[1. Call to Order] [00:00:07] TODAY WE WILL BE HAVING A SPECIAL MEETING TO ADDRESS TWO MAJOR CONCERNS THAT EVERYBODY KNOWS ABOUT WITH ALL OF THE UNPRECEDENTED RAINFALL AND THE AND THE FLOODING THAT WE'RE SEEING. SO WE WILL HAVE OUR INVOCATION HERE TODAY. AND SO WE DON'T HAVE ANYBODY SIGNED UP TO PRAY. BUT COUNCILMAN SCHERLEN HAS OFFERED TO DO THIS. AND SO I'M GOING TO HAND THIS OVER TO HIM AND ASK HIM TO PRAY FOR US, AND THEN WE'LL DO THE PLEDGE. LET'S PRAY. BROUGHT US TOGETHER. FATHER, WE PRAY NOW THAT AS WE COME TOGETHER, THAT YOU WILL GIVE US THE WISDOM WE NEED TO CARRY ON THE BUSINESS OF THIS CITY. FATHER, WE PRAY FOR ALL OF THOSE CITIZENS WHO ARE NOW DISPLACED AND NEEDING HELP. FATHER, WE PRAY THAT AS WE GO INTO THIS, THAT YOU WILL LEAD US. GUIDE US, AND DIRECT US. WE PRAY, ESPECIALLY FATHER, THAT WE LISTEN TO YOUR WILL AND THAT WE FOLLOW YOUR WILL. FATHER, WE PRAY THESE THINGS IN THE NAME OF YOUR SON, JESUS CHRIST, THE KING OF KINGS AND THE LORD OF LORDS. AMEN. AMEN. THANK YOU. IF YOU'LL JOIN ME IN THE PLEDGE. I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS, ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL. OKAY. AT THIS TIME. [4. Public Comment ] WE DO HAVE A FEW SPEAKERS SIGNED UP FOR PUBLIC COMMENT. MISS CITY SECRETARY, IF I CAN HAND THE MEETING TO YOU, PLEASE. THANK YOU, MAYOR. THANK YOU FOR PARTICIPATING IN TODAY'S CITY COUNCIL MEETING. WE ARE THANKFUL THAT YOU'RE HERE FOR THE MEETING. YOUR INPUT AND YOUR OPINIONS, EXCUSE ME, ARE IMPORTANT TO US, SO WE'RE GLAD THAT YOU'RE HERE TO SHARE THEM. WE HAVE FOUR CITIZENS SIGNED UP TO SPEAK TODAY. WE INVITE YOU TO SPEAK FOR THREE MINUTES ON AGENDA ITEMS OR ON ANY ITEM RELATED TO CITY BUSINESS. KEEP IN MIND, IF SOMETHING IS NOT ON THE AGENDA, COUNCIL IS LIMITED IN HOW THEY CAN INTERACT WITH YOU ON THAT ITEM AND SO THEY CAN RECITE SOME STATEMENTS OF FACT. THEY CAN REFER YOUR ITEM TO A FUTURE AGENDA, OR THEY MAY REFER YOU TO STAFF TO HAVE STAFF HELP ADDRESS YOUR CONCERNS. AS YOU COME UP TO THE PODIUM TODAY, WE WOULD ASK THAT YOU STATE YOUR NAME WHETHER OR NOT YOU LIVE IN THE AMARILLO CITY LIMITS. AND THEN IF YOU'RE SPEAKING ON AN ITEM, LET US KNOW IF YOU'RE SPEAKING ON FOR OR AGAINST IT SO THAT WE CAN REFLECT THIS PROPERLY IN OUR MINUTES, YOU'LL HAVE THREE MINUTES. YOU'LL HEAR A BEEP AT TWO AND A HALF JUST ALERTING YOU YOU HAVE 30 SECONDS TO WRAP UP YOUR THOUGHTS AND WE DO ASK YOU TO STAY WITHIN THAT TIME TO BE RESPECTFUL FOR ALL OF OUR SPEAKERS TODAY. SO FIRST ON OUR LIST TODAY, PARDON ME. LET ME CLICK BACK TO MY MINUTES HERE. OUR FIRST SPEAKER IS CHRISTINE ANDREWS. SO WE INVITE MS. ANDREWS UP AND ON DECK WILL BE CALVIN HORNSBY. HELLO, I'M CHRISTINE ANDREWS. I DO NOT LIVE IN THE CITY LIMITS. I LIVE SOUTH OF TOWN. HELLO, MR. MAYOR, COUNCILMAN, CITY MANAGER AND STAFF. THANK YOU FOR THE OPPORTUNITY TO SPEAK. LIKE I SAID, I'M CHRISTINE ANDREWS, AND THIS IS MY HUSBAND, J.B. ANDREWS. I USED TO WORK IN CITY GOVERNMENT IN NEW MEXICO, AND J.B. BRAVELY SERVED THE CITY OF AMARILLO IN THE FIRE DEPARTMENT FOR 20 YEARS. SO WE ARE BOTH QUITE FAMILIAR WITH MUNICIPAL RESPONSE TO EMERGENCIES, AND WE ACKNOWLEDGE THE STRESS YOU ARE ALL UNDER RIGHT NOW. WE ARE THE CO OWNERS OF SOUTH GEORGIA LAUNDRY, WHICH IS LOCATED AT 2510 SOUTH WEST 45TH AVENUE IN BETWEEN GEORGIA AND LAMAR STREETS NEAR THE BENNETT PLAYA LAKE. SEVEN MONTHS AGO, AFTER CRAFTING A WELL THOUGHT OUT BUSINESS PLAN UNDER THE GUIDANCE OF THE SMALL BUSINESS DEVELOPMENT CENTER, WE INVESTED A LARGE AMOUNT OF PERSONAL CAPITAL TO SECURE A SMALL BUSINESS ADMINISTRATION LOAN AND REALIZE OUR DREAM OF BECOMING SMALL BUSINESS OWNERS INTO OUR RETIREMENT. SOUTH GEORGIA LAUNDRY HAS BEEN IN BUSINESS AT THE SAME LOCATION FOR 50 YEARS A LOWER INCOME NEIGHBORHOOD WITH LOTS OF RENTAL PROPERTIES FULL OF HONEST, HARD WORKING FOLKS. BUSINESS HAS BEEN ROCKING ALONG WITH A FEW BUMPS AND SOME DAYS MORE STRESSFUL THAN OTHERS FOR SEVEN MONTHS. THEN JUNE 2ND CAME ALONG AND A NIGHTMARE WE NEVER IMAGINED WAS REALIZED WITH FLOOD WATERS REACHING THE DOOR OF OUR LAUNDROMAT. WE HAVEN'T BEEN OPEN TO CONDUCT ANY BUSINESS SINCE JUNE 2ND, EXCEPT FOR A BRIEF REPRIEVE YESTERDAY WHERE WE WERE ABLE TO GET INTO OUR BUILDING FOR A COUPLE OF HOURS. OUR FOUR EMPLOYEES HAVE EARNED NO INCOME. WE HAVEN'T COLLECTED A SINGLE TAX DOLLAR TO HELP MAINTAIN CITY INFRASTRUCTURE AND SERVICES. [00:05:01] OUR CUSTOMERS, MANY OF WHO WALK TO OUR FACILITY, HAVE HAD TO GO WITHOUT THE CONVENIENCE OF A LAUNDROMAT IN THEIR NEIGHBORHOOD. MEANWHILE, FLOOD WATERS CONTINUE TO GET INTO OUR BUILDING. TODAY'S THE WORST IT'S BEEN SINCE THIS BEGAN, WITH WATER SURROUNDING ALL FOUR SIDES. OUR PROPERTY, OUR EQUIPMENT AND OUR ELECTRICAL SYSTEMS ARE ALL BEING DAMAGED. THE CITY HAS HAD YEARS SINCE THE LAST HEAVY RAINFALL EVENT TO EVALUATE THESE PROBLEMS, DEVISE SOME PLANS, FUND THOSE PLANS AND UPDATE INFRASTRUCTURE. YET HERE WE ARE WITH MANY BUSINESSES AND HOMES SUSTAINING DAMAGE, UNABLE TO PROVIDE SERVICES OR TO LIVE IN THEIR OWN SPACE, UNABLE TO COLLECT TAX DOLLARS TO HELP FUND YOUR BUDGET. AND WATCHING OUR AMERICAN DREAMS FLOAT DOWN PARAMOUNT OLSON OR LIKE US, 45TH AVENUE. IN 2020, THIS COUNCIL PASSED ORDINANCE NUMBER 7906, WHICH IDENTIFIED THE BENNETT PLAYA LAKE WAS ILL EQUIPPED TO PROTECT THE SURROUNDING NEIGHBORHOOD FROM FLOODING. YOU ALLOCATED $800,000 TO ADDRESS THE PROBLEM, AND YET HERE WE