, THE APPLICANT IS GOING TO OBSERVE THE SAME FRONT YARD SETBACK FROM SONCY ROAD AS THE CURRENT BUILDING OBSERVES IN ALL AT OTHER DEVELOPMENT STANDARDS WILL FOLLOW GENERAL RETAIL DEVELOPMENT STANDARDS IN TERMS OF SETBACKS AND OTHER REQUIREMENTS.

REGARDING PUBLIC COMMENT ON THIS ONE, WE DID RECEIVE TWO COMMENTS AND OPPOSITION AT THE PLANNING AND ZONING COMMISSION MEETING ON THE ITEM IS FROM THE NEIGHBOR TO THE NORTH AND TO THE SOUTH AND THEY WERE CONCERNED THAT IF THE APPLICANT WAS ALLOWED TO BUILD CLOSER TO THE SONCY THAN THEY WERE, THIS WOULD CAUSE VISIBILITY ISSUES WITH THEIR BUSINESSES.

AT THE MEETING AND DISCUSSION BETWEEN THE COMMISSION AND THE APPLICANT, THEY DID AGREE TO OBSERVE THE SAME SETBACK AS THE BUILDING DOES CURRENTLY AND THAT RESULTED IN THE TWO COMMENTERS AT THE MEETING DROPPING THEIR OPPOSITION AT THAT POINT.

WITH THIS BEING SAID, THE PLANNING AND ZONING COMMISSION DOES RECOMMEND APPROVAL OF THE 5-0 VOTE.