ARE. NOTHING HAS BEEN DONE. THE STREETS ARE FLOODED AND CLOSED. AND THE PUMP AT BENNETT LAKE, ACCORDING TO YOUR RECENT PRESS CONFERENCE, IS THE ONLY ONE NOT RUNNING. CLEARLY, YOU'VE NEGLECTED THIS SITUATION AND YOU OWE YOUR CITIZENS AN EXPLANATION, SOME ASSISTANCE OF SUBSTANCE AND AN ANNOUNCEMENT OF HOW YOU'RE GOING TO ADDRESS THIS SITUATION. BUT MOST OF ALL, YOU OWE YOUR CITIZENS ACTION ON THIS ISSUE. THANK YOU. THANK YOU, MA'AM. APPRECIATE YOU COMING IN. THANK YOU, MISS ANDREWS. NEXT, MR. HORNSBY AND ON DECK AFTER MR. HORNSBY WILL BE LAVONDA MOSLEY. THANK YOU, MR. MAYOR. MY NAME IS CALVIN HARVEY FROM DUMAS. BASICALLY, I COME TO AMARILLO IN 1971. AND AS FAR AS I'M CONCERNED, THE CITY OF AMARILLO BEEN REAL GOOD TO ME. AND BACK IN THE 80S, I GOT A CALL FROM THE DIRECTOR OF UTILITIES, A FELLOW NAMED RON FREEMAN. AND SAID THIS PLAYA LAKE OR DONOVAN LAKE IS FLOODING AND ASKED ME IF I COULD HELP HIM OUT. HE ASKED ME IF I COULD FIND ANY 24 INCH ALUMINUM FLOW LINE. I KIND OF LAUGHED AT HIM. I SAID, THEY DON'T MAKE THAT UP HERE IN THIS COUNTRY, [INAUDIBLE] FLOW LINE YOU'RE GOING TO FIND IS A TEN INCH FLOW LINE. AND IT'S ANTIQUATED. AND I SAID TO BOB BRADY HE'S AN ATHLETIC DIRECTOR AT BOYS RANCH. I THINK HE'S GOT A STRING OF IT. AND GREEN MACHINERY. THEY GOT A STRING OF THAT OLD TEN INCH NOT REALLY BEING USED, TOO HEAVY AND SO FORTH. AND HE SAID, WELL, CAN YOU COME HELP ME? SO MEETING ME AT PECOS AND I-40. YEAH. SO WE GO OVER AT PECOS AND I-40. WHAT'S YOUR GAME PLAN? AND HE SAID WE'RE GOING TO PUT A 500 HORSEPOWER MOTOR ON I-40 UP THERE ON THAT RIDGE. AND TRY TO PUMP THAT WATER TO [INAUDIBLE] STREET AND OVER THE OLD ROCK ISLAND RAILROAD TO THE YELLOW CREEK. HE SAID THAT'S WHERE AMARILLO GOT ITS' NAME, BY THE WAY. AND HE SAID THAT YELLOW CREEK ENDS UP GOING THROUGH THOMPSON PARK AND IT ENDS UP IN LAKE MEREDITH. [INAUDIBLE] I'LL CALL BOB. YOU CALL THE MEN NAMED DOWN TO YOU. HE GOT A LOAD OF TEN INCH COMING HIS WAY. AND WE GOT UP THERE AND I HAD A COUPLE OF GOOSENECKS. HARD FIVE GUYS AND GETTING IT OVER THERE AND WE'RE STRINGING THAT PIPE UP PECOS AND THERE'S A GUY STANDING ON THE GAS TANK OF THE TRACTOR AND THEY HAD A 40 FOOT TRAILER. AND HE SAID, I SAID, WHO'S IN CHARGE OVER THERE? AND HE SAID, I AM. AND I SAID, WELL, YOU'RE GOING TO HAVE TO TURN ALL THOSE JOINTS AROUND. YOU CAN'T FLOW THAT WATER. YOU KNOW, AGAINST THE JOINT. ASKED ME WHO I WAS. I TOLD HIM, HE SAID, TAKE CHARGE OF THIS. I AIN'T NO FARMER. AND I SAID, I'M NOT EITHER. SO WE RUN THAT STRING UP TO PLAINS BOULEVARD AND OVER. RIP VAN WINKLE WAS THE MANAGER OF JOHNSON PUMP. THAT'S WASHINGTON AND FARMERS AVENUE. MY WAREHOUSE IS OUT THERE ON FARMERS [INAUDIBLE]. WE'RE GETTING THAT PIPE ALTOGETHER IN THIS RON FREEMAN HOUSE AND WAS WADING WATER UP TO OUR PANT POCKETS. [00:10:09] AND WE GET IT UP THERE. THE MAN WALKED THROUGH ARBY'S FROM THE SOUTH SIDE, HOLLERED OUT THERE, MR. FREEMAN, WHO HAVE YOU GOT HAPPENING? HE SAID, HIS NAME IS HORNSBY. HE SAID, COULD I TALK TO YOU? AND I [INAUDIBLE] OUT OF THAT WATER WALKED UP THERE AND HE SAID, MY NAME IS JOHN STIFF. I'M THE MAYOR. IS THERE ANYTHING YOU NEED? AND I SAID, WELL, AS A MATTER OF FACT, WE NEED A COUPLE OF PIECES OF NINE AND 5/8 [INAUDIBLE] PIPE SO WE COULD TIE THIS STRING TO. AND HE SAID, COME, GO WITH ME. HE GOT A PHONE AND PIONEER NATURAL GRASS, THIRD AND GRAND, I BELIEVE IT WAS. WE DRIVE OVER THERE AND I HAD A MEASURING TAPE AT THAT PIPEYARD AND I WAS OUT THERE ABOUT 50 YARDS. I FOUND OUT, MR. STEELE, I THINK I'VE FOUND WHAT WE NEED. LET ME LET ME ASK YOU, CALVIN, REAL QUICK. I KNOW WE'RE A LITTLE OVER TIME AND I DON'T WANT TO INTERRUPT YOU, BUT BUT ANYWAY, WHAT WE DID, WE GOT THE PIPE. HE CAME OUT THERE AND WE GOT HER CUT. WE GOT THAT PUMP GOING. YES, SIR. AND HE SAID IF THAT WATER GETS IN, THAT PUMP, WE GOT GOING. THE WATER BEING THE SECOND STORY OF THE BANK OF THE SOUTHWEST. AND I SAID, WELL, MY OFFICE IS AT 204 BANK SOUTHWEST. HE SAID, WELL, WE GOT TO GET BUSY. AND MY SUGGESTION TO THE COMMISSION, IT SAID AN EMERGENCY 500 HORSEPOWER PUMP AND TAKE IT UP AND TIE IT INTO YELLOW CREEK. AND THEN WHEN IT DUMPS, IT'LL GO RIGHT INTO LAKE MEREDITH AND NOT GOING FROM ONE [INAUDIBLE] LAKE TO THE NEXT. AND THANK YOU. THANK YOU FOR COMING IN. THAT'S SOME INSTITUTIONAL KNOWLEDGE THERE. SO WE WILL WE ARE TAKING ALL ASPECTS OF POTENTIAL HELP AND RECOMMENDATIONS. THANK YOU, MR. HORNSBY. MS. MOSLEY IS NEXT. AND THEN OUR LAST SPEAKER ON DECK WILL BE JUSTIN WANN. GOOD AFTERNOON. MY NAME IS LAVONDA MOSLEY AND I'M A RESIDENT OF TASCOSA ACRES ON THE EAST CREEK, ALSO KNOWN AS WILLOW CREEK. CONGRATULATIONS TO MAYOR STANLEY, COUNCILMAN TOM SCHERLEN, COUNCILMAN DON TIPPS. WE'RE GLAD TO HAVE YOU GUYS HERE. I'M GOING TO APOLOGIZE TO YOU THREE FIRST BECAUSE I FEEL LIKE YOU'VE WALKED INTO A DRAINAGE NIGHTMARE IN AMARILLO. AND WHILE I DO AGREE WITH THE APPROVAL OF THE TEMPORARY PUMP IN THE AMOUNT OF $98,965.58 FOR PLAYA 7, THE GREENWAYS LAKE TO ASSIST THE RESIDENTS AND BUSINESS OWNERS FROM FURTHER DAMAGE. I WOULD LIKE YOU ALL TO KEEP IN MIND THE DAMAGE THAT IS BEING DONE TO THE RESIDENT PROPERTIES ALONG EAST AMARILLO CREEK. MANY OF US HAVE PILES OF DEBRIS, FALLEN TREES, TREE LIMBS, TRASH, TIRES, DESTROYED RETAINING WALLS, TEN FOOT SINKHOLES ON OUR LAND DUE TO THE MASSIVE AMOUNTS OF WATER BEING PUMPED FOR MANY OF THOSE FLOODED AREAS. TO THE PLAYAS, TO THOMPSON PARK, AND TO THE EAST CREEK, TO CANADIAN RIVER, TO MEREDITH. WE ARE LOSING MATURE TREES, WILDLIFE, AND MOST IMPORTANTLY, OUR LAND, TO THE POINT THAT NOW OUR STRUCTURES ARE IN JEOPARDY. AT THE RATE OF THE SCOURING AND EROSION IS OCCURRING, WE ARE ON BORROWED TIME. THIS IS UNACCEPTABLE TO THE TAXPAYERS ALONG EAST AMARILLO CREEK. YOU ALSO KNOW THAT WE HAVE BEEN BEGGING THE CITY FOR OVER A YEAR TO HELP WITH THE CLEANUP OF MATURE FALLEN TREES AND DAMS THEY CREATE, WITH NO REGARD TO OUR PROPERTY OR OUR HOMES OR OUR HEALTH. THE CITY IN THE PAST HAS REMOVED DEBRIS BEFORE IT HAS CAUSED BLOCKAGES. THEN WE WERE STRUNG ALONG BEING TOLD WE DON'T HAVE THE MANPOWER, WE DON'T HAVE THE EQUIPMENT. THE EQUIPMENT'S DOWN. IT'S NOT THE CITY'S RESPONSIBILITY AND WE DO NOT USE THAT EASEMENT. IF YOU ARE SENDING HUNDREDS OF THOUSANDS OF GALLONS OF WATER THROUGH THIS NATURAL CREEK, YOU HAVE DRAINAGE EASEMENTS ON, THEN I BEG TO DIFFER WITH YOU ALL. YOU DO USE THAT EASEMENT. NOW, AT THIS POINT, RESIDENTS CAN'T EVEN GET INTO THE CREEK OR THE DRAINAGE EASEMENT TO TRY AND TO TRY AND REMEDY OR RELIEVE THE TRASH AND BLOCKAGES BECAUSE OF THE CONSTANT WATER FLOW, ALONG WITH NOT HAVING THE ABILITY TO OBTAIN OR RUN THE EQUIPMENT, IT WOULD REQUIRE TO REMOVE THE AMOUNT OF DEBRIS THAT HAS ACCUMULATED AND IS STILL ACCUMULATING TODAY. NEW COUNCIL, I ALONG WITH MANY RESIDENTS ALONG THE PATH, ARE ENCOURAGED BY YOUR WILLINGNESS TO TAKE OUR CALLS, OUR EMAILS AND TO OUR AREA. NOW IT'S TIME TO DO SOMETHING WITH THE EAST AMARILLO CREEK. WE ASK THAT YOU DO SOMETHING TO ASSIST YOUR NORTH AMARILLO TAXPAYERS BEFORE MANY OF US LOSE PROPERTIES THAT WE HAVE WORKED SO HARD FOR. PLEASE DON'T WAIT TO TAKE ACTION ON THIS SERIOUS ISSUE UNTIL WE SUFFER FROM THE SAME POOR ENGINEERING AND LACK OF MAINTENANCE OF THE PAST AS THOSE IN OTHER AREAS OF [00:15:01] THE CITY OF AMARILLO ARE SUFFERING NOW. EAST CREEK RESIDENTS WOULD ASK THE CITY TO PUT FORTH AN EMERGENCY BUDGET TO SAVE OUR AREA. THANK YOU FOR YOUR SERVICE AND TIME THAT YOU ARE SPENDING TO ENSURE SAFETY TO THE OTHER RESIDENTS AND BUSINESS OWNERS OF THIS CITY. THANK YOU. MRS. MOSLEY I WANT TO LET YOU KNOW WE WILL WE EXPECT TO BE READY TO SIT DOWN WITH YOU AND THE RESIDENTS OUT THERE FOR A MEETING NEXT WEEK. AND THEN I'D ALSO EXTEND THAT INVITATION TO CHRISTINE, TO YOU GUYS AS WELL. WE WILL GET YOUR CONTACT INFO AND REACH OUT TO YOU GUYS AND COORDINATE A MEETING TO SIT DOWN AND LOOK AT EVERYTHING FOR A FULL EVALUATION. THANK YOU. THANK YOU, MISS MOSLEY. AND LAST, MR. WANN. WE'LL PUT YOU ON NEXT MR. DAWSON. SO ON DECK WILL BE NOAH DAWSON. MR. WANN. HELLO. MY NAME IS JUSTIN WANN. I LIVE AT 3012 MOCKINGBIRD LANE JUST GOT OFF A TRAIN. DID NOT HAVE TIME TO PREPARE A SPEECH. I JUST WANT TO GET UP HERE AND TALK ABOUT A FEW THINGS. MAY 26TH, I CALLED THE CITY OF AMARILLO DRAINAGE DEPARTMENT. LAKE LAWRENCE WAS HALF FULL AT THE TIME AND IT WAS AROUND 8:20 IN THE MORNING AND BECAUSE I HAD DRIVEN AROUND THE LAKE. THE NORTH THERE'S TWO PUMPS AT LAKE LAWRENCE, ONE ON THE NORTHWEST SIDE OF THE LAKE AND ONE BEHIND ON ABOUT THE CENTER OF NORTH RIGHT AROUND DISCOUNT TIRE. NEXT, JUST CATTY CORNER FROM THERE. THERE'S ALWAYS BEEN TWO PUMPS THERE, ONE PUMPS FROM WHAT I UNDERSTAND TO MATTY PARK AND THE OTHER ONE PUMPS NORTH TO THOMPSON PARK. WHEN I DROVE AROUND THE LAKE BECAUSE I SAW IT, IT WAS GETTING HALF FULL AND ALL THE TRASH IN THAT LAKE IS IS AWFUL. AND A LOT OF THAT'S FROM THE PREVIOUS COUNCIL, BY THE WAY. THANK YOU ALL FOR BEING HERE. I DIDN'T DIDN'T TELL YOU. BUT THE TRASH IS THE DUMPSTER ISSUES THAT WE'VE HAD. ALL THE TRASH IS JUST GONE INTO THAT LAKE. AND SO I CALLED COUNCIL SCHERLEN AND TALKED TO HIM ABOUT MAYBE GETTING THE LAKE CLEANED UP AND GETTING THE PUMPS ON. THE PUMP ON THE NORTHWEST PART OF THE LAKE WAS COMPLETELY MISSING. THERE'S A PALLET LAID OVER IT. IT'S NOT PUMPING ANYTHING THERE WAS NO PUMP TO PUMP. ONE OVER THERE BEHIND DISCOUNT. IT WAS A TEMPORARY PUMP LIKE THEY'D BEEN WORKING ON IT. IT WAS NOT PUMPING. SO THAT'S WHEN I CALLED THE CITY. I WANTED TO KNOW WHY THE PUMPS WEREN'T PUMPING. I GOT AN ANSWER FOR THAT TODAY. THEY SAID THE LAKE. LAKE LAWRENCE WHEN IT'S HALF FULL, THAT'S MANAGEABLE. THAT IS NOT MANAGEABLE IF IT'S HALF FULL. IT NEEDS TO BE PUMPING BECAUSE ALL THE OTHER LAKES PUMP INTO LAKE LAWRENCE. IF LAKE LAWRENCE IS IS EMPTY, THEN THAT'S MANAGEABLE. I'VE LIVED AT 20 OR 3012 MOCKINGBIRD SINCE 2009. MY PROPERTY HAS FLOODED FOUR TIMES. IT'S NOT A 100 YEAR FLOOD ZONE. IT'S A TEN YEAR FLOOD ZONE OR A SIX YEAR FLOOD ZONE. SO WHEN THE PUMPS ARE WORKING AND THEY'RE INSTALLED AND THEY'RE WORKING. AND THEY SAID SEVEN OF EIGHT PUMPS WERE WORKING, HER PUMPS NOT WORKING. AND THEN THERE'S ONE PUMP OVER AT LAWRENCE LAKE THAT'S NOT WORKING. SO THAT'S TWO PUMPS THAT AREN'T WORKING. AND THEN THEY'VE GOT A TEMPORARY PUMP IN ANOTHER ONE. SO I THINK YOU ALL ARE BEING LIED TO. I WAS BEING LIED TO, I BELIEVE. SO I JUST HOPE YOU ALL CAN GET SOME ANSWERS. I KNOW TOM'S BEEN WORKING REALLY HARD. I HAD A CALL IN TO YOU, MR. TIPPS, THE OTHER DAY. I WAS BUSY ON A TRAIN. I COULD NOT ANSWER MY PHONE, BUT I HOPE YOU GUYS CAN GET SOME ANSWERS AND GET THIS DRAINAGE SITUATION FIXED. THERE'S TOO MUCH WATER. AND EVEN WHEN IT DOESN'T RAIN THIS MUCH, IT'S TOO MUCH. SO THAT'S ALL. THANK YOU. THANK YOU, SIR. I APPRECIATE THAT, MR. WANN. AS A STATEMENT OF FACT, REAL QUICK, FLOYD, CAN YOU CONFIRM OR ARE ALL PUMPS FUNCTIONING RIGHT NOW AT FULL CAPACITY WHEN THEY CAN BE RUNNING? SO THERE ARE A SET OF PUMPS AT LAWRENCE LAKE OF THE PERMANENT PUMPS THAT ARE IN REPAIR, BUT THERE'S TEMPORARY PUMPS IN PLACE RUNNING TO REPLACE THOSE AT A VERY SIMILAR VOLUME. THERE ARE AVAILABLE TO RUN UNDER THE CONDITIONS OF THE SYSTEM. HOW MANY PUMPS ARE TEMPORARILY RUNNING AT LAWRENCE LAKE, SIR? WELL, THAT ONE SET ON THAT ONE SET. WHAT HE DESCRIBED NOW NOW, AS OF THE DAYS HE DESCRIBED, I DON'T HAVE THE FACTS ON THAT DAY, SO I CAN'T ADDRESS THAT. THANK YOU. SO. NOT NOT ABLE TO GET INTO A DISCUSSION AT THIS POINT. I'LL TELL YOU WHAT WOULD BE GOOD IF YOU WANTED TO TO STEP OUTSIDE AFTER THE MEETING OR NOW IF YOU NEED TO GO, WE'D BE ABLE TO JUMP INTO THIS A LITTLE BIT MORE IN DETAIL. OKAY. THANK YOU. I KNOW WE HAVE ONE MORE. THANK YOU, MR. WANN AND MR. DAWSON. I JUST WANT TO TAKE A MOMENT TO THANK COUNCILMAN TOM SCHERLEN. [00:20:04] ABOUT A YEAR AGO, JUNE 14TH, THE CITY BEGAN THE PROCESS OF DEMOLISHING BUILDINGS NEAR THE SITE OF NEW EMERALD CITY HALL PROJECT. I ATTENDED THAT EVENT AND HAD THE PLEASURE OF SPEAKING WITH COMMUNICATIONS MANAGER DAVID HENRY, WHERE I LET HIM KNOW AT THAT TIME THAT I HAD TAKEN OVER MUCH OF THE DAY TO DAY OPERATIONS OF THE EMERALD PIONEER AND ASKED HIM TO ENSURE THAT I MY EMAIL NOAH AT AMARILLO PIONEER.COM WAS INCLUDED ON THE CITY'S MEDIA LIST. HE SAID HE WOULD SEE TO IT, BUT APPEARS THAT NEVER HAPPENED. IT'S FINE. PEOPLE MAKE MISTAKES. IN FACT, I MADE THE MISTAKE TOO, BY KIND OF BLOWING IT OFF WHEN I PERHAPS SHOULD HAVE BEEN MORE PERSISTENT AND REMINDING HIM. UNFORTUNATELY, EARLIER THIS WEEK, THE CITY HELD ONE OF THE MOST IMPORTANT PRESS CONFERENCES IN RECENT MEMORY, ADDRESSING THE RECENT DISASTROUS FLOODS WHICH HAVE WREAKED HAVOC ACROSS OUR AREA. APPARENTLY, DUE TO THE FACT THAT MY EMAIL ADDRESS WAS AT THAT POINT STILL NOT INCLUDED IN THE MEDIA LIST, I WAS NOT MADE AWARE OF THE EVENT UNTIL AFTER IT HAD ALREADY HAPPENED. NOW, COUNCILMAN TOM SCHERLEN TOOK NOTE OF THE EMERALD PIONEERS ABSENCE AND REACHED OUT TO SEE WHAT HAD HAPPENED, AND I LET HIM KNOW THE SITUATION AND HE'S TOLD ME THAT HE HAS NOW SPOKEN TO DAVID AND I HOPE THE ISSUE HAS BEEN RESOLVED. TRANSPARENCY IS IN GOVERNMENT IS SOMETHING THAT SHOULD BE EXPECTED, NOT JUST HOPED FOR. ON DIFFERENT NOTES. I KNOW MY NAME'S NOAH, BUT LAST TIME I BUILT A BOAT BACK IN HIGH SCHOOL PHYSICS, IT SANK ALMOST IMMEDIATELY WHEN PUT IN WATER. SO PROBABLY NOT GOING TO BE ANY HELP IN THAT REGARD IF IT COMES TO THAT. DIFFERENT NOAH. THANK YOU. MR. DAWSON. WE'LL MAKE SURE YOUR ISSUE IS ADDRESSED SIR. AND, MAYOR, THAT CONCLUDES OUR SIGNUPS FOR PUBLIC COMMENT. DO WE HAVE ANYONE ELSE HERE TODAY THAT WOULD LIKE TO SPEAK BEFORE WE MOVE ON WITH OUR MEETING? YES, MA'AM. PLEASE COME FORWARD. AND IF YOU DON'T MIND STATING YOUR NAME SO THAT WE CAN GET YOU ON THE RECORD. THANK YOU, MAYOR. COUNCIL MEMBERS. I AM DONNA KEEL. I'M THE PRESIDENT OF THE BETTER BUSINESS BUREAU THAT SERVES THE 26 COUNTY AREA OF THE TEXAS PANHANDLE. I'M AN AMARILLO RESIDENT. AND TODAY, I WANT TO JUST REMIND EVERYONE ABOUT THE BETTER BUSINESS BUREAU SERVICES. THEY ARE OF NO COST TO CONSUMERS TO USE OUR SERVICES. AND JUST A COUPLE OF DAYS AGO, WE PUT UP OUR DISASTER WEBSITE AND IT DOES INCLUDE FLOODING INFORMATION. SO THAT IS IMPORTANT THAT PEOPLE BECOME INFORMED AND EDUCATED ABOUT THE SERVICES THAT ARE OUT THERE FOR THEM TO TAKE ADVANTAGE OF. WE ALSO WANT PEOPLE TO KNOW THAT ALTHOUGH WE'RE NOT SEEING COMPLAINTS RIGHT NOW FROM COMPANIES BECAUSE THAT WILL COME LATER WHEN THEY DO WORK AND THEN THAT WORK IS UTILIZED BY THE END USER, THE CONSUMER. AND WHETHER OR NOT THAT WORK WAS SUFFICIENT. RIGHT. BUT WE ARE SEEING DOOR TO DOOR SALES ALREADY. COMPANIES AND PEOPLE COMING INTO TOWN FROM OUT OF THE AREA AND COMPANIES IN TOWN THAT ARE GOING DOOR TO DOOR. THIS IS FINE. IT'S LEGAL AS LONG AS THEY HAVE THE PROPER CITY ORDINANCE DOOR TO DOOR SALES, CERTIFICATE OR REGISTRATION. AND THAT HAS ITS OWN PARAMETERS. BUT THE POINT IS, HOW DO YOU KNOW THE DIFFERENCE BETWEEN SOMEONE WHO IS A LOCAL COMPANY OR AN OUT OF TOWN COMPANY THAT HAS A GOOD REPUTATION AND SOME LONGEVITY? AND HOW DO YOU TELL THE DIFFERENCE BETWEEN A POP UP COMPANY, FOR EXAMPLE, AND A POP UP OR A FLY BY NIGHT COMPANY? AND ALL THOSE DEFINITIONS CAN BE HAD IF PEOPLE ARE INTERESTED. BUT WE DO HAVE FLY BY NIGHT COMPANIES WHO WILL COME INTO TOWN, AND THEIR SOLE PURPOSE IS TO DO A LITTLE BIT OF WORK, TAKE SOME MONEY, PERHAPS WORK MIGHT BE SUBSTANDARD WORK. THEY TAKE MONEY UP FRONT AND WE WANT TO EDUCATE CONSUMERS AND OUR CITIZENS ON HOW TO HANDLE THOSE BUSINESS TRANSACTIONS. DON'T PAY MONEY UP FRONT, DON'T PAY ALL OF IT AT ONE TIME. KNOW WHO YOU'RE DOING BUSINESS WITH. THAT'S WHY THE BBB IS HERE. AND SO TO TELL THE DIFFERENCE IN THOSE COMPANIES, ESPECIALLY THE POP UPS, THESE ARE PEOPLE WHO HAVE WORKED FOR OTHER COMPANIES WHO THINK THEY CAN NOW OPEN THEIR OWN COMPANY AND HAVE ALL THAT EXPERTISE. THEY AGAIN, DON'T HAVE THAT EXPERIENCE. SO TELLING YOU THE DIFFERENCE, THE BEST WAY TO DO THAT IS THAT BBB.ORG BECAUSE WE CAN LET YOU KNOW THE COMPANY'S RATING THEIR HISTORY ANY COMPLAINTS, HOW THEY HANDLE THEM, WHETHER THEY'RE RESPONSIVE. AND AS THESE CONSUMERS HAVE THESE LOSSES, WE ALSO WANT TO MAKE SURE THAT THEY DON'T INCUR LOSSES FROM SPENDING MONEY WITH THESE COMPANIES THAT AREN'T GOING TO DO THE JOB FOR THEM. SO AND THEN THEY HAVE TO SPEND MONEY AGAIN. WE DON'T WANT THEM TO GIVE THEIR INSURANCE CHECKS DIRECTLY TO THESE COMPANIES. YOU ALL KNOW HOW THAT WORKS. INSURANCE AND CONTRACTING THE BUSINESSES THAT YOU ARE IN. AND SO WE HAVE OVER OVER 110 YEARS OF EXPERIENCE NATIONWIDE AND ALMOST 80 YEARS OF EXPERIENCE NEXT YEAR, 85 ACTUALLY, [00:25:01] HERE IN AMARILLO. SO WE DO WANT PEOPLE TO BE AWARE OF THAT AND WE WANT TO PROVIDE THESE SERVICES AND WORK WITH THE CITY AND AND WITH THE EMERGENCY MANAGEMENT. WE ARE OUT THERE TODAY AND WE WILL BE OUT THERE AT THE CENTER TOMORROW AS WELL TO PROVIDE THIS INFORMATION TO OUR CITIZENS. THANK YOU, MA'AM. APPRECIATE YOU COMING UP AND THE ADDITIONAL INFO. OKAY, SO THAT CONCLUDES PUBLIC COMMENT. APPRECIATE EVERYONE BEING HERE AND THE CITIZENS THAT WERE WILLING TO SPEAK. WE WILL AND HAVE EVERY INTENTION ON DOING A FULL EVALUATION FOR EVERYTHING WE'VE GONE THROUGH OVER THE LAST THREE WEEKS. IT IS UNPRECEDENTED. AND THERE IS SOME FACTUAL INFORMATION THAT YOU GUYS HAVE AND THAT WE HAVE. BUT THEN THERE ARE A LOT OF NUANCES AND DIFFERENT THINGS THAT WE HAVE TO TAKE ON AN INDIVIDUAL BASIS. SO JUST KNOW IT WILL TAKE US A MINUTE TO GET THROUGH IT. BUT WE APPRECIATE YOUR PATIENCE AND WE'RE GOING TO WE'RE GOING TO WORK ON THIS. AND STAFF HAS BEEN VERY RESPONSIVE IN WORKING ALONG WITH US. AND WE WILL DO THE ABSOLUTE BEST WE HAVE WITH WHAT WE THE ABSOLUTE BEST WE CAN WITH WHAT WE HAVE. SO AT THIS TIME, WE'RE GOING TO MOVE ON TO ITEM 5A, CONSIDERING A RESOLUTION NUMBER 06-08-23-1. [5.A. CONSIDERATION OF RESOLUTION NO. 06-08-23-1] THIS ITEM IS A CONSIDERATION OF A RESOLUTION CONFIRMING AND CONTINUING THE MAYOR'S DECLARATION OF DISASTER. AND SO LAST THURSDAY, WE WERE ABLE TO PUT A DECLARATION OF DISASTER IN PLACE, WHICH OPENED UP FOR OUR COMMUNITY THE OPPORTUNITY TO INVITE [INAUDIBLE] AND OTHER AGENCIES TO THE TABLE, SO TO SPEAK, TO HELP AND TO ASSIST. IT ALSO ALLOWS US SOME REIMBURSEMENT COURSES OF ACTIONS WHERE THERE ARE SOME FUNDING AND SOME THINGS THAT CAN HELP US AS CITIZENS. SO THAT WE'RE NOT LOOKING AT JUST OUR GENERAL FUND OR JUST OUR DRAINAGE UTILITY FEE TO PAY FOR SOME OF THESE REPAIRS. IT PUTS IN PLACE A COURSE OF ACTION FOR ALL OF OUR PRIVATE PROPERTY OWNERS, BUSINESSES AND RESIDENCES WHERE THEY CAN FILE THEIR OWN CLAIMS AND THEIR OWN APPLICATIONS IN ORDER TO BE TAKEN ON ONE AT A TIME. WE ENCOURAGE EVERYONE IN OUR COMMUNITY TO FILE ALL OF THOSE PIECES OF PAPER, ALL THAT PAPERWORK, AND TO REACH OUT. AND THEN WE ARE COMMUNICATING EVERY WAY WE KNOW HOW, EVEN TO THE POINT OF HAVING A THE MARC OVER THERE, WHICH IS. ANDREW, GIVE ME THE THE TECHNICAL DEFINITION OVER THERE AND THE ADDRESS, IF YOU WILL. SURE. WE'VE GOT MAX HERE CAN ANSWER THAT. IT'S THE ASSISTANCE CENTER. I CAN'T REMEMBER WHAT THE M STANDS FOR. I HAD TO RUN OVER HERE FROM THE OPERATION CENTER. SO THE MARC ACTUALLY STANDS FOR A MULTI-AGENCY RESOURCE CENTER. CURRENTLY, IT IS ROUGHLY 16 DIFFERENT AGENCIES RANGING FROM THINGS LIKE THE RED CROSS, SALVATION ARMY, FAITH BASED ORGANIZATIONS. YOU KNOW, SOME OF THESE CENTERS CAN HAVE ENTITIES SUCH AS INSURANCE COMPANIES THERE TO GIVE, YOU KNOW, SUBJECT MATTER EXPERTISE ON INSURANCE CLAIMS, THINGS LIKE THAT. I DO BELIEVE SINCE THERE WAS ROUGHLY $10,000 GIVEN TO SALVATION ARMY AND AMERICAN RED CROSS FOR THIS EXACT REASON TO HELP THOSE INDIVIDUALS IN NEED, WE WERE GOING THROUGH THAT PROCESS. BUT IN A SENSE, THIS RESOURCE CENTER IS A ONE STOP SHOP TO HELP OUR CITIZENS AND ANYONE WHO HAS SUFFERED DAMAGE TO FIND A SPOT TO COME GET SOME HELP, GET SOME RIGHT DIRECTION. IF THEY HAVEN'T FILLED OUT A DAMAGE ASSESSMENT FORM FOR THEIR PROPERTY. THE TEXAS DIVISION OF EMERGENCY MANAGEMENT IS ALSO THERE TO ASSIST THEM WITH THAT. SO SOME OF THE THINGS THEY DO NEED TO BRING IS PROOF OF RESIDENCY. ANY DOCUMENTATION. IF THEY IF THEY CAN GET IT, THAT HELPS SPEED THINGS ALONG IN THE PROCESSES. BUT IT ABSOLUTELY IS JUST THAT IT IS A RESOURCE CENTER FOR OUR CITIZENS. THANK YOU, SIR. SO THAT IS 1111 LOOP 335. IS THAT RANDALL COUNTY ONE? YES, SIR. OKAY, SO THAT'S A FIRE STATION OVER ON THE LOOP ON THE SOUTH SIDE OF TOWN. MULTI-AGENCY RESOURCE CENTER WAS THE THE DEFINITION. I COULDN'T REMEMBER. BUT EVERYTHING THAT YOU NEED IF YOU, YOU KNOW, AREN'T ABLE TO GET ONLINE AND CLICK THE LINK AND FUNCTION THROUGH AND NAVIGATE THAT, YOU HAVE THE OPPORTUNITY TO GO AND GET PERSONAL ONE ON ONE HELP AND MAKING SURE YOU'RE GETTING ALL THAT PAPERWORK FILED. IN MY OPINION, THAT'S ONE OF THE MOST IMPORTANT THINGS WE CAN DO AS A COMMUNITY IS TO ENCOURAGE YOU GUYS TO DO THAT, BECAUSE THIS IS A FUNDING SOURCE THAT IF YOU DON'T GET IN LINE FOR, IT CAN BE TOO LATE BY THE TIME YOU TURN YOUR STUFF IN, IF YOU TURN IT IN LATE OR YOU DON'T MEET CERTAIN CRITERIA. AND THEN WE'RE LOOKING AT EACH OTHER ONCE AGAIN TRYING TO FIGURE OUT HOW TO HELP. AND SO WE WANT TO UTILIZE ALL THE RESOURCES THAT WE HAVE AT OUR FINGERTIPS HERE AND TO CONTINUE TO COMMUNICATE THAT THAT MARC MULTI-AGENCY [00:30:01] RESOURCE CENTER IS IS A GREAT LIFELINE. DID YOU HAVE ANYTHING ELSE THAT YOU WOULD LIKE TO CONTRIBUTE TO THAT, SIR? CURRENTLY, SO WE WE HAVE STOOD UP A A ANOTHER SHELTER THIS MORNING AFTER THIS MORNING'S EVENTS AND LATE LAST NIGHT'S EVENTS. SO CURRENTLY THAT SHELTER IS ACTUALLY AT THE NORTH END OF THE CIVIC CENTER. IT IS. IT WAS FOUND THAT ROUGHLY I'LL GET THE EXACT NUMBER. ROUGHLY 173 PEOPLE WERE AFFECTED WITH A TOTAL OF ROUGHLY 39 PETS. AND THAT WAS AS ABOUT AN HOUR OR SO AGO. THAT SITUATION IS STILL ONGOING AND UNFOLDING, SO WE'RE STILL WORKING THROUGH THAT. MY HEART GOES OUT FOR ALL THE CITIZENS WHO ARE AFFECTED THERE. I CAN ASSURE YOU THAT THERE IS MANY OF US WHO HAVE NOT SLEPT IN THE LAST 36 HOURS, AND WE ARE DOING THE BEST WE CAN AND WE'RE WORKING DILIGENTLY FOR YOU. WE ARE ONE IN THIS COMMUNITY AND WE WILL CONTINUE TO FIGHT FOR YOU. BUT OUR TEAM [INAUDIBLE]. FIXED IT. SO THAT IS WE CURRENTLY ARE STILL ADDRESSING NEEDS AT THE FLOODING AREA OF LAWRENCE. WE ARE STILL BUSSING INDIVIDUALS WHO NEED TRANSPORTATION FROM THAT AREA TO THE CIVIC CENTER AT THE SHELTER. AND ALSO WE ARE SETTING UP BUS ROUTES AND ONGOING BUS ROUTE FROM THE SHELTER TO THE MARC AS WELL ON A SCHEDULE. SO WE ARE WORKING WITH CITY TRANSIT AS THAT. SO, JESSICA, AS YOU WERE DISPLACED FROM YOUR HOUSE, DOES NOT MEAN YOU WILL YOU WILL BE KEPT FROM THAT ASSISTANCE CENTER AS WELL. WE WILL GET YOU THERE AND GET YOU BACK. WE'LL CONTINUE TO TAKE CARE OF YOU THE BEST WE CAN. OKAY. DO I HAVE SOME QUESTIONS FROM COUNCIL? JUST A QUESTION FOR SOME OF THE CITIZENS IN FILLING OUT THAT PAPERWORK. AND I DON'T MEAN TO PUT YOU ON THE SPOT. YOU MAY HAVE ANSWERED, YOU MAY NOT. IF THEY GO AHEAD AND FILL OUT BECAUSE IT IS IMPORTANT THEY GET IN THERE. SO A BUSINESS OWNER OR A HOMEOWNER, CAN THEY GO IN BECAUSE THE EVENT'S NOT OVER? I MEAN, WE'RE PRAYING THAT IT IS, RIGHT. BUT WE DON'T KNOW THE EXTENT OF THE DAMAGE. SO IF THEY GO IN AND THEY FILL OUT THAT PAPERWORK AND THE ASSESSMENT OF THE DAMAGE AND THAT TYPE DEAL, CAN THEY LATER GO BACK AND AMEND THAT? [INAUDIBLE] I WOULD ACTUALLY HAVE TO DO SOME RESEARCH ON THAT AND GET BACK TO YOU ON THAT, SIR. AND I DIDN'T MEAN TO PUT YOU ON THE SPOT. I JUST JUST FOR CLARIFICATION [INAUDIBLE]. THAT'S A GREAT QUESTION. I REALLY WOULD HAVE TO GET BACK TO YOU. I'M HESITATING. SO I DON'T WANT TO DO IT YET BECAUSE I DON'T KNOW. BUT YET MAYOR STANLEY SAID IT'S KIND OF A WE GOT TO GET IN LINE IT'S BETTER IT'S BETTER TO PUT SOMETHING IN THERE, A GOOD FAITH ESTIMATE AND, YOU KNOW, POSSIBLY WHEN WE SPEAK WITH THEM AND AGAIN, I WOULD HAVE TO GET BACK ON [INAUDIBLE]. THANK YOU. SO JUST FOR CLARIFICATION, BECAUSE I KNOW ONE OF THE BIGGEST ISSUES THAT I'VE HAD IS CLEAR COMMUNICATION CONTINUED THROUGHOUT THIS EVENT BECAUSE THIS IS VERY UNIQUE THAT WE'VE BEEN IN THREE WEEKS OF ONE SINGLE EVENT THAT'S CONTINUING LIKE THIS. SO TO OVERCOMMUNICATE TO OUR POPULATION, ONCE YOU GET CONFIRMATION ON THAT, IF YOU CAN GET THAT BACK IN COMMUNICATIONS HANDS AND WE WILL POST THAT ALL OF OUR SOCIAL AND OUR WEB PAGE ONCE AGAIN SO THAT EVERYBODY KNOWS THE TIMING IN FILING THAT CLAIM. YES, SIR. I HAVE A QUESTION, MAYOR. I'VE BEEN APPROACHED BY SEVERAL CITIZENS THAT WE HAVE BLOCKADES OR DON'T HAVE BLOCKADES ON CERTAIN STREETS. AND PEOPLE CONTINUE TO DRIVE DOWN THESE STREETS, CREATING A WAKE THAT IS ACTUALLY GOING INTO SOME HOUSING NOW. AND I DON'T KNOW IF THERE'S SOMETHING WE CAN DO TO ALLEVIATE THAT PROBLEM, WHETHER WE NEED TO GET TOUGHER ON GIVING TICKETS OR WHATEVER WE NEED TO DO. BUT I THINK ANYBODY THAT CROSSES A BLOCKED STREET NEEDS SOMETHING. SO I APPRECIATE THE QUESTION. YOU KNOW, I SEE ONE OF OUR APD GENTLEMEN BACK HERE, MR. LOFTUS, IF YOU IF YOU WOULDN'T MIND COMING UP, MAYBE YOU COULD SPEAK TO THAT IN THE WAY OF JUST TELLING US WHAT'S APPROPRIATE IN HONORING THOSE SIGNS AND THEN MAYBE HOW SLOW YOU SHOULD BE DRIVING JUST IN A COURTESY TO YOUR NEIGHBORS WHEN YOU'RE DRIVING THROUGH THESE AND NOT CREATING WAKES. WELL, RIGHT NOW, IF THE BARRICADES ARE UP, IF ANYONE PASSES THROUGH THOSE BARRICADES, WE HAVE ALL OF OUR MOTORS OFFICERS RIGHT NOW. WE HAVE SEVEN OUT ON THE STREET AND THEY ARE STOPPING AND TICKETING THOSE INDIVIDUALS. NOW, I KNOW MAX HAS BEEN WORKING REALLY HARD ABOUT GETTING US ADDITIONAL BARRICADES, BUT RIGHT NOW, TO MY UNDERSTANDING, THERE'S MORE NEEDS FOR BARRICADES THAN WE HAVE BARRICADES AVAILABLE. SO WE ARE PUTTING THOSE UP AS MUCH AS POSSIBLE. ONCE THEY'RE UP, NO ONE'S ALLOWED LEGALLY TO PASS THROUGH THOSE. [00:35:02] WE EVEN HAD TOW TRUCK DRIVERS TRYING TO PASS THROUGH THEM AND WE HAD TO CALL THE TOW COMPANIES. YOU KNOW, YOU CAN'T PASS THROUGH THOSE UNLESS THERE'S A SPECIFIC REASON. AND IT'S REALLY EMERGENCY ONLY OR EXCUSE ME, EMERGENCY VEHICLE ONLY. OKAY. THANK YOU, SIR. THANK YOU. I THINK IF WE CAN JUST REITERATE AND THEN WE'LL GET TO YOU, MR. COUNCILMAN SMITH. THE COURTESY THERE IS, IS YOU DON'T FULLY UNDERSTAND WHEN YOU'RE DRIVING 15 OR 20 MILES AN HOUR THROUGH THAT FLOODED AREA, THE CHANGE IN ELEVATION ON THOSE WATERS. AND SOMETIMES WE HAVE OWNERS, HOME OWNERS, THAT IT IS LITERALLY UP TO THE THRESHOLD OF THEIR DOOR. AND THOSE SANDBAGS ARE THE ONLY THING KEEPING THAT DAMAGE FROM COMING IN. AND SO AS YOU SPLASH THROUGH ON THAT WAKE AND YOU ELEVATE THAT WATER 6 TO 8IN AT A TIME, IT'S CAUSING SEVERE, YOU KNOW, SEVERE ISSUES FOR US. AND MAYBE YOU'RE JUST NOT CONSCIENTIOUS OF THAT. SO WE'RE JUST TRYING TO COMMUNICATE THAT HERE IN THE RIGHT WAY AND US ALL WORKING TOGETHER. COUNCILMAN SMITH. WELL, LET ME MAKE A COMMENT. I HAD ABOUT A TWO HOUR TOUR DAY BEFORE YESTERDAY WITH THE FIRE DEPARTMENT. IN A VEHICLE THAT COULD GO IN DEEP WATER. AND WE SAW A LOT OF ORANGE CONES. I USED TO COMPLAIN ABOUT ORANGE CONES. WE STILL WE NEED TO OBEY THOSE AND NOT GO BEYOND THOSE. IF I REMEMBER THE ORANGE CONES WERE BEFORE YOU GET TO THE WATER. SO IF YOU GO BEYOND THOSE THAT'S GOING TO CAUSE A WAKE. AND SO THE PUBLIC'S JUST GOT TO PAY ATTENTION TO THOSE ORANGE CONES. IT WAS EDUCATIONAL FOR ME TO SEE ALL THAT IN AROUND TWO LAKES AND IT'S HORRIBLE WHAT'S HAPPENING. WE PRAYED FOR RAIN FOR A LONG TIME WHEN WE GOT IT, BUT WE DEFINITELY DID. DO YOU HAVE ANY QUESTIONS FOR MR. DUNLAP BEFORE WE LET HIM SIT DOWN? I DON'T. ANYBODY ELSE? NO, SIR. OKAY. THANK YOU. APPRECIATE YOU COMING UP. THANK YOU, COUNCIL. YOU KNOW, AT THIS TIME, I JUST WANT TO OPEN UP FOR THE COUNCIL IF THERE'S ANY FURTHER DISCUSSION. IT'S PRETTY STRAIGHTFORWARD WHAT WE'RE HERE TO DO ON THIS PARTICULAR ITEM. IT IS A 30 DAY CONTINUATION. CAN YOU CONFIRM THAT? YES, SIR. OKAY. THAT'S CORRECT. SO IF WE NEED TO, WE'D PUT IT BACK ON A FUTURE AGENDA TO EXTEND AGAIN. WE WOULD HOPE THAT WITHIN 30 DAYS WE'LL HAVE A SIGNIFICANT RECEDING OF ALL OF THE WATERS. ALL OF THE PUMPS WILL WILL WORK LIKE WE NEED TO. WE NEED TO EVALUATE THE DAMAGE AND SEE TO THE EXTENT AS BEST WE CAN BEFORE WE KIND OF MOVE OUT OF THIS PHASE AND CLOSE THE BOOK. AND SO 30 DAYS IS WHAT WE'RE WHAT WE'RE ATTEMPTING TO DO. WE BELIEVE THAT THIS WILL BE ADEQUATE FOR US MOVING FORWARD. ANYBODY HAVE ANY OTHER QUESTIONS ON WHAT WE'RE LOOKING AT? NO, SIR. I'LL MAKE A MOTION THAT WE ACCEPT. RESOLUTION NUMBER 06-08-23-1. SECOND. OKAY. I HAVE A MOTION BY COUNCILMAN SCHERLEN. A SECOND BY COUNCILMAN SMITH. DO I HAVE ANY FURTHER DISCUSSION? ALL IN FAVOR PLEASE SAY AYE. AYE. THAT PASSES ON A 4-0 VOTE. WE'RE GOING TO MOVE ON TO ITEM 5B, AWARDING THE CONTRACT FOR PLAYA 7 GREEN GREENWAYS LAKE TEMPORARY PUMP FOR $98,000. [5.B. CONSIDER AWARD - CONTRACT FOR PLAYA 7 GREENWAYS LAKE TEMPORARY PUMP] MR. HARTMAN, WOULD YOU PLEASE COME FORWARD AND GIVE US AN UPDATE ON THAT AMOUNT OF MONEY AND WHAT IT'S CURRENTLY DOING, PLEASE, SIR? YES, MAYOR. COUNCIL. THANK YOU. YES. LET ME EXPRESS A COUPLE OF APPRECIATIONS. FIRST, MAYOR AND COUNCIL FOR SUPPORT OF STAFF DURING THIS EVENT AND WHAT WE'RE ABLE TO ACCOMPLISH. I ALSO WANT TO EXPRESS MY APPRECIATION TO RANDALL COUNTY FOR PARTICIPATION. SO UNDERSTAND THAT RANDALL COUNTY HAS AGREED TO A 50% PARTICIPATION ON THIS ITEM, BUT THIS ITEM IS THE APPROVAL OF A TEMPORARY WE PROCURED UNDER EMERGENCY CODE TEXAS PROCUREMENT CODE, A PUMP. THAT PUMP WAS PLACED AT PLAYA 7, WHICH IS BETWEEN COLTER AND CHAUNCEY, WHERE ARDEN ROAD WOULD BE IF IT WENT WEST OF COLTER. SO THAT PUMP IS ABLE TO PUMP TO A GRAVITY FLOW MAIN THAT PUMPS TO MCDONALD LAKE. MCDONALD LAKE PUMPS ARE IN OPERATION OUT OTHER THAN WHEN IT'S RAINING AT THIS POINT, THAT SYSTEM IS BUILT THAT WAY. SO WE ARE NOW ABLE TO PUMP FROM MCDONALD LAKE, WHICH SPANS AREAS INSIDE AND OUTSIDE THE CITY LIMITS. AND THAT PUMP IS ON A TEMPORARY BASIS. THIS $98,000 IS FOR THE MOBILIZATION INSTALLATION AND UP TO ONE MONTH. AND THEN WE'LL HAVE TO RECONSIDER HOW LONG WE MAY NEED IT BEYOND THAT, THAT IS TO ALLEVIATE THE FLOODING THAT WE ARE SEEING ABOVE [00:40:08] ANY EXPECTED CONDITIONS DUE TO THOSE EMERGENCY CONDITIONS OF THAT JUST BACK TO BACK STORMS THAT HAVE INUNDATED ALL OF OUR PLAYAS. THAT BEING SAID, THE OTHER PLAYAS TO THE OTHER DIRECTIONS ARE NOT CAPABLE OF HOLDING THIS. THIS IS REALLY THE ONLY IDENTIFIED METHOD WE HAVE AT THIS POINT. WE DO NOT HAVE A PUMP THAT WE'VE IDENTIFIED THAT COULD GO ALL THE WAY TO [INAUDIBLE] PARK WITH THE HEAD PRESSURES THAT WOULD BE ALMOST UNFEASIBLE AT THIS POINT. SO THIS MECHANISM IS THE BEST THAT WE'VE BEEN ABLE TO COME UP WITH TO PROVIDE AND ALLEVIATE THE PROBLEMS ASSOCIATED WITH THAT. HOWEVER, THERE ARE LIMITATIONS IF WE PUMP TO MCDONALD OBVIOUSLY IT WILL NEGATIVELY IMPACT MCDONALD'S. SO JUST SO YOU KNOW, THE PUMPS AT MCDONALD EXCEED THE CAPACITY OF THIS PUMP. IT PUMPS ABOUT 3800 GALLONS A MINUTE. THOSE PUMPS OVER AT MCDONALD, PUMP MORE THAN THAT. SO IN DAYS LIKE TODAY WHEN THE SUN SHINE AND WE'RE PUMPING, WE'RE RUNNING ALL OF THEM. BUT THERE WILL COME CIRCUMSTANCES DURING A RAIN. WE HAVE TO SHUT ALL OF THAT OFF AND THEN START IT BACK UP AFTER A RAIN. BUT THIS WAS PROCURED. IT'S ALREADY OUT THERE AND RUNNING. THAT'S ALLOWED UNDER TEXAS PROCUREMENT LAW UNDER THE EMERGENCY. THAT LAW ALSO STATES THAT WE SHOULD HAVE IT ON THE NEXT AVAILABLE CITY COUNCIL MEETING FOR CONSIDERATION. THAT'S WHY IT'S ON YOUR AGENDA TODAY. I WOULD ANTICIPATE OUT OF THE EVENT THAT WE WILL BE SEEING ADDITIONAL EMERGENCY ACTIONS TO BE TAKEN, POSSIBLY WITH PROCUREMENT AND FURTHER AGENDA ITEMS. BUT WE HAVEN'T AT THIS POINT. WE ARE WORKING WITH OUR PARTNER AGENCIES TO IDENTIFY ANY AND ALL THINGS THAT WE CAN DO. WITH THAT I'D BE GLAD TO ANSWER ANY QUESTIONS. DID WE HAPPEN TO GET THE PICTURE OF THE PUMP WHERE WE CAN SHOW IT? I DON'T THINK WE GOT THAT. WE DO. DO WE HAVE [INAUDIBLE]. COUNCILMAN TIPPS DO YOU HAVE ANY QUESTIONS [INAUDIBLE]? DO YOU HAVE ANY QUESTIONS ON THIS SIDE? NO. IF YOU WOULD, I'D LIKE TO JUST GO A LITTLE DEEPER ON TWO ITEMS. OKAY. ONE, IN THE IN THE WAY IN WHICH WE'RE HAVING TO TURN THOSE PUMPS OFF BECAUSE THERE'S A CURRENT RAIN EVENT. RIGHT. JUST SPEAK A LITTLE BIT MORE IN DEPTH ON WHERE YOU'RE PUMPING THAT WATER AND WHY YOU CAN'T PUT, YOU KNOW, PUMPED WATERS INTO CURRENT RAIN WATERS IN THE SAME PIPELINE. OKAY. SO THIS PUMP WILL PUMP UP THE HILL TO A GRAVITY FLOW STORM DRAIN THAT IS DESIGNED TO HANDLE THE FLOWS WITHIN THE COMMUNITY, THE BUSINESSES AND THE HOUSES WITHIN THAT COMMUNITY AND IN THAT EXISTING UNDERGROUND STORM DRAIN THAT DRAINS TO MCDONALD. THIS PUMPS WHEN IT'S NOT BEING USED FOR THAT FIRST PURPOSE IT WAS INSTALLED IS TO PROTECT THAT COMMUNITY. SO IF YOU TURN THIS PUMP ON WHILE IT'S RAINING, YOU CAN FLOAT THOSE MANHOLES AND CREATE ADDITIONAL FLOODING AND HAZARDS TO THE TRAVELING PUBLIC AND THE RESIDENTS AND THE BUSINESSES IN THAT AREA. SO THAT IS THE EFFICIENCY OF USING YOUR INFRASTRUCTURE TWICE. THE NEGATIVE OF THAT IS YOU CAN'T RUN THE PUMPS ALL THE TIME, ESPECIALLY WHEN IT'S RAINING, BECAUSE YOU HAVE THAT DUAL FUNCTION OF THAT GRAVITY COMPONENT. AGAIN, A PUMP OF THIS SIZE. IF YOU ADD THE 4 OR 5 MILES TO GET TO [INAUDIBLE] AND THE DISRUPTION TO ARTERIALS. ARTERIALS AND OTHERS. BUT THE RESISTANCE AND HEAD PRESSURE. THE RESISTANCE ON THAT PIPE WOULD BE SUCH THAT THE PUMP WOULD PUMP VERY LITTLE WATER WITH THAT ADDITIONAL MILEAGE OF PIPE. SO WE GET THE MAXIMUM AMOUNT OF PUMP PER MINUTE, WHICH WOULD EXCEED WHAT WE'RE ABLE TO IF WE RAN 100% OF THE TIME WITH THAT LOWER DISCHARGE GOING THAT OTHER DISTANCE. THE ENGINEERS CAN EXPLAIN IT MUCH BETTER THAN I CAN, BUT IT IS THE MOST THAT WE CAN PUMP OUTSIDE OF RAIN EVENTS. OKAY. THANK YOU FOR THAT CLARIFICATION. ONLY OTHER THING IS JUST A LITTLE BIT IN THE WAY OF HOW THE $98,000 IS BEING PAID. SO WILL YOU SPEAK TO WHERE THAT COMES FROM AND WHAT THAT CAUSES IN THE WAY OF OTHER PROJECTS THAT ARE IN LINE? SURE. WHAT YOU SEE IN YOUR ANNUAL BUDGET IS IN DRAINAGE UTILITIES AND OTHERS. WE BUDGET THE ANNUAL [INAUDIBLE] THAT INCLUDES THIS TYPE OF EMERGENCY. SO WE IDENTIFY THE ABILITY THAT THIS MAY OCCUR AND PLAN FOR SOMETHING LIKE THIS WITH FUNDING AVAILABLE IN THAT [INAUDIBLE]. NOW, IF THIS KIND OF EVENT DOESN'T OCCUR, THEN THAT MONEY IS TRANSFERRED INTO AN ACTUAL CAPITAL PROJECT TO BE COMPLETED DURING THAT AT THE END OF THAT FISCAL YEAR. SO THAT IS OUR MECHANISM SUCH THAT THE BUDGET ISN'T NEGATIVELY IMPACTED AND YOU GET THE MOST MONEY FOR YOUR MONEY. SO THERE'S A PROJECT NOW THAT WILL BE PUSHED OUT A LITTLE BIT AT THE END OF THE YEAR BECAUSE WE SPENT THIS EMERGENCY MONEY. [00:45:02] BUT THAT'S YOUR [INAUDIBLE] ACCOUNTS IN YOUR DRAINAGE AND YOUR WATER UTILITIES. DOES THAT ANSWER YOUR. THAT HELPS, YES. ANY OTHER QUESTIONS FOR MR. HARTMAN? WELL, MR. HARTMAN, WE I THINK WE TALKED ABOUT THIS, BUT I THINK THE CITIZENS WANT TO KNOW AS WELL, IS THERE A PLAN OR ARE WE LOOKING AS A CITY TO MAYBE DO SOMETHING PERMANENT FOR 5 ARE WE LOOKING FUTURE WISE SAYING, OKAY, WE GOT WE GOT TO DO SOMETHING, STOP BRINGING TEMPORARY PUMP IN PLACE? SURE. AS ALL OF THESE CHALLENGES HAVE AND ALL OF THESE DRAINAGE BASINS, THERE ARE PLANS IN PLACE AND IDENTIFICATION OF THE CHALLENGES RELATED TO THEM. IN THIS PLAYA 7 AREA THIS PUMP WAS IDENTIFIED AS A NEED AND CURRENTLY RESIDES IN YOUR FIVE YEAR CAPITAL IMPROVEMENTS PLAN, THE UNFUNDED PORTION YEAR 20 FISCAL YEAR 2024. SO THERE IS FUNDING TO CONSTRUCT PERMANENT PUMPS AT THIS WITH A FORCE MAIN THAT DOESN'T GO TO MCDONALD, THAT GOES TO A SEPARATE STORM DRAIN SUCH THAT BOTH LAKES CAN BE PUMPED INDEPENDENTLY OF EACH OTHER, STOPPING WHAT YOU HEARD EARLIER FROM A CITIZEN THAT THIS DAISY CHAIN EFFECT IS NOT VERY PRODUCTIVE FOR US. BUT THAT'S SCHEDULED UNDER THE EXISTING PLAN TO BE FUNDED IN FISCAL YEAR 2024 OCTOBER 1ST OF 2024. AND THAT PLAN INCLUDES THAT HAVE A RATE INCREASE WITH A DEBT ISSUANCE IS THE ONLY WAY WE SEE TO BE ABLE TO FUND THAT. I APOLOGIZE. I DON'T HAVE THE EXACT NUMBER OF THAT, BUT I CAN GET THAT FOR YOU. BUT IT'S IN THE PLAN. IN THE INTERIM, WE'VE ALWAYS IF WE HAD AN EVENT THAT REQUIRED IT, WE WOULD GO TO THIS EMERGENCY, WHICH WE'VE USED IN THE PAST. SO WE'VE GOT A SOLUTION, A POTENTIAL SOLUTION. IT'S JUST A MATTER OF FUNDING IT. YES. NOW, REMEMBER, ANY OF THOSE PUMPS, JUST AS WE'RE EXPERIENCING TODAY WITH ANY OF THE PUMPS, THERE CAN ALWAYS BE A RAIN EVENT OR SERIES OF RAIN EVENTS THAT OVERLOAD THEM. IT WOULD TAKE AN UNLIMITED FUNDING TO HAVE A SYSTEM THAT WORKS IN EVERY SCENARIO, AND THAT'S NOT REALISTIC. SO THE CHOICES HAVE BEEN MADE IN THE PAST AND NOT ALL OF THEM ARE GOOD. I AGREE WITH THAT. AND THEY'RE SHOWING UP TODAY THAT THERE PROBABLY CAN BE THINGS WE CAN DO TO HAVE A MORE POSITIVE IMPACT. BUT THIS IS ONE OF THEM. OKAY. THANK YOU. THANK YOU. I JUST COMMENT THIS COUNCIL THAT EXIST NOW, PLUS TWO MORE MEMBERS THAT WILL JOIN ARE GOING TO GET TO GO THROUGH THE BUDGETING PROCESS IN JULY AND AUGUST. YOU, I'M SURE, WILL BE ADDRESSING THIS. YES, SIR. YEAH. FULL EVALUATION AND THEN ALL OPTIONS ON THE TABLE IS WHAT WE WOULD EXPECT. ANY OTHER DISCUSSION FROM ANYONE? AT THIS TIME I WOULD ENTERTAIN A MOTION ON ITEM 5B. I'LL MAKE A MOTION TO APPROVE ITEM 5B, CONSIDER AWARD CONTRACT OKAY. I HAVE A MOTION BY COUNCILMAN TIPPS. A SECOND BY COUNCILMAN SMITH. ANY FURTHER DISCUSSION? ALL IN FAVOR, PLEASE SAY AYE. AYE. AYE. ANY OPPOSED? THAT ITEM PASSES WITH A 4-0 VOTE. AT THIS TIME THAT CONCLUDES ALL OF OUR BUSINESS THAT WE'VE NEEDED TO ATTEND TO HERE TODAY. I APPRECIATE EVERYONE BEING HERE IN ATTENDANCE AND THOSE WHO WATCHED ONLINE. AT THIS TIME, WE ARE ADJOURNED. THANK YOU FOR YOUR ATTENDANCE. * This transcript was compiled from uncorrected Closed Captioning.
